This happened to me! I was paying over 1100.00 a month in support and retired from military. I couldn't afford the payments but couldn't afford an attorney so I had to file through the courts myself which took a year, mind you based off of what I made child support was taking 70% of my take home pay! Had to move on with my parents until the case was heard. I live in Texas the ex was in Florida. Anyways 9 months later we end up in court and she hires an attorney to represent her! So here we are in court I'm on the speakerphone with this female judge and she just breaks it down and asks what we made. During her calculating my ex asks if she can speak and judge grants it. My ex bashed me as a father not seeing my kids and at the end the judge asked me why I didn't see my kids I said I have no money and I had to provide medical insurance as well and was living with my parent's. She then asked why I haven't found a job and I explained I got in trouble with the law for misdemeanor assault at a grocery store and nobody wants to hire somebody with a fresh record 😔! Anyways the judge asked the CS attorney what my visitation time was with my kids and he used some legal phrase, don't know what it was but all I know is that it went against my ex in a bad way! My order states I can only see my kids twice a year and not even on the same day and I must be supervised by her father lol because kids don't know me! I told judge how is it financially feasible to drive 1000 miles to visit my kids for one day supervised and that's if she let me see them. So I explained 500 miles a day so two nights in a hotel or sleep in my car and then 2 days traveling back which is another two nights in a hotel or the car. I said to the judge so 70 dollars times 4 is $280 plus gas equals another $160 round trip and this doesn't include my meals! I said if I flew it would be about $400-600 round-trip but then I either had to Uber to a location to see my kids or rent a car which was about 60 miles from the nearest airport! So now the judge is like okay I got the picture now and then asked my ex what do you think is fair and my ex said I should pay more, that I shouldn't have left the military lol! The child support attorney chimed in and asked my ex weren't you in the military too and she said yes and he said what's stopping you from raising your right hand again lol! I was shocked that I'm being defended by the child support attorney in her jurisdiction! The judge starts smacking away on her calculator and proceeds to tell me sir based off of your financial documentation I'm reducing your support to $583.00 my ex was like what the hell! She added do youvwant to forgive the arrears owed to you and I was like arrears and she explained that since I filed almost a year ago and was paying over the amount alloted by state law that I could request a credit for those 8 months or waive it and I said I'll take the credit lol! To add insult to injury the judge asked who was the primary medical insurer and I said I was and she said well now I was only responsible fir 35% and became the secondary and she was the primary at 65%! The funny part about this is I told my ex I could pay $700 a month and she said no so essence of this long story is nice guys don't always finish last and that this is a win for those fathers that do the right thing! This judge saw through my ex and her greed and karma took a chunk of her ass!😁

Besides the fact that it was her income that was funding the lifestyle, not his, child support is completely separate from alimony. You will never get child support payments when its split custody and you make literally over $100k more than your partner.

Given the possible outcomes, the legal argument was that such a fear of loss in an abusive relationship would be akin to the fear an indentured servant might feel. However, ever since WW2, when women were able to work, the spirit of that law changed without the letter of the law keeping up.

@@delvinlino869 You guys are not understanding the entire ruling in the slightest. They have the kid equal time. Which means there is no custodial parent by right, it’s split. She is making them both pay child support. However, they are both paying child support which means they would cancel out the lesser of the two. It’s the offset of the child supports. This means, when she brought child support into play and there is no custodial parent, both parents are “obligated” to pay. The child support is determined on the same calculation for each party. With that calculation, she made what would be an offset of $1600. Her actual could have been $4600; but, he probably made what would be the $3,000 back to her. He does contribute the same as her if they live in his house and he feeds them, drives them to school, the SAME amount of time as her. She chose the school and since there is no custodial parent, he is not obligated to pay that school. By right, if he is paying insurance, and she is not. He is contributing more. Private school is a choice. Take that away and she does the same as him.

@@delvinlino869 they had equal custody, in a lot of states, that means that childcare expenses and lifestyle values are supposed to be split, and in this case, she made more money just like in many cases men pay women when they make more money. It's not alimony, it's to make sure that regardless of which house the kids are at, they're at a similar lifestyle. They don't want kids going to like a poor house for one parent and then a mansion if it's joint custody.

I'd buy property and rent homes until I could build my own gated community and then begin expanding my property empire. The passive income you can generate from owning homes is enormous. Despite the income differences, I think both parents should bear the same burdens in caring for their kid(s). That isn’t to say both pay 50% each, but rather a 1/3 & 2/3 split or whatever the breakdown that reflects the income difference. If she makes double what he does, then his 1/3 of the childcare expenses becomes her 2/3 of the financial burden.

Don't forget private school is optional and I'm sure when they were originally divorced that was brought up. At the end of the day private schools are a form of luxury which means she chose that option for her kids! It amazes me that women are complaining about this when men have been lambasted by the child support system for so long! How would you like it if the father chose to send his kid to Harvard and sends a bill to the ex saying you owe half but she makes minimum wage!

I currently live in Ontario Canada, with the current child support system, its based on monthly income that doesn't take into account regular monthly expenses a normal person has. Unfortunately my current amount is rendering me homeless. I currently live out of my vehicle and my work truck. Justice system is not flawless.
