I hope that Your Honor does not give probation. I was assaulted with a knife, robbed . He smashed my door open, I had to get 4 eye surgeries . I was 73 yr old. I still have many sleepless nights . Please no probation for people who use assaulting as a way to talk. Bob

The gentleman was rightfully upset.(brass knuckle beatdown in a funeral home). A victim advocate hopefully can assist him with being heard and making his feelings known/documented. Fingers crossed he physically heals well and most important can obtain a sense of peace and feel justice served.

*There are two types of victim impact statements:* those where the victims try to impart the *pain and suffering* they've endured and want to know what sort of *sympathy* the court might have for their plight, and the ones where the victims try to impart *vengeance* and wants to know what sort of *revenge* they'll be able to exact through the courts. *This is the latter.*

No. I know what you mean but this isn’t that. The prosecutor has drug their feet, this man is a victim, and he feels jerked around. While it was misplaced anger I don’t think it’s just about vengeance. Also… if you got attacked by someone at a funeral home with brass knuckles you wouldn’t be angry? You wouldn’t want restitution. That’s literally why we allow victims to give impact statements, to try and make sure the victims view is taken into consideration and they can tell the judge what they would hope for sentencing.
@stansbruv3169

Definitely misplaced anger and rage. This guy should speak EVERY chance he gets because all of this has clearly interrupted his life, but he shouldn’t make accusations without any evidence.

A victim's advocate for this stuff makes a huge difference in these situations. They do a great job of bridging the gap between the law side of things and the personal side of things. Also think judge could've handled this a lot differently - it's not like he's there trying to play the victim to downplay his own criminal behaviour. He is literally the victim of the criminal behaviour

There really should be an arm of the DA's office that advises victims of what they should put in their victim impact statement, and what is immaterial/inappropriate to put in one. So that victims get the most bang for their buck.
@CindyCockerham
@CindyCockerham 7 ай бұрын
There should be a victim's advocate assigned to him. The impact statement is the only chance a crime victim is able to speak out. The advocates do advise the victim on what to include, but they can't help write it.

Totally agree! When I was 20 I was the victim of domestic violence incident. The prosecutor only spoke to me once, literally while we were waiting outside the court room to enter. That was the first time I ever met them, they literally didn’t know my case. I feel like my victim impact statement just ended up retriggering me so badly. I was trying to tell them how it has impacted me but I just sat and listened to a complete stranger hardly fight for me at all, despite the fact I didn’t actually press charges, the police did when they came to save me. So now I’m subpoenaed to go to court and sit across from my abuser, who has gotten an attorney and there I am, never spoken to anyone. I got a letter saying appear on this date for the trial and sentencing … ALL it did was retraumatize me so so so badly. And they only gave him a slap on the hand even though two police officers took the stand expressing their concern and aligning with everything I had said. Going forward, if I ever were in a DV situation again, (i won’t be) but if I were, I would certainly think twice about call the cops for help. The cops were great but they are legally required to press charges and I was subpoenaed to a court room with zero support from a single member of the court system. I think for a lot of victims who experience DV and then end up having a trial, end up feeling the same way. Why call for help if they are going to force you to go in front of a judge and a bunch of people and talk about the worst scariest moments of your life only for them to give him a slap on the hand and let him out…. All it did was make me more scared because now he was really angry.

What the victim is forgetting or ignorant of the fact that the judge is from the judiciary branch of government and the prosecutor is from the executive branch of government. Thus, she has no say over what the prosecutor's office does. This is a hearing concerning sentencing, not a trial. Later on this stream she had to lay the smack down on someone else who was contemptuous of the court. A neighbor disagreement.
