Marriage and Divorce in Morocco - Al Jazeera World
Moroccan family law is built around the Moudawana, a family code that governs marriage, divorce, child custody, maintenance and the division of assets.
Adapting well-established traditions, it has been in existence since the 1950s; but, historically, marriage - and divorce - had always been in the hands of men.
But in recent decades the Moudawana has faced pressure from civil society groups and women's rights campaigners to introduce reforms, prompting King Mohamed VI to appoint a commission to examine its principles and practice in October 2003.
Its findings have resulted in more rights for women and updates to many of its rules, particularly in introducing new types of divorce, including for "irreconcilable differences".
In Marriage and Divorce in Morocco we look at a host of areas affected by the family code including registration of marriage, division of assets, maintenance, domestic violence, rape, and the effects on men who find themselves in abusive relationships.
We hear from lawyers, judges, social commentators and also ex-wives and ex-husbands - like Fadma Amzil, who had a Fatiha marriage, but which was not registered with the civil authorities.
"I only had a Fatiha marriage," she says. "He got married to another woman and their marriage was registered. My situation would have been different if my marriage had been registered."
We also speak to critics of the code who argue that some discrimination has survived the 2004 reforms.
We hear from the family of Amina Filali, a 16-year-old whose case grabbed headlines when she took her own life after being forced to marry her alleged rapist.
A loophole in the law, penal code article 475, meant a rapist could evade prosecution if he married his victim.
This film looks at the human stories behind the Moudawana, how it has modernised family law, and at the progress it still probably needs to make.

Being a Westerner, I have to say I think Morocco is doing an excellent job! Changing but attempting to preserve the family unit. I spent some time there, and I must say it's one of my favorite countries. The king is working for change and growth, and I know he'll do it. The most important thing is to hold on to traditional values and not change too much to ruin a good society. Great documentary and kudos to those working for a change.. nice to see men and women involved.

Are you a lawyer? and you have studied family law? Well ask your King first to study law, human rights and take care of the poor. I Then you can pontificate about womens lives. Your king is a lovely man but he can never understand sacrifice, pain or need. He is privileged . Basically he is a rich person , having a stress free existence and loving life. In the name of Mohhammed . He is not charitable or sacred . He is just a normal human liviing in luxery unlike his people lol.

After spending time in many countries, I am qualified to discuss the issue. And yes, I've studied family law. I'm not sure what that or any part of your statement has to do with what I said. 😂

I met a girl from salé Morocco 2 years ago and felt in love with her after she told me her story about being forced to marry at a younger age and after 10 years she divorced. I trusted her and thought I found the right woman to married and cherish until I meet her and we spent 3 months together come to find out all she was telling me was lies. I was so hurt because I planned to moved her to New York to start a new life

Morocco is a northafrican / maghrebian country with Amazigh roots. In Amazigh culture the woman had a strong role in society. In the Amazigh culture there were even women as leaders. Morocco needs to find its identity again and move forward

@@abdellahsalehi9231 most of these so called arabs are arabized amazighs. It is against logic that a few immigrated arabs dominted the entire northern african continent. Arabs are only those from the arabian peninsula, the rest are arabized.

Kudos to Morocco for taking such a positive step. Most of these problems will be solved if people are educated. Schools in these places need to educate people on a broad range of issues rather than just present a narrow religious worldview.

Islam allows men to marry more than one woman.And Islam is responsible for the Islamic world being and behaving how it does. Same with Christianity and with Communism. It is you who has an emotional issue, maybe. Religion makes tradition. Culture IS tradition. Surely? Both are to blame and both should change. But Religion argues that it must not be changed, so really religion is the obstacle to a better way and fairer way of life.

The spouse in an abusive marriage can go to court system for relief but most spouses as in the west usually don't tend to involve the authorities in these cases.

In this video, I'm pity on that only single mom with her daughter. I hate that Morocco Govt didn't help her much financially. Just $50 dollars each month and one thousand dollars for divorced seem like a curses on single mom rather than help. I wish I know her where she lives and wanna to support her on my behalf. After all I'm still single & doesn't need that much $$$ for my near future.

one of the most important points and biggest problem which spreads through the population and society and even through future generations is mentioned at 26:34 by Ali Chaabani. He says how it disrupts and destroys not only families but the society and the word foundation is used. which is very accurate. the foundation of morocco and moroccans on a behavioural and social standpoint has been shaken. The principles and moral values and behaviour and good etiquettes and moral pride need to be reintroduced into the society. and that can only happen by breaking the bad cycle and teaching the next generation principles and values from childhood. its an ongoing cycle until the youth decide they want something more something better. and it can start at any time. it can start now. and that going for both the men and women, boys and girls. Self pride in your morality and your values bring a more respected and advanced society and also happiness. and as the more intelligent in the society are more responsible for this. their understanding is higher and so their standards should be. the true intellectuals have a bigger responsibility within their society. they set the standard. change happens from within and then spreads to others. its contagious. Have self respect and pride in those good values. real self confidence not the fake kind. their is a huge difference and you see it clearly in the way your society is.

If society is unaware, or ignorant about the matter then one solution would be to teach moraliry, respisibility to young children in school and have teachers be advocated of children and a resource for families as well.

The problem is the law. I am married to someone from Morocco and I would never in a million years live there because Islamic family law does not reflect the best interest of the wife. If you are a house wife and have lots of kids or a husband with lots of relatives or more then one wife if he dies you are likely left to become poor because you only get a tiny fraction of his assets. If you are not Muslim you get nothing. That is why when I am in Morooco I see so many old women begging on the streets. Never in a millions years would I put myself at risk of being poor in my old age. Morocco might be better then many other Islamic countries but still has a long way to go.

My husband always asks why I watch “random” shows. We arrive for a family visit a few states away and my sister in law walks in with her husband from Morocco. My husband looks at me, I just give him the “I got this” hand signal. He is well versed I the Muslim cultures, I’m a history teacher, and our job is to now bring the concerned parents up to speed on all things Morocco. I was made for this.

Morocco government is responsible of Talaq in Morocco, many factors are there, major factor is provirty, government salaries are not enough to live according to their standard ( like wearing branded cloth even cannot afford) question is from where? Girls loosing verginity because of poverty when they got marry husband cannot accept, unmarried girls increasingly each year. Majority people wants to go out of Morocco. Government cannot reduce price of transportation, water bill very costly compare to other countries, hospitals many but service is zero, banking system and charges very high, taxes collection like Europe but services are zero. This is the cause of divorce and mentality of Moroccians are not to help people. They are looking benefits from each others. Actually majority marriage not not on faith or love , this is requirement of life. Slowly marriage will reduce from the world because of high cost living

Although I very much enjoyed this video and appreciate the strides that Morroco has done to improve womens rights, I find that the editing is horrible and detracted the quality from this video. They keep repeating the same shots of women stating they were married at 14 and there are weird shots/frames of hands or odd angles. I would of expected better from Al Jazeera! still a good video though... just edit it better guys!

I also observed in this documentary, they did not include in the interviews men who who married girls at young age, abused them, and divorce them, so we can see the situation on both sides. I think this is still biased on the part of the women. They were the ones who were expose in the camera while the men are just part of the subject. . .

Education is the only solution. They should require every child to finish high school, and make it punishable for parents who take out their children out of school or marry a child who didn't finish high school. Education not only teach people their rights but it also give them confidence and self worth. Poverty also plays a big role, I don't think Rich Arabs or Africans marry their children early, they probably send them to Europe to study and put marriage second. As an African I've been witnessing the progress being made in every culture, people, especially women are fighting for their rights. And I'm sure that in 30 years we won't be dealing with child marriage or cultural believe over justice and equality.

Ania Sacrario apparently the desire to have nice teeth is a “tourist “ country thing. It’s becoming more popular but countries that have less tourism , use less body language. Thus less dramatic smiling and attention to the teeth. Long explanation but it’s probably just not that important or thought of as an appearance flaw.

After the divorce why a man has to pay to the wife (if there are no kids involved), I dont get it. But if the reasons for divorce are very flimsy may be yes. But if the wife wants divorce or if wife did some grave mistakes she has to take up a JOb after divorce. Only in case of a kid/kids monthly expenses should be paid. If men and women are slowly becoming equal then women should get ready to work and get the similar kind of pay check home. Divorced women sit at home, they or their parents dont encourage them to take care of their health, get fit and take a job. They keep cribbing over their ex husband who left them 5-10 yrs back. Its a downward spiral.

I just got married and a few month ago to a moroccan man When I looked at the marraige cert . I was worth 200 euro. I was shocked to see that I had a price! It's pure pathriarchy . I was asked about 'if I had any conditions before the union. I had no clue ! I am not muslim. I wish I had have known that ot was basically a pre-nup. He never educated me .Now he thinks I should be a certain way as wife but I will always remain the same/ I am pagan , he is an 'open muslim' can anyone tell me what that means lol. He is open so he can do whatever he wants! I stand in solidarity with morroccan women expieriencing these abhorrent conditions. Allah preaches love but allows women to be subjugated.

Aside from improving the marriage registration process, it looks like priority is to improve the births registration process: only husbands can register their children, apparently. Even women giving birth out of marriage as a consequence of rape could be criminalised. Their children illegitimate/unregistered (in most cases). What a horrifying patriarchal system

مابُنِيَ على باطل فهو باطل زعموا أن حضانة الطفل للأم بعد الطلاق بدون دليل شرعي من القرآن الكريم أو السُّنَّة النبوية،وبسبب هذا الإدعاء الباطل اختلفوا في مدة حضانة الأم للطفل وبدؤوا يخترعون ويفتون بلاعلم فمنهم من زعم حتى يبلغ الطفل ٧سنين ومنهم من قال ١٠سنين و١١سنة و١٣سنة و١٥سنة وحتى الزواج تخبطا وكذبا وزورا ونسبوا آراؤهم تلك إلى الأئمة الأربعة حتى يوهموا الناس أنها فتاوى هؤلاء الأئمة الأربعة ولم يأتوا بأي دليل شرعي على صدق فتواهم وتبعهم من تبعهم ممن ينقل ويردد بلاوعي ولاتعقل وعلم ولاإطلاع على وجود دليل شرعي من عدمه ودُرِّست هذه الفتاوى الباطلة في المدارس والمعاهد والجامعات وانتشرت بين الناس ولم يفكر شخص واحد إن كانت هذه الفتاوى صحيحة أم باطلة؟ وهل يوجد دليل من القرآن أو السنة النبوية على صحتها؟وهذا ماوصل إليه حال الأمة،ثم بدأ أشباه الرجال من اللاحقوقيون وقضاة المحاكم الوضعية في تحريف معنى النفقة فصار معناها الفلوس كما في كتابهم المقدس(القانون الوضعي الفرنسي الأصل واللاإسلامي) وليست النفقة عندهم كما هو في قانون الله وطبقه رسول الله والصحابة وتقدير هذه النفقة -إن صح تسميتها بذلك- والتي هي فلوس في عُرْف المحاكم الوضعية وعند النساء متروك لقاضي المحكمة الوضعية لأنه كان يعيش في بيت الرجل ويعرف قيمة مصاريف الأسرة وطبعا فرحت النساء لذلك فرحا شديدا لأن هذه الفلوس مصدر دخل لهن وإن كان باطلا ومغصوبا وصار الرجال عرضة للابتزاز والحبس والتهديد ليلا ونهارا من أجل تنفيذ حكم قضاة المحاكم الوضعية في دفع الفلوس للنساء الخارجات عن الدين وهُدِمت بذلك الأُسَر وفُكِّك المجتمع لأجل عيون النساء وتطبيقا للقانون الوضعي الباطل بالقوة،وحُبِست الرجال الذين لايملكون مالا يدفعونه لنسائهم الفاسقات حتى يقوم أهل الرجل بدفع أموال للمحكمة الوضعية لإخراج قريبهم من السجن،وحُرِم الآباء من رؤية أبنائهم لأن الأبناء صاروا مِلْكا للمرأة(وليس حضانة) كل ذلك يحدث بسبب الجهل المركب من أشخاص يدّعون العلم وهم ليسوا علماء ويقيسون أحكام قوانين الله بآرائهم ويفتون بما لايعلمون ويبنون على ذلك فتاوى متتالية باطلة من فتوى واحدة باطلة زعمت أن الأم أحق بحضانة الطفل لأنها حملته في بطنها ووضعته وأرضعته وغيرت حفاظاته وسهرت عليه وهي أحن عليه من الأب وأرأف على الطفل!!؟ متى سيعود مشايخ الباطل ووعاظ السلطان وقضاة المحاكم الوضعية لرشدهم ودينهم وينبذون القانون الوضعي الباطل الذي جعلهم يحملون أوزارا على ظهورهم لمخالفتهم أحكام الله وقوانينه الشرعية.

And last of all how about as an asian going to live outside the country for better life and of course proper dental care. @@elesis_cabrera There is one Arabic language which is "standard Arabic" or El Fosha but not spoken in daily life only in academic educations, while there are a lot of dialects which are mixed "Tamazight+Aarabic and some French, Spanish and English sometimes Italy Languages" in north Africa but in the middle east it's kinda more Arabic with some Turkish, Persian and the horn of Africa languages.

Sorry but, its an economico problem. Man and women should be economicly Independent. To be able to Keep dignity. For now mariege Is a way to survive when It works. Otherwise many girls and up pregnante, in the street. It's a very hard Life, many do prostitution. So the future of women in Morocco ,africa,Asia,latin America Is a delicate Matter. And there are many wierd exampels. Where victims can be the man or women. Like when a girl Need get maried to cover up a relation out of mariege declare to have been raped. Lately many man don't want to get maried to avoid legal responsabilty and so girls get pregnant at a vary young Age.

Indeed, the problem of Islamic countries is without doubt, Islam, but it's different from the view of foreigners who only listen to mass media. The real issue of Islamic countries is that they are no longer Islamic. In the old days when we were following the rules, we almost governed the whole world in all domains; science, philosophy, finance, military, human rights, medicine, literature, technology etc. But once we moved away and started following our own desires, it was the start of the fall. How can you say that a religion that forbids stealing, lying, cheating, killing, slavery, mistreating elders, mistreating others, unofficial relationships, hurting its own body, using drugs, hurting animals, hurting even nature etc, is the cause of Islamic countries misery?

I'm Moroccan and I'm Arab. So should I move to the middle east or to the Golf region? But then again, I can't say with certitude that I'm 100% Arab, since my grandmother is from Rif. It's almost 2017 and people are still spreading hatred. Instead of pointing differences, it's in our best interest to try finding similarities and try to live together, because it's too late now to fight.
