It took about 14 months to get out first interview and my spouse was issued a 2 year conditional card. We filed the 751 in Nov 2023 and the current processing time for that form is 48 months.

once your spouse has had the initial green card for 3 years, a naturalization application can be filed while the I-751 is pending! This usually speeds up the process.

My wife overstayed her visa and they tell her she has to go back to her country for 10 years, we have 3 children together. I’m an American citizen. Any hopes?

@@vazquezfordspowerstrokesunlimi you may have some options. It really depends on a few separate factors. I would recommend consulting with a immigration attorney to get a layout of all options available.

From your experience... a few questions, but all about the same: Is it normal for the embassy to ask for the Affidavit of Support when in the process of a K-1 visa? What is your advice, should the documentation and form be taken to the interview or wait until they ask for it to be presented? Or even, is it something the sponsor has to send to USCIS before the fiance interview?

Good interesting stuff as always! I am not sure if my question was answered; I am married to a US citizen who is currently unemployed, but I am employed (in Puerto Rico) on an L1 visa. Is my spouse able to petition for me seeing as she is unemployed currently or must we have a co-sponsor? (my current salary covers our family of 4 reasonably well)

Thank you for all of this information. Do you have information after completing a I-130 about the I-129f letting the spouse come to the US while waiting for the I-130 is pending approval? I was told once the I-130 is submitted and you received the notice of action with a copy of the marriage certificate that it can be submitted by mail.

I have a question please help me understand this. How do you live with your spouse if one spouse is Canadian and the other a us citizen and as a Canadian you can only be in the US for 6 months and vice versa?

Hello sir, I am applying for an H1B visa with the help of my sponsorship employer from us, while filling the ds -160 form I encountered the work experience section and that has two sub categories, present and previous employment, I resigned my job in the end of the February, and officially I am not working. no wait time! As long as you are a green card holder or U.S. citizen you can file the I-130 for your spouse.

hi atty,what if ,b2 visa,i came here from philippines were marrued for 11 yrs.in the phil.my american husband and 2nd child they came here in usa to visit his family last year. and because of wheather here he got sick.and found out that he had bone marrow cancer.need chemo soon.then,he said urgent we need to come usa to takecare of them.because my husband may not be able to takecare my ither son.so, we had 3 citizen kids and now in school here.im 3 month nxt month.im 6months on aigust 6.i want tto gi back to phils but how.my 3 minir kids in schiol plus my husband undergo chemo.im worried i dontvwant to have trouble in immigration or u.s. which one doni need to file,i485 or extension again for 6months.my husband is a retired and on dissability pension.pls.help me atty.give me some advice.thank u so much in advance

my USC spouse submitted my marriage based green card application on the 15th of september 2023, i got my biometrics on the 20th of october 2023, i got my work permit on 5th of november. i had my interview called for the 6th of march and no decison was made on the interview (i was told to be patient ) and got the paper to wait 120 days. two weeks ago, uscis officer came to my place and left with the satisfactory visit. i checked my online status which says that , my parole document is produced and that's it. my i-130 and i-1480 is still being reviewd by USCIS. as of today, its 107th day of 120th. what should i do? and what are my options after 120 days? my field office is in spokane, WAshington state.

Why does USCIS still stick to the old-fashioned legislation and rules for sponsors who are willing to sponsor their spouse or anyone willing to marry a partner who is not financially secure? For instance, why is it always on the sponsor to earn more and take care of financial obligations? It could be the other way around for a spouse who is making more and willing to marry someone who is not-supporting them in that way. I guess that's why many people are not willing to start a family, as they live below the poverty line or are not able to find a partner to spend life with. I think the rules need to change or policy makers need to be educated. #pov #innovate

I’m a US Citizen. I filed I-130 for my foreign wife. After I filed I-130 for her in couple months she got a B1/B1 visitor visa. So my question, when I-130 gets approved and by that time if she is gonna be here in U.S., should we file I-485 for her or it’s better to let the process go on and let the USCIS to send everything to national visa center? Can you please tell us which way will be faster for us in our case, since we have an option? Thank you.
