The plaintiff purchased a car from the defendant. He claims the defendant told him the car was in good condition, but it ended up being a piece of junk. He’s suing for his money. The defendant argues the plaintiff knew the car needed work and he was upfront about that.

Even if there was a misrepresentation, the plaintiff gave the car away. There is no way he could return it to the defendant and get his money back.

Those cars are highly coveted! That mechanic saw him coming and knew he could tell him whatever he wanted and he would believe it! The mechanic scammed him! There’s no way I would just sign over a car I just paid $4k for over $500 without getting a second opinion!

IKR the mechanic is now sporting a new used car lol. It looked nice too. Or maybe he fixed the mechanical issues and sold it. Either way he got scammed by the mechanic that knew he was out of town.

Exactly! THat guy probaly resold that car. A mistubishi eclipse GSX turbo was a nice car at that time!! Still looks nice too. Also if he knew it was a project car, why would you buy it? And red flag is, its not running!!!

The question I was left with is this. If he knew he bought a project and it would cost money to finish said project why didn't he have money for the tow back to his house? I don't think we heard the truth from the plaintiff.

The plaintiff gave his misrepresentation case a good effort, but disposing of the car left him in an untenable position because if the contract was voided he woukd be obliged to return it to the defendant in exchange for a refund.

Plaintiff never should have gotten involved with this. He clearly has neither the knowledge nor the money to get involved in this type of car project. He didn't have the $500 for the tow but expected to be able to make repairs to the car? And he obviously got hustled by the other mechanic and doesn't even know it.

Ol’ boy doesn’t know cars wants a “project” car. Buys said project car and realizes he can’t handle the project (bit off more than he could chew). Then proceeds to gift the car to a mechanic friend (who probably could handle the project) for disposal only to turn around and ask for his money back. Sounds reasonable 😂😂😂

This is why I like Judge Judy better, this is a 3 minute case at most. He signed a contract that says 'as is', that's it. Even if it breaks down on the way home it's not the seller's problem.

Guy got in over his head, DSM are cool but are a full time job keeping them running. They are not for inexperienced car guys unless you have help from others. That shop definitely got over on him too and probably flipped or kept the car.

One of the carved in stone car buying rules that shall not be neglected - NEVER BUY SOMEONE ELSES PROJECT! Plaintiff was quite naive all the way through this deal and the shop that looked at it after he bought it? Oh my, definitely scammed him again with getting the title. Ouch. A life learning experience that only cost him $4k isn't that bad at all.

The plaintiff is more than dumb, he buys a non working car for $4000 and then because one mechanic says it isn't worth getting repaired, he signs it over to the junk yard, to be junked, then how does he expect to get his money back if he doesn't even have the car any more and actually sold it to the junk yard? Either he is lying or he got scammed by the junk yard...

This case reminds me of my first car. 1973 Dodge Charger. It was a fun car, but it cost a LOT of money to keep on the road. There was always something that needed fixing or adjusting, etc. Anyway, I decided to sell it and get something more economical. A friend of mine desperately wanted the car. He knew from hanging around me that it’s just too many issues and I could not afford to keep it. He wanted it anyway. Sold it to him, explicitly stating it costs too much to keep on the road. About 2 weeks later he told me he wanted his money back ~ for the same reason I sold it to him! … He did NOT get a refund.
