The plaintiff says she reached out to her mother for help when she was struggling with drugs. The plaintiff claims her mother took in her children, and when she filed taxes, the defendant claimed the plaintiff’s children as dependents and received a hefty tax refund. The plaintiff is suing for wages that were garnished from her as a result. The defendant argues the plaintiff actually owed her money for child support, so she had every right to claim the dependents.

Taking drugs is a choice (in most cases) I’m sorry but just because you grew up rough (if that’s even the case with them) that’s not an excuse to start taking drugs, especially not taking drugs while bringing kids into the world. And if her mom is so bad why are the kids with her?

I think the mom should feel partially responsible for her kids being exposed to drugs. She also gave her cigs as a present? She sounded like a terrible mom. That doesn’t excuse the fact that it seems plaintiff only took her kids because her mom filed CS on her. She still needs help and I’m only feeling bad for the kids at this point. She took energy to go to JM but no energy to follow through with what the system told her to do about the garnish. Make it make sense.

Wow! So it doesn’t matter that her mom and boyfriend started her to taking drugs???!!! I know she’s an adult now, but maybe if they had not started her on the wrong path she might not have turned out how she did. He’s taking up for the mother, but the pot can’t talk about the kettle. Mom did the same thing to her as a child. They BOTH need to be accountable.

Judge Mathis has probably seen hundreds of cases like this one. He's heard all of the excuses and the plaintiff's are common. The plaintiff still has to learn how to take responsibility of her life. Even if she was mistreated and abused as a kid it's still on her now to make a change for the better.

I used to work for the IRS and child support and usually in cases where an overpayment is made in child support to one party, they order them to pay it back and if the person who paid it is all caught up they would send a check to that person whether the funds have been paid back or not. They'd deal with it on their end. There's definitely more to the story here because it really is that simple to let Child Support know that the kids aren't even in custody anymore with the Grandma. And then there's the possibility that what was taken was backpay for the grandma anyway which is possible even though she didn't have kids anymore. This is why JM was like she should have done what they told her to do because he's not getting involved. He wouldn't know the circumstances behind the refund offset.

Wishing you the best, it is not easy however it is possible. I struggled with addiction but can proudly say I just passed my 6 year sobriety date. Some people can go cold turkey personally I wouldn’t suggest it. It’s ok to need help and it’s ok to not have all the answers. I stand by inpatient treatment because the first piece is chemical dependency and there are medical professionals to assure you withdraw safely. With a treatment facility you can get away from everything for at least 30 days, no phone, no social media, no work just you and professionals getting your life back in order. I met some of the best people in treatment and you don’t have to feel judged because if anybody gets it they do. After inpatient and the chemical dependency is gone it is truly mind over matter! 💕💕💕

Sure it's sad and unfortunate the mom exposed her daughter to drugs and I definitely thinks she is still continuing to pay for her mistakes through her children. But the daughters an adult now who continued to make her own mistakes as well which is why her mom had to take care of her kids. At what point does she take responsibility and have to pay for her mistakes as well? I hope she seeks help and they can mend their relationship. *I also don't think he went in on the mom too much because the daughter started doing drugs at 18 as an adult after seeing the effects of drugs already so she made that decision on her own free will.

This reminds me of my cousin who claims her ex MIL is such a bad person and a drug addict yet she left her kids in her care for years without her or her ex paying for her MIL a dime in child support. If your mom exposed you to drugs you don’t leave your kids with your mom unless the plaintiff cared more about drugs than her kids. She didn’t go get those kids until the state came after her for child support. If the plaintiff hadn’t behaved like a deadbeat the state would not have garnished her money. Also the fact that she broke stuff in her mother’s house and crashed a car in her mother’s name, I don’t see why she’s bothering to sue. I would just get the situation cleared up with the state knowing the kids are now with me and move on with my life.

This is a sad situation for daughter being introduced to drugs by her mother and boyfriend. She didn’t have the right paperwork to sue her mother but her mother stood up there and wasn’t accountable for doing drugs with her daughter. The daughter needs help and probably didn’t know how to do the paperwork and the mother definitely wasn’t going to help with paperwork. Mother said daughter is still using but is the mother on drugs or clean that was never talked about. But it’s a big thing the daughter on drugs and loss her children. I think Judge Mathias should have asked about mother crack ways as well. Daughter needs help filing papers to get her money back!!

Why go all the way to Chicago to appear on JM when you couldn't even make a simple phone call to your local agency that handles these types of issues? It took more effort to be scheduled to appear as a litigant on the JM show, and I'm certain they were done via the telephone, than what it would have taken to contact the agency as they stipulated.

I really try to like you Judge but I think you forget where you came from sometimes because you always have an aire about you like you think you are better than the people in your court room. I know that you use tough love and I respect that to a degree... but sometimes you just seem heartless 😢✌️
