So, there's a few things that could negate the idea of this being a legitimate "gift". First off, if she had any part in picking out the ring, that's skewing the value of the gift. Because that type of "gift" is given for a very specific reason, given the timeframe that she hawked the ring and did so prior to the "cheating", casts doubt that she accepted the "gift" with good intent. But the big problem... Nolan: "Uh, who the hell are you?" Her own son reacts in a manner indicating he's never even heard of this guy, much less met him. Which, if she intentionally grifted such an expensive "gift" casts further doubt that she was acting in good faith. See, most of the time you see these "gifts" being allowed to be kept by the recipient by a TV Judge, they were accepted in good faith. And it's in the confines of a civil court, not a criminal court. When you're talking about a civil proceeding and division of property, that's a completely different animal than proving to a jury of peers that someone committed an actual crime. If she had taken that ring with no intention to marry him and sold it so quickly, she committed fraud under either California Penal Code 484 PC "Theft by Fraud, Deceit, or Trick", or 532 PC "Theft by False Pretenses". The differences between the two is whether the intention was to transfer ownership of the property, or just possession, but they both amount to the same conviction and punishment if the state can make the case that she had fully, knowingly, and willfully accepted the ring without intention to fulfill the obligation it had been given to her for (namely, marrying him). And just from this scene, there's some pretty good evidence to begin formulating a case.
