Where I live, the city will red tag a dead tree, and if the homeowner won't remove it, a city contractor comes out and removes it. The home owner gets 1 year to pay it without interest. I had a tagged tree and opted for the city contractor. I was quoted $2100, but they lowered the price to $1600. What a deal!!

My favorite line: A dead tree is a pretty unhealthy tree.

I live in a forest and we ALL have arborists who take care of our trees. Period. If a neighbour’s tree is leaning over our roof or if it’s dead, I let them know and they get it trimmed. We don’t want problems like this. Thankfully, I have great neighbours!

I live in Massachusetts and the trees are really tall and the neighbors unfortunately don’t keep up with them because it’s expensive to trim them . The cost the paid for his damage is what they would’ve paid to get rid of it . They should have done their due diligence’

I drive up and down my road and there are quiet a few dead trees near the road. Asian beetle has killed many maple trees. I had to have 5 taken down. $2800 is what it cost. That’s why people blow it off.

Judge Milian & Harvey- Not directly related to this case, but Harvey mentioned tree maintenance in a question the other day. In many jurisdictions, the neighbor may be able to do what they want with branches and roots encroaching across property lines. No so in California. Civil Code section 3346 considers the encroachment of branches and roots onto your property to be a nuisance. You are allowed to trim the tree on your land in a way that the tree is not damaged. However, if you damage the tree (including beautification issues) or the tree dies, you can be sued for the value of the property. If the tree variety has federal or state protections, this can be in the tens of thousands of dollars.
