I've been watching People's Court for 20+ years and my favorite cases are auto sales and auto accidents. There must've been hundreds of auto sales cases and the plaintiff loses about 99% of the time. Only times I've seen them win was when they couldn't get a valid title or when defendant blatantly lied about major problems on the car.

To anyone who thinks the plaintiff is a liar, the defendant clearly lied when he tried to pull one on the judge by saying he resold the vehicle for $5000 and the judge did her homework and found he sold it for $7000.

As a guarantor on the loan shouldn't he have received the repo paperwork too? 🤔 because as a co-signer on the loan he's "financially liable" in the case of non payment on the loan so they should send him a copy of the letter too 🤷🏾‍♀️ so he's lying about not having any paperwork pertaining to the repo ESPECIALLY since he has a professional relationship with the finance company

It was like talking to a brick wall with the defendant. You're not the loan company but you are a cosigner which means you should have access to those documents and could have gotten a copy of it.

The defendant knows that poor credit people will eventually default on their payments and since he co-signed their loan he is alerted immediately, (and probably puts a tracker in each vehicle), so he then goes to repo the vehicle and resells it, without going through all the necessary and legal repo process. What a snake in the grass...

In this case, time was of the essence. The plaintiff sought a refund right away, and was given it. If he waited longer, it would have been considered a repo and the plaintiff would be out . Lesson for people in this case, is if there’s a warranty, check the details like what happens if the car is far away. Also check how much the seller honors his warranties.

Here's the deal with most car dealers, especially the one's who deal with bad credit. In order for most banks to yes we'll finance the loan, car dealers will put in the contract that the customer paid us a $2,000 down payment in full all at once that same day they bought the car. But between the car dealer and the customer, the dealership is being nice and says to the customer, since you don't have the full down payment today, you can give us $1,000 down today and bring the rest in 2 weeks when you get paid again. But when the bank calls you, tell them you gave us the whole entire $2,000 the day you bought the car. Because that's the only way they'll actually approve the loan. This is something that's been going on for many years all around the world. And the banks know it happens but they just want to hear the full down payment was made before approving any loans. So since the Judge isn't broke with credit issues, she's never had to buy a car under these circumstances.

Glad he got his money back. Wish he understood this. The defendant is so shady

In Judge Milian's defense. The plantif is extremely difficult to understand, he does not speak clearly, mumbles terribly and just does not pronuciate. I am sure it gets tiresome speaking to people that refuse to open their mouth and form their words! She was trying to make sure she got his story straight. I still feel as though the plaintiff didn’t receive all of the money he was owed. It wasn’t that huge of a discrepancy even if he didn’t have the itemized invoice. Given the fact that the defendant was disrespectful towards judge, falsified documents, and a known scammer, I would’ve awarded the entire judgement requested, as the defendant forfeited his own counter suit the minute he was dismissed from court.
