The plaintiff says he bought a car from the defendant, but the guy scammed him and never gave him the vehicle after he paid for it in full. He’s suing for his money back. The defendant claims the plaintiff only paid off part of the car, plus he’s stuck paying storage fees. He denies owing anything.

@@cheleamerica1st87 how about the effort it took to keep a car he already sold someone else in his own garage he had to pay for, while having to move his own car to park it legally in the streets? I know for damn sure I would’ve had parking tickets if it were me coz I get too tired to even get up some days, let alone get out and look for parking when I have my own garage. Some people would’ve countersued for that!!!

@@cheleamerica1st87 That's absolutely not what unjust enrichment is, but you go on lol. Unjust enrichment is when a breach of a contract occurs such that one party is enriched under circumstances the law deems unjust. In other words, the court would have to have found that the defendant breached the contract and therefore, keeping the plaintiff's initial payments was unjust. That isn't what happened here. In this case, the defendant is NOT the one who breached the contract; in fact, he went above and beyond to attempt to get the plaintiff to retrieve the property - even though the racist, race baiting plaintiff never honored his end of the agreement by 1) paying the car off and 2) picking up the vehicle when the defendant clearly tried to get in touch with him to do so on numerous occasions. In fact, this is the opposite of unjust enrichment because it was the plaintiff who breached the contract - and therefore unjust enrichment could never be assumed or imposed as the court would have to find the party who breached was the party who was unjustly enriched - and because the defendant didn't receive the entire amount of the contract and then refuse to turn over the vehicle and thus kept both the full amount of payment, plus the vehicle. THAT would be unjust enrichment. I LOVE IT when people with absolutely zero real understanding of the law attempt to play armchair attorney/judge. Next time, make sure you actually grasp the legal concept you're trying to argue...otherwise you just look kind of foolish. Also, no one ever said judges were gods or that we were being forced to worship them; however, there are certain honorifics that have become part and parcel of courtroom procedure. These types of appropriate salutations don't just apply to the courtroom. I'm guessing you're just throwing out an excuse for the vile plaintiff because you agree with him that all Asians must know each other and be in cahoots. There's nothing wrong with addressing someone respectfully and using their title. People work for years to become attorneys and judges, and there is a certain amount of decorum and respect owed when dealing with them. If you're not someone who respects rules of politeness and etiquette, or the hard work and sacrifice that goes into becoming a judge, that would be a you problem, not a societal one. People just don't know how to act appropriately, and end up getting themselves into trouble because of that, and then they want to openly disrespect the court. That is the law of our land, and untold numbers of our citizens have fought and died to uphold that law. They also fought so that people like you have the right to jump online and whine about legal terminology you have entirely wrong.

He wouldn’t call a male judge mister. There’s sir/ma’am, then ms/mr. and you know she’s making her point which I think is great, ab the whole male/female respect thing. Bc the disparity still goes on.

I don't think he was trying to be sexist. If you aren't use to going to court, something as common as using the word "miss" can come out accidently, if it were a man he could have said "sir" And I guess she assumed he is sexist just like he assumed she was antisemitic. Both were ridiculous for the accusation. Just correct him and move on, no need to assume he wouldn't have said sir to a male judge and that he is sexist. Sometimes the Judge acts like she's on speed or something. She's rude, irritable, talks over people and just let them answer the question which I guess makes for great TV, but it also makes the average person nervous because they are being filmed, they are in front of an audience and a judge. Nerves can get the best of you, and make you do stupid mistakes like calling her miss twice in a row, certainly doesn't prove he is sexist. People are so quick to label people without even knowing them.

I swear he almost said "Mrs" a 3rd time. I used to work with a doctor and even when his friends/patients would call him by his first name at his office... it used to make me so livid. Like you are in his office and he earned that title. The only one that could call him that was his wife. It's a matter of respect. Even if you don't want to respect the person you respect the position.

This plaintiff bases his opinions and judgments on others based off their race, so when things don’t work out in his favor he is assuming the other person is using the same ideaology. I hope this gentleman eventually becomes aware of how terrible/prejudice his actions AND words are in this epsiode.

Judge Milian definitely got in her feelings about the “miss” reference however I don’t think it played any part in her final judgement. The 30+ days the defendant gave is more than enough time for the plaintiff to pay up and on top of that the defendant reached out to him to come get the car even when he didn’t finish paying and he didn’t.

okay, to be fair, if someone calls a woman "Miss", I think they are intending to be respectful. It's weird when people call me "ma'am", but "miss" seems friendly in my opinion. I think it's more of a cultural thing than anything else. I don't mind it.

I guess many of you never tried to buy a car in NYC that was NOT at a dealership or especially in that amount range. It's usually scammers with their family members or friends trying to scam, so his comment that "the other guy was asian" was NOT out of the ordinary or racist. Just go on facebook marketplace, put cars 1500 or less in NYC, and you'll see the same car listed by multiple accounts that are on each other's friends list, and they are always scamming. "LEL WHO IS THEY?? RACIST!" THEY AS IN WHOEVER COMES UP. Usually Middle Eastern or Russian. I had one more threaten me after saying to immediately pay for the car tomorrow after ONLY asking him if it's still available. I avoided MANY by taking this show's advice and Scotty Kilmer. Don't reply to me with your grievances, I just told you go on FB marketplace and look for yourself.

Plaintiff should have got at least some of his money back. He was told the car would pass inspection, but instead the defendant removed the plates. He was supposed to have had until the end of the september, but the defendant was phoning him to pick it up on the 14th and 15th. The judge started questioning the defendant about that, then stopped and did a complete turnaround. Why? There was no time limit for payment on the original contract, so the defendant can not impose one at later date unless a new agreement is drawn up and both parties sign it. I know this from watching many episodes of The People's Court. Yes, very inconvenient for the defendant, but he brought that on himself by removing the plates, instead of getting the inspection like he promised. The plaintiff paid $475 dollars towards this car, over half of the "value " and he gets NOTHING !

That’s the law. If you’re told to satisfy the agreement and you don’t do it over a certain amount of time, the law considers that an act of abandonment. He must not have truly cared about the car or his money or he would have gotten everything done himself and actually moved the damn car. The law doesn’t protect inaction or ineptitude.

BECAUSE SHE IS A JUDGE. Wow, I thought it was simple but apparently not… A judge is a profession, like a doctor. These professions come with relevant titles that the person earned by going through the education necessary to attain that job. Neither the plaintiff or defendant had those titles or else she would have used them in kind, as part of her position. In any court case I’ve EVER seen or heard, there’s been the expectation that the judge be called “judge” or “your Honor” as a symbol of respect for the position they hold. Calling her a “miss” was absolute disrespect towards her profession and she rightly admonished him for it.
