The plaintiff bought a car from her co-worker. She says the car worked fine the first time she drove it, but then it started breaking down. The plaintiff argues the car can’t be driven safely, so she’s suing for her money back. The defendant says he never saw any issues with the car, so he doesn’t owe her anything. He’s countersuing for lost wages.

Seriously. My Jeep Compass is getting there, and I've already had to replace the throttle control, the A/C system (thankfully covered by the warranty at the time), and one of the CV axles is leaking... ugh. Worst purchase I've ever made when it comes to cars.

i think this mechanic knew it was a bad vehicle simply because one of the first things mechanics start learning is what year make and model cars are known for which problems and which ones go the most miles . he is not a very wise person for doing that to a coworker at a school where he teaches auto mechanics . i could see how this can possibly get him fired from being a mechanics teacher at that school .

My mother in law does this every year. Buys a $3000 pos and expects it to run forever and never give an issue. She only takes it to a mechanic when it breaks down, never does any preventative maintenance. And then complains saying the previous owner did her dirty. I've told her a thousand times to buy new or low mileage with a warranty but she can't afford a car payment she says. But by the time she gets it out of the shop every other month she could have made a monthly payment.

There's lots of cheap and reliable cars out there. Old Toyotas, Hondas, Buicks, Crown Vic (Ford), etc., etc., etc. You just have to find them. AND you just have to get a pre-purchase inspection before you buy the car.

Buying a 15 year old 200,000 mile car is always going to be a crap shoot. Not everything is a scam old things break. Listening to her at the end she didn't learn a lesson.

I purchased a used car ($1700 but gave it to me for $1400) from a mechanic after my car was totaled while I was in the process of buying a home. He allowed me to test drive it and bring it to my mechanic. What was supposed to be a temporary car, I've been driving for the last 3 years to the horror of my family! When I pick my daughter up the other parents have luxury vehicles and I'm parked with my Focus! Lol. 0f course, years from now it will be considered childhood trauma, lol. It's only needed a battery, and a new air conditioner compressor which will cost me more than the vehicle. So, I turn off the AC while I'm waiting for her - in my attempt to not cause her additional embarrassment. lol

Don't buy used cars if you don't know anything about them. Especially 4x4s. Also nobody buys a used car and doesn't have to fix something.

My Jeep is from 2005 and have over 200,000 miles. Trust me, the fact that her car didn’t fall apart is a miracle in itself.

The plaintiff as most who sue over a used car is ignorant. She should have had a mechanic look at it before she handed over the money. This is a car with over 200,000 miles on it! Come on people, it's an as is sale!!! Game over.

200,000 miles says it all! With that many miles on a vehicle (except big rigs), everything is on the verge of failure. Mechanic owned or not 200K is 200K.

not necessarily it depends on how well the car was taken care of. 200k miles is nothing now days. Also depends on the Vehicle manufacturer as well.

@@rodboijones7390 I had a 2004 Dodge Ram 1500 w/Hemi. It had 189K miles when I traded it in. The truck was meticulously maintained, it looked good inside and out but it's inevitable for things to go south with that many miles just like I experienced with my truck. Your experience might be different but I speak from personal experience. If you buy a vehicle with 200K miles you are most likely going to have issues.

@@marleonetti7 why would he put himself in an uncomfortable situation and his reputation on the line at his work place where he actually teaches? There was no issue at first, she couldn’t replicate her alleged issue in front of him nor could he replicate it in front of her.. perhaps she isn’t having her foot firmly on the brake when switching from reverse to drive? I’ve done that before when wearing heels in my own car it was truly user error, meaning me. when firmly applying the break switching gears there’s zero issues. buyers remorse in my opinion or unrealistic expectations. Who’s to say she didn’t hit a pothole or something on her way home causing damage herself? But when they are together in the car it doesn’t happen? I think buyers remorse. I don’t think there’s any bad intent on his part and he offered to help her but she herself said she JIST wanted her money back and refused his help.

@@Blueeyedjenn14 a mechanic of all people would know that even if a older used car seems to be running ok at the time its sold , it can have a problem at any time after they first drive it away and so i still think a mechanic of all people working at a school is unwise to sell a used vehicle to a coworker.

@@marleonetti7 of course unwise…. the old saying “never shhhhT where you eat” comes to mind and that’s why I couldn’t think why he would jeopardize his own interests, especially his career on purpose intentionally selling to a colleague… I have no dog in this fight, don’t know them and doesn’t effect me but I don’t see why anyone be dumb enough to be malicious - especially when he still offered to fix the car weeks/months after the fact to help her. We can simply agree to disagree, I was just simply sharing my two cents not worth half that, much like you did! Take care

You have to have your foot on brake to engage the transmission in gear. Pressing the brake too tight doesn’t effect the transmission like she thinks it does

I had a 98 Jeep Grand Cherokee and I drove it for years until 165k miles and it was wore out. 200k miles is lucky

Next time you buy a used turd with 200,000 miles on it, get it inspected first! On the other hand, Mr. Auto Shop teacher better start bringing his own lunch, because Miss Cafeteria Lady ain't gonna forget this. ;)

I hate that she says "I didn't think a coworker would do this to me." The mechanic wants to get rid of it and make a little money from the car. I'm sure she knew up front how old it was and how many miles it had on it. He doesn't sound like he was trying to scam her. If you're scamming, you wouldn't sell it to someone you know and work with.

2000 XJ is a nice old Jeep and worth some money. Used transfer case for $50, then reseal for another $50. Send out trans for a rebuild $400. Then a 4” suspension lift, WJ steering rods, and 33” tires. 200,000 miles ain’t s***, that 4.0L will run forever. Everything on those is easy to work on and parts are super cheap.

About ten years ago I bought a used car. I took it to a mechanic for inspection before I bought it. He pointed out a couple of minor things but said it was in good shape overall. Three months after I bought it, it started falling apart. I ended up paying several thousand dollars in repairs just to keep it running. Either I got a completely dishonest mechanic, or a completely incompetent one, or there are things on a car that they just can't see when doing an inspection. I'm not sure which, but I do know that taking it to a mechanic first doesn't always work out. I'll never buy a used car again, only a new one with a warranty.

You didn't see the same case I did. When she test drove it, it didn't make any of those sounds. Also the mechanic she took it to tried to sell her new rear shocks even though they were new. What else on the list really didn't need to be done?

Her attitude needs some adjustments. Instead of taking the guy to court when buying a used car "as is", she could have cooperated with him when he offered so he can fix whatever issues she claims.

He knew exactly what was wrong.. he’s a mechanic n drove the car daily.. it had no shifting issue at test drive but following day.. that’s why he was getting rid of it.. is she wrong for not having it checked out yes…but he’s a jerk to do that to her

Yes ....my thoughts exactly. He took advantage of her trust as a mechanic and co-worker. People are quick to rain heavily on the cheated person. It is the cunning cheater that must be shamed and blamed. For doing this, he lost his trust with someone he has to work with.He did this because she was naive and a woman. May divine justice get him.

So as a female mechanic, I’ll explain why you’re wrong. Things are sometimes hanging on by a thread and we as techs can’t see it because it’s internal. What works today, may not work in a few hours anymore. ESPECIALLY transmission parts. I noted that the mechanic she took it to didn’t explain why she was getting the clunk during shifting. He only mentioned things he could see. Which is a routine inspection. Diagnostics is something different and will require tear down.

If you buy a car without having it checked by a mechanic, that’s your problem. It’s a used car with more than 200,000 miles on it. It’s an “as is” sale.

Sounds like the transmission linkage. And like defendant said that’s par for the course for a 200k mile car.

Sounds like motor mounts to me. 9 times out of 10 I get people who think their transmission is going because they get a loud bang sound when they shift. It’s the motor slamming into the firewall.

I owned a 2005 Toyota Camry for 5 years . Well maintained and I decided to sell it. It had 134k miles on it. I never had one problem. The person that bought drove it ten feet and ABS module went out 🤣🤣🤣 I just gave them thier money back.

As bad as it may sound, perhaps he should offer to have the students work on it to see if he can fix it. I agree with this ruling. This is one reason why I try not to buy anything over 5 years old. Not everyone has that option.

1) Why in the heck do people keep buying old high mileage used up vehicles at the end of their service life and expect them to be new car turn key reliable vehicles? That math don't add up. 2) NEVER SELL A USED VEHICLE TO SOMEONE YOU KNOW! 3) NEVER BUY A USED VEHICLE FROM SOMEONE YOU KNOW! It's not rocket science folks.

My friend was a car salesman who tried to sale me a car claiming how cool and clean it it. My intuition told me to run a way so i did. Found out later that car was the worst in the market so never trust anyone when it comes to buying cars

What gets me is the defendant sold the plaintiff a car, the plaintiff takes HIM to court & the defendant wants to counter sue the plaintiff for, among other things, lost wages for him & his wife. Wtf?! It's almost 99% you can't get lost wages as part of a claim, number one but also, what'd the wife have to take off work for, to supervise him? Stay at home!!

Could be worn out U joints on the drive shaft (minor problem) A busted motor mount (minor). I put 30,000 miles on my toyota with the cvc joints making a God awful racket, Noise doesn't always mean something will break right away.

If you have to buy used, then maybe buy a Corolla or a Civic with 30 - 50 k miles and chances are you'll be driving the same car 10 years from now.

Do something like that? You paid 3k, for a 200k Jeep. You weren't ripped off. Wow you heard a sound on a transmission with that many miles! Congratulations. You can't diagnose problems if you can't replicate them at a shop. The fact he got a Jeep anyways up to 200k probably shows he knows what hes doing

MY MOTHER WOULD BUY CARS SIGHT UNSEEN, THEN NOT LIKE THE FEEL OF THE RIDE AND SELL OR GIVE THE CAR AWAY THIS WOMAN REMINDS ME OF MY MOTHER AS A CAR BUYER(1960'S, 197'0'S) WHEN CARS WERE CHEAP. ONE YEAR SHE SOLD, GAVE AWAY OR JUNKES 6 CARS UNTILL SHE FOUND ONE SHE LIKED!!!!! I NEVER GOT ONE OF THE CARS, I WAS 12 YEARS OLD.

I have a 2004 Volvo that was given to my kids and I. It has almost 260,000 original miles on it and I’ve only put in $300 worth of parts in the 18 mos I’ve owned it. I absolutely love it. In buying a used car, I’m definitely checking it out with a mechanic. Seems like a good idea either way.

I had a vehicle that would kinda jump when it started or had a clunk when I shifted into drive. Ended up being an engine mount. My mechanic pointed it out when he did another small job. The cost for the mount was minimal.

The plaintiff doesn't seem very bright. She test drove it and it was fine. And now she thinks that the defendant tried selling her a lemon, smh! A used car that has that many miles on it could easily get a problem the next day the next week the next month etc. What did she expect with the vehicle that has over 200,000 miles on it? Does she think that defendant magically rigged the car to go bad 3 days later? She just does not strike me as the sharpest tool in the shed!

I would never purchase a vehicle with 200k miles or even 100k. However 4yrs ago I took a chance and purchased a 2004 Jaguar S-Type off Facebook for $2600 with only 53k miles and I did not wait for my mechanic to check it first. The mechanic checked it afterwards and it turned out to be a good car in wonderful condition. I got lucky that time. But I certainly will not do it again especially with out a mechanic first.

I know it's as is, but he said he'll fix it. I know it's as is, but he's my co-worker. I know I should've taken it to a mechanic, but he's my co-worker. I know it was older than Moses, but I expected it to be perfect. My gosh, please tell me she's not an actual teacher.

If it was my car I'd have to take it to their mechanic and watch him check it over. For all I know they're just using my car to run errands and then bring it back after they're done saying they'll pass on buying it.

The seller can tell you whatever they want to get you to purchase the used car. They could say it's been blessed by unicorns and that's called puffing. If you buy a used car as is you can't complain later. People are so ignorant.

The guy stupid for selling a car to a coworker and she don’t have a clue. Leaving the car parked at work is a dirtbag move. I worked for a Jeep dealer for 15 years and if you put a Jeep in drive without holding the brake down any suspension or 4x4 part that have wear on it going to clunk. That don’t mean you can’t get many more miles on it. It just mean you can manipulate the vehicle to make it clunk.

I've owned 2 Jeep Grand Cherokee Laredo's...The Best one was the 1999. My 2006 (only 2 years old at the time) had TWO motors and a transmission put in.... CAN'T STAND JEEPS!🤬

All these cases end the same. People need to watch and not waste their time. However, if this man is a mechanic, he should give it a fair attempt to look at the car. At the same time, it has over 200k miles. The older jeeps were tough but still required repairs.
