The plaintiff brought his car to the defendant to fix his brakes. Ten minutes after leaving the shop, he rear-ended someone. He claims the brakes failed him, so he’s suing for his money back. The defendant says the plaintiff is just trying to blame him for the accident even though it was the plaintiff’s fault.

This is why you use the emergency brake or parking brake in a situation like this. If your pedal brakes don't work all of a sudden hit the E-brake or parking brake it may hurt the tires but prevents a front-end collision.

They’re for parking, not emergencies. Most of the time the parking brakes around here are either rusted apart or seized together from not being used… so it won’t do anything. That or the rear brakes lock up and you fishtail.

@@hankrhill324 You're right, that is why it's important to use the e-brake when you park the vehicle, so it don't rust up or freeze. You just have to learn how to use the e-brake to slow down or stop; so, you don't lock up the wheels or fishtail. I have had to do it a few times and it worked fine.

@@randyvac01 you keep calling it an e-brake. It’s NOT an emergency brake… it’s a parking brake. It’s not meant for any type of emergency. Yes, I can use a parking brake or hand brake to slow down a car too. It’s really not the best way to slow a car down that’s traveling over 20mph. Much quicker and safer ways to stop a car than using the PARKING brake.

A defective ABS module can absolutely cause a brake system failure. Having air in the system can also cause the brakes to fail. But in this case there is just no way to tell for sure. The judge ruled the only way that makes any sense.

Probably needed to run the bleed procedure with the scan tool to get the air out of the module depending on the vehicle

As an auto tech who’s done hundreds of brakes, it’s absolutely plausible that the plaintiff is correct. I’ve seen it many times where the peddle goes to the floor after a brake job and it wasn’t bled correctly. Hearing the defendant sounds like he shouldn’t be touching brakes.

They didnt bench bleed the master, or in some cars with the newer ABS you need to go through the auto bleed procedure with the scan tool

@@thecommodoredeckerdude owns a Exxon station so he does tons of brake jobs maybe not to many master cylinders js he’s already be in court I feel if he wasn’t doing the job correctly as customers will allow I’m guessing it could’ve had some to do with the abs sensor bc surely that Saturn has a e-brake he could’ve eased on it he had enough time to try and bail out into a yard like he said

I wish ppl would start bringing evidence. There’s been quite a few times I’ve seen cases where I believe the plaintiff or the timing of their story makes sense yet they lose their case. C’mon, you’re coming to court. You need enough evidence.

This brake issue has happened to me before, I had my brake line replaced 3 times in an Isuzu Rodeo it would work for a minute and then all the way down to the floor. I thought someone was trying to kill me honestly lolol

The mechanic probably didn’t pump the brakes after he installed them you gotta pump the brakes so they’ll get stiff and then they’ll work. If you don’t pump the brakes, the brakes won’t stop the car

The defendant said after the master cylinder was replaced, they regained system pressure. Furthermore, if they had forgotten to repressurize the system, the mechanic would have hit something when pulling the vehicle out of the service bay; or the plaintiff would have noticed it instantly when picking up the car and pulling out of the parking lot.

I was yelling, "Judge Milian! Please?!? Ask the defendant a few simple questions: Did you bleed the brakes? Yes? Okay, all FOUR of them...? Okay. Did you do it right...and have a helper...?" This is because I've seen multiple cases where a mechanic replaces for the most part, a car's entire brake system, but a problem arises when it comes time to bleed the brakes on all four wheels. This could be due to a myriad of reasons, that usually involves a situation where the shop finds itself short-handed. So instead of waiting until a helper is available, in order to get the car out the door, the mechanic takes a chance and tries bleeding the vehicle's brakes himself without the required helper. More times than not, when a mechanic takes this type of reckless shortcut, with such an important and vital function, it will almost always end up badly...or worse... Something was left in the air too. All the mechanic had to do - since the plaintiff was an idiot and took the car back to the same shop to repair - the mechanic got a reprieve, and was given the chance to bleed the brakes - correctly - this time. Dumb plaintiff...and the most ironic part is, he was probably right too, when he said the mechanic probably didn't bleed the brakes right, but screwed up horribly by taking the thing back to the guy he was now suing, duh!?! Another mechanic could have detected whether or not the brakes were bled correctly or not, and if they weren't bled right he'd have won hands down.

That is an extremely rare thing and only happens with certain systems.

@@DonziGT230 an abs system works by reducing and holding pressure many times a second. If not working properly it can continue to reduce pressure and give the driver such a reduction in pressure, the pedal can go to the floor. ANY system. The failure is rare, yes, but any abs controller can fail in such a way

Master cylinder and the line? Damn they ripped him off 😑 all he had was a leaking brake line and all the sudden all these other parts are bad too 😂 This whole master cylinder upcharge b.s. is because they didn't know how to bleed an ABS system properly. You usually have to use a method to open the valve system inside the module to properly release air. This is proven because they were claiming he has an ABS system problem from it pulsating. That's air trapped in the ABS module from improper bleeding technique. He didn't need a master cylinder or an ABS module. He needed a more knowledgeable shop His biggest mistake was taking it to the same shop... Never do that if you plan to sue

You dont just add brake fluid if its low. If its low, theres a leak, or the pads are worn and the fluid is sitting in the calipers. Its designed that way so it sets the brake light off as a way to tell you that you need brakes. If thats the case and you add it to shut the lite off when the brakes are replaced and you push the pistons back into the caliper the extra fluid will come running out or possibly damage the ABS unit or master cylinder

Fixing the brakes doesn't fix the braking system. There's multiple parts involved. It could've been something wrong with a line. It could've been an air bubble. Replacing one thing usually leads to needing to replace others as well.

I believe the plaintiff. I believe when he let that guy fix it the 2nd time, he corrected whatever went wrong. He should've taken it somewhere else, but I get why he towed it to him. Given the comments in this thread he should've brought an expert witness. Karma will catch him.

Plaintiff testified that he had quite a distance to bring his car to a stop, but he ignored his emergency brake? He is lying thru his teeth, and did not say a word about the car being fine the next morning when they test drove it.

Line was rotted and blown out, he repaired that and got a new master cyclinder as well. Now with the new pressure, and 3 other lines as old as the one that originally blew, im sure another was close to follow a short time after.

I wish they'd said what car it was. Most ABS system failures won't cause a low pedal or loss of braking ability, but there are a few systems that can.

Did I hear the car was towed in then sat overnight before the mechanic looked at it? The mechanic could have discovered that the line dislodged & the fluid drained out, causing the failure. He fixed it & refilled the master cylinder before the customer showed up the next morning.

Many years ago I had a similar experience when Pep Boys replaced a brake line. The mechanic had failed to properly bleed the brakes and the minute I pulled out of the shop the brakes went to the floor. Luckily I didn't get into an accident but I took the car back where they had a different mechanic correct their mistake.

I have to side with the judge. if the plaintiff planned on suing for faulty breaks due to what the mechanic failed to do, he should have taken the car to another mechanic (or even better, a dealership) to figure out why his breaks failed. if the reason for failure was caused by the same problem the defendant claimed to have fixed, then the cost of fixing the vehicle plus the cost of the accident is directly a result of the defendant not fixing said issue. the plaintiff deciding to take his car right back to the defendants shop even after he believes the defendant responsible for the accident makes it difficult for him to later prove the defendants workmanship on his breaks was the direct cause of the accident.

I can’t believe either of them. I totally believe the plaintiff rear ended someone and it wasn’t the brakes. That mechanic is hiding something or lying about something though. His face and grin is like a guilty 5 year old. Like didn’t really replace the module… he replaced a wheel speed sensor or bled the ABS unit and cleaned it off to look newer.

I'm not a mechanic, or an expert on cars. If it was stopping okay the first few times after he left the garage, and the mechanic tested it driving "around the block", could the brakes "grab" enough at low speeds even if the brake fluid was low? Just from the simple mechanic friction, without hydraulic assistance from the master cylinder pumping brake fluid for extra grip? I know I probably jumbled that.

Something I don’t think was explored enough was the test drive after the car was towed to the shop after the accident. They both said they were in the car… mechanic said he couldn’t find the problem , plaintiff never explained what that test drive was like … I think that if pivotal….

Here in Denmark🇩🇰 we have to go to periodic car inspection every 2 years - so rust and other problem serious or minor dont set ppls life in danger. Many ppl take there to a mechanic to get tjek before the inspection😊 When it is a brand new car never used before will it go yesrs before inspection. So for mostly part old cars are in good condition here.æ in Denmark. Of course are there bugus mechanical who cheat but they get caught usually.

The mechanic did not bleed the line properly. It would show up if you have to power brake, not normal braking. The ABS module would have coded and the ABS and brake light would have come in.

I had this happen to me years ago. Had a brake job done and they failed to bleed the line. There was air in the line. I was slowing to stop at a red light and I had no brakes what so ever. I hit the car in front of me. I had the car towed to the garage and luckily I got a letter from the garage stating all of it so the charge I had was dropped in court.

Had a master cylinder done brakes weren't bled. Pulling into a parking spot, brakes went to the floor and ended up running into the building. I had 2 toddlers in the van with me. Very scary moment.

plaintiff should have tested brakes in parking lot. just go forward slow, break, go forward, break,…. just make sure it feels right before leaving.

Didn’t state what car was but it sounds as if the mechanic bleed the brakes improperly, some ABS system requires a specific procedure to bleed brakes. I think mechanic messed up .

Mechanic clearly didnt do something right i think it was enough proof the pedal went to the floor and caused him to get into accident within 10 min of leaving….this was bad decision on the judge

12:47 😂😂 who has a camera in their car to prove anything? 😂😂 he’s obviously never watched dash board cameras on KZfaq!! Most insurance companies now will give you a discount if you have a camera in ur car!! It protects you big time nowadays with all these scams!! Specially in the USA

He lost because he was too cheap to go else where to have another shope fix the brakes, which would prove his case. Instead he returned to the guy that replaced EVERY POSSIBLE PART OF THE BRAKE SYSTEM, UNTILL HE FINALLY GOT THE BRAKES WOKINGi(THE CUSTOMER PAID THE SHOPE TO COVER UP THEIR MISTAKES??? THEN WHY SUE????????

He rear ended someone and because it happened right after the brake job, he thought he had an out. I don’t believe the plaintiff. I believe it’s the second possibility. #FullOfBaloney
