You have to satisfy 3 conditions simultaneously: 1) be within 9m of the scoring line 2) be under immediate pressure from the opposition 3) not have had prior opportunity to dispose of the ball While he clearly satisfied the 9m condition, he did not satisfy the other two as he was not under pressure when he took the ball and had both time and space to dispose of it. He wasn't even tackled over the line, he stepped over while the opponent was still a couple of metres away.

While he had time and space, and wasn’t under physical pressure, he wasn’t further than 9m from the scoring line. Therefore not all conditions met, therefore not deliberate.
