Monica has been on Paid Maternity Leave in California Since March 23. She will be returning to work on July 21st. During all that time, she will be receiving a paycheck from the state.
In this video, we will be discussing our experience, ups and downs, of trying to navigate the Disability Insurance and Paid Family Leave laws in California. We will talk about the differences between the two, how much of that time is paid time off for BOTH mothers and fathers, and how much money we're earning while on leave.
If you were confused before, we hope we can clear up some of the confusion because pregnancy on its own is challenging enough for mothers. And, most fathers also want to spend time with the baby but don't know what the paternity laws in California are.
We are by no means professionals in this topic, but we were able to learn how to maximize the amount of paid time off we received while on parental leave, and hope this information will be useful to you.

As a nurse, she worked until 37 weeks 😱 in canada, in quebec to be specific, you get to go on leave after 20 weeks paid n get an extra 40-52 weeks of paid maternity leave.

If you have medical problems during your pregnancy you are entitled to pay disability leave, and many women do take extra time and not just starting at 36 weeks into the pregnancy. The state disability in California covers any non-work related injuries or illnesses, and technically provides up to 52 weeks. You really just need a doctor or nurse practitioner to fill out the form for you…

The pay is about the same. It’s just paid to you in 2 or 3 months instead. You can take time off longer.

Hi would someone clarify on how total paid leave adds up to 20 weeks? I am counting a total of 18 not 20 for a natural vaginal delivery (pre 4 + post 6 + baby bonding 8 = 18. Where am I missing an extra 2 weeks? Thanks!

Before I became a nurse I worked at Kaiser's HR Service Center and processed leaves of absences. One thing you said that I believe is incorrect is you do not need 1250 hours for paid family leave/bonding. You need 1250 for FMLA which is different. At Kaiser I believe the policy or practice was if an employee didn't qualify for FMLA, they could still take their PFL for bonding as personal leave, but I believe in some regions you can't use your PTO during this leave. Your co-worker's manager probably didn't know that, because honestly the policy is very confusing and Kaiser's HR is a mess and doesn't communicate these things well.

It's coming back to me...in SCAL if an employee didn't qualify for FMLA for bonding, we would automatically approve them for a personal leave, in NCAL the manager needed to submit a new 1480 through myHR authorizing the personal leave. The employee was entitled to personal leave, but had to give the manager 30 days' notice, so if a manager wanted to be a dick they could make dad wait to take the bonding leave. I remember when I sent out an email denying FMLA, I would put in a note in bold to submit a 1480 for personal leave, because most managers didn't know to do that.

I do have a question since this just up for me today. I’m currently on maternity leave but being told I can only take 12 weeks by the insurance company my employer uses. Putting me back to work only 2 months after my baby was born. (I took the 4 weeks off before my due date). Is CFRA applied for separately?

I am not an expert in the matter and I think you should consult one to confirm the details. However, an employee who is disabled by pregnancy may qualify for State Disability Insurance wage replacement while the employee is unable to work. In a normal pregnancy, a worker will typically be disabled 4 weeks before the expected due date and 6 weeks after for a vaginal birth or 8 weeks after for a cesarean section. It is illegal for an employer to fire an employee because that employee is pregnant or taking pregnancy disability leave. Your employer is not required to pay you during this time and may ask you to use sick time to cover your time off. However, you may apply for state disability, which means the state would pay you during the 4 weeks you take off from work. You may then apply for CFRA and again your employer is not required to pay you during this time but you may apply for PDL to have the state of California pay you for up to 6 weeks for a vaginal delivery and 8 weeks for a cesarean section delivery. After that time is up you may apply for baby bonding time (PFL) and have the state cover you for up to 8 weeks of paid leave and 4 weeks of unpaid leave.

I work at a hospital in WI... We just get 2 weeks of payed maternal (or paternal) leave...or 4 weeks if you're willing to get payed 50% your usual pay...

Yes, the 8 weeks paid and 4 weeks unpaid is definitely better than nothing at all. Monica was off for a little over 4 months and she was paid for all of those weeks she was off. And she still has another 4 weeks available unpaid if she chooses to take it. Gotta love California.

You probably figured this out by now, but FMLA/CFRA/PFL all run concurrently for male bonding. You will only get 12 weeks max, unless your employer will authorize a personal leave.

Hi, the ACLU states that "There is no guarantee you won't be fired for using the program. If you work at a California company with fewer than 50 employees - and 40 percent of California workers do - the PFL law does not prohibit your employer from firing you."

The whole 12 weeks of bonding time it’s not paid in my experience only the first 6 weeks were paid. I had to save for the last 6 weeks of unpaid time.

Im a PA in Sacramento area as well and my wife is an RN. We have had thoughts on relocating back to family in SoCal. We are due in August, do you recommend having the baby here in Sac, take the leave, and then consider the move? I’m sure moving before the baby will be easier but qualifying for a leave after leaving sounds difficult

That is correct, you can take an additional 4 weeks of unpaid baby bonding leave. However, if you work for a company with fewer than 50 employees, there is no guarantee that you won't be fired while on leave.

Hello, so were both your jobs at risk? I believe with FMLA/CFRA in CA the most your position at your job is secure is 12 weeks but you guys say mom was out from March-July that's over 12 weeks also you say you got 20 weeks paid leave which is a little over 4.5 months of leave. So i am wondering how your jobs were still protected? Hope that made sense thank you.

Yes, you are correct. It is a total of 12 weeks for women having a c section (4 weeks prior to the due date and 8 weeks after delivery for a c section.) and another 8 weeks of PFL (or baby bonding time) for a total of 20 weeks paid.

Hi! I’m currently on paid family leave and I’m not ready t go back to work, my daughter will be starting to eat more purée solids soon and I want to dedicate my time to make sure she get freshly purée food, how can I extended my paid family leave? Will I need to ask my child’s doctor? Or do I just call and ask for a extension? I’m not sure what to do first or how to do it but which will be more helpful to extend? Can you talk about how to extend it?

That's something you will have to speak with your doctor and employer about but, unless you have a disability that would prohibit you from going back to work, I am not sure you will qualify for an extension with pay.

Would you have any info on that? I do plan to extend it if possible. I do suffer from ppd, but fixing my insurance at the moment so I do plan to speak with my doctor about it once it fixed

Hi, you stated 4 weeks before labor and 6 weeks after labor given vaginal birth, that equals 10 weeks total. Then you stated 8 weeks of baby bonding, that equals 18 NOT 20. Am i missing something?

Question? Since i'm sure you guys also make a side income off of social media/affiliate marketing, how did that effect you FPL as a nurse? I too am building my website and hoping to make a side income as well and wanted to know if you had any hiccups because of this? I heard that you cannot have any source of additional income if the state is paying you your FPL. Thank you for this video!

Monica and I are able to alternate our shifts because I work 20 hours per week and she works per diem. She schedules herself to work on the days that I have off. Otherwise, everyone else that I know has had to hire a nanny to care for their child on the days that they work.

Hey guys.. Question about the baby bonding leave for CA. I had a meeting with my HR department regarding the 1250hrs and she was telling me i won’t qualify for next year’s baby bonding time from january - april 2023 before bb turns one (estimated due date is 04/2022) if i didn’t meet those hours this year but it’s impossible because i’m planning to take 6mos off for baby bonding? I’m so confused.. i thought i had up to 12 months for baby bonding leave, i didn’t know it’s calculated by the year? 2023 baby bonding leave would be based on hours worked in 2022? hope my question makes sense. thank you for this helpful video!

@@NursesToRiches do you know if the father gets 12 weeks CFRA/FMLA on top of the 8 weeks paid family leave? My husband was told the 12 weeks is concurring to the 8 weeks which means he’d only get 8 weeks plus 4 additional week of unpaid FMLA and this was coming from his Personnel Specialist.

I recently started a new full time 40-hour week job in Nov and my expected date is mid May. Does that mean I will not qualify for baby bonding leave as well as FMLA? prior to November I was working per diem for 12 months at another hospital working on average several days a week.

Actually per EDD website, you are qualified for bonding time. Just not qualified for FMLA. I hope you got it all figured out by now though.

When you say paid, do you mean you received payments, or your current income amount was paid? In essence did your income reduce from what you were working

While on paid disability you receive 55% of your income and 60%-70% while claiming PFL, for a maximum of $1,357 per week while claiming either of the two.

I could not file my claim until the day the baby was born and I actually took off from work. But Monica, as the mother, after submitting a doctor's note specifying that she would be off from week 36 through to 8 weeks after her due date, was able to submit her claim up to 4 weeks before her due date (although she actually waited until she was 38 weeks because she didn't realize she could take off from week 36).

You can use "up to 4 weeks" before the due date. So it's entirely up to you whether you want to use all 4 weeks or not. But you will have to get a note from your OBGYN informing your employer and the state that you are physically unfit, due to your pregnancy, to continue working. Also, I am not an expert on the matter, so you can always call the state at 877-238-4373 and the could answer all of your questions much better than I ever could.

As far as I'm aware, you cannot file for leave until you actually stop working 4 weeks before your due date. We actually tried to do it before the 4 weeks and the website told us we would have to wait until the first day we are off from work.

Fortunately, living in California, we do not have to pay federal or state taxes on any of our parental leave. I an article online: "The federal government doesn't tax short-term disability benefits in California (unless the SDI payments are a substitute for unemployment insurance)"

She went on leave 2 weeks before her due date because we had no idea she could take off from work up to 4 weeks before. Is there somewhere in the video where I said she went on leave prior to 4 weeks before her due date? And, you definitely can go on leave more than 4 weeks before your due date if your doctor believes you are too disabled to work, but you might either have to use your sick time, or not get paid at all.

"Paid sick time, PTO, or holiday pay that you receive while receiving SDI will be subtracted from your SDI benefit amount, as will wages for part-time work."

Question ..Who qualifies pfl?? I will be working for 1 year now starting 10/26/21 I’m due Dec 15.. So I can take pdl and pfl after ?? Is pdl paid ??

Here is the text you're looking for: "In order to be eligible for baby bonding leave (pfl) an employee must have 12 months of service with the employer, have at least 1,250 hours of service with the employer during the previous 12-month period, and work at a worksite in which the employer employs at least 20 employees within 75 miles." Also, you are able to take paid disability leave up to no more than 4 weeks before your due date. So, all of this is paid. And, yes, you take your 4 weeks of paid disability leave first. Then, if you don't deliver in time you can take fmla (unpaid) or use such time until your delivery date, then when the baby is born you for four pfl (baby bonding time). But this is just information I've taken from the California DOL website. Your HR department should be able to clarify everything for you.

@@NursesToRiches okay so my understanding is Pdl is 4 weeks Before your deliver (36 weeks) + additional 6 after you deliver , after that time is up you can then apply for pfl which is another additional 8 weeks …pfl 8 weeks right ?? And pfl Considered baby bond time right ?

@@carinaortega813 You are correct with your numbers, as far as I'm aware. If you end up having a c-section, you can take an additional 2 weeks on top of your 6 weeks of pdl after you deliver. So it'll be 4(+6(or 8 for c-section) for pdl + 8 (pfl). You can also take an additional 4 weeks, unpaid if you choose to continue spending time at home with your baby.
