The plaintiff claims he was driving out to dinner when the tailgating defendant bumped him from behind, resulting in extensive damage to his Mercedes. Now he’s suing for the costs. The defendant argues that the plaintiff slammed on the brakes out of nowhere, intentionally causing the accident. The defendant is countersuing for damages to her front bumper.

Yeah, this case was hard to watch for me, because the plaintiff seems like a diva. His car was only worth $1,090, maybe he was thinking it was time for a new one.

That cowboys voice 😍😍...plaintiff should not have any fault because it was cowboys responsibility to keep a safe distance. I was rear ended super hard, got a concussion, shoulder & neck snapped, head rests popped. I required surgery and pt for 6 months not no 2 weeks. He was definitely hoping for a payout.

It is called contributory negligence. Both parties were are fault. Plaintiff for slamming on brakes and defendant for tailgating.

Love the Defendant's accent, reminds me of that country dude played in Fast n furious Tokyo Drift. - Anyways, it was stupid in his part to not have insurance, his friend that cosigned for him was pissed. I believe the Plaintiff write that letter stating it was from his lawyer, being shady.

Yah the fake lawyer letter got me, that’s a form of intimidation to send 3 threatening letters with a cut and paste job from a lawyer’s letter head. But I think the ruling was fair.

It wasn't established that the letter was fake because the calls to the attorney who may have wrote the letters weren't made. True, the letters appeared of questionable origin but nothing was proven. The letters had no effect on the judge's ruling.

Before I watch this, IT DOESN'T MATTER if the guy brakes, keep a safe following distance. Every day I get people on the road who I swear wants to ride in my trunk, unnecessary. Be smart, keep your distance and don't be an a$$hole. If you're late, accept the fact, wake up earlier tomorrow.

The road-ragers in the comments think you don't get out of their way fast enough 😄😄😄 I know what you're saying though. I used to have to use the expressway to get to work, and I would go with the flow of traffic---although they were all speeding like crazy. But it would have been dangerous to do the speed limit with heavy traffic all around me going much faster than that....and they all ride on each other's bumpers, including mine. So many road-ragers, and apparently they all have a death wish. I now avoid the expressway like the plague. Where I live there's a giant stroad (a 7-lane expressway with parking lot entrances all over the place & cross streets with traffic lights). I avoid that too.

Neither of them were being 100% honest, but the plaintiff was clearly lying. Physical therapy for only two weeks? Wow! It must’ve not been that bad. When we were rear ended I had 2 years of physical therapy!😕

I honestly think that the defendant was riding his bumper a bit, but the plaintiff saw an opportunity to make money. I think he deliberately slammed on his brakes knowing that the defendant was too close. Yes, I know that the defendant should not have been riding his tail, but I 100% believe the plaintiff wanted to "win" their road rage game & make some money as well. I think the judge should have just made them both responsible for their own damages. Plaintiff should not have gotten a dime. I don't believe he or is wife had any medical damages. Judge should have thrown out any of his evidence as it was already proven that he forged the attorney letter.

If you hit someone from behind you are at fault! Love the defendant's voice and he has a beautiful smile. Hate that he lost the case because I think the plaintiff was a bit shady.

It blows my mind how people play ice hockey, and football, and rugby, and box for years and years of their lives relatively unscathed. Yet you see people on here all the time who get rear-ended at like 5 mph and then all of a sudden they need to see doctors and they need physical therapy. It's a big crock to make money.

I've seen the type. You get in front of them and they are angry. This may not be that. Still, if you hit someone in the rear I'm not sure how you get away with not paying. Wouldn't the police report say who's at fault?
