The plaintiffs purchased a puppy from the defendant and claim it had parvo, so the dog had to be euthanized. The plaintiffs are suing for a refund and vet bills. The defendant says she was shocked because none of her other puppies had parvo, and the puppy was perfectly healthy when she sold the dog to the plaintiffs.

@eddiesaviarycom-fu9me it has nothing to do with spaying or neutering, which by the way is a responsible way to control our domestic animal population. Back in the day, mutts were everywhere before leash laws were thankfully applied. Dogs were allowed roam free, and inevitably they would mate with other dogs that roamed free. These mixed breed puppies were given away or euthanized or, sometimes disposed of in cruel ways…

@@justinturner8278 Mutts are not "better" dogs, in any sense of the word... That may be your opinion and you're entitled to think that but you're objectively wrong. Your personal experience is not evidence to your claim that mutts are inherently better dogs. I'm sure that you have had many great experiences with mutts, as have I, and it's not to say that they are bad dogs, by any means. But in reality, mutts are inferior to purebreds in general, overall, and it's cruel for us to breed them, in many cases. Unfortunately, because of us humans, selfishly wanting to create new breeds for their looks, behavioral characteristics, or their specific performance instincts, we have carelessly caused a lot of suffering in these dogs with major health issues and complications and unfavorable behaviors, due to mixing different conflicting characteristics and natures. It's incredibly irresponsible and inhumane to either deliberately create these new "breeds" or to allow the interbreeding to take place between unspayed and neutered dogs, especially when we know the damage it causes and continue to do it anyway for superficial and/or financial reasons.

Yes I had. A Dalmatian back in 1994 that had her first litter of 12 Dalmatian Puppies and at exactly 6 weeks old parvo took the lives of only two I immediately took them too Veterean ASAP they were admitted in hospital under Iv and medication sadly it still took their lives ... We were Renting Home and property and was told We could have our 3 older dogs No problem they would be Fine had a fenced in yard and outdoor guess house and attached room were the mom and puppies were .. The landlord knew the property had previously had A Parvo Problem there and Neglected to Inform Us knowing we raised Pups for resale .. This caused the lives of two all others were fine so goes to show you the same with that pup .. Property Owner Assumed that Parvo was just a seasonal once in so many extended years virus.. Not true Parvo lives in grounds and on any thing it comes in contact with for years... I took and bleac the room out and bleach the concrete area he let me moved ASAP due to health of my dogs and Me not wanting anyone else’s pups to die .. I saved four pups not sold for liability purposes I always do then after all as been picked up and paid in full and waiting my grace period.. But with these I kindly and willingly told all new owners what had happened and that I took them to vet for testing... shots.. worming and complete checkup... Due to the fact Two got Parvo I gave them the choice to back out and if they still wanted their pup I extended the grace period to 30 days if they developed Parvo by some reason but lefted the original grace period the same if anything other than Parvo happened .. I felt I needed to give them the 30 day grace on Parvo to make them feel Protected and I put myself in their shoes if I was purchasing one that the owner be open and honest and held liability on my pup.. I don’t want my reputations Love and care for my pups to be ruined ................ ............ As for the four pups that were held back not sold like others I keep them a additional 2 weeks after 30 day period then the potential buyers on list by availability were contacted then too see if they was still interested in a pup and was given a discount on those pups ... keeping those pups keeps you from getting sued and having a happy buyer and keeps your reputation in good with all buyers future buyers and they will give you a good reference this is how I want to be treated, I want good honest relationships with all my Buyers....it’s worth taking a small lost on those last four instead of being out thousands and court cost by trying to cover up lies. Lies I don’t want to be apart of and I rather profit a little , rather than major and still lose it by not being Honest... Honest is your Best Policy......

This is a tough one. I’ve nursed nearly 20 dogs through parvo (I run a rescue) and there is really no way to tell where it came from here. Parvo can show up within days and kill a dog within days. I have a major issue with the vet for euthanizing the dog without even trying because it’s absolutely survivable, especially if caught early. I’ve only lost 5 dogs out of all that I’ve cared for and those 5 were far along when I got them. I imagine that the vet told them the cost of treatment and they chose to euthanize. But it could have come from anywhere, honestly, because it can live in the soil and untreated places for years. The puppy could have picked it up from the vet the day they got the dog or it could have come from the breeder and the breeder is lying. It’s impossible to know. More often than not, though, it comes from the breeder

I've raised purebred rottweilers for the last 21 years and had 3 die from parvo (rottweilers are more affected by parvo than most other breeds). The defendant was absolutely right when she said the plaintiff's could have contracted the virus while dog shopping at other kennels that week. A small group of kids stole one of my pups and after offering a reward I was able to recover it after a few days. However, the puppy had been exposed to parvo during that short time period and died after 3 days of me having her back. The parvo lived in my yard for nearly 2 years, even after several treatments and killed 2 more of my dogs during that time. There's no way the parvo came from the defendant's home...the defendant's other dogs (at least one of them) would have certainly tested positive as well. I would bet my bottom dollar the plaintiff's contracted it while dog shopping that week. That's exactly how parvo works.

Parvo, like distemper, can be transferred by fomite contamination. Parvo is ubiquitous in the environment, that is but one reason why we vaccinate. It isn't just the parvo, there are intestinal parasites and ear mites too. That reflects very badly on the breeder.

The defendant has a good point. They could very well have picked up parvo somewhere and were carriers of it. They did see and expose that puppy a few days before purchase, giving it time to effect the puppy and then test positive a few days after bringing the puppy home. When my puppies arrived one was sick the following day I did test all my 5 puppies and only one had parvo I immediately went to the vet within two days all the 9 week puppies got parvo but initially for 48hrs only one had it and I believe it did come from the shipper. I later found out through the breeder that the day my puppies were shipped was the only day the vet could see them for the health certificate and he had given them their parvo and set of shots that morning so it shouldn’t have been shipped there wasn’t enough time for the parvo shot to protect my puppies. Only two of my puppies didn’t get parvo and one was 10 months old show champion he had all his vaccines up to date and a 12 week old puppy also had all his shots up to day unlike my three 9 week old puppies that were defenseless. The vet treated them and wasn’t sure they survived but with much pedialyte and ambers naturals tinctures paxxaid and vibactra they all survived I saved all my dogs and it cost me less than 100.00 lessons learned never ship your dog go and pick it up it is not worth the trouble

Wouldn't really recommend a rescue because they lie about the dogs breed all the time to unsuspecting people who have no experience with said breed and also their history is mostly unknown. Vetted Breeders though, totally recommend.

Just another unethical breeder, breeding 2 random pets together and throwing micro and teacup on the name to try and get the most money they can. She didn't even treat the dogs for parasites (which takes a breeder a couple bucks to treat). Parvo can literally come from anywhere. So many pet people instantly take their pups to pet stores, groomers, let them run around vet floors, take them to dog parks, etc right after they get them. Within 3-4 days, they can easily show signs of getting it. The smaller the dog, the faster it shows after catching it. Because the pup was showing signs of parvo of around 2 days after having the dog, then yes, I do believe it came from her. Add the fact that there was a huge case of worms, that pup never had a fighting chance. This is what a BYB is.

Nope parvo is highly contagious if none of the litter had parvo, that puppy could’ve picked it up anywhere. Parvo lingers so it could be in their grass from a neighborhood dog. If the vet didn’t try to save the puppy it was because the plaintiffs didn’t want to pay for the procedure. It isn’t cheap, it’s a process. If you love your pet enough, you’ll do it. It’s like cancer. They can absolutely recover with the right relief

I seldom disagree with this judge; however, in this case I do. I believe the defendant made a good case that the virus could have been picked up, by the buyers, at another location (I actually had this happen at my home, almost 50 years ago). In my opinion there was actually more evidence that the virus could have transferred off the clothing of the buyers, than had originated in the home where the pups came from. I would have dismissed claims from both sides and tell them that there wasn't enough proof for where the virus came from.

Sorry. But when they did the first fecal it’s not how it works. If it had parvo when it was purchased it would’ve been visible on the first sample. They don’t just “pick and choose “ what they see. And they should’ve went to a different vet bc it absolutely is curable especially if they took it the day after they “noticed symptoms”. The dog I promise you wasn’t locked in the house the whole time they had it.
