Today the Dickinson County Sheriff Dept came to my house! Apparently I made a Facebook post alleging that "some BIG thing would be happening on the railroad" or something to that effect.. I find it hard to believe that the railroad would just call police on me, but I did create a FB post about kids trespassing on a group I help run. You'll see that first video of the trespassers, plus the FB post and the interaction with the Dickinson County Sheriff Deputy whom I knew already. I just DON'T UNDERSTAND how they can keep making false reports about me!?!?

If it's the same guy that bitched to the police last time, Rail Road foreman, He has to worry that his bosses will see the crappy work he is doing in general. We had a pipe line supervisor here that was up to all kinds of shoddy maintenance. He was always on the defensive when we questioned what he was doing on our property. The ancient leaky pipe crossed our farm, and he would just show up unannounced and tear up the place with out first talking to us. Last time I called their main office and raised hell about it, they called back in less than 15 minutes and got the facts. Within a few hours a big boss from Tulsa, arrived via company helicopter, handed us a check for damages, and took control of the situation! I don't think they were aware of the situation at the home office as local guy didn't want them to know how bad he screwed up. Never heard from that local jerk again, and guess what, no more pipe line troubles here after that.

I guess if I was that cop I would go back to the railroad employee and ask them to see the supposed Facebook post they say you made. If the reporting railroad employee couldn't produce that post, my next topic of conversation with that employee would be informing him that filing a false police report is a crime. They tied up and wasted the time of the Sheriff's Deputy when he could have been needed elsewhere (ie. Traffic crash, etc). You have video proof of your conduct, I'm pretty sure the employee does not.

Claiming you made a Facebook post which seem to be something that could be easily checked. I agree that in his investigation the deputy should probably ask them for some evidence of the post. Then again, he’s already wasted taxpayer money. It might be something to remember for next time and save the deputy having to take a trip and visit you.

I’m always impressed how you are aware of your surroundings and avoid trespassing on railroad property. I follow several other railfan sites and I have to say some of their videos make me nervous because they appear to be way to close to moving equipment.

Adding to my comments. A while back you did a video of some switching activity where the conductor did some things that were questionable safety wise. Several comments about it were posted. Maybe railroad management saw the video and called him on it. On some railroads that could result in a furlough. Maybe he saw you and is getting a little revenge.

I was bullied and harassed by two NS employees for simply standing on a public bridge (Ohio State Rt. 4 ) which crosses the Eastern throat of Bellevue Yard. I was only observing some workers at some distance below working on a switch... In retrospect, I should have stood my ground and let those fools try to have me arrested. For what?

Iam a Locomotive Engineer for a Class 1 Railroad, we have special agents to handle issues, outside Sheriffs deputies or any Police agency has "NO JURISDICTION" on our railroad or any Class 1 railway. Our railroad actually welcomes any photographer to photograph or film our trains, you can actually go to the regional office and they will take your pucture and make you an I.D. allowing you to film or photograph on Our Railroad (Federal Property) We welcome videographers simply because it curbs "Train Roberies" and yes, there are train robbers and rip off trains daily taking hundreds of thousands if not millions of dollars worth of goods of the trains constantly. Being that the railroads have their own "Special Agents" and Sheriffs and Police have no jurisdiction, trains are easy pickins, and there aren't enough Special agents to go around. Although your dealing with a private shortline, I can't see any reason whatsoever why they are giving you a hard time, they sound like a bunch of "Karens" that have nothing better to do!. I would tell them to fuck off!!!🤣👍

@@woozleboy Hello: Contact the General office of the subdivision closest to you, ask for the public relations dept, they should be able to help you out. Iam assuming your dealing with a "Class 1" R/R????. Sometimes dealing with these people is like trying to contact the Wizzard of Oz, but dont get discouraged, they are usually good at working with public entities. If for some reason you cant find the right number for that dept, Go to a classification yard and find the Trainmasters office, they can help you get intouch with the correct people.👍

I wonder if they aren't just being pissy about their track condition and equipment issues being shown far and wide. Clearly there was an issue and you caught it. This makes twice the ELS called the police on you for nothing illegal. At some point I'd consider putting a lawyer on it.

Its def something that I need to keep records on. The fact that I saw trespassers and reported it (on video) to RR workers, then an hour later police come about a post I made? Talk about ironic eh? I know they watch my videos because when I film trouble spots, they get worked on.. I may FOIA the call they made, just to hear what was said.

@@jasonasselin oh I absolutely would FOIA the calls along with all responding officers body cams. Officers may have spoken to the RR workers. Then compile the video and post it. It's done all the time in 1st Amendment Audit videos

This poor excuse for a railroad should concentrate on improving their deplorable track conditions and unsafe operating practices. I am a retired conductor, 43 years of railroad service, plus military and part time police. The deputy was responding to a chicken shit report, but has to since a report was tendered. I'm almost positive that the MOW employee is the one since you are a You Tube celebrity. Jealously is one of the greatest sins and I'm sure that this might be the reason for this phony report. I enjoyed rail fans and went out of my way to assist them in their efforts. Yes, I have Lionel and Marx layouts in my basement and perform repairs. Don't be dismayed, we enjoy your informative and wholesome videos. By the way, I also helped transients (hobos). Best to you and all those who give us these videos. Take care and God bless!

Usually something like this occurs because mistakes were made and they’re trying to cover them up. I’m talking about the railroad workers. And they are just like the police, they don’t want people videoing them. Decades ago the ordinary citizen couldn’t do that and now everyone can do it that has a cell phone, they don’t adjust very well.

With ALL the bullshit going on in this country, how do they know you're not another terrorist looking to sabotage the rail lines? Maybe somebody DID sabotage the lines and when you went down there with your camera and they saw you recording, they may have suspected you as being the one who did it? You know that bad people always return to the scenes of their crimes, don't you? They may be looking for whoever is messing with Rail Road property? I'd just stay away from there and don't go poking around them with your camera unless you want the cops returning all the time.

@@glenturney4750 Something you should’ve done before you posted your comment and that was Google how many miles of train tracks are there in the US approximately. There is, 140 thousand miles with thousands of bridges. This person videoing is known to the railroad workers. You think that someone who is known to the railroad workers that lives along the railroad and they know, is or could possibly be, a terrorist with his many miles of train tracks and thousands of bridges many of which are in very remote locations this is where a terrorist act is going to take place? Unfortunately the government owns your brain. And in my opinion they don’t want to be on video, they think because they work for a railroad that the police can stop him from videoing, not going to happen. I wouldn’t be surprised if some of the people that work for the railroad steal things and resell them.

By the looks of the railroad ties laying all over the place, the railroad is is violation of Federal laws stating all railroad ties cannot be left over six months due to ground pollution of the cresote.

Railroad enthusiasts are the best public relations advocates any railroad could want. For some reason a limited number of railroaders seem threatened by the interest these enthusiasts have. The people who should be concerned are the railroads’ executives. They allow rights-of-way to become overgrown with weeds. They allow derelict engines and rolling stock to sit rusting in yards, spurs and sidings. Railroad buildings are abandoned only to become community eyesores. Profane words spray painted by vandals on railroad bridges and abutments are allowed to remain while other businesses would address such ugliness immediately. Nonetheless, railroads get upset when some enthusiast is amazed with the skill of locomotive engineers, the bravery of switchmen, the amazing strength of the engines and the power to pull 250 cars. Go figure!

Johnny, That's when they worked for good railroads and enjoyed their jobs. It's all corporation and big business now. No one, as in None, know how many thousands of Rules, Regulations, Policies and Procedures ( written and unwritten ) there are now. There is no way you are not violating one or more each day. If management wants to get rid of senior workers, it's a simple matter. Hard to cheerfully work with a target on your back. Used to have 3-5 workers per train. Then down to 4 and quickly to 3. That held for a awhile. Now down to 2 and talk of just running with one. Anyone coughs out of turn and they bring up running them autonomously. Hard to work like that ...

Fill out a Freedom Of Information form to request a copy of the file and you can find out who made the call. Request audio and file. Hang in there buddy!

I enjoy your vids Jason. I work for the railroad and some of the guys I work with look down upon railroad enthusiasts and refer to them as foamers etc. the majority of us don’t mind having pictures taken of our equipment and we enjoy seeing the pictures and vids.

I agree with some of the other comments that you shouldn't freely talk to the police like that. Just say you have made no such Facebook post as they describe. You don't need to / shouldn't go into all the unrelated info you shared. Never show them your phone. You might want to stop provoking them also by always bringing up the trespassing claim from so long ago. Let it go. All you are doing is triggering them.

As long as your off RR property, they can’t do anything, just keep recording for proof, and after a while if you get sick of it, you could take them to court for harassment, false accusations, and probably some other things too

In Yorkshire UK, we have a saying "There's nowt so queer as folk". There are some very odd people about who seem to get fun out of trying to stir up trouble for others. Over here they would be charged with wasting police time. Someone must have a grudge. Probably they don't like the fact that you manage to make a living by filming trains for the enjoyment of others. Don't let them put you off. Your videos get seen by railfans worldwide so keep them coming son. Jaw tooth has also had railroad staff report him just for being there so it's not just you! Made a good video for your fans anyway. Keep on keeping us informed. We like to see a bit of life in the films but this takes the biscuit. I hope it gets you a lot more fans by going viral.

I have a friend that lives along railroad tracks and has for about 30 years. The tracks were owned by SP and are owned by UP. This is in California. Anyway after UP took over they started to give my friend a bad time. The UP police broke into his house one night, this guy is a Vietnam veteran special forces. One cop lost his gun and the use of his right arm and the other ended up in the ICU. The courts found my friend was well within his rights. My friend told UP that the next time he would send them in body bags. They never come back.

The sheriff dept should go back to the person who phoned in the issue. Listen to what they have to say, then if they detewrmine it not true. Advise them if they are calling in false police reports they will be held accountable for that.

Exactly what you said.. WOW.. I once got officially arrested for video taping from a public dirt road by the then, B&M police.. It of course got thrown out because the charge said I was standing on the rail head.. yep, I was literally sitting in my car on a dirt road belonging to the town. You must have pissed off that RR employee asking him a mundane question.. no sense of humor..

I deal with these kind of situations all the time, but most of the time when people call me in it's usually not the railroad but actually people that drive or walk by and see me taking videos of trains. Couple weeks ago some woman walked up to me and tried to tell me that filming trains was a federal crime.🤣

Thing that beats me, as a Brit, is how it's worth tying up a cops time with so little prior investigation. "Something about you posting on Facebook about a big incident about to happen..." I mean, wouldn't the cops actually look into that before committing resources and coming to talk to this guy? Shouldn't the police have some idea about what matter they are actually supposed to be investigating? Don't cops in the US have access to Facebook? No crime has been committed, obviously, yet it looks like the local police are working at the behest of the railroad company, intimidating citizens, rather than policing independently. Not good optics...

It's a small town and the Police are locally funded by property taxes and managed. In small towns a good portion of the property taxes are paid by the railroad........so in Britain you understand the concept of a company town. Same concept in America and my guess if we had to look at the books the E&LS railroad pays a chunk of property taxes into this towns treasury. If I am Mayor or Police Chief and one of my top taxpayers is making complaints no matter how frivilous, I am going to probably listen. Also, in the United States, Facebook is blocked on most LANS to prevent employees from wasting workplace time on their website. Not sure if the same is true about Police but I would venture to guess that only a Police Detective would have access to Facebook at work not a street cop.

Good thing about small towns is most people know each other. This deputy knew me and could see my face to tell if I was being real or not. He knew it sounded crazy, I've known him for years now. Good to know they have my back.

Jason, the only thing, IMHO, you messed up with was questioning 'if' the real trespassers would be talked to... Take the oath, "I shall not talk to railroad employees about other people." In fact, I would 'not' talk to them for any reason, other than if a life or death situation came up. Non-railroad employed, railroad photographers pledge: "I take nothing but photos, I leave nothing but footprints, I never trespass, and never interact with the employees unless they say "Hi" first". The lower your profile, the less likely you're bound to be noticed.

My wife and I are historians, train chasers, we take photographs not only for money, but as historical documentation, we are tour guides, and we write books. We found corruption in our local government, and the cops started harassing us hard-core. I'll just leave it at we discovered millions in misappropriated funds and no one was going to investigate/prosecute themselves. Every activity in our lives was/is still disrupted and we were falsely accused of everything under the sun and harassed by our badged domestic terrorists. The cops even told us that we did NOT have the appropriate licenses to take photos of trains, we had to apply for official town train photographer status next year, and interfered with our photo taking as one of their uniformed buddies went over to a D&RGW special (containing a tour that we were waiting to lead) and started taking photos of the train at one foot away from the engine. One assifer actually grabbed me from behind and kept jiggling me as I was trying to take photos, everytime with a comment like "Oops, you're not licensed to be here." I was on the public platform. However, the badge gave his deputy buddy permission to get up close and personal with the train and get good photos. One RRer even told the photographing cop he needed to back up to a safe distance and he just pointed at his badge and kept taking photos. A couple of days later, the local train crew called us and parked an engine at a location where I could take photos of a different engine while standing on the raised street and proceeded to tell me about the problems that the RR was having with the local cops too. Personally, I would demand documentation and source of the "accuser" because it can become a decade+ long pattern (it's amazing how many body/dash cams "malfunction and the footage is lost" and how many times the cops have an anonymous -- but "good" -- source), then the next problem is finding a good lawyer. Things change after you have a list of non-incidents contacts and you discover that even though the cop is in uniform and in a cruiser he is "off-duty" and harassing you for a buddy while on "his personal time." Sadly, recording one of their "information sources" who showed up at my front door and demanding $50k cash to "reverse their false charges" doesn't improve the cops' dysfunctions. So, long story short, document everything in detail and could your false accuser be a corrupt politician or a "rival" making false accusations for their own personal reasons?

As a former railroad employee, railroad workers don't like Railroad 'Buffs" because you interfere with their screwoff time. The only people who don't have a problem being filmed on the job are the people that are actually doing their job!

I guess the plain and simple truth is some people simply do not like to be filmed when they are working or out in public. The place I work has cameras everywhere inside the building and we don`t give them a second thought. I guess the people that don`t like it are either afraid that they will be recorded just standing around when they are supposed to be working, or they are doing something they shouldn`t be doing, or they are just paranoid. Hey man, they`re out there everywhere and you never know what`s going to set them off. Stay safe brother!

Well, that was interesting. The Police Officer’s demeanor was great, he told you why and for what reason he was speaking to you. And then he listened to your explanation to him, why and what you were doing there in the area. Obviously the MOW personal on the scene called the Police. I remember you saying in previous videos that there was some interaction between you and one or more railroad employees that was not a good interaction. There must be a stigmatism by the railroad employees placed on you and that other employees only know you by what those employees say about you. You know the old saying, make a mountain out of a mole hill. From my experiences, sometimes you get a call, get there and find out the original call was not what dispatch said it was, not the fault of dispatch. That’s human nature, every person has their own personality, sometimes it’s normal and others, well it’s not. Just keep documenting your surroundings around the railroad area, this will show that you do not trespass and it may save you of any problems in the near future with the railroad. I think it's stupid how people play favorites (or in this case, least favorites). There was like one or two people literally climbing on the locomotive (or at least it seemed that way) and you were just driving by in your car. So who does the railroad call the cops on? The guy just casually driving by in his car.

The cop was professional and didn’t harass you. If he had an ounce of evidence you would have been arrested. He was doing what he needed to do. Your buddies on the RR obviously exaggerated and created a story. I’d be back ASAP to stand my legal ground. If he can’t behave the cops will tire of him and take corrective action. My experience is that the cops always take the most passive easiest person to task for an altercation because it’s less paperwork!! Carry-on my good man, keep your chin up!

Open records request. Ask them who made the call and ask for a copy. They likely phoned 911 or the non emergency and recorded should be avaliable for both.

Jason, what I am about to write is not a judgement of you or an indictment of your passion. In another lifetime, I used to work for a model rr manufacturing and distributing company. I frequently traveled for trade shows and conventions. There were always these guys who we cringed at seeing. The guys with complaints or unreasonable expectations of what was produced or criticisms of lack of accuracy. “The SP didn’t have that. Why are you making it that way”? My gut tells me that there is a railroad employee or two that don’t care for you for whatever reason. They see you coming down the road and say to themselves S###, here comes that guy again.. what they have that we didn’t is a company that can throw some weight around because of the perceived threat posed by the general public to disrupt operations. They just have to make a call to the police and hope that the cops coming to talk to you will scare you away. But dude… as long as you’re staying within the boundaries of public rights of way… keep on doing what you enjoy..

My husband and I have been following you for years now and I honestly just can’t understand what their problem is with you videoing the trains ? People love trains, we don’t watch your videos for the trains we watch for the other videos and we are fellow Michiganders and my family is buried in Calumet. Is there someone we can call and ask why they have such a huge stick up their rear end and that they need to remove it because people in this state actually enjoy your videos and maybe people would actually like the people who drive the trains a bit more if they weren’t such as$ hat’s? Thanks for the videos Jason, we enjoy the effort you put into making them and appreciate what you do especially what you did for Ray.
