When Frank accidentally hits Dennis's car while Dennis is eating cereal, Frank and Dennis go to the Paddy's Pub court to face off on who will pay for the damages. Court is in session at Paddy's Pub as Frank and Dennis present their cases to the rest of The Gang (with Dee and Charlie serving as lawyers and Mac as judge/bailiff), resulting in a verdict that will change their lives FOREVER... but not really.

Well he's an actual trial attorney, it's not like this is his day job. But in addition to being a trial attorney he also sells a law school prep course that these videos rely on to substantiate his knowledigibility in the law and credibility as a tutor. And I never would have known any of that if not for youtube recommending me these videos, meaning they work very well as free advertisement for both.

Trivia: Glenn Howerton (Dennis) was actually involved in a traffic accident where he was eating a bowl of cereal. This episode came about after discussing it in the IASIP writer's room and no one could get past the fact he was driving while eating cereal.

Interesting! I knew that almost all episode ideas came to them from stuff they heard on the radio, saw on tv, or had happened to them, but not about this particular one. Best comedy show to this day, because despite being in 2022, they are, to my knowledge, the only ones who do not shy from dark humour, racism and non pc humour, violence and drug and alcohol abuse as means of comedy, which I absolutely love, and applaud them for, despite all the butthurt people being triggered. (of course I mean comedy show with real people, cause Family Guy isn't far off)

I still remember the theory that Pepe Sylvia was Charlie failing to read Pennsylvania on the incoming mail. Shame the writer said that wasn't the intent, because that would have made the whole thing better.

To be fair, Charlie is not completely unable to read. He is just functionally illiterate. Hence, him deciphering "Pepe Sylvia" from "Pennsylvania". Besides, I'm sure Frank provided the documentation and Charlie just followed.

Always Tempted yeah, he likely doesn’t watch the show. All he does is just study recommended TV scenes to explain them. Also, he made this channel in order to educate people on the topic of law. It’s like Doctor Mike (a common comparison). Doc. is a confirmed practitioner of medicine, but the fact he owns a channel doesn’t soil his record. Same applies here. Mr. Eagle is a confirmed practitioner of law, but the fact he owns a channel doesn’t soil his record.

Objection: When Dennis says that the burden of proof is not on him, he is referring to the accusation that he has donkey brains. When Charlie accuses Dennis of having donkey brains, the burden of proof for that accusation is on Charlie. The burden is not on Dennis to prove that he does not have donkey brains.

This show has TOUCHED almost every sensitive and taboo subjects out there few shows are willing to delve into. Unapologetically confronted the societal hypocrisies and double standards. This was practically a documentary of human behavior if we were to actually FREELY express and act on our thoughts and emotions. To think he would say that in an episode which actually is about attacking one's character. Wow. Just offensive. That's like saying a show couldn't be RIDICULOUS and smart at the same time. Practically contradicted himself applauding something good (less than a minute ago) coming from something "stupid".

If no one has recommended this already, there is an always sunny episode where they meet with an arbitrator to settle the dispute over who is the rightful owner of this scratch off lottery ticket. You should definitely review that one as well!

He did not even describe any particular example that you can analyze to determine anything.. you have just prejudged him, and assumed the worst.. even though the worst is not the most common scenario. My best friend growing up turned out to be almost exactly like Dennis, from the way he talks down to his mannerisms. Even some of his logic, how he thinks so highly of himself, and his outbursts. Based on an episode of South Park in which Chef sues a major record label and Johnny Cochran, the label's lawyer, starts bringing up ridiculous arguments about Chewbacca being on Endor in Star Wars: Return of the Jedi. Within legal circles it's become a term for when a defense attorney makes completely irrelevant and illogical arguments with the goal of confusing the jury. The hope for the defense attorney in that case is that the jury then interprets their confusion as doubt, which could then result in a not guilty verdict.

Fun tidbit, this actually happened to the actor who plays Dennis. He was eating a bowl of cereal and got rear ended and then came to the set livid because the first brand new car he ever owned now has damage after weeks. Objection: Hadley v. Baxendale is a contracts case about the extent of damages owed. The more on point 1L case would be Palsgraf, since this is a tort case and the issue is whether Frank is the proximate cause of Dennis’s damages. But the test for each case is basically the same-foreseeability. Also can someone please send this to my parents so they know I only wasted most my time messing around in school?

I concur in the objection. Furthermore, a specific analysis should be done to determine whether the question is now that of proximate cause or, in fact, an instance where the Defendant takes the Plaintiff as he comes. I would move on summary judgment (or motion in limine) to exclude any and all arguments about assumption of the risk, as assumption requires Plaintiff's speicifc knowledge of the harm that could occur. I think, as a matter of law, you do not assume the risk of a rear-end collision. As opposed to walking over ice and falling (one of the more popular AOR defenses). Similarly, no comparative or contributory negligence is available as Dennis' act in eating the cereal doesnt require any duty and was not the proximate cause of the spill. 2 cents. PS- glad you circled back at the end and cleaned up that (if it was an arb) party's make their rules in arb, so objectionable evidence in normal proceedings could be entirely permissible! Great video!

The assumption of risk, seems to be that in any given situation the cereal could spill and ruin the interior of the car. It could have happened with a hard left turn, or with a rear end collision.

Of course there would be lots of legal episodes. One of the main gags of It’s always sunny is seeing how horrible, insane, and asinine the gang can be. What better way to showcase this after seasons of “normal people” and other crazies interacting with and being corrupted by the gang then by putting them into a typically professional environment(and watching the professionals interact with, and be corrupted by, the gang.)

The tragic humor at the end with poor Dee having to pay for the car damages is- that in previous episodes of the show, her car or cars she had always in up damaged by the rest of the gang. 😃

Objection: when Dee talks about precident, she does not say ‘legal precident.’ I think it is reasonable to assume that she wants to set the (non-legal) precident among her (lunk-headed) friends that actions have consequences.
