What are the rules about trying to work after filing for Social Security disability?
Because Social Security disability claims are so backlogged, often taking two to three years (!) from start to finish, many truly disabled people have to try to work to avoid homelessness.
The question I hear more and more - "if I try to work, will it hurt my disability claim?"
In this video I give you my perspective.
As I discuss, you have to understand what SSA considers "work" or, more accurately "substantial gainful activity" (also called SGA). In 2023, SSA will find that you are engaged in SGA if your gross earnings received in a calendar month exceed $1,470, or if you are engaged in an activity that would pay you $1,470 per month.
Note that the $1,470 refers to gross (before taxes) income. Further the SGA amount changes every year - here is SSA's SGA table for SGA over the past few years: www.ssa.gov/oact/cola/sga.html. The SGA amount will change every year so if you are watching this video in 2024, 2025 or beyond, check the table.
Further, SSA uses different earnings numbers for its Trial Work Period program, and another table of numbers to determine earnings credits. The SGA table is what you need to look at to determine what SSA considers “work.” Here is a link to an article I wrote that discusses these confusing tables of numbers: 4socialsecuritydisability.com...
In my opinion, the SGA limits are ridiculously low - $1,470 per month equals $17,640 annually. Where in the United States can anyone survive on $17,640 per year? But this is SSA's reality.
If your gross earnings from a part time job are below SGA, are you in the clear? Maybe. In my experience on-going, part-time earnings that are close to the SGA limit will raise the question in a disability judge's mind about whether you could work at an SGA level if more hours were available to you.
As such I advise my clients part time work a few hundred dollars less than SGA will likely raise fewer questions.
Also in this video I discuss what happens if you should exceed the SGA limit occasionally or frequently. This raises the question of whether your over-SGA work constitutes an "unsuccessful work attempt" or not.
SSA's outrageous backlogs have left deserving claimants in a very difficult situation so I expect to see more and more clients who are working part time, with difficulty, but out of necessity. The best advice I can offer is to file as soon as you can so you can get in line and allow the process to play out.
And most importantly, do NOT take on the government (SSA) alone. Choose are seasoned veteran like me to help you navigate these very deep waters. Remember, there is no fee unless you win, and you keep 100% of your monthly checks. Act now!

I always knew that volunteering could kill a claim. My mom used to say it wouldn't affect me because I wouldn't be paid. What people like her need to know is that if it makes you appear to be able to work the SSA could look at it and review you or cancel your benefits. Just realize that even if you only did it once, some continuing disability investigator may have followed you. Maybe he even got a few photos of you or some video of you doing some work or worse, something you said you couldn't do. Also stay consistent in what you tell the SSA. Just realize that as you age, you may not be the same person you used to be 30 years ago. You don't have the same energy anymore, things start to hurt and stuff like that. Maybe some aspects of your life slowly turned a little bit worse so don't think that you have to tell them you are the luckiest person alive! Is your life a grim tail of misery and woe? Then tell it that way!!!

We tend to refer to "work" but the actual term is "substantial gainful activity." Earnings from a job are only one way to identify SGA. Volunteering or other activities that are equivalent to work can also trigger a review.

Mr, Ginsberg im the one who has been 18 months at the initial application stage. Per your advice i did contact my senators and representatives. Ive recieved notice my case has been sent to Alabama for a final non medical review to see if i still meet eligibility? I filed within days of my crushing injury and worked solid for 43 years. Im not sure what this is but ive endured this long. You have been a blessing and certainly thank you.

_Impressed you taking action! I often tell people to contact their representatives because the voters have more sway than lawyers state by state. "Squeaky wheel gets the grease." I encourage all those reading today - if dissatisfied with The Disability System - to take action and let them know. Be courteous but direct!_

I know someone who is on disability and after he was granted his disability benefits the social security administration told him he could get a job making up to a certain amount of money per month he went got a part time job not getting very many hours per week and getting very little per check per hours worked social security sent him a letter a few weeks after he got paid job that social security told him he could have the letter said now that you're working your disability benefits are no longer going to be paid so he had to leave the job he was specifically told he could have while on disability and fight social security to keep the benefits

Yes on one hand SSA tries to encourage disability claimants to try to work but their rules are so confusing that a good faith effort to try to work can end up with a review and termination of benefits.

@@ssdattorney he was told by social security at the local branch that he was able to make x amount a month working even though he's on disability then as soon as he got a job working to get half of what social security said he could make a month social security sent jim a letter that he was losing the benefits since he got a job his situation with them makes my mistrust for the social security administration to be nonexistent and to deepen my mistrust for them is I've been fighting them since 2009 and the way they've treated me makes it even worse the first time I when through the process and went before the alj when the vocational expert would bring up a point that was beneficial to my case and the lawyer I had at that time would try to elaborate on that point and the alj told her to keep quiet and only speak unless she was specifically called upon the second time I went through the process the alj never once asked anything about my medical conditions the very reason why we all were there and only wanted to ask questions about the fraternity I belong to and the third time theough the alj acknowledged my health issues and the severity of them but still denied my case and now I've waited 8 months to go into the hearing with alj and I'm currently in year 14 and some odd months into the battle with them

Excellent Video..I’ve been going through your library to find one that addresses my current issue. I filed for Disability on June 13th, 2023. I am NOT working, since I’m unable to work, I am currently receiving checks from my Employers Disability Insurance Company. These checks will stop after 52weeks, if I still haven’t returned to work. Should my representative explain this to SSA so I’m not denied for SGA because I am not working?

Are you getting SSDI from EDD disability ? The reason why I ask because when I was hospitalized for covid pneumonia I was able to apply for SSDI through EDD for 52 weeks. Before my ssdi end I ask EDD ssdi if I can applied for ssdi through SSA they to me that I couldn't until my EDD ssdi payment was over . Then applied for SSA because they said I couldn't applied for both until edd ended . Hope for the best & good health to you.

What if you have eczema and having to buy creams and gloves for the job? What about money invested in the stock market? You have had help with getting it invested and it's creating dividends. Does rent come off the top or if you share expenses of a household that you live in. Also could you address about signing up for a SSA account and they now have a place to enter/ scan in your paycheck information.

Good morning Jonathan I would like to ask you a question I didn’t get notice of Ssi Ovrrpayment from Ssa, but I do get the billing statement I owe them money! that’s not the same thing !? what should I do? There is no Ovrrpayment if there is no notice of Ovrrpayment is that true?

Yes you can. You can’t make as a non-blind more than 1470 a month. However, working at all can be risky.

Blind or non-blind, if you go over $1,050 a month, you will trigger a trial work period, screwed either way.

What about expenses as a self employed Doordash driver. I've spent a lot on gas and repairs to my car..Can I use those deductions before they decide if it's SGA? Also can I average my wages monthly? I've had some months I made a couple hundred and other months make case to a thousand ,expenses not withstanding. I have my hearing coming up and not sure what to tell judge regarding how much I'm making. If I average its only 300 to 400 per month. Thank yu

I receive SSDI and just got a ticket to work. I get a review in 3 years (mental)...not sure what to do because my mind races alot but I cant do jobs that I used to do..but I can probably do small jobs....do you think that will affect my review in 3 years. I haven't worked in 2 years

Well for the past 15 I tried to work with my disability longest I could work was about 4 months. My mind doesn’t allow me to deal with people because I have bipolar and it has left me without a job every year. I don’t k ow what to do I want to work but with the way peoples attitudes are being my attitude out and I’m told I have to deal with it and I can’t. And meds are not on the table. I just want to be myself away from people. So what can do.

Hi! When filing for SSDI you’re presented with the option to select as to whether or not you will/intend to work on disability. If approved for SSDI, at any given time while receiving those benefits can you change your mind about wanting to work or are you pigeonholed into not working due to opting on your initial application that you will not work while receiving benefits?

Mr Ginsberg…I’m in a horrid situation. I worked below SGA but I did it after my onset date and did it for years! I was a substitute teacher and the work was sporadic. Is there ANY argument I can make? Probably not…it’s a dire situation. Had I known about SGA I would not have worked…or would have done a lot less.

If someone is awaiting a hearing and has representation already and ends up in a bad financial situation and needs to go to work regardless if they can or not, does their attorney have a right to charge the client any legal fees or can the client just return to work and end the process by not attending the hearing?

One option would be to change the claim to a "closed period" if the claimant was unable to work for 12 consecutive months. Otherwise you can withdraw your claim. Your rep could file a fee petition but few do.

i think i might have shot myself in the foot; i applied for ssdi on 12/20/22, non med review was done and moved to med review on 01/20/23, but i unexpectedly got called to started working a temp job from home that started 02/1/23 that i couldn’t pass up. it was only 4mo long (predetermined end date) but it WAS above SGA during that time, and my claim has been processing through the whole year still. after that ended i got a called to a mental status ssa exam and they’re waiting for the report to make the decision

I get paid on commission. and I get a commission. in January for $4200. And I make nothing else for the year. Is that over the 1500 limit? Or is that averaged for the whole year? Also, the work that was performed was just referring the work to somebody else and I got a referral fee.

Disability rules of disability is bs I worked ever since I was 14 and worked til my 30’s than I stopped when my daughter was born than went back to work and worked strenuous construction work and got seriously hurt at home from the apartment I lived in renovations of the shower by using a slippery paint in it. on my back on the toilet now my backs hurt badly and since this new thing, I don’t qualify for disability because I took a break away from work to raise my daughter

If your blind in one eye but 2200 vision or worse in your other eye you can earn upto 2590.00 a month or blind in both eyes but if your low vision in both eyes it's no more then 1500.00 a month.

I have congestive heart failure. I was just laying around. So i took a job where i just sit and run things on a computer. I was thinking about quiting because it was getting to be more than i could do anymore. Then they stopped my check. Now ill have to risk my life to keep going to work. I thought i was helping by paying in SS still. But they dont see it that way. Now that getting ready for work and going wears me out. I have to work. Makes no sense. But illegals get phones, healthcare, a check, and a place. I paid in all my life. They are here illegally.

What about if a person works part-time on a consistent basis, but they are consistantly or mostly earning less than SGA ( particularly if they have work records and/or a co-worker or someone like that testify that in fact they are working as much as their health will allow.?

I have changed my thoughts about this. With SSD claims taking 24+ months many claimants have no choice but to try to work. SGA in 2023 is $1,470 gross per month. I tell my clients that on-going part time work of around $1,200 or less should not be a problem if the evidence suggests that this is their max capacity. Realize that $1,470 monthly is equal to $17,640 per year - not a lot of money. If a claimant consistently earns $1,420 per month however that starts to look like "income suppression."

​@ssdattorney how do I go about telling ssi about my part time job? I got a part time job offer yesterday I have not filled out any paperwork yet, it's at 9 dollars an hour and so gross earning is 1,480 for 2023, do I tell them once I get my hours worked out and have filled out my w4 or do I speak to ssi before hand without knowledge of how many hrs I'll be working exactly yet even know I will be working a short amount of hours, I'm scared of losing my ssi, iv been told that 1100 to 1200 is the max I should god on my earnings limit.
