The process of applying for Social Security Disability benefits is long and difficult. If you make the wrong move, you could RUIN your chances of getting benefits. In this video, David Henson--managing partner of HensonFuerst Attorneys--discusses what NOT to do during the application process.

Applying for Social Security Disability is tough. At the time when you are feeling bad enough to be considered disabled, the agency seems to want to make the process as difficult as possible. If you want to make their job easier, I can help you with that.
Hi, I'm David Henson, managing partner with HensonFuerst Attorneys. We help people through the long and exhausting process of attaining Social Security Disability benefits everyday. Of the many things we've learned along the way, one lesson is clear: The SSA looks for reasons to reject your claim. Here are the top 5 things you can do to help SS shut you out.
1. Don't get medical care for your conditions.
2. Do drugs or alcohol.
3.Break the law, or end up in jail.
4.Don't keep your lawyer up-to-date on your situation.
5. Miss deadlines or appointments.
If you work hard all your life, and end up so injured or sick that you can no longer work, you may be eligible to receive Social Security Disability benefits. But just because you are eligible, that doesn't mean you are entitled. There is a world of reasons why your case may be not be approved...don't hand the courts a reason to deny your claim.
This is David Henson, with HensonFuerst Attorneys. For more information about how we can help you fight for your SSD benefits, visit our website at LAWMED.com/SocialSecurityDisability/. Or, call us at 1-800-4-LAWMED.
If you have questions, HensonFuerst has answers.

I never received it! I was denied for 9 YEARS even though I did EVERYTHING you said! In the end, none of it mattered! They just completely ignored all statements and records from my doctors and their doctors made up things in their reports because they have an ulterior motive and a conflict of interest, not to mention two of them were overtly racist and biased against me. My doctor sent them multiple personal letters and even took time out of his busy schedule to call them himself to tell them that I was permanently disabled and STILL they denied me! So going to see their doctors and getting my doctors to say I was disabled was a waste of time AND money! I even had a crappy lawyer that expected me to do everything and on top of that, they abandoned me a week before the ALJ hearing, leaving me to face them in court ALONE!!! Lastly, I have no criminal record and am not on any drugs of ANY KIND! They have NO EXCUSE! These people don't care if I'm sick and homeless, starve to death, or commit suicide because I'm tired of the pain and suffering! Racist, evil, system!

I had good luck with my case several years ago. I did not actually hire an attorney but a lawyer commercial I saw on TV provided great guidance on how to better my chances of winning. The lawyer commercial had focused on appeals. They later changed their service to include original applications for disability benefits after I won my case without having to file an appeal.

1. They will use medical records to deny you, even if those records support you in every way they will find cause to use them against you or consider them to "carry no weight" and they don't need a reason to do this, they just do it. 2. If you don't use drugs or alcohol you will be considered non compliant and stable and they will use it to deny you. 3. If you get along fine with others it will be used as evidence that you are not disabled. 4. If you are capable of making appointments you are capable of working. I feel sorry for anyone who thinks they are doing something wrong. You are presented with 2 choices multiple times along the way, no matter which side you fall it will be considered the ineligible side and it's designed to give the impression of free will and make you blame yourself. It's designed to be ruinous I guess.

From the beginning i have been consistent in all my disability issues. I reported my knees my ankles and my wrists are damaged plus my vision and schizophrenia. Is disabilities ive suffered from. They only approved me for my wrists having torn ligaments and nerve damage. They gave me a year review and i had to go to a one on one hearing and they denied me. I asked for reconsideration and continueation of benefits a little before that hearing i was hospitalized for mental health crisis. I had even had xrays of how bad my joints looked. They admitted to me that the only way i can continue to receive my benefits is to get on my antipsychotics and coincidentally have proof of keeping my mental health appointments. This is the year of my second review hearing and now i think i have %50 chance of them stopping my benefits. So now i am waiting to go to another hearing and a little worried because to them i am just a number. I just don't understand why the original reason they approved me isn't good reason enough to keep getting my benefits without having to do hearings if i and my Dr's know i have not improved and i never will improve.😞

You think getting social security disability is bad? Wait until you have to jump through flaming hoops to try and keep it. I'm disabled. My condition will NEVER improve because it's a mental disability. But every month or two I'm harassed by social security to provide this documentation or that documentation to prove my disability. Last year I had to fill out a form and send it back to social security. So I did. A week or two later they send a letter saying they never received the form they wanted and were going to end my benefits. So I call them and tell them I sent it. But they continue to claim I didn't. They tell me they'll send the form again and this time I should fax it instead of mail it since it's faster and sure to get there. So reluctantly, I agree to do it. I fill out the form AGAIN and fax it to them. A week later they're complaining they don't have it. Now I'm getting upset. I'm on the phone with them again. I'm sitting there telling them I have the receipt in my hand with confirmation on it that the fax went through. But they won't budge. So I fax it AGAIN (3rd time they've received it if you're keeping score). I get back on the phone with the same person. This time they confirm they got the fax. The person tells me that all is now good. My benefits will continue to be sent with no interruption. Fast forward a month or two. The day my benefits usually come each month passes. I'm like what is going on? I've received no mail from Social Security about any change so it's unexpected that my check wouldn't be there. So I call Social Security. I shit you not, they cancelled my benefits claiming that I never sent in the proper forms (the same forms I had sent multiple times)!!! I was PISSED. The whole situation fucked my finances for that month before they finally fixed the issue. And to top it all of, after all of that they decided my case was due for a review. And this month they stopped my brothers social security disability (he has mental disabilities as well) with no warning. Social security is run by completely inept morons I swear to god. They fuck with peoples lives. People who have disabilities NEED that money to live. How they can just stop benefits with no warning is confusing to me. And it makes me mad.

I went through the same thing 2 years ago when new president took office. If your on social security and this has not happened to you yet just wait. Social security told me they are randomly picking people to prove disability after all over been on it since 2007 . We all have to go through reviews and it is extremely stressful. I have a mental disability and they sent me to a new doctor even though I see my doctor for mental health every month and have a case manager I see weekly. I have been in the hospital several times since getting ssdi so the fact is they had PLENTY of documentation.

I fought hard for my disability pention. When a court awarded me an $80.000 debt for my life long horrific injuries , I was charged $38.000 by centerlink and denied my pention for a further 12 years. It took me 22 years to get centerlink in the supreme court where the case was withdrawn by my solicitor no doubt through centerlink threats to her. In June 2004 I had a ruling in my favour before member Alan in the administration appeals tribunal where after centerlink were ordered to pay the money back , a fraudulent letter of withdrawal was created and secretly submitted without my knowledge. The supreme court judge upon viewing my cace said , " this case raises many questions and serious concerns. Centerlink are criminals who prey on the most vunerable in our community. The worst criminals of all.everyone will be happy that after making a serious threat to centerlink staff in 2008 the police were not called , I wonder why and the next day I received a letter saying my new start appointment was cancled and a second letter stating my disability pention was reinstated no medical reports required.

But Social security said that it would take months to see if they could approve her...I didn’t have months. If I waited for them my mother would’ve died. She needed chemo fast. I had to beg organization after organization to please save my moms life. Finally an organization decided to help her get chemo. Because I did that....because I saved her in time...they denied her the disability. She finally found a job and started working recently....but imagine...she’s working with a port in her chest, fatigued out of breath and in pain. It’s not fair...it’s just not..how can you make someone work while getting chemo? How is that fair? I had leukemia myself and I couldn’t do anything for months while trapped in a hospital getting intensification chemo. How could they make her? It’s just not right...

Everytime I cancel a doctors appointment I ask them to put in the notes that I'm in too much pain to get out bed and cant make my appointment I did all the things that cause me injuries (bend over, do the dishes, walk) to show them what happens if I do day to day activities. As a result I couldnt walk and half crawled to get into the evaluation room I was honest and explained I do have good days and if I have a good day I try to save it (resting though it and if i have a few good days in a row which is so rare I try to get out to do something even if it's just a walk in the park) I explained how my injuries affected me and how hard it is to do day to day activities I am approved now for disability.

You will struggle getting it no matter what you have going on health wise unless you’re 50 or older, I have chronic back issues and severe anxiety panic attacks to the point I have trouble sometimes even going out in public and applied at 44 after going to a primary dr every month for pain management and a therapist and psychiatrist every month it still took 4 years. But I had exhausted all my appeals and filed a new claim and then after a year it went through no problem without a lawyer, so I’m not really sure if it was my age or they were ready to give it to me anyway they just didn’t want to give me the back pay for the previous 3 years so they settled on letting me have it after the new claim and 1 year

I got my disability. I had to wait 5 years to get it. WHY?? Because there was NO DISABILITY JUDGE IN JONESBORO AR. I moved in with my son in Houston Tx and in 3 Months I was given a date for a Hearing. I hope you will add this to your information The Number of SSD judges is short.

Back in 2009 I was told I have underdeveloped back muscles and can end up in a wheelchair by the time I'm 45 as my back will never get better (I'm currently 35.) and two years ago I had a heart attack and spent the night in the hospital. The doctor who treated me diagnosed me with severe anxiety and told me it's not advisable for me to work. I have no medical so it's hard to get into a doctor unless I find a free clinic. My question is, do I apply first then talk to a lawyer or do I talk to an attorney first then apply?

It's is policy for SSD to deny all initial applications - no matter how overwhelming your case may be. In order to "win" and receive benefits you must appeal that initial decision and stay on top of all the paperwork and deadlines they give you. Currently the backlog is so great, the entire process will take 18-30 months to receive your award benefits should you "win". And benefits are retroactive from the date of your disability/application. Remember people, this is a marathon, not a sprint! Good luck and health to all and persevere - ultimately you will get through this damnable process so you can get on to trying to heal.

Boneskullzy I am not a minority. I’m a white female, I’m also 24 years old and very physically/mentally ill. It is suppose to be challenging to get any types of benefits. This is because it cancels out people that don’t need it, to people that actually need it. My doctor encouraged me after 2 years of suffering. So I reluctantly did. I was accepted on my FIRST application for all of my benefits I applied for because I am truly ill and I need medical care for my illnesses. The system is suppose to be hard to discourage non medically ill people that are frauds. If you have strong support and accurate medical documents that fulfill their needs as being “disabled” you will be accepted. Also I’d like to point out Medicaid is a needy base program for low income individuals. So if you’re receiving/or have any kind of money above what they consider poverty levels you will not be accepted for the NEED base program.

Boneskullzy I am someone with no kids, no income, VERY young and NOT a minority. I was accepted almost instantly(5months). I’m one of the 33% accepted first application. Not because I was pregnant or a female or a minority or my age but because I’m actually disabled. You guys need to understand what your medical records have everything to do with being accepted or not. If it isn’t adequate you’re not getting accepted. Even if doctors supports your claim but doesn’t properly keep records of your symptoms and issues, you won’t get accepted. All matters what is on that medical record and if you are able to go to continued treatment.

But it seems things I was diagnosed with they did not write down, or have listed on record. As a result of this very thing I dont have a good relationship with most of my doctors. I made the mistake of telling my doctors i was applying for disability, for some reason they run and hide. I never understood it.

Donnie Lee: I am sorry to hear about your son’s situation. Emotional and psychological conditions can be very difficult not only for the person experiencing them, but also the family support network who are they to assist them. First, I would recommend that you talk with your son’s treating physician about whether additional psychological counseling and treatment might be in order. Given that it sounds like he has not seen much improvement in his situation, it may be a good idea to consider getting a referral to a practitioner who concentrates specifically on these kinds of issues. In addition, I would also recommend that you talk with a social security lawyer in your area who can evaluate whether your son may be eligible for SSDI and/or SSI benefits. It is a long process to navigate through, so starting the process earlier than later is usually the best approach.

Maybe in certain situations, it is, but not in others. Firstly, some Employers will not hire you if they see a (visual disability). It is discrimination but it is hard to prove. They see you as a liability vs an asset. Secondly a Man with Mental illness was told to "go to work". He eventually did and killed someone on the job. I don't know about you but if someone is Mentally ill. I'd prefer them to get disability and not work alongside me, untreated.

I'm trying for disability because of a reoccurring diabetic ulcer on my lower right leg, it covers the front half of my lower right leg. I am under care from my doctor, the wound clinic, and the lymphamadema clinic for my condition. I contacted a disability lawyer first thing and have done everything they have asked of me. I see the doctor every month, I see the wound clinic 3 times a week and am also seeing the lymphodema clinic also 3 times a week. If the lawyer asks me to fill out a form, as soon as I get it I fill it out and back in the mail the next day. The same goes for the social security administration, I do exactly as they ask. Don't want to give them any reason to tell me no. I was told that it takes on average 6-9 months but can take up to 18 months to be approved. Was told they pay back pay from when you first apply. You got to hang on, but if you do everything you are asked to do, you should be good.

It took me 17 months to win mine with two denials and a hearing in front of administrative law judge and and then close to 90 days to start receiving benefits. I cannot count the times people ask me how saying they gave up after first denial. I always tell them to find a good law firm to represent you and a have a paper trail. My attorney received 25% of my back benefits for which I did not care. It's about securing the benefits for your disability not hitting the lottery and in addition your lawyer needs to get paid also. One of biggest excuses I hear is people don't want to have to pay attorneys fees which is a piss poor excuse. Not only that listen to your lawyer and do what he says so much as in people that don't follow their doctors orders and can't figure out why shit turned out wrong. My attorney once told me many claims are denied because of incomplete paperwork, missed deadlines done by people with know experience. Could go on forever here but one last thing is when you get your hearing before a judge how you present yourself and respond to his questions can be a factor. If you are truly disabled and know it do not quit.

Warrior, got cut off. Anyhow, meant heavy equipment field mechanic n worked 70hrs a week plus travel n then shod horses some nights till midnight at times. After going SSD which I fought not to get, but am veryyy thankful I did now n give Jesus all the credit to help my family n myself. After a few yrs, my wife of 25 yrs left for work as my youngst son left for college. An she never came home n I never saw it coming. Guess when the sex n good times end, most ladies find another hard one n good times. It took 5 yrs to divorce n cost me 600k n been 10yrs n still not done paying her. I have exhausted most of my funds n struggle to make ends met. While she builds her million dollar easy life. I still love her very much, but she's a total stranger today. I don't know how someone can change so fast n care nothing of the hurt. But my boys are good, one a USN SOF ODA, n youngst is a MD now. Very proud of them both. Not sure why I am saying all this. 🙈🐸😜😝 I praise God everyday for saving my life, as being a Paradog n warfare didn't help either. If it wasn't for SSD, I would go out on the deck. You must be a extremely tough soul I suspect warrior. I couldn't live like you got it bad, hands down bad. 🤕😰. Some nights I pray n ask God why he saves my worthless life, as I have 7 heart stents (3) in the widow maker. They nuked it last month, costs 94k for 20 minutes of work n 8 days in hosp. But, I have 2 really sweet little taco doggers n now a kitten that thinks she's a dog too. I always had big German Sheperds before, lol. An the fact I got 3 adopted gkids n being a grandpappy is good stuff. N they do certainly need a pappy too. Maybe that's why? Hang in there warrior, I will keep you in my prayers too. You are one tough warrior for sure. If by chance you don't know Jesus, I'd look into it as its sure helped my life n I look to be in His Presence one day soon. John 3:16. Later, Ty

Guillaume Youmans: Great question. It is my opinion that for a lawyer to represent a client most effectively, that lawyer typically needs to know about all of their client’s various legal issues. Sometimes, there are actions or decisions that a lawyer may advise you on, that can be impacted by other legal issues that to you don’t seem related, but to a lawyer, may in fact be related or interconnected. As such, I would at least advise your lawyer of this pending claim out there, so that he or she can make note of it, and if necessary explain any effects that it could have on your current case.

This man is describing the exact things that helped me and also I was diagnosed a suffer depressive because of the hell I went through and I was a single man and all I can say is God was there with me. And my dog kept me from suicide because I went through a tough time.

This is for I did you have a doctor a doctor can get your benefits in a week if he feels like you have to see a state phsycologist and a doctor if that's all that's on your record you ain't gonna get shit that's why you build a medical record if the judge sees that are going to see your doctor regular and a phsycologist he will not look at what the state doctors say also I think you are full of shit that you applied online and got it in six months

I am 49 and am a disabled combat veteran. I did 18 years active duty when I was medically discharged honorably. I am rated at 100% thru the VA, and I received my social security immediately. I have been receiving social security for 4 years. They just sent me a letter stating that I do not need a review of my case.

Thanks for serving us. You are only getting your just reward for it in that they rubber stamped your paperwork. I went to at least three of their doctors and the last one was my best evidence proving my case. I simply took all my meds exactly as prescribed rather than leaving some off so I could be aware of the situation and have a sensible memory of what the doctor did and said. They write all they observe down about each patient as a matter of fact. No matter what their specialty is they are experts at reading body language and seeing possible indicating behaviours as they develop a diagnosis of their own. I was too sleepy to fill the paperwork out without some assistance and went to sleep waiting in the exam room. The doctor had to wake me when he finally came. I could not function well enough to do the things he asked properly. I was not able to stay balanced during the standing parts of his exam. I saw an orthopedic dr. for them last even though my disability was not physical in nature he told me I could not work due to my meds I was on at the time. I know he put it in his report as my Attorney told me it was a - for ssdi and a plus for my case. Almost three years and broke and very deep in credit card debt after filing I finally got a hearing and was approved. I have been audited several times but after 50 they only say I am not going to be having to audited. Now my physical issues would keep me from being able to perform the tasks necessary to work in my craft. Some people simply get approved after the six month wait and never get denied. Your VA and discharge on full disability made you impossible to deny. Otherwise many people angry, disillusioned or acting originally that are denied are not willing to sell their investments and spend all their savings only to end up ass deep in debt just from living and paying cobra insurance, I did but then I had no alternative either. I still have my home but the cost of living has eroded my money so much now I am presently deep in debt again. It is all unsecured debt so if the checks stop I will start shredding all the paper presentments and let others worry how they will pay as they sure cant get any money without a lein or until I get paid. Best wishes to all who really need to collect what you yourselves have paid into the system.

I really wish I would not have survived my accident this whole system of trying to survive and denial I really believed that working hard would pay off if anything happened I paid my taxes I would be ok. I seen people on disability doing all kinds of things I always thought disability would be easy for me since my obvious loss of appendages damaged knee's and constant nerve pain but man was I mistaken. Sadly iam not one to grovel in front of a doctor or judge trying to make my case if seeing my fiscally mutilated body and a look over my medical history is not enough. I've had enough of this corrupted society it is a three ringed circus and iam not a bearded woman or a trapeze artist who wants to impress the judges of my disability so they can throw money that I already paid into the system back at me what a joke! Iam over it funny when you have had enough they then want to give you medication and send you to more doctors for a mental problem the irony of it all is to much I don't even care anymore

Applyed in July got mine in Feb following, never denied no lawyer just medical records and good social worker. Its only 750 a month so nobody will get rich getting bennifits. Back pay only goes back 1 year and they hate giving that to you, you still have to fight to get that and they will let anyone redirect your payments, then blame you. I'm still waiting to get back April and Mays money due to workers letting scammers steal my bennifits won't tell me who did it, you can bet if you owe them they'll waist no time getting it from your bank. Watch your deposits check them every now and then, it's not going to be available to us citizens much longer after trump gets his dirty little hands on the as fund anyway, usa has a thief in office and he has no end to his greed and corruption. Eat cat food will be your retirement. Let the sick and poor suffer the GOP way.

My mom didn't make her appointment and she still got her disability. I'm easily legally blind and am still waiting for word back from Pennsylvania. I have no idea what will happen after that. I need to call my lawyer. I think why the judge didn't say yes was because the lawyer was pushing my mental disorders more than my blindness and guess what? My eyes have gotten worse. I can't see long distances anymore even with my glasses and my close up vision (forgot what it was called) isn't any better. I couldn't even finish school (college) .

Ive just turned 18 and i litteraly cant work, i have 6 chronic conditions with extream pain and fatuege i cant stand for more than about 45 mins. This was after about a year of physical therapy. As well im autistic with severe anxiety and depressive disorders and ill start to have panic attacks when i have to process too many things, like if im doing the dishes and then my mom asks me to go put something away or to let our dog out ill just start hypervenyilating. I worked in a kitchen for about 4 months off and on but had to auit because the stress caused my immune system to tank. Im so nervous and praying for my life to be able to get on disability cause my moms a sinle mom and ive just lost my insurence. I have so many medications that used to be about $10 cause of my insurence but now is going to be in the hundreds and we might not wven have enough for healthy food. Im so stressed. Sorry for the rant!

Great advice! Appreciate you sharing with us. I have been at this since 2017 and have a hearing in June. I have spent the last year trying to figure out why this process is so vicious and inconsistent? I am 59 will be 60 in Aug and have worked continually since I was 17 years old ( 37 + years). Retired military and can't understand why the system has to be so cruel to people that have contributed tonthe system their entire adult life? I didn't even know what the difference in SSSI, SS , SSD was until I started this process in 2017. I hope to work til 62 and then put in for SS. I would rather make my salary and enjoy the work I did than get a check. Back surgery in 2014 and Crohn's Disease changed all that. Your video was excellent ( straight to the point) and has given me a new outlook. To everyone on here fighting for a benefit you have worked and earn , I wish you all luck and keep fighting! We need a Class Action Lawsuit against the US Government over how SS is managed. Their taking our benefits by these questionable procedures. Semper Fi

I'm sorry but I believe that one could do just as well or even better and getting Social Security benefits without an attorney. I applied for disability and I was actually advised not to use a lawyer because a lawyer could actually delay things to purposely get paid more. Unfortunately, I chose not to follow that advice and I hired want to turn into the nothing for me and then after firing that attorney I got another attorney that basically did the same. I now realize that I didn't need an attorney and that I could deal with it with Social Security Administration.

blueagle1100 I never needed an aterny to get my SSI I was disabled as a child at 5 for mental disabilitys. But my sister sherry was different she had proof and aplied again and again and was denied. Got an eterny and he got it approved at the first time. It all depends on the eterny. If you have a shitty one it could delay it. But if you got one who is good he or she can work wounders.

Thank you for your question. You present a situation that faces a large majority of Americans today, unfortunately. Until such time as you either are eligible for health insurance, Medicaid or Medicare, unfortunately, you will most likely either have to private pay with the physicians or you will have to get in with a free/low cost medical clinic. We regularly have clients who are able to get treatment at free/low cost clinics until they are approved for SSI/SSDI benefits and are able to get Medicaid or Medicare.

Dave Dalton I couldn't even afford Obamacare. I believe I was penalized for that on my income taxes earlier this year. I only end up with $5 or $10 to my name from paycheck to paycheck (I am only able to work part time). Many act as if it is easier to get disability if you are over 50, but I'm almost 55 and I still got denied. Now I have to go to a Administrative Law Judge in September.

Right now I have 5 fatal diseases and schizophrenia after working full time for 15 years and 4 in the Army and was awarded ssd back in 2004 I wanted to try working some more and I did for 2 more years which made my conditions worse!
