GBI Agent Jason Seacrist testified on Friday, Nov. 12, 2021 in the trial of the killing of Ahmaud Arbery.
Arbery was shot and killed on Feb. 23, 2020. Cellphone video leaked to the public shows two armed white men in a truck approaching the 25-year-old Black man as he runs down the road. One of the men, later identified as Travis McMichael, and Arbery struggle over McMichael's shotgun before Arbery is shot and collapses.
Travis McMichael, his father Gregory McMichael and William "Roddy" Bryan, who recorded the video, are all charged with murder in Arbery's death.

@@paddyholly2184 The Brunswick D.A. at the time and she is currently under indictment. There was a second prosecutor who recused himself, and it was at that point that the Georgia Bureau of Investigation (and this agent) got involved, although there had not yet been any arrests or a public announcement of prosecution. It was at that point that the video was leaked-that seemed to put pressure on the Georgia AG to appoint a prosecutor.

That's the way a majority of criminal defense attorney's operate; they make a statement and then add a little inflection at the end to make it sound like a question. In my experience, I have never answered a statement like that on the stand. I always make them restate it like a question, After the tenth time, the judge usually tells the attorney to ask questions directly.
@CineGisticMedia
@CineGisticMedia 2 жыл бұрын
It’s not a old trick. The word play whoever is referring to goes beyond what he’s doing here. In this case, he’s, albeit with unusual confidence, he’s simply rehashing an interview of the GBI agent. Since he does already know the answers that’s how the law requires those types of questions as it somehow “paints a pic” for the jury, and of extreme importance helps remove open ended questions (open is where we start doing the word play)… ..During a deposition. But the depo cannot be used as evidence itself in court unless the witness dies prior to the trial or somehow becomes incapacitated as depo are used to preserve their testimony like I mentioned. The old school tricks is just not what it is. It’s just legal, I don’t wanna say jargon, but it kinda is since it’s a way of speaking in the court. If you watch most trials they’ll ask this the same ways (prosecution as well) but normally they don’t stutter and act all fake confident for having a JC PENNY law degree, like how folks on the Internet who’ve never worked in criminal defense” -atty with 42 years exp crim law, in GA. The guy has a shit reputation from what I hear.
@keithfrierson5462
@keithfrierson5462 2 жыл бұрын
@@CineGisticMedia well from your statement you’ve been given false information because he’s only been practicing law for 35 years. So go back to whoever told you 42 years and give them an ear full of this nonsense. It’s definitely an old school lawyer trick, because new lawyers ask questions and not statements that sound like questions. I work in the OJAG office (military court) in Michigan and this is a stunt all the old officers use.

The 5th amendment protects one against self-incrimination. It doesn’t shield a witness from testifying. In this case, the defendant participated in a crime, and he could have invoked his 5th amendment right from the moment the cops showed up (or any time afterwards). If he had truly been merely a witness, the courts could have compelled him to testify.

@TheMaleficent1
@TheMaleficent1 2 жыл бұрын
@@DuskyJewel Wow. Somebody sure needs a Snickers bar. Anyway...the fact that most folks don't know the names of Bundy's victims means little. He was a notorious serial killer...of course his name will be the "headline." However, there have been many criminal trials where the victim's name was far more prominent than the defendants. And, yes, there was ZERO confusion about who was the bad guy. More importantly, no one got their panties all bunched up in a wad over it. Did anyone ever refer to the Richard Davis trial? No, it was the Polly Klaas trial. It was always the Rodney King trial. The case was never referred to by the names of the cops charged. Was it the Derek Chauvin trial or the George Floyd trial? Hmmm... The Manson case was regularly referred to as the Tate-La Bianca murders. And, if they were to ever find her killer, it will be referred to as the JonBenet Ramsey trial rather than the defendant's name. These are just a few of the really famous ones that came to mind. Finally, I doubt that Armery's mother is upset in any way that the media is using her son's name when describing the trial. That his name is regularly being broadcast over the news and various court TV shows. That he is being remembered by name rather than as just another anonymous murder victim. But, hey, I guess you'd rather have the defendants get that notoriety.
