Yes. He can sue. And yes any court would rule in his favor. But he won't ever win. Firstly he would never see a cent of the payout he might earn because it would be made out to Spiderman and not Peter. And as Spidey learned long ago. He can't cash that kind of thing in no matter how much he would like to. Because Spiderman is an alias and not his real name. So he would have to out his public persona to get the money, or donate it to charity. Secondly he would be out of a job. The Daily Bugle would go under and he would lose his job. Also no other newspaper would dare to run a story about Spiderman for fear of being sued.

Which, given it was another supe' that was his lawyer, is a really stupid thing to happen. If you're on the prosecuting side of a civil lawsuit, always check with the client BEFORE calling in a new Witness. She-hulk fucked up on that one, if he'd gone for Matt Murdock like in this skit, he'd probably have won outright, if for the sole reason that Matt knows Peter Parker is spiderman and therefore wouldn't have even considered making that fuck up. I genuinely hope that out there, there's a cut panel with spiderman saying to She-Hulk "Because you didn't ask me before calling in another witness and adding them to the Suit, I've just lost out on a million dollars, because you made me sue myself. Thank you for that, please consider the possibility of secret identies in an future cases where you're representing masked supers'"

And he really shouldn't. Matt Murdock is one of the worst lawyers in the business. Yes, his powers makes him one of the skilled people on the bench. His Daredevil persona causes him to miss trials, fail to do research, and causing him to lean on Franklin Percy "Foggy" Nelson to do most of the work for him. And Foggy has his own cases to do. And then there is Matt's greatest weakness. Woman. Elektra is the most famous example but by no means the only one. The guy dated Typhoid Mary! If a lady is involved at any level of this lawsuit and Matt is doomed.

In the comics this happens, only Spidey ends up dropping the case halfway through when he discovers that Peter Parker would also be held accountable for the defamation, since he always supplied the pictures used in the articles.

If I remember correctly the judge wasn't opposed to Peter fighting such a ruling, but it'd require him coming to court to testify, which may have been a LITTLE tricky with Spiderman already in the room.

There is a story about Spider-Man sueing Jameson, but writesr somehow shifted part of the blame to Peter (even though he just shoot the photos, he don't write the news) in order to maintain the status quo and make him turn the millionaire compensation in to him and Jameson dressing as chicken while distributing flyers apologizing to Spider-Man.
