I am a professionally trained artist and the whole situation with the t-shirts is completely UNPROFESSIONAL even if it’s not in the contract. He paid MORE money to have EXCLUSIVE rights to the art he purchased from her. They are 100% his now. She can put the shirts in her portfolio or have it on her own website or her own social media accounts and say she did it for this company but to poach his customers is outrageous. I noticed with bigger companies there are some projects where in the contract you can say you did work for them but you are prohibited from even displaying them even in your portfolio. Luckily she works for herself cause that type of behavior can quickly get you fired or blackballed in a production studio setting.

Depending on what the contract says, she may not even be able to display them on her own portfolio or page. If he has exclusive rights, it means she is excluded from using them without permission. Her fault for not having that addressed in the contract.

@@AmItheJerk Can you please use this in your next video? My dad was yelling at this random mother and her teenage daughter for no reason until he told me, so this happened 9 years ago back in ‘13 I’m now a male 17 year old senior at Bonita High, and I still can’t stop thinking about this situation. So here’s what happened: we were sitting in my dad’s car waiting for my mom in a Costco parking lot when that’s when we encountered the mom and daughter, who passed in front of the car. When my mom got in, my dad started driving fast after them, my mom asked what was going on and my dad said he’s trying to catch up with the mother and daughter, so rolls down his window and yells: HEY YOU WHY DON’T YOU ASK YOUR DAUGHTER?! The mom yells back: What’s the matter?! My dad yells: ASK YOUR DAUGHTER! With that we go our separate ways. My entire family asked what that was all about, I thought there was no reason, but my dad angry with the daughter in question says the daughter flipped a finger at him, my family is Chinese-Filipino and I was younger when this confrontation happened so I think my dad’s culture takes serious offense to that, I still keep thinking about this today, cause my parents are both very mild-mannered, and I have never seen my dad act like that before. So I have ruled that both my dad and the daughter are equally in the wrong, my dad admitted he was in the wrong, but the daughter is more in the wrong. So who was the jerk here? My dad for yelling at the daughter, or the daughter in question for flipping a finger at my dad for no reason?

Story 1 : The father is a legend. That girl is rotten inside. In my case, I can say that I come from a "rich family" as my parents are both doctors. But they never spoiled rotten either me or my brothers. My very first car was the used 2002 Citroen C3 that used to be my mom's (I had it in 2007). She bought herself a New Audi A1, well deserved as she worked hard both on her job and our education. Since then, I never had a New car, only used ones and I'm 34.

My mom would’ve just gave me a new bike if I acted like that girl 😂 that spoiled brat needs to learn that she should be grateful that her parents even considered a luxury car as her first one In rich families, not all parents give kids brand new luxury cars unless they barely even see their kids bc of work or the kid was spoiled at birth and they just don’t want to deal with the consequences so they give them more money

Regarding the Carolina Reaper story, I had a similar situation at work. Two or three times a week I would head down to the break room to find my lunch had been stolen. I set out a jar of mayonnaise on my counter for a couple days then made a tasty looking sandwich. I checked it out later and the "special" lunch was gone. I never did find out if anyone got violently ill at work.

4: Had a similar relationship on a smaller scale. Despite seeming bubbly and perpetually positive, an ex of mine exclusively told her friends and family about the 5% of our relationship that was negative, and never told them about the 95% that was positive. 5 months in, her friends and family, who she never introduced me to, hated me. When I figured out why, I ended it. Turns out our relationship was just a Taylor Swift song in her head. She just wanted a relationship sob story so she had material for "let's trash men" wine nights with her friends. Gentlemen, don't ever let yourselves be a prop.

The second lunch I put a really hot sauce on it. 3 hours later young man walks by crying. I asked what happened and he says domes curly fries burnt his mouth. I asked why he was eating may lunch. He said the room was unlocked and he thought food in fridge was free. Found the sandwich stuck to wall and heard his sister crying in restroom

First of all I have to say, the way you imitate different voices for the ppl in these stories is HILARIOUS 😂 . In the last story, if I was the wife, I would be more mad at the fact you didn't tell me that the other woman was fixing you lunches than anything. It's like he knew it would hurt her feelings. I think had he let her know up front, like " hey I know that making my lunch for me is an extra burden. So would you mind if I was getting it from so and so bc she wants to use me as a guinea pig for her culinary skills!" Maybe she wouldn't be as upset. Instead you hide it from her. Just my opinion 🤷🏿‍♀️

Lunch bandit. I’ve done something similar. I bring my own coke (small bottles) to work and noticed the level dropping alarmingly on a regular basis. I got sick of it when I found my unopened coke bottle open and half had been drunk. That night I went shopping, bought a bottle of coke….. and a bottle of Tabasco sauce. Next morning tea time, cue screaming and Karen running out into store (I work in retail) accusing me of spiking my coke. Me: “how would you know if you weren’t stealing my drink?” There was not much Karen could say to that and the drink stealing stopped. Lol.

Artist here. The 3rd story has their own shades. From one side OP isn't the jerk if the designs are paid and exclusive as well, plus the page doesn't had any of him crediting any design her does or purchase as well too. In other hand, he is, if he doesn't had a site to properly advertise his own art and whatever design he purchase as well. I know contracts are made for this exclusivity to not been put through. BUT as someone who works with a lot of artists as well, i often credited them and as well like them to credited me if i did something as well. This comes because i prefer to everyone share a piece of the pie and had them push to had clients as well too. Sometimes one try it to keep clients, and i understand as well, but that's up to your skills.

Is he in the legal right to not allow the artist to use his site to advertise? Yes, clearly. The way he put it, that was part of the agreement to make the artwork before the artwork was made. That being said, a lot of people really want more of a particular artist, so when they buy merch, sometimes they want to know the artist who designed it. A lot of merch stores don't provide that information, so right now the industry standard is effectively in his favor, but from a consumer's perspective, I would like to know who designed a piece in case I want something in that same style but not exactly that, or if I want prints from that artist rather than wearable merch. In my personal opinion, he ought to just have "artwork originally designed by _____" in the description on the site, but there is no obligation to do so. I just think it would be better for both consumers and the artists he hired, but since that takes more work and is not going to benefit him directly, I would find it hard to convince any for-profit business owner to do it. That's just how things are, in my experience, so even if I did say he was the jerk, it wouldn't do anything. He's not interested in benefiting others with his work, he's interested in making a profit, which again, is his prerogative.

In the third story, the OP is in the right here, though it pains me as an artist myself to admit it. There was a contract, they went over all of this with the artist, and by copyright law, since he purchased these designs from the artist, they belong to him and she has no rights to them anymore, and cannot claim them as hers, and by law, the OP is allowed to sue if she does attempt to claim.
@FerrumAnulum
@FerrumAnulum Жыл бұрын
True OP does "own" them. But how I read it the artist wasn't claiming she "owned" what he bought anymore and that she just saying I'm the designer I also have other work over here. I do not belive the artist selling the same exact pieces she sold to him. If she is then yes that's breach of contract and definitely copyrights and grounds for a suit. I feel like there's missing context in this story (but to be honest most if not all these story's on here are always missing context and can only take the words of the OP's at face value.)

@@FerrumAnulum ....there is literally a clause in a lot of contracts dealing with these types of things called a 'Non-compete clause'. So yes, this IS illegal depending on the contract. Considering the OP paid premium, was up front and open with the artist ahead of time about owning the designs about not wanting them to claim the designs as their own (with the artist agreeing) then that is pretty sue worthy and he has a good case. Even a verbal contract is still legally binding. He offered specific terms. She accepted terms.

Not entirely correct, OP has right for the art but she doesn't OWN the art as being the creator of it. (European Copyright Law, artists are very protected here) The Copyright is still with the artist and per contract extented to the OP. The contract can exclude her of usage for the art as in posting the work on her art sides or portfolios and such but that has to be specifically stated in the contract. For example my Terms of Service say that I have the right to the art and can make an artbook of commissions that I want in it UNLESS they buy the right from me not to that and that my art can not be commercially used by the buyer UNLESS (you guessed it) they buy the right from me.

In the Carolina Reaper story: not the jerk. While Carolina Reapers was probably a touch of overkill, it wasn't a deliberate attack and for most people it wouldn't have had such an impact. While being sneaky about food allergies and such is a bad thing to do, the lunch bandit was stealing other people's food meaning they lose that sympathy. If a diabetic steals someone's Coke and chugs the whole thing then needs to go to the hospital, it isn't the fault of the Coke's original owner.

Last story: DEFINITELY the jerk. Putting aside how selfish OP is , the wife didn't get a say. People don't always consider that *communication* is fundamental. Wife would be more alright if she was in the loop and was able to talk with the Chef in Training. By the lack of communication, it can lead to thoughts like OP was becoming attracted to the chef and not his own wife. And worst case scenario, OP just ignores his wife's feelings, and Chef develops feelings that are immediately shot down because OP is just being a selfish jerk that just wants free food that's delicious.

Making lunch for your partner is not a given. It's an extra. This wife prepared his food every morning dispite being busy with her own responsibilities. It's very disrespectful towards the wife to just ditch her for a chef, because "your quality isn't good enough, I only want chef quality". I have a partner who takes all the housework and taking care of the kids for granted. He doesn't even realise how upsetting it is that he doesn't even know what the kids need for their schoolday, how the washing machine works, or where his own laundry goes in his own laundry closet 🤦‍♂ (After living in this house for almost 10 years) I can imagine this isn't the only thing the wife is annoyed about. If he thinks others are entitled to make his lunch every day, he'll probably feel like she's also entitled to do a lot of other things in the house or with kids.

@@Nathan_Bookwurm man works in construction he could literally die on sight and probably works long hours of the day a good lunch could be the difference between misery or a productive worker I understand where the wife is coming from but unfortunately he is as much priority as the kids because he's bringing home the bacon

You meant definitely NOT the jerk. Food is literally what you put in your body to survive. If the wife's food is lacking she can either try to get better or stop complaining. Life is too short to eat subpar food.

The wife should have put more effort into those lunches instead of giving the OP the same lunch as the kid's which I can assume it's PB&J, bag of chips and a juice box.

story number 2 - I worked at an amusement park and you would be surprised how many people smuggle booze in baby bottles. A dead giveaway is a grown man unscrewing the nipple and taking a swig with an explosive "PPahhh!!" of breath. I wonder how many drunk babies got the wrong bottle?

Never realized Robert Downey Jr. was hiding a UK accent this entire time, why didn't he use it properly like this in Sherlock Holmes? Either that or he's also Paul McCartney on his days off 🤣. Julia was spot on. Love it.

Yes jerk. For last story. Like the dude can’t understand that he made his wife feel so sad because you asked for “quality” lunches. THE FACT YOU LITERALLY ARE GOING TO A DIFFERENT WOMAN HOUSE BECAUSE YOU WANTED QUALITY FOOD!? Excuse me!? Your wife or neighbor doesn’t NEED to be making you lunches AT ALL!? What are YOU doing to help in this relationship other than bringing in money? NOTHING! The one where the wife keeps lying. She is literally going to put her husband in JAIL!? She’s an impulsive liar and NEEDS HELP NOW!

Food thief: I'd do it. Don't touch my things without my permission. Respect my boundaries. Ask if I would make you a lunch. I love to cook for people. I would if you asked and gave me 6 dollars. One dollar per day basically. The lunch thing: cheating can happen anywhere really. Lol he's just get lunch. But that's just me. 🤷🏾‍♀️

As far as the Carolina pepper guy I have to admit that at first I was thinking yeah he deserved whatever he got but after I searched Google for what the Carolina pepper was and what it could do potentially I do think it was too far. People should not get potentially life-threatening consequences from stealing lunches

Story 1: the worker isn't the jerk. Sad how that dad had to create such a disappointment in society. Hands down to him for giving the OP 100$, tho Story 2&3: I would do the same thing as both of them did. I'd be very frustrated if some random scumbag just went around and stealing my lunch. They're both Not the jerk.

How i would handle the lying wife? Divorce and sue for defamation. I see loyalty and fairness as important parts of the personality. A partner without these qualitys doesn't deserve my love or time. I mean, it's just fair since i don't get her love either🤷‍♂️
