The plaintiff says he repaired the defendant’s car, but she stole it off his lot before she paid him for all his hard work and the parts he bought. He’s suing for every penny he’s owed. The defendant says she hired the plaintiff to put in a new engine and he didn’t do it. She says he actually owes her money and is countersuing for missed work.

@@marleonetti7 did you even watch this case???? He gave her the list of engines and where they are supplied from and she chose the junk yard motor (knowing it was from a junk yard) because it was cheaper. He then told her that the engine would need some work and she was still ok with it. That is exactly why he suggested that she purchase a warranty, which she did!! The warranty served its purpose but she asked him to fudge the paper work and up the price of what it was going to cost so that she could get the extra money to cover her original costs as well. Not to mention that once she made a claim on that warranty, it was out of the mechanics hands and it was up to the junk yard (who she chose) to supply a new engine. The mechanic couldnt do anything until there was an engine to put in the car. When she became difficult, he offered for her just to pay him the $500 for the engine which he was out of pocket for and not to even worry about paying any labour costs and she can take her car somewhere else. He was willing to take the loss. She then went and took her car and paid him nothing for what he was out of pocket for. And she made the deal and agreed to pay the $500 and take her car elsewhere. But instead, the thief and liar that she is, just went and took her car back and paid NOTHING. How you came to your conclusion really baffles me!

I never cease to be amazed at how some people can believe what they want to believe about evidence that is clearly against them. There wasn't a word on that recording that supported the defendant's claim that she "couldn't trust him." That may have been her rationalization for stealing the car, but there was no evidence to that effect, yet she thought there was. I didn't wait for the post-mortem, but I fully expect her to fall back on "he's a liar," the last projectional refuge of a liar.

@@bunji_beans my comment was based on the many court cases i have seen where the professional has to prove that the customer knew or was informed of the risk . and to me , a warrantee is supposed to cover something that works now but may not work after a period of time but if the motor never worked to begin with and she was never told that the motor may not even work at all from the beginning then the fact that he tried to SELL her a warranty should not matter that much , what matters is that HE is the professional and he should have informed her of something so important as the MOTOR MAY NOT WORK .

By the defendant asking the plaintiff to increase the bill above actual costs so that she could pocket the difference, isn't this insurance fraud? If he did that, he will get the business he works at in trouble, I believe. This defendant is not to be trusted. No FREE Rides For You.
