I love Harvey but this trial was doomed from the moment mike told him everything at the interview. Harvey has access to all the information beforehand and it was from none other than the criminal himself. Legit free win on a platter. Good luck lying about something when the accuser is your partner in crime who knows everything about you. I think mike did amazing for his position. He actually convinced everyone for a while that The Great Harvey Specter was an idiot and that he went to Harvard.

yeah except the only way to prove Harvey's affadavit wrong would be to bring everyone from his class in to testify, and even if Mike only went for tests at least a few people would still be able to recognize him. So if nobody recognized him that would prove he didn't go there, Harvey trapped him perfectly.

Mike accusing Harvey of faking it is just hearsay if he can't prove it.

I dont think that asking the witnesses whether they remember mike or not, will be allowed since they are not their for that purpose. They are their to answer whether their signatures are real on the affidavit are real which they are not.

Aryaman Gupta no both lawyers have the right to cross examine every witness presented (which is why Harvey was able to destroy Trevor even though he wasn’t the one who called him to the stand). So if Mike did call the classmates in and ask them ‘did you sign it’ they would say no I’d didn’t but then Harvey would get his turn and he’d be like well did you know Mike and they’d say no. So Mike could prove Harvey faked the signatures but he’d be destroying his whole defence in the process.

Not to split hairs since it's a show, but Mike rarely showed any behavior that displayed intelligence. On the contrary, he repeatedly showed poor decision making, problem solving and reasoning skills in a multitude of situations. The word you are looking for is knowledgeable with good memory recall. To be fair, he might have changed after I stopped watching after season 3. I would still love to have that memory though!

Since this is a criminal trial and Harvey is playing the part of the prosecution, he has the burden to call witnesses and put forward evidence. Mike doesn’t have to do anything. As such, Mike’s objection was perfectly valid and Harvey’s response to the objection was completely wrong.

Not a lawyer myself so correct me if I'm mistaken but the affidavit is essentially equivalent to calling the witnesses in as it is a signed statement to be presented under oath. At this point, if the defense wants to question the truthfulness of the witness' accounts, the defense has to provide evidence there is cause to do so.

Well he had the affidavit so he didn't have to call the witnesses, that's the point of an affidavit. He told Mike to call them up more rhetorically because Mike was trying to dispute the validity of the affidavit. Harvey's response was "this is legit. But if you wanna say it's not, prove its not by bringing in witnesses" which is a legitimate response. The only way Mike could prove that the affidavit is false is if he called the people who signed as a witness for them to testify that they never made such statements. Harvey had Mike dead to rights. It's an ongoing theme with them actually. Whenever Harvey outsmarts Mike, Mike throws an illegitimate tantrum about how Harvey is being sneaky. Just rewatch the season when Mike went into investment banking. All he did was cry the whole time.

But Harvey taught Mike that when you're a lawyer you never ask a question you don't know the answer to. Mike has no idea what the students will say if he were to actually call them all to the stand, and if every single one of them says they don't know him then he's screwed. It was a perfect trap by Harvey because he knew Mike would never do it.

You kinda have to turn your brain off to run with the whole premise of the show. No way would someone as smart and self centered as season 1 Harvey Spectre have been so casually willing to commit a major felony that could have brought down everything in his life just because Mike impressed him with good memory recall. Harvey could have hired Mike as a paralegal or given him a job in the mail room and mentored him just like Jessica had done for him. He'd have had access to Mikes talents with no threat of criminal action, and no way would Harvey have been too dumb to realize that.

That's not how it works in law schools, people recognize you even if you only come in tests. Not only that if this wasn't enough harvey can just theoretically subpeona mikes admission. mike knew that he lied about going to harvard. Secondly if, it was in court and that graduating class was called to bear witness ALL of them not noticing mike would be grounds for that subpeona. And that would immediately point out that mike didn't attend any of the major tests or ever attended/graduated from harvard.

I think that Harvey wanted to win but he didn't want to oust Mike since he knows for a fact that he did in fact never went to Harvard. He could've gone for the jugular and gone for Harvard's records, or any official paper from Harvard really. He could've asked specific questions about Harvard's structure (since Mike supposedly has 100% photogenic memory he should remember accurately), name the professors who was taking the class at the time etc. So he went with the vanilla option but still getting the win because of pride.

I don't understand, how people are saying Harvey to be smarter when in the entire series(before season 7), there's hardly any case, he settled or won without Mike's help. Harvey was good at throwing mud(that too with Mike's help) at the opponent and forcing them to settle the case. He has done nothing legal in the series unlike Mike.

That was the point of Harvey's affidavit, the only way to prove it wrong would be to call in everyone in his class. And Mike has no idea what any of them will say and one of the first thing Harvey taught him was never ask a question you don't know the answer to. So he couldn't call them in because they could end up proving Harvey right.

Makes for good TV, but Harvey makes a specious argument. First, legally speaking, the burden of proof rests with the prosecutor. Mike isn’t responsible for disproving the legitimacy of evidence as much as Harvey is required to solidify its legitimacy. And argumentatively you can’t prove a negative. It’s easy for people to not remember for any number of reasons. It’s easy for them to misremember, and in similar ways to one another (I.e the Mandela effect). A room full of lawyers would know this better than anyone.

yeah i see the point of many people, IN rlf we dont remenber all the classmates if they only go a couple of times, but this is not the same case, as we know ot atleast i though so, Every school legally has so submit the documents to the council and get back to the school with signatures and also you need to make courses or present final work to call you a graduate, is not only finnish and i go like some basic school like high school etc, you obtain the certificate, there is school photos and many evidence like MIke cannot possibly present, for the end of the season 1 he is already on jail, but for the Drama the producers and directors they make him like that, and he save his ass from the jail so many times, and every person and the firm is allow to make whatever he/or she whants without apparent consequences, even betray your friends and the next season or the next opportunity they forgive forever or momentarily even for mere convenience; I LOVE THIS SHOW, THIS IS THE SECOND TIME I´VE SEEN IT I ALREADY ON SEASON 3.

There is a good chance somebody would have “remembered” mike. Even if he never went somebody may have remembered him falsely. Harvey making up a fake document to “win” isn’t even smart. Like a five year old kid losing a board game and making up his own rules. I don’t know that mikes is smart but it’s not Harvey dumb.either way all mine has to do to win is discredit the witnesses that they do manage to get. Most people don’t remember all of the people they went to class with. Especially someone who only showed up for tests. Just be like is it possible we had a class together and that you do not remember me. Many years later most people would be like yes and some may even think they remember someone similar to you. Honestly those would be the easiest to discredit and least reliable witnesses ever.

People are saying Harvey obliterated Mike because he's better. Maybe he is, but in this case, it was not that. Mike is starting at a disadvantage. Its like Harvey is trying to prove that 2+2=4 and mike is trying to defend that 2+2=5. Harvey has the easier position and still has to end up cheating because Mike outsmarts him at every turn.
