The plaintiffs say the rented a house from the defendant and it had bad plumbing. They wanted out, so they’re suing for their security deposit back. The defendant says the plaintiffs were nightmare tenants who broke his showerheads and damaged the property.

When I was a renter, the first thing that I would do was to change the shower head. Put the original head under the sink for safe keeping until I moved out and added on my Water Pik handheld shower with 7 different water pressures. When it was time to move, bust out the original and put it back on.

my mom has been doing that since I was a kid. 20 years renting houses she does the same thing every year

Some rental agreements/leases prohibit that due to potential damage.

@@JenniferFuchek I don't know of ANY rental agreement that would prohibit you from screwing off one shower head and screwing on another. That's all it does; screws off. If that's the case, they also shouldn't permit you to change out the light bulbs; they're equally as simple to change.

@@4everThoughtful lightbulbs don't cause flooding if something goes wrong. Pipes can become unscripted in walls and move around, causing leaks. Any government housing has that stipulation.... husband does flooring and we see it all the time.

Have you priced that type and size of shower head lately? They're pricey as hell. Plus, you would want a plumber to install them so they don't leak using Teflon tape, etc...

Judges are not mind readers or perfect. In the beginning the plaintiff said in the video something might be clogging it. So it's believable that one of them tried to open and see if it was just something stuck in it. That would be an easy fix because most men would rather do it instead if calling someone.

I think the guy used a screw driver also. Marilyn isn't always very sharp. I've even done things like this to my own stuff to find out what the heck is wrong. I think the Plaintiffs are lying through their teeth. The house was brand spanking new when they rented it.

Water does not bend material inside towards the force it’s trying to get out. The defendant was correct on the shower head.

He still needed to fix them regardless. Obviously he replaced and they are fixed??? Either way defendant is out the money for repair

I agree. And how I knew they put a screwdriver to that shower head? Cause I did the exact same thing trying to pry it open cause it wasn't working correctly, and it looked just like that. Had to just buy a new one. Plantiffs lied about that, but still not worth keeping that much money.

I think the judge was wrong on this one … there is no way that the shower head was damaged from the inside out …. It was CLEARLY forced open with a screwdriver… he even showed her where the screwdriver hit the inside and she did not put it together 🤷‍♀️ I think the landlord shouldn’t get all the deposit but he should have got to keep the money for the one master bedroom shower head ✌️

it can if the shower head is made out of thin metal & the water pressure goes awry for various reasons. same type of issue that can cause horrendous water hammer inside the structure. sudden bursts of water pressure can do all iinds of wacky things in a house.

That is exactly what I thought. I have been a landlady for 35 years and I've had my fill with contractor tenants, they always try to fix things and makes them worse. I don't rent to contractors anymore, they cause too much damage in my rental homes.

I have to disagree with these comments on the shower head. Although I do agree that the shower head was likely forced open, it was probably done so AFTER they complained about the popping and the water pressure issue and then opened it up to see what was going on. The shower head still would have needed to be replaced regardless so there isn’t technically any harm in opening it up when it’s already broken. The defendant had no reason to keep money for the shower head and then double it for 2 and keep the rest of the security deposit for no reason. The house was brand new. They shouldn’t have to deal with that many issues

I have to disagree with you. There’s never a reason to pry open hardware like a shower head. You hypothesize that it was broken and needing replacement anyways, so no harm no foul. I’d like to hypothesize, what if the gentleman had a warranty, manufacturers or otherwise, and could get a free replacement. Now you just caused him monetary damages, if it’s not yours don’t touch it! That’s a very entitled way of thinking. I hope you never actually do this

@@joeythemoose I agree with both of you in part. Don't mess with something that isn't yours and that you paid for. If the landlord is going to toss it in the garbage, then you could ask him if you could pry it open to see what might be in there.

Okay. I love the judge but she lost her common sense about that shower head. Water did not do that. One of them probably destroyed it on purpose to get it fixed or did it to get back at the landlord.

I'm not saying the plaintiffs did or didn't do anything, but the judge sure was quick to dismiss the defendant's claims. Her biases were on full display.

I agree with the landlord. It's literally not possible for outward water pressure to somehow make an inward indentation.

Whatever the circumstance may have been for the showerhead, literally it is easily replaceable and does not have to be expensive. This problem could have been solved for under $100 and would have been the owners responsibility to take care of it and replace it as a landlord. All of this is kind of dumb

that can actually happen. if that shower head is cheaply made (even though it's expensive) the water pressure CAN dent it if the pressure is high enough...easily. I owned a house for 17 years, you'd be surprised at what kind of weird things can happen in a home that you own. water pressure can do all sorts of things, including exploding water heaters right through the floor upwards. if the pressure was high enough in that shower it most defiantly can do that kind of damage. The water pressure in my bathroom caused the hot & cold handles to turn up on their own & move without anyone touching them.

I am curious, that JM did not ask why in the video of the shower head, they didn't show the tap being turned up. How do we know they had the tap open as one would for a shower, they could have had the tap barely turned on, so no pressure. JM likes to share with litigants, and has many times, that she comes from a construction background. With that in mind, she did drop the ball on this one.

I think the renter was using the screwdriver to PRY the head off, to see what was clogging it. He wasn’t hacking at it! He’s liable, not the landlord. IMO

Low water pressure is the first major sign of a clogged shower head. That water can build pressure and needs to go somewhere. While the damage isn’t common, it is possible. That shower head was cheap and the landlord was outrageous to withhold so much. Maybe $50 per shower if they’re at fault

I dont think the Average person knows hoe to clean a shower head. All you need to so is soak it in some CLR or baking soda to remove the rust buildup. He looks like a person that knows that. Taken a screwdriver to it, is something a child would do.

The shower head wasn't pried open, the seam burst. The metal bent inward because of the angles, when the top and bottom bent away from each other they pulled the edges inward. Those edges had to bend inward to allow the top and bottom to bend outward. The only other option would be to stretch or break and bending is much easier given the angles and metals typically used for that stuff.

Water never bends metal . The female plaintiff did it . Wouldn’t trust that look . Both the plaintiffs are liars . I believe the defendant . I am surprised that JM did not use her common sense in this . How the hell can water do that ??

The bathroom/ shower area is the most important part of the house/apartment in my estimation. So for me if that's not up to par then there will be problems. Showers are the most important thing. But the plaintiffs deserve their money returned.

Not saying I would believe the tenants in this case because I don't, but I don't get why landlords that are keeping deposits don't take pictures of the supposed mess left behind? What I do know is that MOST tenants that get screwed out of deposits only complain but typically don't take the landlords to court and that is what crooked landlords depend on. Once in a great while it happens and they lose in court and have to give back the deposit, but considering all the deposits they keep, it's still a good gig for them.

Marylin is getting senile in her old age. More and more of her decisions have been biased and baffling. Someone tampered with that shower head. What's more likely: The defendant damaging his own equipment, or the plaintiffs thinking something's clogging the shower head and trying for an unsuccessful quick fix before going to bed or because they're in a rush to get to work and can't wait?

She meant the had PTSD from the propane stove exploding. I doubt that since apparently they weren't traumatized enough to seek medical care, but it is more understandable than PTSD over their landlord withholding their security deposit.

I'm siding with the defendant on the damage to the shower head(s). He also should've done a video walkthrough with the plaintiffs, on their last day there, to show how clean or how filthy they left the place and to include any other damages as well. This goes to show that *everybody* has problems from time to time.............even the high enders!

The judge was wrong with this verdict! Seriously water did that? I believe at some point the plaintiffs were trying to damage so they can either get out of the lease or not pay at all..

Wait... isn't the water the water companies problem? Our water used to smell like chlorine. I called them because they control that. They claimed it was normal amounts but funny how my water don't smell like chlorine no more.

Water Pressure is powerful especially if it’s clog yes it can damage a shower head ... he better be happy it didn’t hurt her anf he would have been getting sued I would have left well enough along... You could tell by the Plantiffs home behind them they are very clean even when he should stove blew up his house was clean ... He should have sued for his burns it could have seriously hurt both of them...

That's gross - your running water should not smell like chlorine; this means they added too much chlorine. Did it not taste bitter?

The water treatment places can add a surprising amount of chlorine and still stay under the limit. It does make the water taste bad. I have to use a filter on my tap water.

What renter in their right mind would stick a screw driver to fix it themselves when they could easily just tell the landlord to take care of it for free? Especially, if this is a brand new building with brand new everything? My friends have built new homes and they all say there are many kinks to work out. This is the blessing and the curse of building a new home.

Who in their right mind waits for the landlord to fix a shower head when you think you could easily pry it open to unclog a clog, especially when it's right before bed or getting ready to go to work? I can easily see one of the defendants fiddling with the shower head instead of having to wait days to get it fixed.

Who cares how fast it gets fixed? They said they have more than one shower. He can shower in the other bathroom. He can literally go up stairs to shower. Duh. They also don't take any risk if they leave it alone. Why stick a screw driver and risk not doing it right and being responsible for it? Do u live in a bizarro world where as a tenant u take repairs into ur own hands and risk breaking things that doesn't belong to u? Do not know how the tenant and landlord relationship works? I understand the word literally thanks.. haha

@@DanLee8884 How much time do you save by not sticking a screwdriver into a shower head? If it takes you more than 10 seconds you're doing it wrong. Who thinks about the "risks" when trying to unclog something? You try and if it doesn't work, you call the owner if you're a renter. If it breaks, you're not the owner and you just have to say who in their right mind would stick a screwdriver to fix it themselves when they can call the landlord to get it fixed for free. See how that works? Sounds like you have some experience.
