The plaintiff says he’s done the defendant’s taxes for years. He claims he used his own money to pay for an adjustment, but the defendant hasn’t repaid him and he’s suing. The defendant says the plaintiff messed up her taxes and the government took money directly out of her bank account. She refuses to repay a thing.

Sometimes the Judge needs to give time for her questions to be answered. She asks a question and then before two words can come out she talks over and interrupts and that can really throw a person off

I think for a judge any judge in a small court room cases, the cases brought forward to them every day for 30 years become irritating to the judges. Its the same old " i forgot to do this or that" or something so trivial that causes the issue to get bigger than it was. They get irritated when an question is not answered properly or the plaintiff and defendant isn't clear on what they are wanting the judge to conclude, also the evidence provided to them is very limited or very confusing that the judge has to keep digging for more information to get a clearer picture on the spot at times. It would be very mentally draining and you would need a lot of patience at the end of 30 years when all the judge wants to do is do the job correctly by the law and judge fairly. And yes Marylin needs to allow to give time for people to speak instead of cutting them off, but for her she has heard the scenario many times before and also i do agree she does it to her husband as well so its a habit of hers that needs to be adjusted . You also need to remember judge Marylin was a prosecutor before she was a judge, so in people's court , i do see her more like a prosecuting judge who prosecutes the plaintiff and the defendant so she can get the full picture of what is the real issue at the crux of this problem , because majority of them time neither the plaintiff or the defendant is giving her the full picture. I commend her for the way she does her job as a judge on a TV show as it would be very hard not to eventually blow up in anger due to stress after 30 years.

Sometimes Marilyn gets a little ahead of herself. The guy was explaining the exemption perfectly. When you use a Tax Program you use what you have for that year. If something changes then you file an amended form. No big deal, it just makes your refund a bit late. I wish she would learn to let people speak and not keep interrupting them. It's no wonder people get flustered, you couldn't keep a thought in your head with her always interrupting you. She does it constantly with her husband too so I know it's a problem. She should try to work on that. We all have our foibles.

@get in, Judge Marilyn Millian does not get ahead of herself. You are very disrespectful and should be ashamed of yourself. She does not get anyone flustered; they are nervous being in front of the television cameras. She can also interrupt them as they would be in a regular courtroom. You need to visit a real small claims court and see the real live action. She has nothing to work on deary. Good day and good luck at the courthouse visit.

@@trekgirl65 I love Marilyn but she most definitely gets ahead of herself at times, and due to that she misunderstands or misconstrues things. It is okay. We are human and we all have our flaws and sometimes get ahead of ourselves. We are not perfect and she is not immune to this. Their comment was perfectly fine.

This is why I do our taxes myself.....I use Turbo Tax Free Edition and have used them for atleast 30 plus years....

In my opinion, the plaintiff made a mistake coming to court. 500+ dollars is less than the damage he did to his reputation in front of the whole world. This case shows he is clumsy and does not pay attention to details.

A lot of tax software, including the freebies offered by New York State, gave people the exemption that the state never agreed to. I ended up owing this money (along with interest), as well. I suspect a lot of New Yorkers did.

That lady should have gotten something for all the trouble he put her through because of his incompetence. I'd be furious and frustrated. He's supposed to be a professional at preparing taxes! There should be a penalty for him.

These are the types of contract cases I really enjoy on this show. It's not straightforward and requires a Judge with no biases to sift through the mess and arbitrate an equitable resolution.

This is why I do my own taxes at this point. I don’t even have an accounting degree. It’s easier to file my own and walk through the steps. If I make a mistake, it’s on me. The only people that should need additional help are business owners.

Or if you have a lot going on. Royalties, stocks, property, etc it’s better to hire a professional. The problem with a lot of accountants is they take on to much and wait till the last minute causing mistakes. Costly ones

@@LoayMatar Yes. This was a major failure. I work in the accounting industry (not taxes) and it's why I am so adamently against non-cpa's doing taxes... although you apparently have an EA your side of the border and I don't know enough about that designation to form an opinion.

The IRS stole probably a small fortune last year. We did our taxes on time , documenting as usual. Mail certification, of course , was obtained. I got fined $5 for Federal/ $7 for state. My mom got fined $5 too. ALL for being late when we had proof the entire family paid in time. My CPA said it is happening to a lot of her clients. I complained Federal/ State. It turned into this ridiculous ordeal. Of course we all agreed we didn't think it was worth the torture and I'm sure most people thought the same thing. We just thought , for something so small, we didn't want any excuse that might cause an audit . An audit would be more of a headache but, thank goodness, we have learned to keep meticulous records ❤

When did you mail in the forms, for they go by the stamp on the envelope. Getting it done early helps. Do not wait till the last day, for the process will take longer and if the stamp on the envelope is later, that is how they get you.

Obviously we all pay tax, but your employer and the government do it all automatically, and you only have to worry about it if you want to claim money back for work or medical expenses etc. I've literally never heard of any employee owing more tax than is taken automatically from their wages.

@@kameidawn1977 Here, you can claim dependents and get tax exemptions-and money back for that. When a new job is started, there's a form one fills out if the new employee wants to claim dependents or not. If you don't, more taxes are taken out of your check every pay period. Then at tax filing time, you get a refund that way.

Wow, this case gets scarier and scarier! Last years tax return there's an issue too!!! I have anxieties when it comes to my taxes. If, I received a surprise bill of over 1,000, I would be devastated. I don't like money problems with the government. The fact that the plaintiff was dishonest on purpose, and didn't tell the defendant. That's a deal breaker for me.

Taxes are an interesting concept, and she definitely had some confusion regarding her owing money that we sometimes end up owing. I used TurboTax before, ended up owing my state less than $100 AFTER they used part of my federal to pay. A few weeks later, they refunded me a little over $100 saying they made a mistake.... I still owed my state though👀.

The tax preparer doesn’t have the right to file an amended tax return without the approval/signature of the tax payer. And the taxpreparer fails to get updates to his software which is his problem.

With amendments there are penalties, he messed up and should pay for penalties .As a CPA he needs his license reviewed, two years of mistakes are on him.

Oof, I just do not get taxes. A couple of people I know, who are salaried & don’t make other income, have owed taxes to the state/feds. Like how do you owe the govt when they took taxes out of every single paycheck?? Lol.

I file turbo tax my husband and I for the last 13 years we’ve been married. The problem with accountants is they are always trying to finagle more money into your return . I keep it simple I’m not trying to extract every Nickel and dime we’ve spent or adding in “business expenses “ etc . We all know that’s a rich person thing . To be extremely generous with themselves and then get the money back from big daddy Gov . He should retire from taxes .

I forgot to mark a box one year. I got a $10K return. When I realized my return was only supposed to be $2K, I sprinted to the bank, got a cashiers check for $8K and mailed it overnight to the IRS. I don’t play with Iris her sister DNA

Turbo tax is free, and effective. I think the defendant was tying to be sneaky and avoid taxes by going through someone who she thought could work the loopholes in the system.

there seems like there might be an ethical issue with the tax preparer, especially in filing an amendment and not immediately telling the defendant. i hope that she filed a complaint with the irs.

I hope people in their area take a good look at the plaintiff. No one should ever put their tax obligations in his hands. It's unacceptable to install new software every year and use early clients as guinea pigs, hoping for the best 🙄

Exactly why I have a competent licensed CPA to do my taxes. And between him and my financial advisor they just gave me advice which saved me $1000 in taxes. 😊 But lol if the tax preparer makes a mistake we still have to pay the taxes. 😂 Defendant needs to find a new tax preparer. But lol she still does not get it.

Judge is wrong this time. First, if the refund was issued, it will have to be paid back; adding the refund to the 265 owed is the $710. Defendant was wrong. It is true that the unemployment compensation was not decided until after the tax year had started. The CPA shoulda got full amount requested. My .02

The Postal service lost my taxes last year and when I contacted the IRS they told me I had to file another form and I do the LONG form. At least all I had to do was call my tax guy and have him send in another form. I got my refund in August of 2021 which I should have gotten in 2020.

That is why you make copies and send in a copy and keep the original.

Your tax accountant should automatically be printing the copy from the software that they use which outline everything your personal details address job , what is refunded , what you owe with the receipt of the payment that you made to your accountant who did your taxes for you. And if you chose for the payment for the tax service is to be deducted from your refund it should also be stated on this copy as well.

@@trekgirl65 You seem to think you're an authority on a lot of things don't you? Reread my comment and tell me where I said I didn't have copies. I don't deal with the forms, my tax man does. He makes the copies and sends the forms in. It's done electronically now so you no longer have to worry about them getting lost in the mail.

The defendant doesn’t seem to understand her taxes were always a liability and not a refund. Second, for those in the comments saying the plaintiff deserved to be penalized, I’m sure the IRS charged him penalties separately, since there are fines for tax preparers who submit erroneous tax returns. Additionally, it is illegal for a tax preparer to submit payment for their client, and there is a fine assessed with that too

If you are wondering about the box, NYC has a resident income tax. You file a city return just like you do for Federal and State.

When an Amended return is filed the taxpayer has to sign the amended return. So she clearly knew she had to pay state of NY. And he didn’t tell her til May because he was most likely working on taxes that still need to be done before the deadline. Amendments can be done after the deadline.

I used to word for an accountant and the software they use get weekly if not daily updates of all the new tax laws that go in effect. So when he says the software didnt have that information he is full of shit.
