From personal experience, TFL Revenue pick on easy targets : often letting male youths jump barriers , kick gates open or double up through the barrier. They much prefer to interrogate females and also tourists and bully them into paying a fine. Seen this exact behaviour numerous times at Balham, Tooting Broadway and Bec.

The amazing thing is that they are checking anything. Go through most London train terminals and tube stations and if you are lucky enough to see a TfL employee they are usually sat in a nice warm booth looking at their phone or stood on the concourse with four or five of their equally useless colleagues having a chat and a coffee. Meanwhile scores of fare dodgers are piling through the barriers completely unchallenged.

Walk away from these people. Say nothing. If they touch you or try to detain you, tell them there will be legal consequences and let them decide if they want a lawsuit or not. If you are falsely detained, continue to say nothing until you see a solicitor. They'll soon get tired of paying out compensation.

@@MaidinBritain That attitude is exactly what is bringing this country to it's knees. People need to assert their rights or lose them. Not saying anything takes the wind out of their sails and if the police arrive... great. They can continue making a spectacle of themselves while you show the police your paid for ticked and reassert your right to travel without being accosted.
@MaidinBritain
@MaidinBritain 6 ай бұрын
@zibbezabba2491 you talk of asserting rights. The tfl are asserting theirs. That's the point. They've the law behind them regardless of whether we like it or not. Forcing them to get police involved will end up with same conclusion ie you're stopped, forced to give name and address and proof of fare, so why argue with the staff in first place? I don't like their authority or how they abuse it with selecting easy targets but it won't change. Choosing my battles.

Andy, As a recently railway man of 30 years service im sorry they can stop and ask for proof of travel and ask for proof of ID. The people on the barrier also should apply common sense. If anyone is in doubt ask to speak to the station manager and always ask for their name or ID number. They cannot refuse this request, If their is a BTP officer about request one. Always stay polite it works in your favour. I do not go to London without a through ticket anymore as i do not have or want an Oystercard.

About a year ago I took my daughter to the train station as she had three bags, I parked in 15 min drop off and carried 2 of her bags to the platform. I was then denied exit because I couldn't prove I wasn't on the train that had just pulled in. After about 10 mins of arguing I just pushed the guard over and walked back to my car being chased by the guard who stopped me from driving away crying about being assaulted. Eventually the police arrived, checked CCTV and promptly let me go. Guard was still crying about it as I flipped him the bird.

James - the burden of proof falls upon the accuser not the accused. This is a maxim in law and how English Law differs from European law. A small claim for £2,000 would take sting out of the incident a little bit. Or claim whatever you think is reasonable for being accused of theft, fraud or telling lies. How much is your reputation worth, only you can decide that. Another useful maxim in law is "He that is claiming is winning" So the law recognises your claim and the respondents counterclaim. And if they don't have one well that's just too bad boo hoo. Quids in 🤑💲💸 serves em right

@@jamesbinderman5626 - I comprehend, the threat of retaliation is always a mode of control. But in future you may best in mind that 1. accidents can happen. Anyone can trip and unintentionally knock someone else over and compensation for such would depend on the other party's injuries. 2. If 3 warnings were given for the other party to desist from detaining you OR ELSE reasonable force would be used to secure yourself and yours. Proof of these warnings could come in the form of affidavits (notary public) or sworn statements(commissioner of oaths). Or videos , etc. Just a few of the tools to bear in mind for anyone who uses public transport and is accosted by an agent of a company who claims to have a 'duty of care' to the public. These days body cams are so cheap and affordable and I never venture out of doors without one. "It's a jungle out there" 😉 "Be cautious as serpents and harmless as doves" J.C. the Nazarene.

TFL and BTP were no help. We informed them where the phone and cards were, but they refused to help. My daughter was in London studying at the time, and had no bank cards or her Oyster card and was stranded......... she was 18, alone and was left to fend for herself......... luckily she deferred this year, has a full time job and is happy. I get the feeling, she won't be going back to London. We live in rural Wiltshire, where it's predominantly white and safer.....👍🏻

"(4) The reasons are to prevent the person in question- "(a) causing physical injury to himself or any other person; "(b) suffering physical injury; "(c) causing loss of or damage to property; or "(d) making off before a constable can assume responsibility for him." That is section 24A of the Police and Criminal Evidence Act 1984. Anyone can arrest a person in the circumstances laid out in that section. Do try and check what the law actually says before making lofty pronouncements. As for railway staff and fares: "5 Penalty for avoiding payment of fare. "(1) Every passenger by a railway shall, on request by an officer or servant of a railway company, either produce, and if so requested deliver up, a ticket showing that his fare is paid, or pay his fare from the place whence he started, or give the officer or servant his name and address; and in case of default shall be liable on summary conviction to a fine not exceeding level 2 on the standard scale. "(2) If a passenger having failed either to produce, or if requested to deliver up, a ticket showing that his fare is paid, or to pay his fare, refuses or fails on request by an officer or servant of a railway company, to give his name and address, any officer of the company may detain him until he can be conveniently brought before some justice or otherwise discharged by due course of law. "(3) If any person- "(a) Travels or attempts to travel on a railway without having previously paid his fare, and with intent to avoid payment thereof; or "(b) Having paid his fare for a certain distance, knowingly and wilfully proceeds by train beyond that distance without previously paying the additional fare for the additional distance, and with intent to avoid payment thereof; or "(c) Having failed to pay his fare, gives in reply to a request by an officer of a railway company a false name or address,he shall be liable on summary conviction to a fine not exceeding level 3 on the standard scale, or, in the case of a second or subsequent offence, either to a fine not exceeding [F7level 3 on the standard scale], or in the discretion of the court to imprisonment for a term not exceeding three months. "(4)The liability of an offender to punishment under this section shall not prejudice the recovery of any fare payable by him. "(5)In this section- "(a)“railway company” includes an operator of a train, and "(b)“operator”, in relation to a train, means the person having the management of that train for the time being." Now in the circumstances described the TfL agents were definitely exceeding their powers. The fare evasion offences are summary only offences. That means section 24A of PACE does NOT apply to them. Beyond that it was clear that the fare had been paid for the journey taken as the ticket was produced. So the powers in section 5 of the Regulation of Railways Act 1889 also do not apply. Again do try and check what the law actually says before making lofty pronouncements.

I'm inclined to say let this one go, soonest mended, but we've got to think of more vulnerable folk being detained etc in the future? Folk using lifts are likely to be in poor health, disabled, less robust. Ask to see all the documents relating to the processes to be executed where such machines detect omission to check in. You'll probably find they include that it should not be assumed the traveller is a criminal because the system to check in is not comprehensive. This will show that the staff misused their position due to poor training or malevolence. If the latter, consider criminal/civil charges. In any event, the assumption that computers are always correct needs to stop.

They were probably trying to make out she was travelling on a none TfL train and disguising inter-city travel by use of a local TfL ticket -like the old trick of using a platform ticket to travel inter-city, they were wrongly alerted by the luggage. The fault is entirely with the staff, poor training and appalling attitude, but the first BTP officer as much to blame, the first officer should have resolved the matter straight away, by asking the TfL staff the reason for the stop and what EVIDENCE they had, then a brief interaction with the woman would have resolved the matter, as in "where are you travelling from?, okay that conforms to the ticket, off you go" But the reality we are seeing a very poor level of BTP policing just as we see a marked lack of quality policing by both MET POL and C of L Police, under the Kahnate. Added to which there seems to be a marked tendency to go after white people , especially white women., but then you're very much less likely to get a 10 inch kitchen knife drawn across your throat by a nice petite well dressed white female office worker than a ratchet Somalii or Afghan man of rapist age.

I took a train from Doncaster to Manchester airport it cost me £22 pounds which i thought was ok on my way back a few days later i had to pay £37 pounds on a over crowded train on the worse track i had ever traveled on. A few times i thought the train was going to come off the track. I was very surprised because the rail system i have always thought was very good. I spoke to another passenger who told me that its been like this for some time and the train only has 3 coaches at a busy time of the day on a Friday.

❤I live just outside the M25. I haven’t been into central London for years and now will not drive into the ULEZ zone. I refuse to pay that money grabbing little tyrant £12:50 a day. I urge everyone, regardless of your nationality political beliefs, to vote for the Tory candidate for mayor in May. In my book her promise to abolish the ULEZ charge is sufficient reason but on just about every other matter she cannot do a worse job than Kahn.

I wasn’t concentrating on the the whole video so might of missed but did the young lady get numbers/names of inspectors involved and then has she followed this up in the form of a complaint. I’m older and have worked in law enforcement but I can’t state that if I had purchased a valid ticket then I would not have given any of my details other than presenting the ticket for inspection.

I remember watching a TV series a few years ago, that was all about Underground Ticket Dodging. Quite a few were caught, and it is still a problem no doubt. BUT< that doesn't excuse the treatment revealed here. I would ( for what it's worth ) complain to my MP) and or seek legal advice as to the JOBSWORTH's power's and limitations.
