The plaintiff had been living in her apartment for 11 years before she decided to move out. She says a cutting board was glued to the countertop when she moved in, and now the management company is complaining. She’s suing for the return of a security deposit. The defendant argues the plaintiff could not provide any evidence that the cutting board was glued down since the start. She doesn’t think she owes the plaintiff any money.

I totally believe the plaintiff in this case and I’m glad she won. Makes no sense for that to be glued down. I bet the previous landlords had a reason to do it and it was probably to cover up a bad spot they did not want to spend a lot of money on to repair. I’m glad the Judge gave the verdict like she did. It makes perfect sense that the burden of proof would be the defendants job and not the plaintiff’s.

I agree with the verdict. Who would glue a cutting board on a countertop like that? Doesn't make sense at all.

Most likely the previous landlord installed it to try and mitigate against tenants NOT using cutting boards and damaging the countertop.

So gross. I have a feeling the last tenant put a hot pan on the countertop and burned it so they glued the cutting board over the burned area. Is it possible? I think so.

@@getin3949 that's exactly what I think happened. It was in an awkward position for a cutting board in my opinion, it had to be covering something up and like it's wooden so that's a hard no from me on using it. That's absolutely disgusting.

These property management and landlords are a real trip sometimes. They will find ANY little thing to keep that security deposit because they don't want to pay it back. Most of the private landlords have spent that money anyway, which is against the law. Glad the plaintiff won.

What is this landlord talking about? "It's difficult." "It's not fair." And it's fair to keep almost $900 of the tenant's money for something they didn't do??? She doesn't understand the law.

New owners need to inspect EVERYTHING when getting ownership of a new property. So, to the Spanish lady, it IS FAIR that you're going to have to return her deposit. That's your fault, you should've inspected the property before hand. Nice job on the judge's part and congrats to the other lady for getting her money back!

I'm so glad the plaintiff won. Something similar happened to me when the building I lived in transferred ownership. I was young and an international student and I wish I'd have known more about how to fight back when the new landlord kept almost all of my security deposit.

I've never in life seen a damn cutting board glued to a countertop but maybe I'm just Bougie abd have OCD because a damn cutting board gets contaminated from meat and food that's cut on it. It needs to be thoroughly soaked and cleaned not just wiped off. Do you understand now??? If not move on to the next comment.

Makes me think they've possibly held the disposits of other tenants resulting from their own lack of due diligence. Hopefully if they try this with others, they'll sue as well.

Geez. This was the quickest case ever. LOL. Also, the property manager and landlords failed to do their due diligence. They should have pictures of absolutely everything. The property manager claims “who pays attention to a cutting board?” YOU SHOULD! You’re the landlord. You need to have pictures and data of absolutely everything, even more so than the tenant, because that’s YOUR property, and the tenant may not live there forever. Hopefully, she learns to do her job.

The new owners should have inspected every unit and do a walk through before the sale. They bought it that way so it's on them. The landlord would have turned over ALL documentation they had on every current tenant at the time of sale. The original "move in" walk through for her unit HAS to be in the possession of the new landlords. They no doubt saw it and tried to get over on the plaintiff.

Some states require landlords do a walkthrough with a tenant within 5 days of moving in to make a list of defects that existed before the tenant moved in. And then, in some states, if the landlord doesn't do it the tenant can do it and take photos and give them to the landlord. It is on the landlord to prove how it was given to a tenant, not the tenant's responsibility.

It sounds like the previous owner, didn't want to replace the damaged countertop (probably a burned patch) so just glued the cutting board over the burned patch. But where does the new owner get off thinking she should benefit from something she has absolutely no proof about?...

It would not cost $800 to fix that. There is no need to replace the countertop; just chip away the cutting board. Of course if there's some hidden damage under the cutting board that's a different story.

The defendant doesn't think they shouldn't absorb the cost. Owners should have taken pics before or after buying the property. Good way to get tenants to pay for remodeling.

if your a renter you need to take out your phone and photograph everything before moving 1 thing into the home if you see anything odd, like a cutting board glued to a counter, make a note of it

I purchased a property that the cutting board was part of the counter top. I never used it because it was beautiful and I did not want to put knife cuts in it. Is is custom. I am sure because it is part of the counter it is meant to be there. No one in their right mind would try to remove something like that. She should never have removed it without permission.

This case reminds me to never rent again! I was fortunate enough to buy a house a couple of years ago so I could get away from these cheap low down landlords. Trying to charge you for anything so they don't have to pay back the deposit.

I honestly don't think its glued to the counter. Its just stuck from not lifting it off the counter and wiping the countertop off. It's just sticky-icky 🤢. Hot water & bleach will unstick it.
