The fact that even a multibillion dollar company had to fight KZfaq for multiple days just to prove it wasn’t them is actually insane. How does KZfaq expect its smaller creators to defend themselves from false claims with their atrocious system when even the big guys can’t even do it with ease!? I know KZfaq’s system is already tarnished to the ground but man it gets even more pathetic with stuff like this

Destiny 2 and Bungie has it's issues, but the strong content creation community around the game is something money can't buy and Bungie knows this. I'm glad to see them defending this community so strongly, they really could have just brushed it off and left those affected to deal with it but they've offered help with their KZfaq contacts to restore channels.

I actually love how this lawsut made Bungie look good. They've been on a path to redemption ever since they've split up from Actvision, and as a Guardian myself I saw them remove lootboxes and fully invest in player experience. The item shop is literally cosmetics only, it doesn't even matter to the endgame. Yes, the game is a DLC/Expansion selling machine, and that's weird, but the content provided is 100% banger. It's not like certain game developers who spend months advertising something to then sell a product that's half-baked. That's not the case with Bungie.

@@parsar.k.p1337 Bungie left Microsoft after the creation of Halo Reach, then were bought by Activision before the release of Destiny 1, then they split from Activision before the release of Destiny 2 Shadowkeep. Now recently they were acquired by Sony. Kind of a Destiny and Bungie nerd which is why I know all this.

If a particular obscure song or album is not available to buy or stream, then you should have every right to share and upload it. Otherwise, it will be lost and we have no way to hear it. If the right-holder demands said musical piece to be taken down, it should be on them to re-release it through their official channels. If not, it makes them greedy, selfish and out of touch. While this may sound unrealistic, it should be something we can strive for. We need to hear the soundtrack for Destiny 2 on its own.

@@TimelostInTheSauce The fact that Bungie have uploaded D2's soundtrack themselves changes a lot about this case; Nazo is just being a prick for not accepting the compromise. The point stands, tho, that if they didn't do that while also pursuing legal action, they would not have the same level of sympathy. Not naming names, but if another game's soundtrack got a limited, commercial release and then got uploaded here by a third party, the publisher would like like assholes if they ordered it to be taken down and then refused to re-release that soundtrack.

I wonder how YT would react if someone pretended to be YT and put takedown requests on official YT videos to demo to YT how bad this system is. I doubt that anyone would actually want to do this though as YT would probably respond hostilly even if the person made it clear that they are doing it to demo how broken the system is.

I honestly have a bit of respect for Bungie because they have the balls to roast their target in the documents, instead of just being simple and professional in their document. Honestly, it seems like KZfaq should be held responsible for this as well. Their poor system for handling copyright claims and negligence in addressing the known issues with said system are the only reason this got as far as it did in the first place. This guy should never have been able to so successfully damage Bungie's public reputation in this fashion, nor issue such claims against other creators' work in the first place.

Problem is that as far as I know there's no law that requires them to do more than they currently do. They have sare harbor protection that basically makes them immune for legal actions as long as they just stay neutral and comply with takedown requests. This is quite literally what the current legislation forces them to do: to let this madness happen on their turf so that they wouldn't be held responsible. Sure they probably could handle this better regardless but the problem isn't just YT, it's legislation that's still decades behind the current era. DMCA was never intended to govern media in its current forms and sorely needs some serious updating.

@@k_e_n_n_y_mccormick I think if someone were to provide another person with the means to cause financial damage to others, and assisted them in doing so either purposefully or via their own negligence, they could be held liable. In this case, KZfaq gave someone an extremely easy avenue to cause harm to its content creators and to Bungie, failed to utilize any safeguards to prevent said harm (it is WILD to me that their system doesn't even verify that the source of the copyright strike is legitimate), and carried out - or allowed their automations to carry out - actions that directly caused that harm.

I'll be honest, it's kind of surreal hearing about a multi-million-dollar lawsuit by a large company against a single individual which is actually justified. To be clear, I don't really give them any particular credit for this, because no act of any corporation is ever motivated by a genuine moral compass, but it's still weird seeing a case where they actually were acting in good faith and trying to protect their consumers.

I kinda want to disagree here.While i think people who do this deserve to be punished,The amount of money estimated someone with a *HIGH INCOME* will make in their lifetime is estimated to 6.7 milion dollar...the guy/girl was reposting music online,i doubt they could provide enough money for the lawsuit in their lifetime.This guy isnt a compagny and while he did commit a fellony,i dont think its fair to ask for that amount unless they killed or maimed someone for life.

So he is targeting and hurting the company and its employees. It's pretty heinous and evil if you think about it. KZfaq creators have gotten so accustommed to using other people's content now, that things like this aren't given a second thought. The only sad thing is even if Bungie wins, this guy likely has little in terms of assets. So he will likely claim bankruptcy and simply restart and not be in debt for the rest of his life. Meaning especially if he was living with his parents, has little to no assets etc, this may cost him little to nothing even if he losses.

Oh my friend, he has far more worries than that. You see, what he did isn't simply a civil matter and can be picked up by the criminal justice system. Not only did he commit at least 100 counts of Cybercrime but the evidence against him is insurmountable. He'll be lucky if he doesn't spend the next 10 to 15 years in prison. Addendum- There is no way he will eat 100 counts of Cybercrime. What will likely happen is he will enter a guilty plea for a reduced sentence and given the maliciousness of his acts the best he can hope for is 10 to 15 years.

I think it already did. KZfaq changed it so that now, when you get a DMCA and file a counter-claim, the person who sent DMCA in the first place has to provide proof within 7 days, not 30. I genuinely think it's in response to what happened with Bungie.

I don’t see it will. Cuz google/YT is the main reason why this shit happens. And they like to scapegoat onto users. In this case, the person who submitted the claims. And if they are decided as the wrong doer, they implement changes that doesn’t fix anything but rather punishes users. Google is too massive a company for them to actually be threatened by anything. Unless they screw up so bad the government has to get involved, they’ll just use loopholes and claim innocence cuz all they did was neglect to do the right thing, rather than actively doing said wrong thing. That said, someone did mention some changes to how it works. I hope next they’ll remove the fact the person being claimed needs to supply their address. And I hope they’ll remove deleting channels after a first offense, and not give them any chance to properly dispute stuff.

The Safe Harbour provision is all that's keeping KZfaq out of the lava, and it's been that way since ViaCom went for the throat back in the day. I want to be empathetic towards him on this, because yes, he is likely going to have his life ruined by it, but at the same time, he KNEW he was breaking the law maliciously and consistently, and was happy to ruin other people's lives and livelihoods over his little grudge. Copyright law is still law, and he was knowingly committing fraud at least 96 times and blaming everyone but himself for it, if anyone did this with any other kind of fraud, they'd be lucky to avoid spending a lot of time in jail. It is a bit harsh, but he did this to himself knowing what the consequences would be if he did finally get caught, and if Bungie don't make an example like this of him, it's going to convince other people it's ok to follow in Nazo's footsteps. TLDR: yeah the whole system is fucked and it's sad his life is gonna be ruined by it, but it's his own fault and honestly he's getting off pretty light considering what he's actually done

@zeoxeo The laws aren’t messed up, they are issues that are resolved in court. This is why it says in the DMCA “under penalty of purgery”, KZfaq isn’t going to charge people with purgery, and KZfaq doesn’t have police, judges, abd jails. The problem here is quantum is allowed to submit DMCA’s and if someone feels he is making false claims they need to take him to court. This is an issue that is resolved in court. KZfaq doesn’t decide what is “fair use” KZfaq doesn’t decide what is a false dmca. I was glad that act man stood up for some smaller KZfaqrs, but because he didn’t understand the law he turned around, and made this quantum guy look like he was in the right, because thought this is a KZfaq issue when it’s a legal issue that is decided by a judge. Act man came really close to grasping this, because he read the the DMCA, and he said “look you sign that you are submitting this in threat of perjury, if he would have made the logical leap that it’s a judge who determines if you commit perjury.

For KZfaq to get in trouble they would need to do what you guys think they should do which is pretend they are the arbiter of what is fair use, or a false DMCA claim. If KZfaq actually did these then they would get in legal trouble. Let’s do a hypothetical that a person puts in a DMCA, now let’s say KZfaq does what you guys think, and tells this person “that’s a false claim” and deletes their channel. Now this person goes to court, and the judge says “no this is theft of intellectual property” now KZfaq can be sued for pretending they are a judge and acting like they determine what is fair use, or a false claim. They could also get in other trouble for pretending to be a judge who can charge someone with perjury. Anyway i really wish people could understand this topic, because if act man had understood that this is a legal issue than he could have taken quantum tv to court, or understood KZfaq isn’t going to do anything about it unless he did so instead of attacking KZfaq act man could have continued to shine a light on quantum tv, and explained the law and why it’s not KZfaqs place to decide what is fair use, or a false claim so if this quantum guy did this to someone else they would know they can take quantum to court for this.

No KZfaqrs livelihood should be able to get thanos-snapped out of existence by some random person hiding behind a screen. @Russell White Hate to break it to you, but VPNs don't cover your tracks when you commit a crime. VPNs have to legally give up their data to the government. Everything you do on a VPN goes through a VPN server. But that doesn't make what you do untraceable. Any government investigation will simply result in the government asking for info on X IP who did this on whatever website / server during whatever time, and boom, they trace back the original IP. Usually it is actually simpler, and the government can have direct access to VPN servers (but that's widely speculation since a VPN company would never share something like that). You can think of a VPN like this. Instead of you going through your Internet Service Provider to browse the internet, you go through the VPN. And while that can make it difficult for a layman to track you, the government has all of the tools to know everything.

It's really only going to take a company suing YT for their bad copyright claim system to get YT to fix it. The fact Bungie had to Subpoena YT to get information on who this guy was is major red flags.

@@foxinsocks7531 the point would be to disallow randos from getting control of your account and to let artists, content creators and small or large businesses who run on YT to ask for clarification on who is attacking their channels dude. No ones asking for them to give out information they're asking you to validate that you're the owner and not a dude pretending to be a business to strike people. It's like identify theft 101 to have verification...

For those that didn't know by the way, My name is Byf was one of the channels that got striked. He's a destiny lore channel, focused entirely on asking questions about the lore, summarizing complex parts of the lore, etc. One of the videos he posted that got striked was his MASSIVE project called "Dynasty." Which is a 2+ hour long animated project summarizing almost the entirety of the Hive's lore for the whole series from their inception to the current time. It was an incredibly long and arduous project that was struck literally the day it came out by Lord Nazo. It is a fucking masterpiece, and deserves every view it can get. It was endorsed by Bungie themself, and was showcased multiple times during its development and after release. And that video was coming from a guy who doesnt ask for likes, doesn't ask for comments, doesn't ask for subscriptions. His final line in his videos is "And as always your viewership is just enough for me. And my name has been "My name is byf." Per Audacia Ad Astra. I'll see you starside." It's a fucking tragedy that Lord Nazo did that shit to him, because it cut out the most important day of his revenue for a project that took incredible time and effort to create, and deserved it all. And this little dickhead stole it from them because he was salty at a company that has nothing to do with Byf in the first place. He deserves everything they give him.

Man im so glad bungie stepped in when they did. I don't watch byf ss much as i used to anymore, but his videos have always been entertaining and informative, and he puts so much work into them. It would have been tragic if byfs channel was deleted

CSC: ”Hey KZfaq we’re dealing with an person impersonating as us and taking down videos claiming we did it using a fake email, can you reinstate the videos?” KZfaq: “Sure thing champ! Just use the official email to confirm reinstatement :)” *CSC uses an official email and fails* KZfaq: “Sorry! To reinstate you need to use the same email that issued the claims!” KZfaq has the 2nd step in the equation right, as making sure an official email used to retract an claim is good so make them have to reuse the same official email, but it’s only good if step 1 works. And which step 1 is to make sure the email used to file the copyright infringement claim in first place is actually from an official email and not a fake one. It’s such an obvious flaw in the security system. Edit: I feel like my last piece was but inadequate so if you’re curious they’re two fellows have some brighter ideas than me

Even that is sort of stupid; my company goes through email addresses like crazy, as every employee gets their own. There should be, as Act Man said, a direct line of communication between KZfaq and any company authorized to issue copywrite strikes, who should be logged by YT.

See, what they need to do is have a list of authorized emails or names which can make claims on behalf if a copyright holder, as well as a secondary password to verify they represent the holder. If the email that makes the original claim doesn't match those on the list of authorized representatives, or if they don't enter the correct password, the claim gets ignored.

Bungie just started another suit on a guy who threatened the lives of workers and hacked in games and was an overall ass to others. You should try to cover this case because he (allegedly) is being fined for every PVP match he played with cheats on, across multiple accounts.

Man, I hope the PR departments of other companies pay attention to this. Do public things that support your community? People value that. More companies taking the view of brand value building Bungie has shown here (in the document) would be a win for both sides.

This is beautiful. After everything with Quantum and now this, KZfaq has no choice but to address the broken copyright system. I hate to say it but KZfaq don't give a fuck about you however now it's effecting their advertisers. There are a lot of Destiny 2 ads and a precedent of KZfaq screwing over the people that give them money isn't something they want.

theyve did it to themselves. theyve automated themselves into soo many messes and they clearly dont have enough human staff to put out the fires before real damage is done. maybe they shouldnt leave gas cans everywhere that say “DO NOT IGNITE” but with no consequences 90% of the time if they do, because lets be honest. nobody is taking anybody to court except in extreme cases like this, because it costs alot of money and most of us are “judgement proof” ( worth little or nothing so theres no money to be regained even if you get a favorable ruling). if you want to see how difficult it is to deal with copyright trolls in the legal system, look up malibu medias saga by the lawful masses. pretty much all of copyright law is broken tbh.

This isn’t the first time I’ve seen someone abuse copyright for music before. In Recent memory, Neffex’s copyright free music got claimed by a company. It eventually got fixed, but seeing Qtv, 343 Halo series, and now this. It’s honestly stupid how easy people can abuse this system.

I'm just an average KZfaq viewer/enjoyer, so this copyright stuff will never apply to me like it does content creators, but the information you bring to light is invaluable and tends to evolve to points where it DOES eventually affect me and my content creators I enjoy.
