Hi , question: If you’re in the US on B2 visa and your visa category (F2A ) becomes current, can you go ahead and adjust status? Or must you still wait the 90 days before doing so?

Hi there, I have a quick question and appreciate your advice. I am currently in the US on B2 Visa and been here for 2 months now. I am planning to study and have been issued an I-20 form last week but did not file for adjustment of status yet to F1. With this 90-day rule which I just got to know about, so I understood that I will have to wait after 90 days of staying here before I can file for the change of status? Thank you in advance!

Hello. What if a tourist visa holder married her american bf after 90 days of stay and after their wedding the lady goes back to her country . Then on the next year, the lady returns to the US. Can she file her change of status even just after 60 days ( and use her marriage certificate) done from the previous year.

A quick question. I am an international student. I've been studying in the U.S for 4 years, and I just got married with a green card holder who Ive been dating for 6 years. The problem is that I went to my country for a month and came back to the U.S with F-1 status, but I got married right after I entered to the U.S. Is this a problem to apply i130, and i485?

Well that’s not the issue. The issue is that green card holders can’t file for your adjustment at this time Visa numbers have retrogressed

Me and my husband been married since December 2019, we got married in the U.S. but he went back to his country cause of his job now he's coming back in September 2020 to stay with me. How long does he have to wait to do adjustment of status? Can we do it right away when he come or does he have to wait 90 days in the US to do the adjustment of status? How could that be possible if they sre the ine saying that if you come with a B-1 visa and you want to change to a F-1 your intention should be to come to the US with the only purpose of visiting school

Hello Jacob, i am in a relationship with a US citizen since february 2018, we met this summer and i met her family , and now we are planning for marriage and be together as soon as possible, so we though that going there and veing with her to see if things will really work between us and get married if we eventually find out that we cam be together, soy question is it ol if i go there as a b2 viaitor then we get married after 90 daya, or we can get married before 90 days as we know each other and we ve been together since february??? Hi...my mother's visa expires 7 days after her 90 day stay. However, her i-94 card is valid for additional 3 months. Can I file for her adjustment of status after after 90 days but before her visa expiry? I am assuming once I apply before i-94 expiration we should be fine after we recieve a case number? Can you please confirm ? I am a US citizen.

Hello my wife and I recently got married, before we got married I went to her country with her for a month in order to meet her family and ask for her fathers blessing. My wife is currently here on an F-1 visa and has been here since 2017. I went to her country in December of last year and I came back on January 4th 2020, she got back on January 19, 2020. Shortly after we got married on February 6th 2020. We have been dating for 2 years. We wanted to get married in February because our anniversary date was on the 4th, we weren’t able to get married on the 4th so we just tried to get closest to the date. Does the 90 day rule still apply to this situation? She still intends to study (I just made a payment for her classes) we have a lot of evidence our love is real, I’m just concerned with this 90 day rule. What should my wife and I do?
