Having served in a jury...have seen unequivocally how good men and women can easily be swayed by emotional arguments rather than hard evidence. The conviction of Lucy Letby on the basis of such questionable circumstantial evidence is very disturbing to many. She strongly protests her innocence, had no expert witnesses brave enough to testify on her behalf while a lynch mob like public waited outside demanding her to be put away for ever. Something very wrong here.

The inference being that the culture war was found less and that there were never two roughly equal sides fighting for their own values. Of course there were two sides, of course their values are as important to them as ever. Of course the culture war is on-going. This "It's over" statement will age like warm milk.

@@jayjaydubful As far as the discourse goes, I agree. But silencing people in open only pushed more people against you in private - and at the ballot box. I think these buffoons think that closing down free speech in public spaces will make the issues go away. If that's the case, they are in for a real shock.

Excellent debate though I think there is a lot more to Letby, management can blame an individual and say they were a loose cannon, it’s a classic tactic. The Telegraph article was indicating the jury were mislead, I don’t think you have to assume they were stupid for coming to a wrong conclusion. There were serious errors presented as fact.

30:30 I don't know if Lucy Letby is guilty of anything or not, but admitting that there's not a shred of direct evidence, yet being absolutely convinced beyond all doubt of someone's guilt is a way of thinking that absolutely terrifies me. I also don't really understand the argument that a handful of randomly-chosen people looked at very complex evidence for a good few weeks, so therefore we must be fully confident that they came to the correct conclusion. I know a little bit about how the mind works, and the evidence seems to suggest that humans make decisions using their subconscious mind as opposed to their conscious mind at a ratio of something like 4:1. Essentially, the part of someone's mind that a person is actively aware of exists largely to rationalise and justify to itself a decision that's already been made by the much bigger, emotionally-driven part of the mind that an individual can't usually access. In any event I hope that I'm never charged with a crime, because the entire system comes across more like spinning a roulette wheel than any sort of careful consideration of facts and evidence that we've always been led to believe is the case.

The argument is the jurors - who sat for nine months by the way - are in a better position to reach a verdict than people who weren't in court.

@@arfurascii2232 The jurors saw flawed evidence that has now been thoroughly discredited. The babies Lucy was supposed to have murdered had autopsies and were found to have died from natural causes. Unless of course you prefer to believe the discredited, long retired paediatrician, Dewi Evans who fantasized about air embolism and insulin poisoning.

@@arfurascii2232 If anyone not part of the jury is unlikely to have the same level of insight into the case, then by that logic we should dismiss the opinion of any commentator who seems to believe that the result is beyond question, including the people on this podcast. That's aside from the fact that it's not even really possible for the jury itself to have that level of certainty here, no matter how long they took to reach their conclusions, given that we're talking about a verdict in a case with absolutely no direct evidence, formulated largely on the basis that *if* any crimes were committed, that this one person would have been most likely in the best position to commit them. It's simply not possible to be 100% certain in this instance, unless a person is claiming some sort of divine insight. The fact that so many casually claim such certainty without any hint of doubt terrifies me.

​@@arfurascii2232 Just look at some of the arguments and justifications for people's beliefs in this very comments section. Now imagine you were on trial for something you didn't so, and that the 12 jurors who held your freedom in their hands were picked from this comments section - or pretty much any comments section - or at least made the same kind of rationalisations for their decisions. I would not feel particularly confident that the system would automatically deliver the correct result. Hand-wave away a lack of faith in the system as 'silly' all you like; I'd be far from the only one to express low confidence in it, and regardless of what any individual may think, a system only works if enough people believe in it. It doesn't help that a more general lack of trust in all of our institutions is reaching breaking point right now, and that does not bode well.
