@@htvlogs80 its never my intention to say people dont deserve what they get. i just want to give information that when someone claims a higher rating that it comes with stipulations. if you really are that disabled than i feel bad for your suffering. i really do. you can agree that there are lots of veterans who exaggerate their symptoms because the higher rating pays more. i have talked to veterans who claimed to be so bad they cannot do anything at all. but because the va denied their request for 100% they must drive to work. i said if they really were as bad as they claimed their lifestyle would exhibit it.

Hello, Devin. You can work with a VA rating of 100%, but veterans with this rating are generally unable to work. Sleep apnea ow can you tie it to mental health?
@woodslawyers
@woodslawyers 3 жыл бұрын
Over time, sleep apnea can cause severe sleep deprivation. You may always feel tired, and you may even fall asleep while driving or any other time you sit down. You might also discover that you’re more irritable and that you have difficulty focusing during the day. These side effects may lead to mental health issues, which could then be considered secondarily connected to military service.

I tried that route. 1st time about 4 yrs ago and that guy was more interested in chasing a woman walking by. And just recently another DAV "volunteer" who sounded like he might have been 107 yrs old. I am currently at 50% and I am waiting for an evaluation for an increase in my Depressive Disorder. One of the things that have been presented to me on VA.Gov was did I want to be considered for TDIU. My issue with this is, I am currently employed and make fairly good money. I am of the belief that in order to be considered for TDIU, I need to be currently unemployed? So, that is a bridge I am not ready to cross at this time. I do believe that if I were to leave my current employment, I would not be able to find similar or adequate employment and thus I could possibly qualify for TDIU. Am I thinking about this wrong?

Good question! TDIU is based on your ability to work. If you're unable to work in an environment that is NOT considered a sheltered or protected work environment (a family business, for example, where you might receive accommodations beyond what another employer would be willing to offer), then you may be eligible for TDIU. Seeking treatment through the VA does not trigger a re-evaluation of your rated disabilities. If the VA has scheduled no future C&P exams for you for this condition, your rating is considered permanent. According to the rating criteria, PTSD is rated at 100% when the condition causes “total occupational and social impairment.” That means a veteran with a 100% P&T rating for PTSD is presumably unable to work and would not otherwise have the rating. From what I have read and listened to, the VA can if you continue to show improvement in your condition. So, if you are having continuous issues (which you more than likely are having at 100%) make sure you have ways to document these continuing issues such as statements from friends/family or through therapist appointments at the VA or private sector. After 5 years the VA may request a follow-up appointment to reevaluate your condition. They will not lower it unless they can prove you have shown continuous improvement. After 5 years they will not reevaluate you unless they have proof you have shown continuous improvement or if you file a new C&P claim, possibly for a secondary condition related to your disability. Bottom line is that unless VA can prove that your condition has improved then you will more than likelyremain at 100%. Hope this helps

A 100% rating is given to disabled veterans with extremely severe service-connected conditions that usually make the veteran entirely unable to work and mostly unable to care for themselves, including bathing and dressing.
