Bah! This Sabah thing again! Been hearing about it since I was a kid in the 80s. As a Filipino and as far as I'm concerned, let Sabah be. Let the people of Sabah decide their own destiny. After all, if its about national interests and resources ( oil and gas ) to be exploited, we all know the common man whether Filipino, Malaysian or Sabahan does not benefit. It's the corporations and the politicians who benefit, so I'm not going to get all emotional and patriotic over it. It's pointless and at the end of the day, we're all cousines ( more or less ) along with Indonesia.

I'm a Filipino and for me, there's no need to reclaim Sabah. Yeah, it's ours historically but the people in Sabah want to keep themselves as a part of Malaysia and Malaysians themselves. This dispute was comparable to China and Taiwan. We all know that Taiwan was always been part of China (West Taiwan) historically. But Taiwan don't want to be part of China so its the same logic for the people Sabah. And one more thing was, Malaysia has a federal government unlike the PH, meaning if the PH reclaimed Sabah, the resources from Sabah will likely to be concentrated to the mainland Luzon. It's evident on the situation of Visayas especially Mindanao.

1. Sabah chose to Join Malaysia. 2. I can accept Sabah returns back to BRUNEI. Apparently, the Sulu didn't honor the agreement yet claiming the 'promised' reward, which in turn, Brunei rejects it. 3. Yes, British side paid to Sulu, which later Malaysia simply continued, but that doesn't mean the deal proves it belongs to Sulu. British was a horror to the world, and they always support their enemy's enemy to saw discord. This could be one of them. British probably wants the whole Philipine by pretending to support Sulu baseless claim, which again, denied by Brunei.

I'll be advocating Sulu Sultanate independence and reclaiming all it's territory taken from Philippines rules and then Malaysia invite the new Sultan of Sulu to join the Malaysian Federation as the 14th state of Malaysia with reserve seats of Yang dipertuan Agong and Council of Kings. That way instead of Philipine getting Sabah, it's Sabahan will get their new Sultan so they can proudly be part of the Royal state in Malaysia and expand all Malaysian territory into southern Philippines.

Pehin Jamil Umar writing in his book, Tarsilah Brunei II: Period of Splendour and Fame (2007), countered all of the above. Pehin Jamil did not deny the fact that the Sulus were invited and promised the northern Brunei territory by Sultan Muhydin if they helped him win the civil war against Sultan Abdul Mubin. However, during the battle for Pulau Cermin, the Sulu forces who were supposed to attack the island from Pulau Keingaran and from the sea, did not do so. They were terrified by the resistance of Sultan Abdul Mubin's forces in Pulau Cermin. It was only after Sultan Muhydin had won the battle did the Sulu forces landed and took the opportunity to seize a number of war booties. According to Pehin Jamil, Sultan Muhydin refused to cede the territories claimed by Sulu. Pehin Jamil noted that the area was only "claimed" and not "ceded", as Sir Stamford Raffles, in his book "History of Java" (1830), had noted "on the north-east of Borneo proper (Brunei) lies a very considerable territory (Sabah), the sovereignty of which has long been claimed by Sulu Government". Pehin Jamil further noted that according to the oral tradition, Sulu continued to press their claim. In 1775, one of their chiefs came to Brunei pretending to seek fresh water. What they really wanted was to seek an audience with the Sultan regarding Sabah. However, the Sultan ordered one of the chief wazirs to see them and he threatened that if they wanted to pursue their intention, he will kill them all. The Sulus immediately left. Despite that setback, the Sulus continue to maintain their claims. The argument that Brunei has not ceded Sabah to Sulu is supported by LR Wright in her book The Origins of British Borneo (1970). She wrote: "indeed, the legitimacy of the Sulu claim to the territory (North Borneo) is in considerable doubt partly because of the unreliability of tarsilas such as 'Selesilah', which in many cases are nothing more than written-down legends to enhance the status of the royal house which produced them. Succeeding Sultans of Brunei have denied that northern Borneo was given to Sulu, and only the weight of Sulu tradition supports the claim. The weight of Brunei tradition challenges it"

Another interesting document is the British North Borneo Treaties Protocol of 1885 signed in Madrid, which is also known as the Madrid Protocol of 1885, a copy of which can be found on Sabah State Attorney General's website. It was signed by the British, Germany and Spain who was the predecessor government of the Philippines. The two most important articles are Article I British and Germany recognising the sovereignty of Spain over the Sulu Archipelago and Article III Spain relinquishing all claims to Borneo.

The problem with Sulu/PH claims on Sabah is that there is no evidence of ownership. Brunei Sultanate (original owner) granted Sabah to BNBC on 20/12/1877. Meaning Sabah belongs to Brunei and is never given to Sulu. On 22/7/1878, the Sulu Sultanate relinquished all its territories and dependencies to Spain. Sulu has nothing. It just does not hold water in the court.

Sabah was indeed gifted to the Philippines as a form of gratitude by the Malaysian Sultan to a Philippine Sultan for helping in setting a civil war in Brunei before. Britain came in soon and complicated things between the two contries and released it back to Malaysia, to which Philippines protested against but was unheard. I heard Philippines bought it back again from malaysia for a dollar as a formality after british liberations but soon the futility of these international diplomatic efforts gave birth to a secrete occupation plan by the Philippines. The Philippines president sent Filipino families to inhabit the Sabbah and slowly retake its governance. However a competing political opposition of the Philippine president, in order to secure power and support, exposed the plan which resulted to the massacre of the hundreds of Filippino families in sent to Sabah. I am a Filipino and i agree we have rightful claims over Sabah but if it will cost us another war, and dispute with our neighboring countries, im not having it. aside from the meddling of the west, It was our own fault that we lost it anyway. collect my efforts to fight for spratly where chin is building its military base.

The ownership of Sabah by Sulu can be disputable. Because Brunei Sultanate (original owner) granted North Borneo (Sabah) to BNBC dated 29/12/1877. Much earlier than the 1878 agreement. How can it belong to Sulu if Brunei can give it away? Sulu Sultanate relinquished its territories to the Spanish under the Bases of Peace and Capitulation Agreement on 22/7/1878. Sulu has nothing left. Thus the 1878 Sulu-BNBC Agreement dated 22/1/1878 is null and void. The cession of Sabah from Sulu to PH in 1962 is invalid.

Gonzalo Stampa(Arbitrator representing PH) was convicted contempt of court served with 6 months' jail sentence & ban from practising as an Arbitration Judge for a period of 1 year. Court ordered Sulu to pay €15000 + € 100000 to Malaysia( as legal cost & compensation). Sulu-Sabah long legal battle had ended with its Verdict overturned by Paris Court in favour of Malaysia. Conclusion is reached based on December 2023 outcome from arbitration court of appeal(Paris). Nothing can be done after court delivered its verdict. Court ordered Sulu to pay €15000 + €100000 to Malaysia( as a legal cost & compensation). A long legal battle.

Sulu/PH needs to resolve 3 legal aspects before making any claim on Sabah from Malaysia. Firstly, Sulu needs to show undisputable proof that earlier, the Brunei Sultanate (original owner) gave North Borneo (Sabah) to Sulu as a gift for assisting in Brunei’s civil war. This is to rebuke the existence of the 29/12/1877 agreement (consisting of 4 agreements) signed by the Brunei Sultanate that grants the whole of North Borneo to the British North Borneo Company (BNBC). These agreements exist and are kept at the National Archives in London. The word “grant” has been used, and it has never been challenged or protested by Brunei, even when the British turned North Borneo into a British Charter (1881), Protectorate (1888), Colony (1946), and finally British Parliament under the Malaysia Act 1963 incorporate it into Malaysia. Secondly, let's assume North Borneo belongs to Sulu. The Sultanate of Sulu signed many agreements to relinquish his territories and dependencies (including North Borneo) to the colonizers. These include the Bases of Peace and Capitulation Agreement with Spain on 22/7/1878 and the Carpenter Agreement on 22/3/1915 with the US. Later Spain and the US relinquished North Borneo under the Madrid Protocol of 1885 and Anglo-US Border Convention 1930 to the British respectively. In the end, Sulu has nothing. Thirdly, PH claims North Borneo (Sabah) is null and void. For any colonized colony that seeks independence, the territory (sovereignty) is based on what has been given by their colonizer. In this regard, the principle of uti posseditis juris is applicable, acceptable, and recognized internationally. PH got their independence from the US in 1946 and under this principle, there is NO North Borneo. Rebut with facts and references. Not hearsay. The UN has recognized Sabah in Malaysia since 1963.

Ultimately the native Sabahans have the right to self determination. They have chosen Malaysia in 1963 despite the Philippines' protest. The culture and the ethnicity are so different from the Filipinos it is laughable to suggest they are part of the Philippines just because they were ruled (conquered) by some defunct sultanate from centuries ago.

The ownership of Sabah by Sulu can be disputable. Because Brunei Sultanate (original owner) granted North Borneo (Sabah) to BNBC dated 29/12/1877. Much earlier than the 1878 agreement. How can it belong to Sulu if Brunei can give it away? Sulu Sultanate relinquished its territories to the Spanish under the Bases of Peace and Capitulation Agreement on 22/7/1878. Sulu has nothing left. Thus the 1878 Sulu-BNBC Agreement dated 22/1/1878 is null and void. The cession of Sabah from Sulu to PH in 1962 is invalid.

Many Malaysians and Filipinos does not know that on November 2, 1999 Malaysian Government submitted a document known as "Memorial of Malaysia" to UN proving that North Borneo, from Pandasan River to Sibuko, was under the sovereignty of Sulu Sultan before he ceded it to the Philippine Government. Page 29 and 31-35 of 1999 Memorial of Malaysia says, "In the 18th and throughout the 19th century until 1878, the coastal territory of north-east Borneo and its adjacent islands was a dependency of the Sultanate of Sulu, and something needs to be said accordingly about this Sultanate. The Sultanate was a substantial maritime power, exercising authority over a considerable number of islands lying between mainland Borneo and the Philippines, as well as over the Sulu 'Archipelago itself. In fact a great deal of the Sultan's revenue came from the region of north-eastern Borneo under the procurement system, being traded through Sulu with China, Singapore and elsewhere. Under the procurement system, trading in a whole range of commodities (birds' nests, trepang, etc.) occurred via Sulu, and local people made frequent visits there for this and other purposes. The position was described in some detail by James Hunt in "Some Particulars relating to Sulo, in the Archipelago of Felicia", first published in 1837. His account reads in part as follows (modem place names are underlined in brackets): "The province of Mangidora forms the north eastem part of Bomeo, extending itself towards the Su10 Archipelago in a long narrow point named Unsang, or cape Misfortune [Taniuna Unsang]...After refening to the Sulu port of Sabahan, Hunt goes on to describe points further south, including Tidong (where there was in 1837 "a small fort with seven or eight large guns under Sulo"). Then, in "the last province on Bomeo belonging to Sulo", which was named the province of Tirun, he mentions the Sibuko river, followed by other rivers dong the coast before arriving at Bulungan... The earlier history of Brunei sovereignty over the coasts of Bomeo was the reason why Baron von Overbeck in 1877-8 obtained two grants covering exactly the same territory, one from Brunei, one from Sulu. But by the 1870s it was agreed that Brunei exercised no effective authority on the north-east coast and that the Sultan of Sulu exercised control there (See Reports of Acting Consul-Genera Treacher in 1878). This control resulted from the allegiance of the local people and the appointment of their local chiefs by the Sultan. For example, Nakoda Gomba was the Sultan's Agent on the north-east coast of Borneo. When in 1875 a party from the Austrian corvette Friedrich was attacked in Sibuko Bay while collecting wood, it was to the Sultan of Sulu that Nakoda Gomba reported.4 In his statement Gomba notes that he is "the agent of the Sultan of Sulu charged with the superintendence of the trade on the north-east coast of Bomeo". As to the attack on the Austrians, he reports that: "The people who attacked the boat of the Austrian frigate are Bajows of Omadar [Ornadal], a small island near Pulo Gaya.. . They mistook the flag of the frigate and thought the ship belonged to their enemies, the Spaniards. Its full title as shown on the title page may be translated as follows: "General Atlas of the Netherlands Indies compiled from officia1 sources and with approval of the Government. Second edition with improved maps". It was edited by Baron Melvill van Carnbée and W.F. Versteeg, both officers of the Government of the Netherlands Indies. The map of the east coast of Borneo shows a boundary running westwards of an island named "P. Sebalik" [sic]. To the north of that line is the inscription "Gebied van Soeloe of Solokh" ("Dominion of Soeloe or Solokh"). To the north and well to the east of the boundary line depicted on the map are shown certain islands clustered around Darvel Bay, including specifically "P. Siparan" (Sipadan) and "P. Legetan" (Ligitan). The depiction of the islands and coastline here is highly inaccurate, by comparison with the areas further to the south where the Dutch had at that time some measure of control. But it is plain from the map that the islands named and the other territories to the north of the depicted boundary were considered in 1870 as belonging to Sulu, and were not claimed by the Netherlands in right of Bulungan or otherwise. (b) Following the Sultan of Sulu's 1878 grant to von Overbeck and Dent, questions were raised in the Dutch Parliament on the assertion of Dutch claims to control over Borneo. In reply the Dutch Minister of Colonies said: "The north-east and north-west portions of Borneo have never been under Our dominion. We have never disputed the authority of Spain over the dependencies of Sulu in the north-east portion of the island..." (c) This position was expressly reaffirmed in the Explanatory Memorandum to the Dutch Parliament which accompanied the 1891 Boundary Treaty. The two relevant Ministers reported that: "the Bajaus who live on the islands located at the North-Eastern Coast of Borneo, which belong to the Sultanate of Solok...

Ha ha ha ha ha ha. I repeat it to you again so that you can understand better because you only mentioned Part 2 Chapter 5(B) on Sulu territories on the east coast of North Borneo. You tend to be selective in your comments and omit others from the same reference. You only quoted Part 2 Chapter 5 (B) regarding the territories of Sulu on the east coast of Borneo from the Memorial of Malaysia 1999. But neglecting the others as stated below included in Part 2 from the Memorial of Malaysia 1999: Chapter 5 (D) is the recognition of Spain on the British rights over North Borneo. Chapter 5 (E) is the recognition of the Dutch on British rights over North Borneo. Chapter 5 (F) is the recognition of the USA on the British rights over North Borneo. Read the Carpenter Agreement 1915 and Anglo-US Border Convention 1930.

The status of Sulu as defined by this treaty resembled that of a protectorate/commercial/religious agreement. The internal administration of Sulu, its customs, laws, and religion were fully respected and were not subject to Spanish jurisdiction, confirmation, approval, or interference of any sort, except in matters pertaining to regulations for the use of firearms… The commercial relations of Sulu with foreign countries were not submitted to Spanish supervision or control outside of the territory occupied by the garrisons, and the sultan was empowered to collect duties from foreign merchants and ships trading with Maymbung, Siasi, and other places not occupied by the Spanish Government. Even the British Government has always asserted that Spain's control over Sulu and its dependencies was merely "nominal" that Spanish claims were merely "paper claims" and that sovereignty remains in the Sultan of Sulu. As of 1915 Carpenter Agreement, under agreement, the Sultan of Sulu agreed to relinquish it’s temporal powers over “American territory and dependencies,” but retained its sovereignty over North Borneo. As Governor Carpenter pointed out in clear language, in a communication to the Director of Non-Christian tribes on May 4, 1920, respecting the Sultan’s sovereign rights over North Borneo: “It is necessary however that there be clearly of official record the fact that the termination of temporal sovereignty of the Sultanate of Sulu within American territory is understood to be wholly without prejudice or effect as to the temporal sovereignty and ecclesiastical authority of the Sultanate beyond the territorial jurisdiction of the United states Government especially with reference to that portion of the island of Borneo which as a dependency of the Sultanate of Sulu is understood to be held under lease by the chartered company which which is known as the “British North Borneo Company.” And as American Governor General Francis B. Malaysia and the rest of Asian countries and especially ASEAN state members was cowards then and including Malaysia still a coward now. Malaysia is still licking China’s butt. Before Sabah was incorporated into Malaysia your government called in a vote and it was your government that resulted through intimidation blackmailed voters voting for Malaysia instead of the Philippines and Malaysia deported Sabah citizens in the Philippines even though they were born in Sabah and some of them were just working in Sabah.
