honestly, i'm 100% sure Venatur stole the assets, because someone who did nothing wrong would not just give about a million excuses for why they didn't steal something that very clearly is taken from something else (if they got them from somewhere else, atleast admit to that don't just vaguely say "but OTHER people might have stolen it and we took it from them") at this point, its a shit stolen asset flip game made by two thieves over a couple years

Sounds like a "clever" thief trying to hide his actions behind some pseudo-laws. what he's claiming is that other marketplace assets are using OHDs models and he's merely using these packs, but due to some totally real italian law he's not allowed to disclose the violating asset pack, bet if that's a real story the pack itself was made by the Venatur developer himself.

The audacity of (allegedly) stealing assets and then giving legal advice on how to not have your assets stolen.

If you've ever gotten a scam call and messed around and played with them, you know they do the same thing. If you act suspicious, they blame you, say they're just trying to help, and blame you some more. This "developer" responded to BlueDrake just like a scammer would. That tells me everything I need to know.

The fact that the meshes' normals are all screwed up in Venatur, just contributes to the "project using ripped assets" look lol.

A friend who was dumb enough to buy the game sent me some of the "disputed" asset files, and I compared them to OHD, it's a straight up copy, and the OHD files trace back to earlier than any venatur has, it's an open and shut case of who stole it, venatur did

There is enough free assest to use, and to buy. You can always use these assest as placeholders. If it is a game that is worth it for further development, then you replace the free assests with your own. But to steal assests from another developer is really really a low blow. I hope these guys get sued.

As an indie developer myself making a smaller budget game, this pisses me off.

I hope there is not a case where by doing like this these devs get all the attention, then replace the stolen IP and go through the process without a serious scratch into their financial basis still winning the attention. Otherwise this sets a dangerous example to future firms how to make games with getting all the attention to their game this way, then doing some maneuvers and all fine because they fixed it afterwards and then it's all okay. That would make stealing other companies assets even more valuable especially when your product is from begin walking on thin line, and at worst scenario can lead to even more problematic phenomenoms than few asset flips in for example early access genre.

Another thing that looks strange is the guns seem to be from an asset pack called low poly shooter pack, But they have smooth shading turned on which makes them look like they are made of clay

To answer the question of “If it wasn’t them that stole the assets, how did they get them?” It’s possible that a third party could have stolen them and placed the assets on a store somewhere. Not saying I believe these people, as I honestly have no idea if they’re telling the truth, but that’s a possibility.

I’ll never understand why anybody steals building assets. There’s tools out there for Blender that can procedurally generate buildings. Or generate them based on parameters. As for everything else, if the meshes match, or UV maps match, it’s a very open and shut case.

there was a case with a soulslike game that got into trouble because they purchased an animation pack in the unreal store, and those animations were 1:1 rips from Elden Rings' animations, maybe something like that happened here

This is completely wrong, they just dont want to put in the effort to either hire their own 3d assets, or at least buy the assets from others that sell, as a gamedeveloper i use either 3d marketplace assets or i hire 3d designers, i do however make my own 2d textures.. Stealing any of these is clearly wrong, me not making my own assets and downloading free ones or paying for them isn't prefferable, i want to eventually stray away from that and make them myself, but ateast im not fucking stealing

not defending Venatur, nor saying they are innocent. But, there is a chance that they did purchase an asset from the Epic Marketplace (in good faith) and that asset seller is the one who stole (and slightly modified) Bluedrake's assest. I have seen cases of stolen assets being sold in the Epic marketplace. If that's the case, Venatur should provide the link to the purchased assest that are included in the Bluedrake's screenshots, just to show they are not the ones who are stealing. In any case, they should also inform Epic (so that asset is not being sold anymore) and Venatur should remove those (assests) and replace it with other Epic marketplace assets.

i love how they linked to the modding kit (Which is where they probably got the assets) instead of the game itself.

That's why I tell every one making a game, "Use your own assets, you could be doing work for nothing, and if sued, it could cost you more." And to protect yourself there are little things you can do, like the "Trap Streets" method.

The way the first email read to me is they claim that they bought them off the marketplace, which fair enough, someone else might have ripped them and put them up for sale. But that still means you should absolutely remove them.

I read that part of the email to imply that someone took the assets, reskinned them, then put them on the marketplace for sale, and Italian guy got them from there.

Wonder what Big Fry thinks about Dark and Darker. Its basically an asset flip, but it slaps so hard. With all the drama behind the game it would be interesting to see a Big Fry vid on it.

The only other way to fix this issue of stealing assets is to actually just hide a signature of the *creator of said asset* into the asset, its going to be harder to find if you hide it somewhere and devs have been putting their signatures on stuff since the dawn of gaming. An example that comes to mind is from "Stalker Anomaly" bloodsuckers have some writing underneath their foot, reddit said it was a signature of the guy who made the model. So to avoid such issues maybe just place a signature somewhere obscure, otherwise some devs out there are just going to keep stealing from each other like dogs over some rotten meat.

Interesting topic as a conversation with my attorney led to Epic Games implemented a new tag on their resources because their ToS didn't cover things appropriately. I had to get my attorney involved to ensure that I wasn't misinterpreting what I was reading, and he conveyed to me that I was correct and confirmed with Epic that the wording was accurate. Literally a month later they bought another company, made the assets free, and never changed the asset publisher name to Epic Games; which their original ToS used as an exclusivity clause. So I reached out to my attorney again and told hm that I really need him to follow through as this time, they bought a character that I had already owned before they purchased that company. He called me later that night and said that he had spoken with Epic Games and they realized that they had some issues with the original ToS wording, so they updated it and have started to tag all exclusive content within the descriptions. Oddly enough that included the one I owned so I can no longer use that in my game haha. There is a high chance that they grabbed that SDK and just assumed, "I don't see an exclusivity tag like the ToS says so it's free-reign." They should probably have a pop-up before you purchase that shows third-party license agreements like Unity's asset store does, before allowing you to make that purchase.

The email response is so poorly worded it has to be on purpose. I think they're creating a bigger language barrier than actually exists to try and sweep this under the rug and point fingers elsewhere.

It of course got worse after this. The other important part is that it doesn't matter if they were aware the assets are stolen. You think a record label cares if you use a Beyonce song in your video that your friend said they made? Of course not. You still have to take it out because of copyright. This developer needs to own up and take the assets out rather than making threats. They should actually be banned from the store until they do.

Arma 3 had something similiar happen where TFL Went Public, all there Assets were leaked and Put on the Workshop for others to use, then Other people recreated there own Private Versions of those Assets, TFL Tried to DMCA, who they could, and you can't really do anything about that because It passed through who knows how many Hands, and there Authorship was wiped from those assets, people just started using them without even knowing, It practically Nullified the Ownership of the Assets since the Model's were Private, Released to the Public, where TFL then Released there own Public Release after they got leaked, and If they did find the Assets through another Entity or Asset, then there's a Gray zone that law can't really control

I understand developer side and I read their EULA and there is line where is forbidden to modify, reuse, resell and bla bla bla their assets, but on Epic Games page is this: "OHDcore is built on top of Unreal Engine 4. Utilize the tools and workflow your team is already familiar with in Unreal Engine, enhanced with the features of OHDcore. Don't reinvent the wheel, use OHDcore to speed up development of your next Unreal project." And that is a bit misleading, I know that what s in EULA stands, but their description is like, you can make your own game with our SDK, and part of SDK are also assets, so I can use them, but in EULA there is you cannot make your own project with OHDCore, because you cannot do anything with OHDCore. And that is bit misleading in my view for everybody who download that OHDCore. If it was intentional to steal assets, and it seems like it, based on dev response, it's dick move. But base on package description, loot's beginners can do this unintentional.

sounds like they spotted a legal loop hole in some license for the sdk or associated asset pack and are trying to warn you off with the "it won't stand up in court" and "there's nothing you can do about it" reply. OR someone else did and then moved the assets on to them. allowing them to deny any illegality in the process. "wasnt us, we bought them in good faith gov, i swear" in either way... the only dev team that would be at all comfortable with their continued use in this way would be scummy ones with few interests beyond making money and cutting corners. nasty situation. hope it gets resolved and bluedrake's team get what is owed them.

I think that is real scummy. The studio that makes Venatur should be hit with a cease and desist order. Hope this won't cost bluedrake and his team time and money that could have been spent on the game they are making for everyone for free!!

All I have to say is what would the Venatur Team do if their assets which they spent time and money on creating from scratch found carbon copies albeit with slight changes and retexturing in other games. It is one thing to use other assets as inspiration for your own creation and another doing this underhanded theft of IP.

I don't understand laws at all and I don't want to but blu have the full right to sue them ! On the other hand in my opinion all assets on the internet at least in the future time should be fully accessible without any restrictions ( as a natural evolution of the industry ) it's just ridiculous this whole marketing thing for things you can do in seconds with just one currently expensive instroment :) .

its clear, that they used assets that are used in another way before the game even exists. But if i am getting the Email conversation right, the vanature devs wanted to say, that the textures OHD uses are'nt their own. I think he wanted to tell Bluedrake, that the Devs building OHD have used already existing Models and he should check that. in my eyes he doesnt defend it, that they used already existing material. Is that okay to do so?? i think not? i dont know... and that they charged 40 bucks for this i think not... but i think its not making a bad game out of it, if the game is maybe good. If this what they used is legal, and they told the truth... then its ok in my eyes.. but i cant rate this. we'll see what will happen next. Thank you for sharing this :)

Is there a way to verify the assets are ripped that doesn't involve just looking at them? Like do they have hash values or certain checksums like programs do? Or is that hard to do?
