"Justice Antonin Scalia has written that "it is our moral heritage that one should not hate any human being or class of human beings." Judging by the things he has said in court or written in his legal opinions about gays and lesbians, he doesn't really mean it."*
This week, we will hear many arguments on the subject of gay marriage as Prop 8 and DOMA are discussed by the Supreme Court. But...we already know what Justice Scalia thinks, even if his arguments don't really mistake. What are the problems in the homophobic things Scalia's said? Cenk Uygur breaks it down.

+rationalguy Polygamy doesn't work for many many reasons - eg. the vast majority of men could never earn enough to pay social security benefits for several women and dozens of children. In our current legal system, which wife makes life or death decisions if the man is hospitalized?

+rationalguy It can not work the way our legal system is setup assuming on man can marry multiple women or on woman can marry multiple men how are they going to decide in the case of divorce how assets are split if one decides to divorce or multiple partners decide to divorce all the wifes or hubands related or next of kin to each other or just the ones that married the single person that being the man or the woman and the men brother husbands or the sister wifes? who has custody of the children that come from the marriage? are all the people involved parents to the children as in 3 wifes on father, I can go on and on and on about how these marriages can be very complicated and how about same-sex multiple unions where 3 or more men or women can marry now that same sex marriage is legal, wow it would be a nightmare what about when tax time comes along who can claim who geez!

What I find so fascinating that no one actually asks to break down "moral" - I mean I would like an outline of what is immoral and moral behaviour in their view and what I am doing that offends him morally so much - As that is not given I can not possibly treat it as a rational argument

I had my first GF when I was 13 years old, i was hated by a lot of people for it to (I am just now realizing how terrible middle/high school was for me) and that was like 17 years ago, I thought I things had changed, guess I was wrong😠 also, I'm a lesbian, why do I k on watching these videos that basically just hurt my feelings😭

Given that both Scalia and Thomas have openly stated that they want to overturn Miranda vs AZ (Dickerson, 2000), anything they say can be used against them in the court of public opinion.

The same claims could've been made about my upbringing. My parents got divorced, and you know what? I had two daddies too: a dad and a step-father and now a step-mother. I had a mother figure, and I had plenty of male influence around me. And while those circumstances led to my trust issues, they also led to an expansion of my immediate family. Would criminalizing divorce be fair? Is a child, a single mom, and then a step-dad and a step-sister not a family? Who's to say what a perfect family is?

i dont agree with the outcome of Scalia's decisions, but this segment ignores the reasons of why Scalia decided the way he did. Justices aren't stupid; they have concrete opinions which flow from rational understanding and principles. Scalia doesn't want judges to prescribe from the bench what laws ought to be constitutional and what laws ought not to be. Scalia does not believe in judicial activism because he believes it to be counter-majoritarian, which goes against the fundamental value of democracy (that the majority rules). Since judges are not elected by the people, but are appointed, Scalia believes that the legislature (those who are elected to represent the people) ought to decide which laws should be passed and which laws should not be. The judge's role is to figure out whether a law is constitutional, not to take sides in culture/moral wars. I'm not saying I agree with Scalia's decision; I just think this segment was not accurate with its interpretation of Scalia's decision.

Obama McCain Maybe you should learn to spell "tolereance" before telling others what it means. (If we see "edited" next your comment, we'll know you corrected it after the fact) There has been name-calling, bashing, rudeness and childish behavior on all sides of any argument since the beginning of time. Theatrically limping away and pouting doesn't help anything, nor does it create the impression you're above it. I don't believe in Santa (yes, I've come out, I'm an asantaclausist). If I say something rude enough to trigger your leave-it-to-beaver-caliber sensitivity, does that lend credence to the existence of Santa Claus? I believe the earth to be spherical (rather, an oblate spheroid, yes I know). Does this very comment of mine cause you to rethink the shape of the earth?

when looking at polls that ask "are you or have you ever been attracted to someone of the opposite sex" that number jumps to over 15%. when you ask "Have you ever been attracted to the opposite sex and acted on it" that number is about 10% of the people polled.

Scalia equates murder and homosexuality. They are quite different: Murder is an action. homosexuality is a thought. Murder is considered wicked because it causes terrible harm to another. Homosexuality is considered wicked because of an ancient Christian superstition that the presence of gay people caused earthquakes. Murder is a voluntary action. Homosexuality is an attribute you are born with, like left-handedness. Any harm from murder hurts the victim. Any harm from homosexuality hurts the "criminal." This all so basic, I can only imagine that Scalia's Christianity has derailed his legal mind on the matter. He wont to impose the Christian superstitious view of homosexuality into secular law.

Two mommies isn't a family, and two daddies isn't a family. The love and relationship I had with my father was much different than that from my mother. Children need a role model of each gender, and ideally, an extended family.

Not at all. In fact, I forgot to tell you yesterday that through learning from an authority in English, the term "politically correct/incorrect" is a term that isn't used in academic society today. In other words, using the term politically correct/incorrect is incorrect, as it is no longer efficient with its duty in modern time. Your second line I personally agree with, but it is sadly a subjective clause, and is to be the belief of every generation looking back at the recent decades.

"I'm not confusing anything, read the links" The physical reaction of moving away from something you don't want to engage in is not the same as "ew that's gross". Ex, we have an instinct to move away from a lion, for obvious reasons, we get frightened and adrenaline forces us to leave the situation. It's only afterwards we start to interpret what might have happened and how we will further view lions. Such as hating them or seeing them just as part of nature. Does this ring any bells? lol

There were quite a few groups of people who broke off from the church when polygamy was outlawed. They fled to mexico or hid their way of life. It's a lot more prevalent than you think. The things I said were taken directly from their traditional practices. In fact, if you do a little bit of research into the history of your church, you will find that polygamy was a very brutal practice even for its time.

(1/?) I understand perfectly well how the Constitution works. You are correct that the Constitution creates a federal government of enumerated powers. However, that does not mean that people have all the rights that are not restricted by the Constitution. To give an extreme example, the constitution doesn't say you can't murder or rape, but that doesn't mean that the people have that right to commit those crimes. More fundamentally, only the federal government is one of enumerated powers.

which means that there is not any adverse effect from incest except from the fact you can't get new traits input into the genepool so in the end it leads to a lack of diversification but that doesnt mean genetic deformities will be more likely

Marriage is a legal contract between TWO people. When you add more people, it greatly complicates the administration of benefits and other legal protections afforded by the marriage contract. This is especially true when the marriage contract is dissolved either by divorce or death of one of the partners in the legal contract between the TWO.

Scalia references Texas' opinion, not his own, in these statements. Scalia uses the word "its" but The Young Turk ignores that fact and gives attribution to Scalia and not Texas. Why?

They mentioned that in the hearing yesterday. Basically, polygamy brings about a lot more legal factors than two-person marriage. So, it's too complicated to be considered the same. Plus there's only a very very small minority who actually want polygamy legal. But if polygamy did gain traction, I suppose I would support it.

I'd also love to see these anti-religious hate crime statistics you are comparing to anti-gay hate crime statistics. Yes, exactly. He is confusing our mental interpretation of an invent with the physical reaction of 'moving away' or 'vomiting' etc. For example, a person may not see the homosexual act as something s/he would engage in and therefore simply move away from it, but a mental reaction such as, ewww that is gross, is taught to us.

There's also this thing called confirmation bias, where you look for things to confirm your beliefs without considering the things that go against your beliefs. Science, when done properly, works against the confirmation bias, giving us the closest thing to objective observation that we have. From the sounds of it, you are generalizing a few cases and you are demonstrating a textbook example of confirmation bias.

technically no, incest just has a higher chance of both parents having the same deformity as recessive trait. however from an evolutionary standpoint it makes sense to diversify the genetic pool. whilst people say that it leads to deformed offspring it can but it doesnt matter that they are siblings it matters more which genetic traits the individuals carry

Actually he is right and you are wrong the stats you are pointing out one are of phone polls which do not rep the entire country as well the question asked in that poll was " Do you identify yourself as being LGBT" of which 3.5% of the polled people said yes to.

Back in the medieval time there was a law which was dictating the people, married couples, how to have sex. They had to wear some sort of cloth which coverd all their body, except the head and the penis/vagina. The only way they were supposed to lay while having sex was straight face to face (missionary style and i think the man had to be on top, but i can't remeber exactly). Any kind of other position would be a crime (doggie style a crime, it was to similar to animals) And 1000 years later...

If a man knows and understands himself he will have confidence and strength, the woman will be attracted to his confidence and strength and she will be very glad to share with him all of her charms. As the Oracle of Delphi advised: "Know Thyself" or as Benjamin Franklin said: "Caesar deserves the triumphal chariot no more than the man who conquers himself." If you got woman problems it is because you foolishly picked the wrong woman, it really is a mans world, most guys just don't realize it.

Approving or rejecting marriages on a case by case basis would be incredibly bureaucratic and cost more money than it would save. 1) Actually many European nations have birth rates of 1.6-1.4/women. Even with massive benefits for childbearing couples(free nannies, tax breaks, etc.) their populations are literally dying out. They are only sustained by immigrants. 2) Agreed, adoption by gay couples should be considered.

Excellent comment. This guy has not read Galatians. Basically, Galatians tells Christians that they are free of Mosaic Law, and that all of the law is summed up in this: "Love thy neighbor as thyself".

Youre behind the times that magic 10% figure is no longer accepted. most recent results showed around 1% male homosexual, 1% lesbian and 0.5% bisexual. And as you are aware that is much more realistic.

This video was awesome! It's good to see someone actually pointing out that Scalia says that he is an originalist but he is a legislator from the bench. He is a phony who believes in Govt. opression to take away the rights of others in their private lives.

Basically, laws against it now, I think, are to prevent a family's economic depression. For example, a man having several wives and children but he cannot support them all on his income. Plus, some religious people just want to keep marriage like it has been.

you're forgetting the part about polygamy not being mandatory. as you mentioned earlier, a lot of people struggle with polygamous relationships - which is fine, because most people aren't up to the task of polygamous relationships. i can see how e.g. wealthy man can accumulate wives and marriage with a wealthy man can be used as an escape from poverty for some, but this happens even now, so it's not like you can do anything about it regardless of it being legal.

What finally changed my mind were the Justice's words, televised the other day, that why don't we just go ahead and outlaw elderly straight marriages since it's clear they won't be able to have any kids. Clearly, no one would speak in support of that, because no one assumes any straight marriage is for the purpose of just "procreating.” It's because 2 people are in Love (there is a tiny minority of catholics who think marriage is just for "kids") Why should it be any different for Gays?

Ok confession time. I'm actually bisexual so obviously I support same-sex marriage. You put out a challenge for a rational argument against same-sex marriage so I tried my best to see if I could come up with one and see if it holds any water. Clearly it doesn't....lol but I still think that the procreation one is the strongest argument (that's not saying much as you've shown).

civil rights movement and gay rights have more connections. Blacks were restricted from joining the military, FOR THE SAME REASONS AS GAYS. Black people couldn't get hired for certain jobs, as well as gay people (no gay teachers...), only recently was homosexuality added to the list of hate crimes. The civil rights movement and gay rights movement are similar in many ways in their fight for equality and equal protection under the law

Who's comparing gay rights to slavery? nobody, but the gay rights movement and the civil rights movement have gone through very similar things in history. Secure jobs, marriage, right to be in the military, hate crimes... there are many examples to show comparisons of the two movements.

It must be noted that traditional marriage is not solely religious. Traditional marriage has been apart of the secular movement as well. For thousands of years, since man dominance, every civilizations and tribe has practiced traditional marriage and prohibited homosexual actions or sexual engagements deemed immoral. As we know many of these tribes and civilizations have not been religious.

The morality of polygamy is irrelevant to this particular discussion. The issue at hand is that we have straight monogamy awarded certain benefits by law which are not applicable to homosexual monogamy and this is a blatant civil rights contravention as persons of equal standing are getting different benefits. This would also be the case if only straight polygamy, with certain benefits under law, was allowed but not homosexual polygamy.

Your link is NOT definitive by any measure and only POINTS towards it. So in this case, Ockham's Razor applies until there is an answer, and the only conclusion that can be drawn, until, further evidence contradicts it is that grossness is subjective. And BTW grossness is a perception, we may have a physical feeling toward dead tissue but our THOUGHTS towards it are subjective.

From a personal view having a dedicated parent in the child's corner does wonders, from a national average people who grow up in a two parent household are better off, and the funny thing is there is no significant findings in the study of child development that states that children that come from a same sex household are worse off that people from a "standard" household. Having parental figures that care that's the ticket not one man one woman.

I read the link, the point that you're missing is that grossness is PERCEPTION. How we VIEW something is TAUGHT to us. We may have physical reactions, such as vomiting if forced to eat rotten flesh, but how we THINK is subjective. Please tell me you understand that...Now if you wish to go down the road of name calling in order to make yourself seem more intelligent, please, by all means, carry on...I understand that sometimes people need that little boost to seem intelligent to themselves.

Right, I agree with everything you just said. That is the Social Contract. If a people choose that homosexuality is immoral (a view that is obviously absurd) then those people can choose not to afford gay couple the same tax breaks. If a people choose that there is nothing wrong with homosexuality, then great. The point is that the people get to choose this for themselves. 5 people, who have no special insight into morality, should not get to decide the issue on their own.

A slave is, and I quote directly form the New Oxford American Dictionary, "a person who is the legal property of another". Saying that someone can 'own' another person or condoning the buying/selling of a human being against his or her will, is supporting slavery, and it's disgusting.

Who is trying to do that? Churches are a private organization and have the right to their traditions and all marriages are approved by a priest, pastor, etc. for straight marriages as well. no one that I have heard has said we need to force church into marring gay people. but the government should be allowed to discriminate against civil unions based on their own religious dogma.

i have heard some liberal Christians justify gay marriage by pointing out that "as you would lay with a woman" part. they claim that a man laying with a man is not whats bad, but rather laying with a man as you would lay with a woman. which they take as a reference to the historical male-female power dynamic. thats 1 of the problems with the biblical canon. its so fuzzy on details and so easy to interpret in so many different ways, that you take almost anything from it. book o' multiple choice.

People arguing over what is written in the books by unknown authors, supposedly inspired by their all powerful father figure who is mysteriously absent (then again looking at his "creations" maybe he is ashamed and moved onto a new project). Others not understanding why two (or more) consenting parties engaging in a sex act is different then two (or more) parties engaging in non-consensual sex. What a giant cluster-fuck this has turned into.

I just had a crazy realization. In 50 years from now, long when justice Scalia is dead and people don't remember who George bush was, I will be telling my grandkids stories about how when I was a child, being gay was not normal. Like how I get a kick out of watching Betty Boop's racist depiction of blacks, They will watch old videos of Bill O'Reilly and Scalia, and think about how horrible those people were and how ridiculous and primitive society was for letting them say these things in public.

As a devout Catholic Scalia should recuse himself from the case, as a practicing follower of his faith it would be impossible for him to give an impartial ruling on fact alone.

You must not hear very well either. 1:10 "gay people are the equivalent of murderers". Here he says that Scalia implied gay people were like murderers - saying it outright - which Scalia did not. His acknowledgement of the fact that it's an analogy doesn't erase what he said half a sentence before, which was utter shit.

Totally agree. How we think and perceive is taught to us, we may well indeed and do have, physical reactions that are genetically controlled such as mating, vomiting if rotten flesh is eaten etc. But how we view those things is taught to us...without the perception of it we we put it down to a bad experience, remember not to do it again and simply walk away form it.

Who is comparing or diminishing what happened during slavery? Nobody so talking about specifics slavery doesn't further any point, but talking about the civil rights movement of the 1960s, there is a comparison. I'm black and gay, so spare me the lecture on slavery and racism. I've been through both racism and homophobia in my life, they're very similar.

There may be a genetic component to discrimination against anyone who is different. As little kids we may pick on certain other kids for all kinds of reasons adults recognize as totally irrational and cruel, but we (hopefully) grow out of it. Those who don't manage to grow out of it we rightly call sociopaths, prejudiced, biased, racist, etc. Just because something is 'natural' or genetically influenced, doesn't automatically make it desirable or justified. This should be obvious.

Agreed. Well, there is evidence that some of the material in the Gospels originates from around the time of the Apostles, but not necessarily all of it. Even when I was a Christian I felt that Christians should feel no compulsion to adhere to the Nicean canon. Why would the members of the Council of Nicea be any more qualified than any other Christian to determine what is "from God" and what isn't? I figured if God wants people to reach out he'll let their heart know what sounds true or false.

Interesting how only one person recognized that I was ripping off Morgan Freeman... And frankly, I don't think it's fair to count "homophobia" among the phobias. Some people have phobias that cause serious, debilitating physical reactions. Scalia does not have this kind of reaction.

uh, no. sorry, I can't seem to find it. But if you are arguing that the government has no right passing laws about sex, that is absurd. There are all types of laws about sex that make perfect sense. (Ex: consent requirements, age requirements, location requirements, anti-prostitution laws, etc.).

It doesn't say any of that anywhere in the constitution. That comes from the Declaration of Independence. You should read the Constitution before arguing about it.
