As an IT manager, I'm impressed by the IT director not rolling over and doing what his boss wanted. That most certainly would result in job termination, but it kept him out of trouble with the DOJ and makes him desirable to certain types of corporations.

@@andiward7068 Whether or not the argument is "correct," it's still a tacit admission of guilt. If you didn't do anything wrong, there is no reason to delete security camera footage sooner than scheduled.

You need full admin access to delete files, and permission from senior level IT people. Servers usually have limited admin access to prevent accidental data loss.

I think what we're learning here is that Trump is always one step ahead. Without the surveillance video there is no crime. Honestly, this case is getting desperate. Federal prosecutors would be advised to not charge a future president. Trump always wins in the end.

Yep, "get those instructions in writing" is very sound advice. I work in finance and I once had a client who asked me to engage in some fraudulent activity (falsification of records) which he didn't consider to be a big deal - other than the fact that I'm not that type of person, we all know that any time someone is busted engaging in financial shenanigans they blame the accountant or whoever and try to act all ignorant and blameless. So, after trying and failing to dissuade him from doing the dodgy from an ethical point of view, I simply told him that I would be happy to follow any instructions provided to me in writing. Obviously, that wouldn't protect me from any punishment for my role, but that wasn't the point of the request: needless to say, the instructions never came and the records remained as they should be. And I extricated myself from that job as soon as I could thereafter...

I don't see how his crimes would amount to a life sentence, but what I don't understand is why this guy hasn't been remanded into custody to prevent him from further interfearing with the investigation. I'm sure if I had done only a fraction of what he alledgedly did to make evidence disapear, I'd be awaiting my trial in some county jail, probably in solitary...

@@Bird_Dog00 Trump is only 3 years younger than Biden, and based on actuarial tables, Biden has a longer life span. Petty larceny might be a life sentence for Trump. And most of Trump’s crimes carry 5 to 20 year sentences depending on the crime. The upcoming GA stuff could be harder to prove but Trump is just so blatant. There’s also zero doubt in my mind that despite the 5 or so things being looked into, he’s gotten away with 100s of things since 2015. We can kiss this country goodbye if Dems don’t sweep in 2024, 2026 and 2028.

I once worked in a regulated industry as the IT director. One of the board members asked me to direct all their incoming emails to their Hotmail account and delete all his mail. I refused. A few weeks later I was fired, I did the right thing. I can't say why (but you can guess). But it was the right thing.

They are making the connection to Hillary Clinton's private server which was wiped AFTER a subpoena had been issued. Where the equivalence breaks down is that in Hillary's case the government was unable to show she was even aware this was happening. They gave the IT tech who actually performed the wipe immunity and he did not link anything back to her. Either she hires more loyal people who lie for her under oath or she genuinely was not aware what was happening. Whatever the case is, the government lacked the evidence to charge her with any kind of destruction of evidence.

After all, we still have people who think that Trump never condemned white supremacists and called them "very fine people" despite the fact that we have have literal unedited footage - right here on KZfaq _still_ publicly available for everyone to access - from news outlets/affiliates like ABC and NBC where in the span of under five minutes he condemned white supremacists multiple times. Those videos have him saying clear as day "there were very fine people on both sides, very fine people, and I'm not talking about those Neo-Nazis who came later"; even better, one of the reporters kept interrupting Trump and demanded that he condemn white supremacists, and he did. ~ ~ But who am I kidding, that's physical evidence, hard visceral proof that is easily found with just a couple little search inputs. This channel and comments section has proven time and time again that they don't give a single f&%$ about facts, especially when said facts conflict with what the rest of the sheep here bleat.

When I was in 9th grade I had lost my Chemistry text book. I was so scared my father would be incredibly upset because they were expensive but by some good fortune I had found someone else's book under a desk in the classroom a few days later. I spent hours changing the registration numbers in the book and then when the day came to return the book the teacher noted the numbers didn't match. "Oh well, must have noted it wrong. Next!" The best advice in here: if asked to delete files at work, ask for that in writing. I’ll add: archive a copy of your mailbox offsite, unless prohibited by company policy or governing laws. I’m in security, I make sure I export my mailbox at periodic intervals, IT departments have a tendency of “accidentally” losing them, and all known backups. DAMHIK.

@@haxie4516 Correct, in places that don't allow you to save emails externally they usually don't allow logging in from non-authorised devices. I work in a heavily regulated industry and the amount of hoops I have to jump through even to log into the system on a company device when outside their network is insane, it would be next to impossible to log into any of their systems and access my emails on a non-company device. All my emails are recorded, all my im chats are recorded, some of my voice chats are recorded and those policies are regularly reviewed by both internal teams and external regulators. If I tried to get internal emails to an outside location I would probably be fired practically on the spot, the company would likely be investigated and fined and I would be barred from working any regulated role in the industry.

When he says, "I can't," I think he means it quite literally. It wouldn't be much of a security system if the IT director could log in and violate chain of custody. This would probably have to be done by the system owner, not the administrator. Also, deletion does not remove data. Wiping does. Finally, nobody said anything about destroying backups.

I'd always heard that for criminals, the only time you should destroy evidence is if the penalty for your alleged crimes would be worse than getting caught trying to cover them up. It's a risk/reward sort of thing. For us normal folks, we can just go by the ol' adage "Don't be a criminal".

In theory, though in practice "worse" can a difficult thing to measure. Years in prison is one of those things were, to many, 0 to 5 is a worse escalation than 5 to 20, so the cost benefit often goes out the window and the only metric that stands up is likelihood of getting caught. That's the reason many escalate to murder in an attempt to cover up a crime much less severe than murder, they are simply driven by a desire to get away with it above all else.

It also matters how *effectively* you can destroy the evidence. Digital records, for example, are notoriously hard to completely erase, especially if they were hooked up to an external server, cloud storage, or some kind of backup system. Even when a computer system has been effectively damaged beyond the point of usability, it may still be possible to recover data from it.

I am willing to bet that the IT director could have easily erased the footage but knew what was up and lied saying he couldn't. If he simply said "WONT", they get someone else to do it. If he says "CANT" then they have to come up with a different plan. Hence the "accidental" flooding. Unless I have the timeline wrong that is.

and it wasnt even a good plan.. i am sure water damage wont affect the data in any significant way.. it will break the computers, sure. but just let the drives dry out and connect them to a working forensic computer and you can still get it all probably. and if that fails i dont think the bill for the data recovery from the broken drives is that significant.

@@unitrader403 Depends on if it's stored on SSD or HDD. HDD uses magnetized discs to store data. SSDs work more like RAM (but it doesn't clear data when the computer shuts down for any reason). But water damage affects them differently. For an HDD you can retrieve the discs and read the data off of them (because the water doesn't demagnetize the discs), but for an SSD, it's likely that a lot of data has been corrupted by the short circuit caused by the water. It will have "closed the loop" on a lot of reset or overwrite switches. So 0s will have been changed to 1s and 1s will have been changed to 0s at random. So even if you can dry it enough to turn it back on, it's not guaranteed that the data will be recoverable. Of course, if the computer it was stored on wasn't powered at the time of the water damage, it's possible that the data is still recoverable.

I work in IT. I would never obey an unlawful order to delete evidence, especially when there is a previous indictment involved hanging over my boss's head. At that point I'd be dusting off and updating the ol' resume but I would never put myself in a position to be working for someone as vile as Trump to begin with. That said, audit and system logs are very difficult to circumvent on a server, and tampering with them would be obvious.

"Can you put that in writing" served me in good stead. I was on the support staff at an outsourced provider when win95 launched. My boss tasked me with "checking around to see what the limitations are of the firewall." I had him email that to me, I fowarded his email to my personal email addess and I also printed it out.

"Can you put this in writing" also works to get scummy bosses to back off of something stupid. I worked for a live in mental health facility, and I was the only member of staff watching and, in turn, responsible for over 30 adult patients, many of whom had violent offenses. This, in and of itself, was illegal. One day, a patient walked off campus and I tried to report it. My manager blocked the report, saying that they had a deal with this patient where he could occasionally leave campus to go buy snacks or whatever. I asked to get that on writing and they back pedaled hard. I quit that night. F that place. They're going to get someone killed someday.

I agree that asking for something in writing is very helpful in a lot of types of jobs and has come in handy, but I also have been in food service where "I don't want to do this thing that violates health code" "Okay, you're fired. Tell the new guy to do it on your way out" was a fairly normal occurance

Considering just how many have directly removed themselves from the case or refused to take it, any left to actually take the case would either only put in minimal effort or likely would be polishing up their resume so they can land a job in food service/Wal-Mart after this because they'd never get hired again in law after the legal suicide that is trying to defend a client so inept that the Crime-Fraud exception has been used against him twice *and* tried to destroy evidence, things that would normally lead to terminating sanctions.

Be amazed at how rigid the system is, despite the assualts on it. The syatem will learn from Trump. He is not the brain, he is an agent of the time. I think what we're learning here is that Trump is always one step ahead. Without the surveillance video there is no crime. Honestly, this case is getting desperate. Federal prosecutors would be advised to not charge a future president. Trump always wins in the end.

I learned working in IT a long time ago , always get email confirmation when you are asked to do something that bypasses normal procedures and cc in multiple people, explain the risks and concerns, set your email to archive emails locally so if someone has access to delete the email you still retain a copy.

I was fired 3 days after asking my employer to write down that they wanted funds from a grant for X be used for a task Y despite them previously saying that y was different to X in order to get the grant. But I'm sure those things aren't related.
