Mine got transferred to nebraska center in feb 2018 so glad that happened and i got DA In jun 2019 . March 2015 4 years of waiting!

@@karlabarcomb4613 i used uscis case status. You just enter your receipt and they keep track of it you just have to check whenever you want to find out something new on your case.

I'm 22 and I applied for the U-visa almost 3-4 years ago and every time I ask my lawyers about it, they don't say anything or they simply tell me to keep waiting. it's so frustrating but I'm very aware that I'm not the only one who applied so I guess this helps get some perspective on things. they should really change the amount of visas that they give out every year since a lot more people are becoming aware of it and maybe hire more people so that things can move a lot quicker. anyway, thank you!

It's the exact same thing my lawyer keeps telling me to wait, I haven't even received any apart from my biometric receipt, so I know how you feel bro.

Alexia i applied in march 2015 . I got put in Waitlist on jun 2019! I am now waiting on my EAD ! It took 4 years. Be patient

Hi, I am a victim of gunshot incident happened on April 9, 2020. I was shot 6 bullets, one in each leg and 4 in abdomen. I am severely injured and police took me to hospital. I was in comma for 6 days. I have undergone multiple surgeries and got discharged from hospital after 50 days, but still not completely recovered. As the injuries are severe, couple of surgeries are planned after 6 months. Meanwhile, I am planning to file for U-Visa. Please let me know the chances of getting the visa and how many days it might take to get the visa.

Hello, Sharon. It's 2020 and our case was filed on June 2015. Vermont says they are reviewing cases from October 2015, but I see sometimes on the website they can actually go back and forward with the months they are reviewing. Should I get worried about the status or it's just a matter of time on this year to finally have a decision. I hope you can answer this question. I'm worried already. I got a work permit and a social security number that says for work only , I go to college as well do I have to apply for financial aid using the regular FAFSA application or do I keep using DACA?

Hi I was a victim of abuse about 10 years ago but will I still qualify for a u visa now? I’m planning to file police reports soon. Also I’ve been hearing rumors that the u visas will be canceled or put on hold?

Can you please tell me without detail police report I can send u visa certification to law enforcement .. because they didn't give me police report in details. This is the robarry case.

Apart from the biometric receipt was there anything else that I was supposed to get from UCIS?

You should have a receipt for each form filed: I918 (U-visa) I-918A (one for each family member you filed for, if you filed for a family member) I-192 (if you requested a waiver), and I-765 (if you filed to get a work permit once you're placed in deferrd action). After you get those receipts (usually within the next couple of weeks) you should get an appointment notice for your biometrics. After you go to your appointment, you won't hear from immigration until they make a decision on your case. They might however send a notice if they transfer your case elsewhere. So short answer, no, you shouldn't expect anything (unless your case is transferred) until they make a decision on your case.

Hi Sharon, This is Mahesh, I was a victim of crime back in 2016 and the police approved the certification after 30 months.I am currently on H1b which is expiring next year. I have a few questions that would mind answering them. #1 If I file my U visa next month, Can I travel out of the country while my case is pending? #2 After H1b which is expiring next year, how I can work while my case is pending with the USCIS. Do I need file any work permit or I can file my H1b extension #3 Please correct me on this - If my U Visa application is approved, I shouldn't be traveling out of the country for three to four years until I get a green card. what are the options available in case if I need to travel out of the country for an emergency. Could you please answer my above queries. Once again thank you very much.

My husband was a victim of an aggravated robbery in 2016 and fully cooperated with the police. I spoke with an attorney and told me that he would charge me $1,000.00 to assist me with obtaining the certification and recommended that I get the certification on my own. Is possible that I can request the u visa certification prose? Or is it best to take the attorney route? Thank you in advance!

Hi Josania, Great question! You can certainly get the certification on your own, however, in certain cases I don't recommend it, especially in cases involving "robbery". An attorney can help prepare the certification in a certain way so as to make clear that based on the facts of the criminal incident, the incident can also be considered a crime that qualifies for a U-visa. A "robbery" in and of itself is not a qualifying crime. I hope this answers your question.

Hi Sharon, My wife got her U-visa approval on February'18 and based on her approval my lawyer had filed for my U visa using I-918 A and also filed for work permit using I-765 back in August'18. No update since then and their website shows the following, "On August XX, 2018, we received your Form I-765, Application for Employment Authorization............". Recently I came to know that if you are eligible for 2 year work permit under C(14) if your case is under DA waiting list but has to file separately than the original I-765. I asked my lawyer about this since EAD receipt that USCIS sent has class requested: A20 which i assume would only be issued once my U visa is approved. My question to you is, should i need to file for another I-765 to make sure it falls under C(14) or USCIS will process the earlier one under C(14) even-though the receipt shows it under A20 ? Any help would be appreciated. Thank you for helping us out in all the means. You Rock !!

Hello, my mother is filling for a U-Visa and I have a couple of questions: 1. Once her documents are submitted to USCIS, what is the waiting time for her to be able to get her license? 2. After obtaining her U-Visa, can she travel outside the U.S? Or does she have to become a resident first? Based on the answer to the question, how long does she have to wait to see her family in her home country. i.e: travel outside the U.S?

Hello, 1. Drivers license regulations are state law so the answer to this question depends on the state you live in. However, she should be able to get a drivers license once she gets her work permit and social security number and for that she’ll have to wait for her case to get processed and approved. As I explain in the video, processing times are at about 4 years from time of filing (USCIS is currently processing cases filed in October 2014). 2. Can she travel outside the US once she has a U VISA? I do not recommend it. There are ways she may be able to get a humanitarian based permission to renter but again I’d only use it for a real emergency. If she leaves the US without permission she may have problems at the border or later when she tries to become a resident. Once she becomes a resident she will be in a much safer position to travel so it may be worth the wait. I hope I have answered your questions!

Jennifer Arriola how long it takes to be approved to be a resident will depend on the processing times at the time that your mom files for residency. What I can tell you is that she will be eligible to file for residency on her 3rd anniversary with U visa. Please note that she CANNOT file any later than year 4 with u visa. So she must file for residency between years 3 & 4 of being in U Visa status.

Do i need video proofs that i was a victim? Or will the video footage will make my chances strong? Because i was robbed at a gun point and was physically hurt on my head and also have a police report

Hello, for a U-visa you do not NEED a video. In fact, USCIS will not accept any videos as part of the review process. If there is a video however, I recommend you get it transcribed. I hope this helps, let me know if you have any other questions!

I thought a video proof would actually expand my chances of approval of my u visa but should i attach my footage just incase? So that it shows its legit

Like I said above, Immigration will not accept your video. You can however hire someone to transcribe the video for you and then send the transcript as evidence of the incident. As proof of what occurred you will certainly want to send the police report and most definitely the required U-visa certification (signed by a certified law enforcement officer). As proof that you suffered physical, emotional, psychological harm you can also include any evidence of medical reports that resulted from the criminal incident, pictures of your injuries, proof that you went to therapy because of the incident, etc. You will also want to submit a declaration, that is a statement under penalty of perjury, describing what occurred, how you cooperated with law enforcement, the harm that you suffered as a result of the criminal incident, and how a denial and relocating to your home country would worsen the harm you have suffered.
