You might be entitled to compensation if you've been unfairly dismissed from work, but how much should you expect to receive? In this video, we explain the basics of unfair dismissal and how much you might get in an unfair dismissal settlement that’s negotiated out of court, as well as in an employment tribunal. We also look at the impact on any unfair dismissal claim of you getting a new job.
Chapter 1 explains what the main differences between fair and unfair dismissal are and how long you have to have worked for your employer before you can make a claim for unfair dismissal.
Chapter 2 looks at the option of negotiating a settlement agreement with your employer. We set out some of the strategies and tactics you can adopt in negotiating a settlement agreement, with examples of how much you should ask for when you start negotiating and options such as payment in lieu of notice.
Chapter 3 deals with what compensation you would be likely to get at an employment tribunal if you couldn’t settle with your employer out of court. It explains the two financial elements of an award made by a tribunal (called the ‘basic’ and ‘compensatory’ awards), how these are calculated and what their maximum limits are.
Chapter 4 considers the effect on unfair dismissal compensation of getting another job. So, if you have been dismissed and start a new job, you will only usually be compensated for the period between jobs. A key issue is when you have to tell your employer about any new job offer.
