**PART TWO: • What is Up with Don He... **
🎵Don Henley has recently been in the news for an Eagles lawsuit involving stealing lyrics. But Don Henley has been coming after up and coming artists (and existing artists) for recent years on KZfaq, Tik Tok, Instagram, etc. trying to prevent his music from being covered. Where is all of this coming from, though? Did Don Henley just wake up one day and decide to be this driving force? The truth is, Don Henley is no stranger to the legal system. His exposure with the law goes back to 1980, of course, when he as arrested for supplying dr*gs to an underage girl - but the lawsuits just kept coming in his life after that. Whether he was the one suing someone else, or whether he was the one being sued...it seems as though Don Henley has lived most of his life involved in a lawsuit. WARNING: THIS VIDEO MAY CHANGE YOUR OPINION ON DON HENLEY FOREVER. Be sure to subscribe to the channel and hit the bell icon, because this is Part 1 of a 2 part Don Henley Series. In the next episode, we dig into the biggest lawsuit he'd face to date and also discuss his relentless efforts to drive artists away from covering The Eagles music.🎵

I really appreciated your research you put into your video. Something you may have missed though? When Henley and the Eagles came into town play, he demanded a significant amount of more money than he initially agreed upon to play, or he and the band wouldn’t perform. I got the impression that Henley was the one that controlled the group, and he made the decisions. This happened in the mid 70’s.

Please double check dates and research. Don Felder JOINED the Eagles in 1974. He joined just as the band was forming their official corporation to receive all income from concerts and merch. This was different from royalties from music publishing. This is all covered in great detail in Don Felder's book. It is NOT as detailed in the documentary The History Of The Eagles. That documentary is very biased as it was controlled by Henley and Frey. Don Felder was an EQUAL shareholder of Eagles LTD starting in 74. Joe Walsh and Timothy B. Schmit were hired employees of the band. They are handsomely paid but aren't shareholders. After the Eagles stopped recording and touring in 80, the company remained without the band actively making new music or performing. In the early 90s there were multiple attempts to reunite the band with Felder, Schmit and Walsh starting a recording project with Henley and Frey being the holdouts. When Henley and Frey decided it was time to reunite, they presented contracts to the rest. Felder, Henley and Frey were still equal shareholders in Eagles LTD. But they wanted Felder to be a contract band member for the 94 tour as a salaried employee just as Walsh and Schmit. The money was great but signing on for the contract position on the tour didn't dissolve his shares in the company. So when Don Felder decided to conduct his own audit of the company - which he was legally allowed as a shareholder, Frey and Henley voted him out of the company and fired him in 2001. Henley was so childish about this that he attempted to break copyright and publishing laws. When a double CD greatest hits Eagles collection was released, he attempted to change the song writing credits to push Felder's name last. When the songs were published, the writing credit had listed Felder's name first on songs he originated (Felder, Henley, Frey), such as Hotel California and Victim of love. But legal action had to be taken to restore the original and legal credits. Felder sued over being fired and they settled with Felder with an undisclosed amount. But watching Henley refer to Don as "Mr. Felder" with an attitude on the History Of the Eagles, you can bet that Don Felder was the big winner in that settlement. They also filed suit to block Felder's biography. Ultimately, the book did get released and it is a must read if you want more details and to hear his side of everything.

Yeah I’m not sure these guys wrote anything. The wrecking crew laid down most of the tracks to most of the albums we knew of back in the day but that info has been closely held for decades. It doesn’t help that according to Bernard Purdie the Beatles had four drummers and “Ringo wasn’t one of them” so, unrelated example but all bets are off with all these bands now as far as I’m concerned. They said the Sex Pistols were the “great swindle” but I don’t think they were alone.

Henley lip syncing oxymoronic as he pushed Randy Meisner out of the band because he refused to sing the high notes in Taking it To The Limit, anymore. Speaking of Meisner, the Eagles never credited Poco for inspiration. They just stole members Miesner and schmidt. A lot of bad blood there. I personally didn't like the band for singing to the common man, but charged the very highest ticket prices in the industry. Most happy Felder won his law suit. But feel sorry how badly Henly treated Walsh and Schimdt.

I saw him in concert about 10 years ago. The audience begged for an encore, Henley was in his limo racing out of town. He really showed his disdain for the crowd throughout the show. His voice was very scratchy and he explained he did a show in Las Vegas the previous night. Talk about getting the leftovers. A friend who was on the security team said he was the most arrogant person he ever dealt with.

Don Henly is a dick. I presume he'll probably sue me for that, so let me add the disclosure that I'm stating my personal opinion. He's the reason that people can't use any Eagles music under the fair use act on KZfaq as Henly has people scan KZfaq for it and issue them strikes & take down requests. (Henly and Rick Beato testified to this in front of a congressional committee). This only serves to harm the propagation and adoption of Eagles music to new audiences. And now we are finding out that Henly lip-synches his concerts.

Enjoyed your description of Mr. Henley. I had a lot of admiration for the Eagles back in the day, but have virtually lost all respect for them. One fact you might want to correct: Don Felder JOINED the Eagles in 1974 and played guitar to help rock out the Eagles. His run in with Glen Frey at a political rally is what broke them up in 1980. Felder was officially fired from the Eagles in 2001. Felder's book Heaven and Hell is a good read that fills in a lot of gaps in what Henly and Frey reported. There are always 2 sides to every story and somewhere in between, the truth.

Please report on the funniest music industry lawsuit. John Fogerty was the primary songwriter and lead vocalist of Credence Clearwater Revival (CCR). Fogerty and some band members started playing with each other in 1959. 1. CCR became huge in the late 60s. 2. Because of those nasty irreconcilable differences, Fogerty left in 1971/72. 3. The other members released a CCR album in Apr 1972, some songs written by Fogerty. It bombed. 4. Fogerty released a solo album in 1973 and then toured solo as John Fogerty, no reference to CCR. Now the funny part. 5. The other members sued Fogerty stating that his solo album's songs sounded too much like CCR. And he played CCR on tour. 6. When the judge reviewed the lawsuit, he immediately threw it out. He said a person cannot imitate himself.

As a former music publishing executive I have an issue with the suit involving other artists covering Don Henley's or any other of the Eagles songs. Once a song is recorded and released any other artist is entitled to record that song under what is known as " fair use", as long as they don't change or rewrite the words or music and a license is automaticly granted to the 2nd artist.

Have you ever seen Double Jeopardy? Loved it but I also had a major crush on Ashley Judd. Great podcast. I distinctly remember driving through Coldwater Canyon, which was basically a shortcut to the Sunset Strip and it was also where The Eagles lived during the mid to late 70s. Wow. A nonstop party, to say in the least. People coming in and out, but mostly young women. Groupies! They also played a big role in the rock n' roll music scene back in the day. Anyhow, I used to love Don Henley and the Eagles; probably saw them play live a handful of times and loved their shows, yet this was before finding out that Henley was a money-grubbing capitalist. About 15 years ago you couldn't find any Eagles songs or Henley's solo work on KZfaq while most major rock groups had no problem posting their music on the platform. But intellectual property seemed to supersede all else. Looking forward to your next chapter.

I was even more surprised when I got blank stares when I mentioned Don Henley, you know, the drummer for The Eagles? Sang "Boys of Summer...?" I remember when social media was heating up and fans were sharing videos, photos, or covers of his/their songs and he was suing everyone everywhere for takedowns. I'm pretty sure the result of that was wiping out the legacy and awareness of their work. Congrats, Don. You played yourself. I don't even hear your music at the grocery store. On the one hand it limits how much the band can get sued for (in theory, any decent lawyer is going to find numerous times a band pierces the veil) but on the other, corporations do not have the limits on contract duration that personal actors do. edit: and no musician even gets to the point of being able to sign a contract or not without signing a statement of intent to sign a contract which prohibits the artist from recording with anyone else.

Listening to him talk (preach) in the concerts I've attended in the past. He reminded me of an arrogant Jackson Browne. Browne was preachy about the environment and his causes as is Henley. But unlike Henley Jackson Browne comes off as a dorky left winger whereas Henley comes off as a self important narcissist left winger.

Back in 1980 I was working alone after hours in our company's conference room, when in walks Henley, Jackson Browne and our company owner. They were there to discuss some business and I'd just returned from Hawaii where the Eagles had performed not more than 2 weeks prior. I commented on that and Henley was very conversational and friendly. He didn't have to be bothered with a starstruck 20-year old struggling musician, but he carried on a one-on-one conversation with me for about 10 minutes. Not an asshole in the least. I also met Jackson (twice) some years later and in fact, performed with him at a benefit concert. You couldn't meet a nicer guy.

Everyone always forgets about Randy Meisner. He was one of the original Eagles too. He died recently. From what I got from watching the whole Eagles debacle in real time is that Don Henley is an ass. No one should work with him because his ego is bigger than any band. And yes, I got that information from former members of the Eagles.
