At that point in Star Wars history, all of the galaxy (with some exceptions) was part of the Republic, so by extension every conflict was a civil war.

I think the Separatist worlds were able to legally leave the Republic; however, the process to do so would have taken an unreasonably long time. It's been mentioned many times that the Republic by the time of the Prequel trilogy was in an almost gridlock state when it came to getting things done concerning the Senate and even worse when it came to the courts. The Separatist worlds would likely have been able to legally succeed from the Republic, but such a process would have likely taken many years, if not decades for them to be 100% free. And of course most Separatist worlds wanted to leave almost immediately and didn't care about the formal process which would have taken far too long in their eyes, which is why they just straight up left in a manner that was illegitimate legally in the Republic's perspective.

I agree that there was definitely some mechanism for leaving and that it would've taken a while to litigate. Not sure the Republic would've ever let them leave though, but it's hard to say without knowing their Constitution and what the secession mechanism requires.

I can see many Core world senators coming up with rules stating that some worlds trying to succeed are too vital to the economy of the Republic, had too much central government investments to leave, or something like that to where they wouldn't be able to leave; or just straight up drag the process out so long that the Separatist world would just give up before letting it finish.

A lot of people complain about all the talk of trade routes and tax policy dragging down the prequel plot, but I actually kinda like it. It's nice to have a movie conflict started by something boring and rational and not "those guys are evil".

There is a scene in the Clone Wars series where the Separatist Senate holds a vote to open peace negotiations with the Galactic Republic. The phrase "This is a democracy, and unlike the Republic, corporations do not rule us!" was uttered.

And then immediately afterwards, Dooku had Senator Bonteri and the most vocal senators voting for peace negotiations murdered with stolen Republic weapons to escalate the war further.

It should be noted that at a point in the Clone Wars television show (the newer one) that both sides had become weary of the war and were willing to sue for peace. Both sides actually spoke of it in earnest until Palpatine orchestrated a terrorist attack on the Republic.

Palpatine was taking advantage of resentments that the Sith had spent a thousand years slowly coaxing into existence through manipulation of the Senate and local politics. Palpatine was merely lucky enough to be inducted into the Sith when the plans were finally near their end point. Although he royally fucked up by altering the Siths grand plan to speed things up and turn the Republic into an Empire. Plagius and his master before him intended to ease the Republic into a federation of states ruled by groups like the banking clan so as to create a more stable and prosperous republic. His goals were not only to slowly make the Jedi lose the publics love, but to eventually reveal the existence of the Sith and use the Jedis reaction to the Sith as a justification for forcibly disbanding an intolerable religious terrorist organisation. He intended to ensure that the Republic would become even more prosperous under the Sith as a final middle finger to the Jedi and their rhetoric (that the dark side was better).

Lucas main problem was writing dialogue and trying a bit hard with pushing some things like JarJar. It just didn't really have a good flow in the prequels. But ya with how terrible Disney has handled this entire franchise, the prequels have been getting a lot of good PR by the fans.

@@mattwho81 Other than the utter trash The Last Jedi is, the other Disney Star Wars movies are not terrible, just not very good, other than Rogue One and RoS, which one was great and the other I liked(not saying it was Great, but I actually enjoyed it and didn't cringe every 5 minutes like I did in the Last Jedi). Disney's problem is two fold. First they didn't sit down and have a overarching plan for the sequel trilogy. And Secondly, and most importantly, the people they put in charge DID NOT, and still don't, UNDERSTAND Star Wars. I mean, if you look at Rogue One and The Mandelorian, then you will see that they are more than capable of doing good Star Wars. Why they didn't manage that with the sequel trilogy? I have no freaking clue. You spend $5 BILLION, you would think you would take the time to do it right.

Then again, imagine if they had the central episodes be broadly appealing, but have spinoffs in every direction, political + economic thrillers in one end, a military action show about jedi and/or clone troopers, adventurey ones about smugglers during that same era, etc. There was the clone wars show, but that one though great also tried to be broadly appealing. It would be really fascinating to have the setting branch into different series clustered around a particular genre.

@@violentscorl697 Had the Jedi not got involved in the first two of these conflicts, the Republic would have been crushed. The Mandalorians were tearing the Republic apart until Revan took command, and during the New Sith Wars the Republic was utterly impotent, and the Order (and a semi-rogue faction at that) was the only thing keeping the Sith from utterly overunning the galaxy. The Clone Wars, however, was a mistake. In so many ways.

Josh Cain And who is to say that the galaxy (and subsequently the Republic-ruled part) wouldn’t have been better off under Mandalorian/Sith rule? One example: The Jedi committed genocide whilst deeming themselves superior to species who did the same on a moral leven. If that isn’t shameful hypocrisy, then i don‘t know what is. @@violentscorl697 The Jedi committed genocide, once, on the Republic's orders, and they have paid the price for that crime many times since. The Mandalorians and the Sith treat genocide as a valid strategy or even, in some cases, vocation. The Jedi may not be perfect, but on the whole they are much safer to be around, and at least have not made a habit out of mass-murder. That is why the galaxy would not be better under the rule of the Mandalorians and the Sith.

It’s actually a pretty accurate comparison. Ontario and Quebec are like the core worlds who run the entire government and everyone else’s interests are ignored or outright trampled on in favour of the interests of the core BC and Alberta for example pay more federal taxes than they receive in federal services etc basically supporting the rest of the provinces while seeing little benefit from confederation and sometimes being outright held back by a federal government who is completely out of touch with either of their needs and BC and Alberta themselves have vastly different needs to eachother and have entered several periods of rivalry with eachother as well as being close friends at other times so I’d say the only benefit BC and Alberta get from confederation is that them both being in the same confederation never allowed periods of rivalry the opportunity to escalate to military threat or serious trade wars or anything more than banter and telling migrants from the other province to go back home

I wonder if the executions in episode 2 we’re actually illegal. Three agents, not claiming to represent the republic, unambiguously break in, commit espionage, and murder several guards. Espionage alone can get the death sentence irl, so I wonder if the Jedi rescue team was legal.

At that point nobody cared if it was legal or not It’s not legal for a corporation to take control of your home because you didn’t pay your loan back Because they didn’t own the home Did that stop the trade federation? Besides the Jedi there were on a unofficial investigation And obi wan wasn’t trying to find the separatists on geonosis He was following someone else who led him there And then he proceeded to be attacked That’s like shooting down a crop duster because your staging area is in his farm

@@enforcerridley158 the armies of jedi part are the most important, without the jedi the republic would have been crushed against the separatists, and when the empire gets created and order 66 executed they no longer have the jedi, so some of the CIS members create the rebel alliance and finish what they started

What might have made the prequels more interesting is if they had focused on the CIS from the start of the first film. Have it so that a small but growing secessionist movement had begun even before the start of Episode I, but that extremists within that group were using assymetric warfare to push more worlds over to their side. The tonal shift between Episode I & Episode II is one of my biggest problems with the Prequels (well, that & Jar Jar Binks).

Well... ten years have passed... it's not that hard to change the tone of politics in the meantime... in a trilogy, there isn't much time to tell such a long and complicated story, in a very detailed way. A tv series perhaps could connect the dots, just like TCW did it between Ep.2 and Ep.3 . But that would mean even more politics... and we know that the average person (fan) is not interested in and/or doesn't (want to) understand these things. Btw. I would love to have more prequel-era stories. Star Wars was actually what made me like (or at least made me to be very much interested in) politics.

I would have preferred the prequels begin with Alderaan seceding from the Republic due to secret agents stirring up an arms race (clones) in the Mid Rim. Obi-Wan would be a whistleblower, having previously exposed the Republic's back-door involvement as a means to establish a permanent presence abroad. The Republic would use clones, dressed and hidden in newly provided space-suites, to establish an occupation on Alderaan and prevent secession. Episode 1 would end with Obi-Wan helping Alderaan to win its secession. Episode 2 would open with a Confederacy of Independent States, blowback for the Empire having waged war against a sister State.

I've been thinking about this sort of concept myself for a while. Can't help thinking that it would've made more sense, in many ways, if the bad guys invading Naboo in EpI had been an extremist faction of the burgeoning CIS. Motivation would be far easier to understand than a trade group choosing to invade for some tax reasons (since people are still arguing about exactly what it was that made the TF think blockading and then invading a sovereign planet was a good idea, outside of Sideous telling them so) and it would make things a little less jarring between Eps I and II. Separatists are the opposing force for the whole trilogy, just like the Empire was for the OP.

An extremist element of the CIS is attempting to bribe senior members of Alderaan's military into staging a coup against the Organa family. It would explain why Alderaan has no military in A New Hope, & would explain the close bond between Padme & Bail Organa.

We already discussed this a little in the comments, so I feel like I am at least partly responsible for bringing up this issue. I think the points presented by you are, although pretty reasonable, not sufficient to justify why the Separatists weren't allowed to leave legally. A rambly rant addressing your points is incoming. First: Sunk ressources. Second: Bureaucratic difficulties. Third: CIS as potential threat. (Fourth): Republic as institution. (Fifth): Economic impact. All of these arguments would undoubtedly have been made and are not inherently wrong. But I grouped all of them together because they ultimately are questions of convenience. Convenience on a galactic scale, I admit. But even that is no compelling justification for war. Revoking the people's right to choose independence at least in my mind cannot be justified with logistical problems. I'd even go so far and say that all of these issues could be managable. Of course, negotiating a deal disentangling the CIS from the Republic politically and economically would not be an easy task, but in the real world Brexit has become a quite similiar situation. (Brexit is insane, but a war between the EU and Britain would be even more so.) (Sixth): CIS controlled by corporations. Starting here, the arguments address matters of legitimacy, which serves as the basis for legality (or at least it should). The CIS had the Separatist Council and an independent Parliament. This Parliament at least on paper had the legislative power within the confederacy, whereas the Separatist Council was the executive branch of government. Effectively the Council (together with Sheev and Dooku) undermined a lot of crucial decisions made by the Parliament, like sabotaging the very real efforts for peace by staging an attack on Coruscant. Nonetheless, the representatives in the Parliament were legitimately voted into office by their people, just like Republic senators. Like you mentioned, the Republic was plagued by a lot of the same problems. But that just means that these two forms of government are very similiar in their legitimacy. Furthermore the Republic did not wage war to free the Separatists from the oppression by the Council but to revoke their independence as a whole. (Seventh): Republic spreading society. The Republic "spreading society" by force (and certainly not to secure their tax income from trade routes) sound a lot like the USA "spreading democracy" by force (and certainly not to secure those sweet barrels of oil). You cannot force people to accept a system they specifically seceded from because in their opinion (and in the Republic's case arguably objectively) it has become too immoral. (Eightth): The anti unilateral secession provision I think the Galactic Republic is more akin to the EU than to Canada because the members of the Republic are not just states but whole systems. So it makes sense they would be more independent and keeping large parts of their souvereignty, instead of submitting to a more centalized government. This exact issue is brought up multiple times in cannon, for example when the Pantorans declared their conflict with the Talz as internal and thereby excluded the senate and Jedi from intervening. As I already brought up: Brexit is happening and it is legal (and still stupid). It was decided democratically. The democratically elected representatives in the Separatist Parliament clearly are in favor of secession as well. So denying them this possibility is arguably illegitimate and probably not legally justifiable (although that can be debated since we do not have the Republic's constitution). (Ninth): CIS leaving by force. Now this is I think your strongest argument. The Republic does not need a justification for war, if the CIS started it. Building up an army alone is threatening but preemptive strikes cannot possibly be just. The Republic could justifiably have entered a Cold War with the CIS but not outright attack because it "felt threatened". This point can also be reversed and the argument could be made that the CIS had any reason to "feel threatened", which lead them to building up their Droid Army. Since we do not know what legal actions for secession were taken by the CIS before the war escalated, we could just as easily assume that they only wanted the option to use force as a last resort. And since it can arguably be said that the Republic had no materialistic interest (see points one to five) for letting them leave the CIS was somewhat justified in this fear. (We all know that secretely Sheev was behind the Clones and the Droids and war was inevitable but the galaxy didn't.) In the end though, the CIS was guilty of the first act of aggression, by trying to execute two Jedi and a senator on Geonosis. However the Jedi and Senator had no legal right to be on Geonosis. The CIS could legally view them as foreign agents invading on their souvereignty and judge them by (arguably ridiculous) Geonosian law. Still the Republic rescue attempt escalated into the First Battle of Geonosis, which escalated into galactic war (just as Sheev had planned). But the question remains: Was the Republic justified with not letting the CIS leave legally? It is hard to tell, since both sides were controlled by an evil Sith Lord ,but I still think the answer is no.

I completely agree, the Republic provoked due to millennia of: neglect, poverty, piracy, slavery, extortion of gangsters, etc ... Letting the Outer Rim suffer for millennia, besides the corruption, bureaucracy and inefficiency of the Republic worsened more The situation, when the CIS was born as a faction in a democratic way, the Republic did not recognize it as an independent state and then Obi wan, Anakin and Padme made a serious mistake when doing the things they did in Geonosis, and the Republic responds with an escalation each time greatest hostilities until they cause the start of a galactic-scale war ... I think it's easy to see who the aggressors were in this whole situation.

There was an open legal question over whether states could actually secede from the Union before the war broke out. The initial declaration was around the attack on Fort Sumter and murder or imprisonment of all Union officials present in the seceding states in the opening days of the war.

Although it is arguable that constantly checking how many times you've done it could be inconvenient. 2) Impression: It makes people see how many times you've done it, which can impress them, and say "Wow! This guy has suggested this thing (x) times! That's some dedication right there!" or whatever. And this may encourage people to support you, whether it be through liking the comment, responding to the comment, or both. It also allows people to discuss the idea since they can actually see the idea, and may increase your knowledge on both sides. 3) Legitimacy: If you label how many times you've done it, then you can prove that you've done it (x) amount of times. Say if they don't believe you, you can tell them to go (y) amount of videos back, and the amount would then be (x-y) attempts. If the (x-y) seems accurate, then it makes you seem pretty legit in what you are doing. I know it worked for me in the Blacklight Virus vs The Flood video. Those are just some reasons that I have come up with so that you yourself may have some reasons to do so.

Interesting that the CIS created an army before publicly stating any intention to secede. That would suggest that secession would be either illegal or a slow process. A government made up of independent entities working together for shared prosperity would have to have a lot of perks in order for its members to be willing to give up sovereignty. This would necessitate financial obligations for its members, and there would probably be a redistribution of wealth designed to develop weaker economies like tatooine. A rich state like the trade federation would therefore see little benefit to staying within the system, but if rich states leave the republic then it loses its economic power, and would have to rely on IOUs as it dealt with the economic downturn. This would encourage other states to leave, as they would take on more obligations and less perks, eventually leading to a total collapse. To prevent this, secession would have to be regulated to give the republic time to adjust to the different economic situation, and could be held up by years of red tape. As they illegally created a large army ahead of time, they probably expected to be able to bully the demilitarized republic into letting them leave immediately, and were surprised by the clone army and forced into a drawn-out war, as palpatine planned for.

Well both. Thrawn and grievous were taktikal geniuses (in legends) but I think they would rather have shared the command as grievous was a general and thrawn an Admiral. This would have strengthens the cis even more(which was winning the war) the battle above carousing might have ended otherwise as seen in revenge of the Sith. And the CIS would have palpating as their prisoner this would technically lead them to win the war, but as we know palpatine controlled both sides so it would matter few and he would propably be rescued by some jedi(probably Anakin) and the war would just have taken longer to end. But if we say due to Doku still dying at the battle of corousant and now with grievous and Thrawn in charge it would look different. grievous definitely didn’t know that palpatine was Sidius at this point, but I don’t know about thrawn if he didn’t the cis could really win the war if sidius doesn’t reveals himself. But if he knew it could also happen that grievous just kills palpatine as he said he would prefer to kill him in the 2003 series. This would also let the separatists win the war as palpatine is no more able to play both sides and the seperatists are currently winning. Grievous would propably let his anger chip removed after the war or still during and return home or something like that and then start the hukk wars again.

@@jonathancampbell5231 No way Thrawn wouldn't have a ysalimiri stashed somewhere when dealing with Sidious, or any sith underlings of his. In fact, if he was working for the CIS and wasn't in on Palpatine's machinations, he'd probably ruin Palpatine's whole plan. Thrawn would not only win lots of battles for the CIS, he'd be smart enough to notice that something didn't make sense about the whole war. Given time, I think he'd be able to figure out that the war was being orchestrated by someone behind the scenes. It's also likely that he could identify that Dooku was one of this person's agents, based on Dooku constantly making decisions designed to prolong the war. I think he could unravel a lot of the conspiracy, and might even be able to figure out Sidious's identity. Assuming that his goal is a CIS victory, I think he would remove Dooku and take command of the CIS himself, something he should be able to do with Ysalamiri and/or Grievous's help. With full command of the confederacy's forces, he'd kick the crap out of the Republic. Alternately, he may choose to expose Sidious to the Jedi and the Republic and blow his whole conspiracy wide open, then negotiate for the CIS worlds to be allowed to leave the Republic.

@@sayerglasgow115 I do not know why but I have the feeling that Thrawn and Grievous would respect each other a lot, but even be friends, since both are military geniuses who want to win the Clone Wars before anything else, I also have the feeling that a galaxy where the CIS annexed the entire Republic under the rule of Thrawn and Grievous' military tactics would be unstoppable and would be more than prepared to defeat the Vong when they try to invade the galaxy, it would also be incredibly epic to see both legends fight side by side, also I agree with the fact that Grievous after winning would use the army of droids to free his planet from the yoke of the Huk and genocide all that species of critters without mercy, of course after having removed his chip of anger (Thrawn he would no doubt realize that Grievous' fury is artificial and he would know that a less rabid Greivous would be more effective in battle), on the other hand Thrawn would immediately make an alliance After the Chiss ancestry and end all the corruption of the CIS (the Separatist Council), the Jedi order will be disbanded at best and annihilated at worst (unless, the CIS reaches a peace agreement with the Republic, in which case the Jedi will continue to exist but are much hated, and the Republic would have to continue militarizing itself and eventually collaborate with the CIS in the defeat of the Vong.)

I think grievous was that thing that kept the Jedi in it. The idea of some droid being able to take out master Jedi scared them enough to ignore the broader peace. So instead of acting on their suspicion of Palpatine, they are galvanized behind some external enemy.

Really liked this video, much more cerebral and speculative with less structured 'arguments' per se, but obviously this had to be the case, because as you say at the beginning of this video, this question has never officially been answered. I also really like that you've put all of your knowledge of the star wars lore, and clearly a certain amount of real world research into law, into trying to pose a solution to one of its more subtle gaps. I feel sorry for the Separatists. They wouldn't be able to leave not because they made contributions which 'deem' them too important to leave, but also because most of the senators don't want to lose some of their wealth. They bicker over simple things and the corruption is high in the government.

I'm speculating based almost entirely on the basis of one line of dialogue in Attack of the Clones. But I wonder if the reason they couldn't simply secede was because they'd created a large rival polity _before_ leaving. At the beginning of AotC, Palpatine says "More and more star systems are joining the Separatists [...] I will not let this republic that has stood for a thousand years be split in two." That phrasing, "split in two", seems significant to me. Not "torn apart" or "broken up", but "split in two". And the reason the crisis is so serious is because "more and more star systems are joining". So my headcanon is that there was a process for Raxis Prime to leave the Republic, or for Geonosis to leave, or for Serenno or Umbara to leave, but there was no provision for a confederacy of thousands of star systems to all leave at once. The Republic couldn't recognise the legitimacy of the Confederacy, and the Separatists didn't have the individual power to negotiate for good terms on their own.

"They openly attacked the Jedi" Oh really? Because if I recall Episode II correctly, Jedi came to THEIR world and began to spy on Geonosis. And it was the JEDI who struck first when they attempted to rescue Padme, Anakin and Obi-wan. Try to color it up as much as you want, but what the three of them did would be considered espionage - with Anakin personally having killed multiple Geonosians during the Factory battle. Like it or not, the Geonosians - and by extension the CIS - were well within their right to prosecute them for intruding on their territory. The Republic and Jedi struck first. Sure you can say 'the CIS was preparing for war, building an army, so the Republic is justified to conduct a first strike to end the war before it began', but it doesn't paint the Republic's image any better - in fact it makes it all the worse since it shows the Republic is incapable of diplomacy. Sure that was probably due to Palpatine's manipulations, but still as stated earlier - given the Republic's corrupt status, all of this was inevitable.
