The reason the courts shut it down before wasn’t because of the contents of the laws, it was the jurisdiction of the people enforcing them. The courts just ruled that the states didn’t have the right to ban it, and that a tiktok ban wasn’t within the prerogative of the president. Stuff like this has happened before, like with Grindr, where social media platforms have to get their assets out of China. The federal legislative branch definitely has the power to create this ban, so it likely won’t be shot down by the courts.

Did you watch the video? Carter says stuff and adds no proof. he calls it unconsttutional for no particular reason. I am not gonna focus on any of the stuff the federalists wrote but I will focus on the amendments. 1st amendment; This is what most people have a problem with and think tik tok is breaking. The 1st amendment grants the freedom of the press, speech, religion, assembly, and right to petition against the government. Tiktok is not the press, tiktok is not being banned soley because of its content and content and opionions like it can be found on other platforms such as youtube, Tiktok is not a religion, Tiktok is not the only place you can assemble, but one of many, Tiktok isn't being banned because of petitions. Tiktok isn't a miltia so the 2nd amendment does not apply. I don't think banning tiktok will cause soldiers to sleep in your house, but maybe ig. The 4th ammendment is also know as "no search and seizure." Banning tikok doesn't take anything from you, so I think the ban is good with that one. I could go through all the constitutions and how the tiktok ban is fine with all ok them but every argument I've seen is about banning it violating the 1st amendment. Below is a full list of the fallacies Carterpcs made: Ad miserorem(towards Misery): Carterpcs uses an unqualified appeal to miesery at the end by saying banning tiktok would be bad for him Apriorism(Hasty Generalization): Carterpcs uses a past occurence with a different set aof situations. An executive order is much different than the entire legislative branch. Circular reasoning(assuming the conclusion in its premise):"Why wont it get passed, because its unconstitutional""Why is it unconstitutional, because it wasn't passed" Ipse Dixit(He said Himself): He said a lot of statements that he gave no evidence for, e.g. "They are using it to -hopfully- scare people off the app". also the og constitution gives the president very little power, and that is still partially true. While the common public view is that the president is very powerful, that is not(at least not supposed) to be true. This is why a judge said it was unconstitutional for the president to create an executive order. In truth, a single congressman has around the same power to pass laws as the president.

@@6256mateus Tiktok is owned by a chinese company. In China every single company has to give data to the Chinese government, so does tiktok. Also, Tiktok locked down their api requests and other stuff, so it is practically impossible to see what data Tiktok collects

Those terrible things will just happen on other platforms and possibly ones you're using. It's not about the actual platform but the users who exist on it. Keeping TikTok is somewhat of a necessary evil since their users are contained within the app and aren't infiltrating other places.

I mean, technically it's not unconstitutional. It only applies for within the US, censorship of content from outside the US to the US and vice versa is legal

I think that includes most countries in the western hemisphere as well considering that the US is actually involved in most of its social media information and such so sensorship is likely to take effect in countries other than the US as well.

Even if the bill gets 100% Passed, it wouldn’t even be an immediate ban. The Bill would force Bytedance (the Chinese company that owns tiktok/douyin) to sell it within 6 months. Only after those 6 months can they vote to fully ban it, and only then if bytedance didnt sell it.
