Is it true that Social Security disability claimants under the age of 50 will face extremely long odds in winning SSDI or SSI benefits?
As I discuss in this video, your age and your education are very important factors that will be considered by the disability judge, but winning benefits is by no means impossible for younger claimants.
When I am speaking with potential clients in my disability law practice, I advise callers that anyone, at any age, can win a disability case. However, the younger you are, or the more highly skilled you are, you will need more compelling and more supportive medical evidence.
Conversely, as you approach 50 years old and if you have a high school or less education, disability judges often will give you more of the benefit of the doubt because they know that older workers with medical problems will have a more difficult time finding entry level work, and more problems performing that work reliably.
For these reasons, I encourage claimants younger than age 45 to make every effort possible to find and keep a job. Even minimum wage employment is preferable to a Social Security denial after you have used up your savings and waited 2+ years for a hearing that doesn’t go your way.

I had my hearing this morning in which I waited two years for after two denials. I was approved in less than ten minutes of being in the room. I was SHOCKED! I'm 35 (will be 36 in May) and have two associate degrees. I still can't believe I got approved because of all that I've read about age/education level being such a huge factor. I'm so grateful to the good Lord and to Mr. Ginsberg because your videos helped me prepare so much even though I didn't get to testify or speak but once. Again, thank you.

Maranda Best WOW!! Congrats!!! I just got my second hearing date in the mail today. I can't even begin to explain how disgusted I am with SS but I'm happy you FINALLY got approved. SS is NOT supposed to discriminate against age and they DID WITH ME!

My hearing is this month. I’m 38 with a bachelors degree with focus on teaching English as a second language (overseas). That all fell through and I ended up working a lot of part time jobs since 2011. I’m so afraid trust the fact that I have 3 small kids will influence the judges opinion in a negative light, pushing the reason for my cognitive struggles on them and not my MS. My last job was as a bank teller and I LOVED it! I had to step away from it for the birth of my third child but planned that in about 2 years, I would return to that job. That was over three years ago. My flare up in April of 2020 left some pretty harsh damage to my mental facilities. Certainly enough that I wouldn’t trust me handling other people’s finances. Cognitive testing reflects this, thankfully. Thank you for these videos, they’ve helped me feel more prepared.

I'm 49 9th grade education, back surgery, heart problems, imphizima, other things I'd like not to say had my hearing 8 week ago my lawyer told me going out of the room that it went good! The stress is killing me I haven't worked in almost 3 years I owe people money that has helped me through this! I was hit by a man driving wile on his cellphone! Is how it all started!

I am in my final appeal process. Waiting for an ALJ hearing. I'm 45, will be 46 in a few months. I have a PhD. I have TBI, fibromyalgia, seizures, sensory problems, protruding disc, neuropathy, ocular issues, migraines, and am being tested for Parkinson's. I have a spotty work history. I was going to school for essentially 10 yrs straight before I got injured. As well, I was married and my husband took care of me. I got approved for the state's Medicaid medically needy program based on my injuries. I received my last denial based solely on my education. I never thought I'd see the day where being educated was a negative.

I was approve 1st time at 58 after working for 40 years in food service. I only got a high school eduction. I had pinch nerves, a lot of problems with my back and i really wish i could still work it is not ever thing it is cut out to be but i am thankf for it none the less.

Congrats, I hope it goes well with me as I have neck and back issues. Herniated disc in neck with ridicolapathy spurs stenosis hypertrophy amongst other neck problems. Also had crushed disc L7/L8 paralyzed me but I can now walk again not good but I am walking. Both legs are severely tight numbness in legs and feet , pain in rt ribs neck back and legs are constant. How do you think my chances are?

How often will I get evaluated? I was awarded SSDI in 2010 and got reviewed in 2013 and again in 2015 because I went back to work for one month. I just recently got a letter from Social Security about how often I see my doctor and when was the last time I saw my doctor and when was the last time I worked or went to school in the past​ 2 years. I have not received any more mail from Social Security. And I don't know if my doctor has received anything​. Perhaps I will ask him at my next appointment.

Hi Mr. Ginsberg, I'm a 31 year old male with muscular dystrophy (facioscapulohumeral muscular dystrophy, to be exact) and it severely affects my shoulders and what I can do. I can barely lift my arms up at all anymore (I have really blatant winging of my shoulders when I try to do so) and it feels as though it may be starting to affects my hips and legs. It's causes me to get worn out/fatigued very easily and even sitting up in a regular chair for long periods of time is difficult for me now, as well as getting up out of them. I also deal with a lot of edema in the feet, legs, and hands, although I'm not sure if that's due to the muscular dystrophy (I'm in the process of finding that out). All that said, given my condition, do you think I'd have a decent chance at getting approved for disability even though I'm so young? I'm also a little over half way in a degree for a bachelors right now, but I stopped last semester because it got more difficult to even do online courses, part time. Another thing I should mention is that I've never really worked much. My last job was in '07 at Gamestop and I was practically forced to quit because I couldn't do many of the tasks well enough (due to my wasting shoulders). I was planning to apply for SSI but I'm wondering what my chances are. If you could offer your opinion on my chances and/or advice to use going forward, I'd so very much appreciate it. Hi Mr Ginsberg, I'm 42.I had a case open for a number of years but was denied all the way to the end. My Lawyer would scream at me an told me I would have to reapply. Physically, I have been diagnosed 5 times with Fibromyalgia, Osteoarthritis, DDD, migraines. I have horrible memory problems as well. Mentally "which my lawyer didn't include mental problems" they say PTSD, BPD, BI-POLAR, PARANOIA,. I was raised by state and didn't get an education, I have very little work history, because after 5 or 6 weeks I couldn't tolerate the pain. I couldn't get my PCP or the pain center to vouch for me. Now I go to a different pain center and I'm going to see if they will. I have 8 of my nerves burned every 6 months and I can stand for 3 >"bad day" to 10 minutes on a good day until I collapse from the pain in my lower back. They want me to get a pain pump but that scares me. Let me know your opinion. P. S. Your videos rock!

Hi Mr. G I have been watching your video for a while Love the Passion you have for people who are trying to get on Disability because they can no longer work myself included I have waited and waited it is true each case is different I had my Hearing on Dec.12 2016 have not got a answer yet whether I am approve or not been turn down twice so my hearing was in front of a judge one of the lowest judges that grant disability but that is not my issue my issue is I been to doctor offices app everywhere for 3 yrs. all of my Doctors are behind me they wrote letters co workers wrote letter last employer the whole nine can you tell me what's taking so long I am getting scare.

I only have a high school 12th grade education. I worked 36 years of which 32 years was in Banking. I filed at the age at 59 turned 60 3 months after I filled and got dined. I filled my appeal with in the 60 day period and submitted more medical I.e. MRI and Doctors letter and addition paper work from SSDI. While waiting for reconsideration I turned 61 and was still denied. Now filled appeal again to go for hearing. Now 18 months in but adding one year back on set date 30 months.

Usually claimants in their late 50's have a better chance at winning. Did you look at the grid rules (www.gridrules.net)? Do you have a firm diagnosis and support from a treating doctor?

Disability judges when making a decision, use what age? The alleged onset age? Age of person when application is turned in? Or age of person at time of hearing?

So i will be discriminated because of my age. Im a former Marine, and tryed to ignore my ptsd for the last decade since i got out. Ignore and work through it. But it has affected me at nearly every job, and ive tried nearly every kind because going this route seemed much more of a hassle. But since i have 2 kids, i have to try to bring some stablity to their lives since despite my best efforts i cannot provide for them with a stable living, its hard to focus on more than one task. Nightmares and lack of sleep make getting to work ontime a challenge and often i just cannot get myself out of bed, I dont like feeling like im guilty until proven innocent. It feels like people who are truly disabled are expected to jump through hoops higher than we can actually jump, which just seems like a cruel process. I appreciate all your advice here, God bless. Wish me luck. My body has endured a lot of strain, hardship, and trauma, i just need rest. A break from the strain and pain, pray for me and i will pray for all those like me who need the stress lifted from their shoulders. In Jesus Name

I think that SSA, like many large bureaucracies, has created boxes to fit people into. Choosing 50 as the age where the grid rules apply is inherently arbitrary. You can still win at younger ages but in my experience, the quantity and strength of your medical record must be higher the younger you are. Good luck with your case and thanksfor your service.

i am a 100%perm and total from the Va, have 7 combat tours, just had my 14 surgery on my body 4th on my shoulder and left arm. I suffer from ptsd w alcohol abuse, depression, aniexty and many more i was denied 2x from ss, i now have a hearing thanks to a congressman who jumped on my case. what should i do or expect from this hearing thank you

46 with G.E.D. and 30 yr work history as auto mechanic. Never became rich but I made my own way with my own 2 hands. About to lose it all due to hard work destroying my body and a Bad auto accident in 2012 finished me off. Mechanics are paid on commission so you have to work hard and fast to make it and that's a serious problem in my condition. Been watching my ship slowly sink since the accident. Credit ruined, savings gone, assets sold and mortgage behind. Looking into SSD with the long drawn out process is discouraging. I've just about lost all I worked so hard to gain. I have no where to go if I lose my home I can't afford to wait a yr. I don't want to be disabled I want my life back. If I'm just gonna lose it all anyway what's the point? Feels like being punished for something I didn't do and no one gives a dam. So frustrated, angry and feel like a "F"ing loser. And I'm going thru all this because I worked hard? I thought that's what I was supposed to do? Oops?

Warren Chambers I am feeling the pain, Your pain. I am 55 worked since I was 16 and I was in the same situation: homelessness after buying my home over 22 years to being a year behind on my mortgage. The house is slowly falling apart with no means to repair. I am fortunate so far in keeping it. Prayer and fingers crossed. I remember having to reach out to local charities just to be able to eat. I constantly Applied for employment(Completely lost on online sites, no computer skills), Threatened monthly on losing my lights, the ability to just microwave my meals (diabetic neuropathy, a torn rotator cuff requiring surgery, and arthritis in my other shoulder), having no water(or heat) and feeling absolutely helpless, lost, depressed and bitter. I had applied only because a 65 year old friend told me to apply. A little over a year and a half later, I am scheduled for my SSDI hearing in July 2019. This was after 8 months of no employment. I hadn't even thought about it because I thought I could get another job based on my extensive experience, and great work history. Somehow that doesn't seem to matter to these younger Hiring Managers, Human Resource people. Hang in there Sir. I feel/felt exactly what you are feeling. It seems all of those years of hard work just for some to end up in the streets. No one plans to retire in the local homeless shelter. My heart is heavy for all of us whom have to endure this crap even busting our tails, paying into a system that seems as if we are not human. Just a bunch of files and names. Hang tough. I am 53 and have spinal stenosis in lower and upper back. Need knee replacement and hav arthritic hips. I keep doc appointments and do physical therapy. I use a cane to get around. Are my chances good? I was a carpenter most of my life

Hey, I'm 17 years old right now, but when I turn 18 I'm planning on applying for social security. I have my right leg amputated so I wear a prosthetic leg and I have club hand deformity which both gives me limitations. I haven't had a job ever. In your professional opinion, you think I'll get approved when I make my case? I also want to go to college after high school so I wouldn't have to rely on SSI my whole life, which I heard is a good thing to prove to the judges.

hello sir thank you for your videos they're very helpful you appear to be a really great lawyer I'm 43 I had my case last year a couple months ago still awaiting a decision I did not have the support of my doctors but had surgery and had MRIs that show that there's an existing problems what is my chances I had been seeing doctors since 2013.

Sarah, I wish I could answer you but without looking at the medical records I hesitate to say more. If your MRI reports show a significant problem and you testify convincingly you should be ok.

i am 60 years old and i lost at my hearing level they were going back until 2015 can i appeal with the grid rules and how do i meet the grid rules ? the vocational expert said there were no jobs i could do i only have a GED can i appeal ?

School records help but psychological testing can also confirm a learning issue. Whether it would disable you from all jobs is a different question.

I am 59 years old, I have cronic bronchitis,emphazema, COPD, asthma, had foot surgery and cannot wear any type of cover shoe on that foot I also have no feeling on the top of that foot. I had breast cancer surgery which I can not lift my arm but so high. I have work for 41 years and I have all of my credit. Was turned down twice by ssa now I am appealing their decision. What are my chances of winning when I go before the judge. Thanks

Make sure hire a SSDI lawyer. Keep on appealing. I applied SSDI at 51, after many denies and many appeals, approved at 56.

I wish I had thought to watch You Tube videos before my hearing. Your information seems very helpful. I have been denied twice and lost at my hearing. Allsup is representing me. The judge I had approves very few people. Just my luck! I will be 55 in a month and from what I have learned from your videos that changes the where I would fall on the grid? Also I was listening to one of your videos in the car so I couldn't make notes, you were discussing the listings and getting your doctor to write a letter using the listings and how your medical problems fell under them, is that correct. Also how do I check to see what they have down for my education ? Thank you for your help!

What about people who have schizoaffective disorder and a learning disability and education part where they were in special education and has a highschool diploma,and in their late 40's? Will they pass a cdr to keep getting benefits,or will they be cut off disability? I am curious because ^^^^^^^^^^this is me i am talking about,not other people. Im turning in the cdr form in person tommorrow and don't know if i should start packing my belongings to get ready to move,because without my disability i will be homeless. Other attorney videos i watched pretty much say you have a slim chance of passing the cdr.

I agree with your concern about the CDR process. Call me a cynic but SSA knows that claimants facing a CDR will have a very difficult time hiring a lawyer. There are no past due benefits so you would have to pay a lawyer out of pocket and very few SSD recipients have $3,000 to $5,000 available for legal fees. THe key with a CDR is to provide all medical records from the date of approval to the present and to ask one or more treating doctors to confirm that you remain unable to work even a simple, entry-level job. I did not graduate from high School I told them that right in the hearing when asked. Guess what? When reading my denial THEY have I graduated high school. Along with many other lies. I questioned my very incompetent attorney SHE SAID DOESNT MATTER. She said it didn't matter!! She didnt even bring it up in my appeal paperwork. I'm granted an appeal hearing based off of many other errors they made. But I'm pissed I'm suck with this Lawyer

Usually, fee agreements that you sign will terminate after the ALJ hearing so you would not be stuck. There are a number of lawyers who specialize in Appeals Council and Federal Court work (listen to my interview of attorney Karl Osterhout on my podcast at ssdradio.com). If you want a new pair of eyes to look at your unfavorable it would make sense to reach out to one of these appeals specialists.

I didn't realize at that point I could of tried to get another attorney. I called another attorney a while back, and was told I was stuck with who I had. Granted that was prior to the last denial. ( now granted appeals hearing) My Judge even told my lawyer in front me at end of hearing how my h he likes her, and he would be happy to help her pursue being a ADL. She was so excited, she then started talking to me about that even though I was asking her about what just happened with my case. All she said about the hearing was. well you can appeal. She never questioned the 3 absurd jobs they came up with Flower picker Chicken Cooper Electrode Cleaner When you look up the physical requirements for these jobs even their DR report says I can't do what is physically required. So I dont even know how they came up with them. And Of course my Attorney said nothing. Later when I did question her on phone about these errors and why she didn't say anything. She said it wouldn't have mattered if she said anything in hearing. She said that is why you appeal later. Is this true? When I mentioned the error about them putting I graduated and again she said doesn't matter she didn't even write anything about the error in appeal. Also I waited almost 6 months to get that denial. I ended up calling some # I found online and questioned why it's been so long The lady was a little bitchy BUT guess what I got the denial within a week of me calling that # . So that made me think. My paperwork got left on someone's pile to do the write up, once I called it got a rush job done and thats where all their errors came through. Not sure they will to get to far this time with denying me. When disability asked ME to write updated medical info this time after approving appeal I sent them a letter about the errors Also inserted a nerve conduction test I was able to get to approved by insurance finally. Once you hit 62, they encourage you to move to SS retirement. As you get closer to regular retirement age they will require you to change over. When you are switched over, the draw is against the retirement trust fund not the disability trust fund.

Im 50 and have high anxiety. Depression. No high school diploma and an old felony. My common law husband of 14 yrs had his own business so i got to work as i could with him. He passed away and i having problems dealing with others and got fired from missing work too much. Sometimes i cant even leave my trailer. I drink sometimes to ease my anxiety. I cant sleep often.. Other times i have A LOT of energy. I was diagnosed with Bipolar when i was about 18 or so. I hadnt seen my mother in 5 yrs.. Sister in over 10 yrs. My kids in over 5 or 6 yrs. My sister is tryin to help me get my life together and i recently was cut off from them because i was drinking. I need help. Im very depressed and im sober right now.. But know i need help.

I'm 54 - recently received denial on the reconsideration of first round denial - via my attorney, have appealed that decision -- I have a bachelor's degree in information systems and had 25 years continuous employment as an application/database developer, 20 of those years in the same job .... I have several medical/health issues, all substantiated with abundant records, and seems clear to me anyway that I'm truly unable to hold a job .... and yet, with my education level & high tech skills/experience, even being over 50, am I at a disadvantage for ultimately getting approved for SSDI?

James, since SSD is looking at your vocational capacity, your education and work experience, in theory, open up more job possibilities. But if your medical records indicate that you would not be reliable (excessive absences during the day, or 2 or more missed days per month) you would still have a good chance at winning. You might not be able to use a grid rule argument but you can still argue for disability under a functional capacity theory.

Hello to everyone. I'm 42yrs old and i had a hydraulic press crush my left foot.The result was amputation of the grand toe and tendon damage to the remaining toes. i walk on the outside of my foot. I have been working as a metal refinisher for 16yrs. it's all i know and trained for. I will be 45 in October. I have two types of vertigo, degenerative disc disease, severe migraines, carpal tunnel in both hands extremely bad where both my hands go numb very quickly, compression fracture in my back, bursitis in my hip and struggle to work consistently as a home health aide and doing most things. I have the desire, passion and intelligence yet my body does not want me to do much of anything consistently to provide for me and my son. I am in PT for my back. Not sure what else to do.

I was 38 and a half y/o, when I became severely ill with a vestibular disorder condition affecting my balance, driving and other things. I had to have documentation from 3 different doctors plus supporting documentation , was denied 3 times and after 4 years and blowing my life savings and my down payment on a house, just to pay bills - I got approved. There are times when I wished it would have just killed me than to go through all that. It isn't one of those things you can see on the outside unless I happen to to using a cane that day. And it's chronic. And now I have Type 2 diabetes because it affected my mobility so much. Oh, yeah, Now I'm trying to survive on $ 12,000 a year, Oh, yeah I was sure hot to trot to get out of work alright. I was asked that numerous times. I would love to see some of these idiot judges and lawmakers go through what I have been through. I realize there is fraud ,but man they really put me through my paces. I'm a single woman w/no kids. and I often thought if that wasn't the reason. I wish these videos would have been available 10 or 12 years ago.

I have got in car accident as a kid 1981 i had brain surgery i had broken leg and a pin in it now days i have bad anxiety and depression i take pills for both anxiety and depression i have dizziness. Jef, it depends on what your medical records say and if you have a long time treating doctor who will go on record to identify specific activity limitations and reliability limitations. It would also help if there was MRI evidence documenting your stenosis and arthritis. Remember that SSD is not just about your inability to perform past work - could you do any type of work at all.

Remember that the issue is whether you can perform the duties of a simple, entry-level "warm body" job. You need support from long time treating doctors that includes treatment records and a narrative report or a supportive functional capacity evaluation.

Firstly, I will be 49 and a half years old when I have my hearing next month on July 3rd. Will the judge consider me at 50 years of age or is that dependent on the judge? Secondly, does SSA consider a GED the same as a full High School education? It may not matter in my case,as I had both my regular doctor and psychiatrist give me favorable less than sedentary rfc reports*. Also, I think it would be of considerable value to do a mock alj hearing on here to show us a general idea of what to expect on that very important and anxiety inducing date. I have seen a few of those on here, but would love to see one done with you as the attorney, :-)*

Tam, I have asked judges to use the "grid framework" for clients who are 49+. This means that I am asking them to use the grid rules even though my client is not yet 50. Some will do this. Re the GED, I don't know for certain but I suspect that for grid rule purposes a GED is equivalent to a HS education but in hearing testimony I think that most judges would at least ask why you had to pursue a GED vs. a regular HS diploma and do you have educational limitations. Re the mock hearing that is a good idea - I just need to find the time to put that together. JCG

It depends on how these medical issues impact your capacity for work. How bad is the pain? How much limitation of movement do you have? Do you have limitations sitting, standing, walking, lifting, carrying, etc. - and if so, to what degree?

I have my hearing in a few weeks and have watched a number of your videos which have been very helpful. I have a question I have searched the web but can't find an answer. I have heard that if a person is approved and awarded money that goes back a couple of years that you need to refile taxes for the years covered and pay back any taxes for those years. ? is this true how does that get done and are there penalties and how soon does that need to be taken care of?

Donna, I do not believe that you have to amend tax returns from prior years. SSD money is not always taxable and if it is, the rate of taxation would depend on other household income. I would suggest that you pose this question to your tax preparer or a CPA to determine the best strategy to minimize the tax bite, if any, from your lump sum.

multi lit - "get tax money"? Taxes are something you pay, not get. You may be a refund if you overpaid taxes during the year but you don't 'get tax money' Disability may be taxable depending on the situation. Like how much you get during the year, any other income you have, if you're filing jointly. If you think you are going to owe taxes on your disability income you can make estimated payments every quarter, or you can have a certain percentage of your disability benefits withheld for tax purposes. At tax time, if you paid or withheld more than you actually owe in taxes then you would get a tax refund. I believe this is what you mean when you say 'get tax money' The form for having taxes withheld from your benefits is IRS Form W-4V. You must choose between 7%, 10%, 15%, or 25% withholding.

I just got denied after waiting for almost 3 years now I have to start all over! So now Arkansas SSDI won't have to pay the backpay! Ugh. This is exactly what I was denied for. Age and education. They feel I can still adapt to SOME jobs that MAYBE available. Somehow, they now lack the knowledge to even tell me if I can still do my previous jobs that they had no problem trying to tell me I could do before. I have osteoarthritis throughout my entire body. Moderate to severe spinal stenosis in my neck. Retrolisthesis 3mm in the L4-5. Tendonosis+osteoarthritis in both ankles. Hands have been proven to be unpredictable with strength. Fibromyalgia and idiopathic hypersomnia with long sleep. Nerve conduction show nerve damage in leg from L4-5. All proven by tests. Except fibromyalgia since there is no real test. Yet, I am supposed to adapt to what exactly??? How do you win a case when they are blatantly ignoring all the proof hands, mind, neck, back, and legs are all compromised and unpredictable?

My mom was diagnosed with Parkinson's in her late 50s and had a 10th grade education. She worked as a custodian and she was still denied. She ended up taking regular SS at 62 instead. This was in the 1980s so I am sure it is even worse now.

I have worked about 18 yrs straight full time puttimg overtime but my health has become a struggle i have try applying but the employers can tell that i have some thimg wrong and they come up with an excuse . I thing i know that the dissability act law doesnt actually protect or ganruntes a disable person a job , the law clearly says that a disable person needs to be able to perform a job same as a healthy person and an employer can fire for lack of performamce. The judge should keep in mind that when some one has a disability no one wants to hire that person simply because we live ina world that time is money and every employer wants top notch employees and dont want to acomidate a disable person because it too kuch stress for managwmemt .

That trust fund for SS isn't actually what funds SS. That trust fund is the surplus from the balance of spending and revinue. It's a score keeper, like the federal deficit. Funding, however, comes from the same place as all federal spending, congressional appropriations. It's funded by fiat. Even FDR knew this. He set it up with this trust fund and FICA taxes to make people believe that they pay for it, thus making it harder for law makers to get rid of it.

I am 27 years old with congenital heart disease, anxiety/depression and longterm COVID symptoms affecting my heart. I also suffer from migraines. I’ve had a robotic bypass open heart surgery, a pulmonary catherization, 3 angioplasty and an open heart surgery. I’ve been in cardiac rehab about 3 times. I’ve had so many MRI’s, EKG’s, CT’s, stress test and heart ultrasounds I can’t count. Hard to exercise or do daily activities. Hours and days at work kept getting reduced doctors orders. I got taken out of work to seek mental help. Do you think I have a chance at winning?

Whats my likelihood of getting benefits @ 38 w/ehlers danlos hmtype, multiple herniated disks, had a tlif done in 2012, have degenerative disk disease @ multiple levels, knee has been worked on, perinureal cyst between t2-t9 both side of spine, joint instabilities, osteroarthritis in most joints and fibromyalgia. I worked as long as i could until having to quit working 2 years ago due to these issues.

At 38 you are going to have an uphill battle. Remember that your diagnoses do not win your case - SSA will be looking for how these medical issues impact your functioning. At 38 you are going to need evidence to show that you do not have the capacity to perform a simple, entry-level, minimum wage, "warm body" job. Some judges will not get past the age issue while others might.

@ssdattorney I cannot stand or sit for any period of time, I can not lift more than 30lbs without days of recovery. If I can not find any employer to hire me and work with me, what am I to do? The only reason I was able to stay employed for so long was due to FMLA allowing me to miss weeks of works over the years. Once I could no longer work for them or find other employment, I started my own tropical fish store that my wife helps me with. It's not making it and isn't paying any bills. What job is easier than what I'm already unable to do without direct help? By trade, I'm a high-speed industrial Mechanic. I cannot continue using the knowledge and experience I've earned over the years. I'm at a loss

You need to be much more specific than that. You need to identify the medical issues, you need to have treatment and medical opinions about how these medical problems preclude work and you need to focus on how your medical issues would prevent you from being reliable at any job.

My education my age and even my disability is held against me and I find it hurtful like I just want to beg for $1,300 a month when I could easily make double that being a nurse or use the criminal justice degree and make double that it's like if you're able to walk well we'll find you a job to walk and that would be okay if I knew I could be consistent in it it's not that I have zero ability is that what employer is going to deal with me when I need to call in because my PTSD is bad keep calling in 5 days out of 7 days out of the week? How does being in a "protected class" affect decisions, especially over 50 woman? It may be hard to answer. There are questionable ways that recruiters & employers find out a person's age. I think age discrimination is important, whether you or educated or not, especially with a disability. Some employers would rather train two new, young people who would Love to make half of what an "elder" is paid. This is what I am running into....... And would like to know if there's any way around this: With some paperwork I had to fill out for the determination office in Oregon, I also sent a pack 2 in thick of medical records that go back to 93 which are very pertinent to my latest 4th compression fracture, and related to my two different kinds of arthritis and carpal tunnel and depression and anxiety from it, but it also shows my extremely hard-working and extensive work history. Because of the workload they now shuffle my case off to a determination office in Arkansas. Naturally I want whoever's going to be deciding to have all my records. I called the disability determination office here in Oregon and the lady was pretty snooty...( correction, the gallon here in Oregon was very friendly, it was the one in Arkansas or Kentucky that was really snooty )... She saidthey get the records themselves and only look back the past year, because that's how the process works. so basically they're not going to look at all of the pertinent stuff which shows exactly how long I've been leaving with numerous conditions, nor will they see extensive doctor visits with different doctors from different areas I've lived, nor will they see doctors letters stating my severity way back in 93. Why do they do this??? it's supposed to be so helpful when you have a lot of good records but they don't use them, at least not until after you've been denied once or twice and you finally end up in front of a judge who made then look at all of your records in your history. if this is how it really is then I can see why everybody gets denied the first time it's because they're wasting everybody's time they simply not doing their job right the first time through in the beginning. how can I be sure that they are getting the full extent of my records and taking them into the consideration? Because without a doubt,if they just looked at everything it should be pretty cut-and-dry right off the bat, and I don't have time to sit around for two freaking years not making any money just because they have some rule that says they only look at the past 12 - 18 months. Because if that's the case then it wouldn't really have mattered if you had seen doctors off and on for years or anything for your conditions. I want to know how you canget them to consider all of this and show them that you're not going to just lay over and play dead.

@@ssdattorney my lawyer along with thefolks at Social Security almost try to dissuade me from worrying about any medical records older than the past 12 months, claiming that they don't go back that far. I've tried to convey just how pertinent my records are from all the way back, first it shows a timeline of how long I've been dealing with this as it adapted into multiple issues such as back injuries and various other problems from two different kinds of arthritis and back injuries, job loss, old suicide attempt in 97 associated to it...... Diagnosed with severe carpal tunnel back in etc, and I wasn't going to take no for an answer becauseit's my understanding that if it ended up going in front of a judge later down the road he would be up to want to look at any and all records. I'm trying to be thorough at the very beginning and I'm being and it seems like they're just trying to dissuade me from doing, but I'm not going to accept that...... It's up to me to prove my case basically , and by God that's what I'm going to do. Thank you a lot for all of your videos they have been extremely beneficial, I'll recommend you and your videos for sure.

Sheltered work is not considered "substantial" work in most cases so I would say probably not.

Sounds like you have a strong argument for disability. I would focus on how your conditions specifically impact attendance and focus at work.

I'm 58, worked for 31 years "on the books". I have Cardiac, Neuro, Ortho, Pulmonary and GI problems. I was denied. Judge said that the "disability caseworker"(not a RN) said that I, a RN for 27 years, could STILL work as, ready for this? An USHER IN A THEATER. YES! SHE SAID THAT! I can walk 100 ft with a cane, SO...... 🧐 Apparently, there is a great need across the country, and I guess in Delaware 🤷🏼 as well!!! 😫 Oh, and NOW, they're saying that, for my re-file, I NO LONGER HAVE ENOUGH "POINTS" SINCE I DIDN'T WORK SINCE 2016 AND THEY TOOK SO LONG FOR MY CASE THAT I AGED MY POINTS OUT?!?!? WTH??? 🤨
