I know a woman that is retired through the state and she gets 1,800$ a month plus her SS. She worked for the CA school system thats the reason for the 1,800$ per month and we wonder why the school system is going broke. She was the worst client I ever took care of. She had an aneurysym due to being a raging alcoholic. She is disabled because of her own negligance. She also had property that she sold to the State of Ca for $800,000 to build a new school. She does not deserve any SS at all. But the state gives people that are really struggling a hard time. BS !!!!

The biggest thing to consider, or to make sure you do, is never give up!! I applied for SSDI and was denied within 3 months. I wrote my own letter to the SSA and made the case for reconsideration. I won the reconsideration simply by pointing out things which were missed in my initial denial. Thank goodness I was able to get a SSA employee who actually read my reconsideration letter and followed the law. Please do not give up ....... no matter how long you have to fight ........ I wish everyone who is applying the best of luck! I was 42 years old when I initially filed.

I went through exactly the same process. Denial-appeal-denial-lawyer case won. It took 3 years. I was the main wage earner & it was a very long 3 years

I was turned down to. But when i went in front of the judge I made him laugh by telling him something my wife said to me. So the judge wanted to meet my wife the following week. After he spoke to her he approved me. I can't drive anymore either. I have seizures and I never know when its going to hit me.

No ssi if u have a pension, but u need to be disabled through ssdi/ on paper. Crazy a dr note saying you won't work ,ever. Is this right?

My son has been fighting for over 3 years on his claim. He had diabetes with severe nerve damage to his feet, with constant swelling and nerve damage to his hands. He is on opioid pain medication thru pain management clinic. This only helps so much. He finally went before a law judge last month and we are waiting for his decision.

That is so sad. It is terrible that Doyle had to go through that. I also was denied twice before getting approved at a hearing like he did. Similarly took me 3 1/2 years to get approved. It seems like that is the norm which then causes too many people to need hearings which puts a terrible burden on judges. There needs to be better case screening at the lower levels to get people approved faster and keep needless cases from bogging down judges.

I applied for Social Security Disability and didn't follow through. I did the same, a second time, didn't follow through, for I felt I needed to work as long as possible, to support my son and myself. What happened next, completely surprised me. An adjudicator from social security, phoned my home, telling me that I should reapply for benefits, again, and follow through, until the end; if I did not, I would never be able to apply again. I went through the phone book, in search of an attorney who specialized in disability cases, and received a percentage of my settlement, only if I won my case. This lawyer was a partner in a firm, that was located in a different state than the state I lived in. He asked many questions, via telephone. I asked if he thought I had a case, and if so, did he think think I could win my case? His response, "I wouldn't be speaking with you if I didn't think you could win. You've had a telephone interview." I received forms to complete. Medical records were gathered, after I gave permission for my records to be released. Social Security Disability required (at that time) that every potential recepient have an appointment with a psychiatrist. I then waited. I did appear before a law judge, who had the authority to decide cases, as he saw fit. Near the end, I removed my socks and tennis shoes, climbed upon the table, and tried to use it as a modeling runway. It was necessary for the judge to see me walk with a limp; the fact that my left leg was atrophied and the left foot, malformed...all due to CP. Within 6 months, I received word I had won my case! The money was allotted from the date of my initial filing. I was awarded $34,000.00, in back pay, after my attorney was paid. My story with a successful ending. I was 35 years of age, at the time.

If social security waits 4 years and then sends you a letter saying that they over paid you money and you need to pay them back 15,000 dollars. I dont feel this is fair. It's not our fault. What are your feelings about this situation?

I've been widowed for ten years and filed for SSID now going into hearing phase with attorney this go round...was denied due to the seven year death of spouse stipulation which I was told I missed by having a stroke nine days to late but due to misdiagnosis I can show blockage was there a whole year...hope n pray I get Disabled Widows Benefits due to being stay at home mom and wife and lost my credits smh

finally got disability after 4 trays. no backpay. lost my apt while I had my 16 or old daughter. homeless two months before I received first payment. made it through w help of Jesus.

There are shelters for families and they have programs for families and services to help you getting housing

#1: Extremely difficult to be accepted. #2 There really isn't a set criteria for acceptance. #3 Every case is different. It took me 4 grueling years to be accepted for mine. #4 Age does matter. The older you are the better of a chance to receive, because you then have a less of a chance to train for a new career. Companies don't want to hire older aged people. Most importantly: I always had the feeling that the SSA wants you to lose your patients and mind, so that you might decide to give up on the case. I became more sick waiting than before applying, almost like they don't want to give it to you. I learned alot those 4 years!!! Thanx for this important information.

What a fucking disgusting country we live in. I am disabled and got hurt on the job. Had to have surgery. Had to hire a lawyer. 1.5 years still going through it. I served my country and worked nearly 40 years. I am losing everything......

omah do it yourself!!! why you want to give attorneys 1/3 of what you get!!! you can do it yourself, truly. Just go in and talk to them yourself, give them your Dr info and they will retrieve it for you. yes you'll get it after some time​.

Victoria Stevens Disability lawyers don't get 1/3 of the money back paid to you if you win. The law sets the max. at $6000 and only if you win your case. Second, you can't win without a good disability lawyer, especially if you end up in front of a ssd judge.

And the attorney only gets a portion of what you should have ALREADY gotten. There is no contingency based on current and future disability benefits. It doesn't pay NOT to have a lawyer frankly.

I tried to get a lawyer but they told me they wouldn't accept me because I don't have a doctor (I couldn't afford to see a doctor any longer), but social security did send me to one of theirs but I still got denied even after a hearing.

If you don't have on going medical care to support your claim, you will NOT get disability. If you qualify for state medical aid,you should apply. The law also states you must be unable to preform ANY job,not just the job you were doing,and medical evidence MUST support this.

Do they want these people to commit suicide? My nurse friend in SLC Ut that was in her early 60’s massive stroke blind denied denied denied could not afford food let alone drive to get it. Ended up being forced to sell property in mountains that she had owned for 30 years

Took almost 5yrs. for mine. I have been disabled since 1976. After a work injury & dr. who installed the wrong size (hip) part. Too large to go inside my tiny body. Now needing a pelvic replacement. Have, cancer & back & Neck injury, with inturion on spinal canal. Causing nuropathy in both arms & hands.

I've been fighting Social Security for my disability case since 2009, I've been denied like 7 or 8 times in the past 7 years that I've been fighting Social Security, I have Degenerative Joint Disease, which means that my bones are deteriorating, I have a pinched nerve and a bulging disc in my lower back, which is my L-4, L-5 and S-1 & s-2, I suffer from chronic pain and severe arthritis, my bones are 10 years older than I am, which that was back in 2003 I,so I'm sure that it's more than that now, because everything is getting a lot worse. I was diagnosed with a slow learning Disability as a child, I have severe mood swings, I suffer from Panic Attacks 3+ days a week, I've had to have my Mother help me out of bed on several occasions, and there was a time when I had to call upstairs and have her help me up, I was stuck half off my bed and half on the floor, which obviously my feet was on the floor, but she had to get a back brace from out of my closet so I can put it on and I had to use crutches along with her help to get me out to the car to take me to the emergency room, which I thought I was going to have to call an ambulance to come get me. Well, when I got to the Hospital, if had to have help getting out of the car and into a wheelchair, and the Doctor gave me muscle relaxers and Dilaudid pain medication, which is the strongest you can get, then a couple of hours later the Doctor asked me to try and get up to see how I was doing, so when I tried to get up I was in excruciating pain and I started hollering in pain, so the Doctor said there's no way he can let me go home like that and had to admit me. After I was released the next day, I had to use a walker to get around for about 2 months, I was in bad shape. Just the Panic Attacks alone qualifies me for Disability, and the slow learning Disability is a Disability, people who has Bipolar gets Disability, which I was diagnosed with, and I have an IQ of 70, which I should qualify for Disability, because with a low IQ score like that, if I have a physical Disability, then I qualify for Disability. I'm 46 years old and I just went for my disability hearing in front of a Judge, which is my second time being in front of a Judge, the first Judge was very mean and rude, so she denied me, and my Attorney told me before we went in front of the Judge, he said that we are going to have a problem with this Judge, and I said why, he said because she doesn't like giving Social Security to people my age, which is bullshit and is discrimination, but I still lost my case, but I'm not sure about the Judge is just went in front of, my Attorney said that he feels very confident that she'll find me to be Disabled, he said that she's going to pay me, which I pray to God he's right, because I'm sick and tired of struggling! I have medical records going back to 2003 with having back problems, and I have a life long history of having mental health issues, and I forgot to mention that I have a bad left knee and I can't sit or stand for more than a half hour. I swear to God I better get approved this time, my brother got approved when he was 46, and I'm now 46 so hopefully I'll get approved.

Get a lawyer to fight your case! They do not charge you unless they win your case. Regardless of what you are entitled to, lawyers fighting for Social Security cannot charge you more than $6,000 dollars!

Yep, sounds about right. There is a lady who does vlogs on KZfaq and she claimed she simply called up Social Security and she was approved about 3 months later. They never even sent her to one of their dr's. or a psychologist (she claims to have back problems and is crazy). I find that hard to believe. I'm over 50 and I was denied even after seeing one of their dr's and after a hearing.

That clutch hit he got in the hearing was actually showing how worthless he has become. Going thru the SSD process is a humiliating ordeal having to sell your limitations to the government.

The people in social security have a record of you employers reporting of your income from various jobs you worked and they telephone former employers to ask about you. The former employers think they are doing you a favor by giving you a good reference; "capable, punctual, efficient, hard working, etc" Then the question is what changed since, are you on life support in the ICU?

You don't understand it because it isn't true. Undocumented immigrants CAN NOT EVER get Social Security Disability Benefits. If they are working legally and they have been paying into the system then they would have the same access to the process as a citizen worker who has paid in. I know Fox News likes to tell a different story, but it's a lie.

After a car wreck left me with severe cervical spine injury at multiple disc levels and major surgeries, including two different rotator cuff tears and surgeries on my left shoulder, whereas my ACDF fusions all failed leaving me with failed cervical spine syndrome, nerve damage, and other problems. Nonetheless, the accident happened while working so I was getting workers comp benefits and after my surgeries all failed my doctor suggested that I file for my SSDI because I’d never be able to work again. I filed my application myself and was quickly denied due to not meeting Social Security’s idea of being disabled. My workers comp eventually exhausted once they seen I wouldn’t get any better and I immediately qualified for (SIBS) Supplemental Income Benefits Income through workers comp, however I once again filed for SSDI but was denied with the same excuse and that I didn’t qualify because I was getting the SIBS whereas I waited until my SIBS qualifying benefits neared the end where with the assistance of an Attorney I filed two more applications and finally went before a SSA Judge who approved my application and said I should have been approved 4 years earlier. However, he indicated that I had lost work credits and only qualified for SSI that only paid $162.00 per month with Medicaid that hardly pays for anything. Nonetheless, I’m turning 60 this year and wondered when I can try for my SSDI. I really don’t know what to do or who to turn too since my Attorney failed to explain this process regarding work credits, etc. so please let me know if you can offer any suggestions! Thanks…

I received so called retraining but it was entirely inadequate. And I was unable to compete to keep my job. Back injuries are caused by heavy lifting on the job to begin with.

Lets be fair, You will almost always be denied the first two times, not because you don't qualify, but because they hope you'll either give up or die rather than keep pursuing it.

There's a lady that does vlogs on KZfaq and she said she got approved on her first attempt and social Security didn't even send her to one of their doctors or psychologist. She said she has a bad back and is "crazy." She lives in a custom van and drives up and down the west coast with presumably no problems to her back or sanity. It's a wonder SS doesn't see her videos and decide to investigate her.

Someone told me they denied claims for years because as long as they hold your money they make interest. In reality they are paying out with the interest earned on the held monies. Its all a shell game.

My daughter has had MS since she was 25. She is now 48. She has been on medication for years. She was denied twice. She is in the hospital now after having a stroke, lost feeling in her right leg and foot, seizures for 2 years, and 2 aneurysm's. She is now also on kidney dialysis three times a week. She has been denied twice. She has been waiting for an appeal for over a year . Where's the help ??? She was almost homeless 5 months ago. No one cares. She has many medical records showing many mri's. AND ari's. Help please

Adding Mental illness ( Depression) and side effects from MEDS may help a lawyer get it thru on appeal. They generally take case without charge and get paid only if you win.

We could all see that the former baseball player was in no condition to work, & certainly, no employers are going to hire him to train for a new type of work. I wonder what planet these Social Security Administration workers are from. Certainly can't be from earth if they really believed that this guy was capable of acquiring & performing a new job.

5 years and 3 hearing's and i was denied all 3 times, Diabetes, high blood pressure, vertigo, acid reflux and a bad back has taken it's toll but have no choice but to get up and go every morning. I do not want to lose my home and i have to eat so i go. I'm 59 btw so i don't think age has much to do with the decesion, I was told because i work and because of my income was reason for denial. I'm lucky i have an employer that knows my health situation and works with me

I agree with you that being over 50 doesn't matter, or help, because I'm 56 and applied 2 years ago and I too was denied 3 times even after a hearing. I know someone who applied in her early 30s saying she was mental and she got approved on her first attempt, then I had an employer with cancer and he never got it and died. Go figure.

I got disabled for cancer, and by polar and after 3 years I went in front of the Judge with my lawyer 3 months later it was approved, they did give me back pay and all that but as you know during all that time I almost went homeless and none of those bastards at ssi cared so I agree with you and to hell with every one that run those dam offices.Karma Karma.

Try 3 years to get before getting a hearing date before a judge. When you can't work you end up fucked for three years. Denied twice with cervical spinal cord injury with permanent nerve damage and motor skill deficits. Was ridiculous. The judge apologized to me

im 46 ...A LOT of the details in my medical record were ignored, I have fighting for 5 years now and am currently at the appeals council ..next is federal court I am sure.i have nerve damage/failed back surgery along with moderate stenosis and a whole list of other issues ...as well and a nerve root wrapped in scar tissues with no diagnosis of arachnoiditis which is clearly seen in the MRI …..the system is willfully flawed.

The appeals court (or federal court, for that matter) will only remand the case to an alj if there has been a violation of Social Security law. It is irrelevant to them what decision the judge makes either with the Appeals Council or the Federal court, as long as Social Security law has not been violated. Sorry.....

Even in cases where the applicant meets all qualification criteria...they complain that there is such a backlog and there manpower has been cut. Seems to be self-defeating.

This is tyrannical and Mr. Doyle is not alone. 60% of eligible applicants are turned down until it is forced to hearing. Simply put, Mr. Doyle (part of that 60%) was eligible and entitled under the LAW to receive benefits when he initially applied. "Insurance" benefits, I might add, that citizens are FORCED to pay for all their working lives. The Social Security Administration violated it's own laws by denying him (and millions of others) for 3 years (or more, in many cases) and forcing him into a hearing before approving the release of benefits he was LEGALLY ENTITLED to. While it is true that he got back pay, they certainly didn't pay interest and penalties like those the government imposes on citizens when they violate the rules and laws, nor did they compensate for the hardships he endured while the SSA violated the law & his rights.

Disability did not even attempt to speak to my doctors.😢 Where are your attorneys located? Disability would not look at my green form. My daughter filled it out for me, my nueropathy prevented me from doing so.

I will be 60 this year. I've been self-employed Carpenter. For a long time now. And my body is beat up. Bad back bad right shoulder bad knees bad left ankle. Two elbows have tennis elbow tinnitus in my ears I'm pretty worn out. But because of my lack of Medical insurance over the years. I don't have a medical history I just had to deal with stuff on my own.

I am so happy for those who have only waited for 2-3 yrs for their approvals! It can be worse...much worse! I had to take my case to the Appeals Counsel, who, by the way, does not make their judgment on how the judge feels(it took me 7 years!!!!). All they are looking for is if Social Security law has been violated--the alj judge's personal feeling is not a factor in their remanding the case back down to the alj--violation of SSA law is the only factor. This also applies to federal court.

Yes--applied (denied); reconsideration (denied); 1st ALJ (denied); Appeals Council (determined that the ALJ judge made 4 critical errors in his decision; overturned 1st ALJ judge's decision; sent back down (remanded) to ALJ (usually back to the initial judge, but in my case it was sent to a different judge) with the instruction to correct the errors of law and to make a new decision))--2nd ALJ formally overturned the decision of the 1st one, and changed it to "Fully Favorable." (By the way, I misspelled 'Council' in the first post--it is actually 'Council', not 'Counsel'.) The Appeals Council does not usually render a decision on its own, save for something severe, such as a corrupted judge collecting kickbacks, etc., to alter the course of his/her decisions from SSDI law. Their primary purpose is to expose ALJ's errors in law, or an unsupportable attaching more weight to one factor than another, when the justification is just not there. I understand federal court is a nightmare, though I've not had to go that far, and I believe the SSA discontinues your benefits, and your $$$$$ increase exponentially for your attorney. Most attorneys don't particular like to take such cases, because the probability of their succeeding is very low, hurting their reputations. Still, they collect their $$ upfront. Total time: 7+ years!

A lot of these stories sounds downright frightening to think that I just started my disability claim on November 9, 2017 it just sounds like I'm in for an extremely long wait and lots of denials. I don't know what to do either because I can't go back to work.

+Princess Taboo Yes I've read some of your post among many others, and some are just frightening. I'm 51 but the way it seems when I talk to people that are waiting on disability, and those who have recently got their disability that you almost have to be at deaths door to get disability now a day. I believe it was a little bit easier in the 80's and 90's. Looking at these grid rules videos they don't make it sound so bad or so tough. But quite frankly I'm hearing just the opposite. I know this guy that hasn't been too long got his, but he didn't get his until he went on dialysis. That's pretty terrible and bad.. And he was in pretty bad shape health wise he was a really bad diabetic.

In 1988 a shrink told me I was crazy. I told her SHE was crazy, and left her office, convinced she was out of her mind. Happened again and again for years. Finally, decades later, another doctor pronounced me 'nuts', but added I qualify for benefits. No way. Way! And it's true! The state is paying me because I'm crazy. Crazy, huh?

Mr. Boyle is one of millions in this same situation. The lady, Rebecca, was 100% correct as well. One of my best friend's has a friend that works for the SSA and she told my friend that SSA AUTOMATICALLY denies 1st & 2nd time applications. As for me, I am going thru this same process. My issues started many years ago due to back injuries in the US Army (and no, I am not eligible for VA benefits) ending with surgeries to my back and knee. I am the same as M.C. from NJ. I also have major endocrine problems which also causes massive issues for me. Do I like having to go through this? HELL NO! Would I like to be able to work and not do this? HELL YES! And yes, my pride is significantly hit by having to do this.

The first time I was denied 3 times even after a hearing, then I reapplied 3 or 4 months later when I had exhausted all of my appeals the first time, then this second time I was approved on my first attempt, even though nothing had changed for me since the first time I applied. People say it's really luck-of-the-draw and a crapshoot whether or not you'll get it. I totally believe that too.

Guy H. as I replied on an earlier post, it depends on your diagnosis and your documentation. I went armed with a detailed chronological summary of my 17 ye medical history along with EVERY test, lab report, imaging, surgery report along with a cd that contained images of every imaging study I had done.

So according to what you said Social Security is just a stipend basically if you don't have any other income so in other words until all of your money is drained and you're at a poverty level of income you can't get Social Security disability which people are then left losing their houses and living off the state in poverty what a hell of a way to go fantastic system to bring everyone down to poverty level dependent on this date

It takes years for us to get disability. In fact, usual routine is to be denied twice, then you get a lawyer, go before judge. Normal.

yhen when you really need the help and you are on Medicare and Medi Cal or Medicaid you turn 65 and you lose Medi Cal/Medicaid and you have to start paying for Medicare. So here you are older and sicker but at 65 you will lose your assisted medical and now have to start paying to have Medicare, however you are usually still at poverty level. It is BS and hurts those that truly need the help.

That is why if possible, DO NOT TAKE ADVANTAGE of this Program, use it for your life, get healthy! you will have to work hard to get Better! because the system is giving the Bare Minimum they don't give a Crap if you sink deeper in poverty! being on ssi will take years off your life once you try to return back to work, I had no one no family not any to help give me a ride to my doctors after surgery, I began to get depressed you have to live on a strict budget after your savings if you had any i did, but if your a/c goes out your screwed I'm Glad I had four years of college building US Naval ships beside the Marine Corps, i had good trouble shooting abilities, my a/c went out and used UTUBE to fix it basically you have to want more after your ssi and you will suffer and you will get hungry but it only makes you stronger, Pain is weakness leaving the Body! by,... it took me 9 years to get SSI not SSDI, they finally said that because I hadn't worked for the 8 years I was trying to get SSDI I no longer qualified for SSDI so instead they gave welfare SSI and less than 1/2 if what I should be getting on SSDI, I only worked for 45 years paying into SS and some times at a very high %. SS is a CROCK

@@lucieelizabethannwesson7016 yes I know that but the reason I didn't work is because I couldn't and they drug out my case beyond the 10 year years they go back to look at work history. I do know how it works, they kept denying me and sending me to different Dr.s and my file was sent so many different people in their system which took even longer to deliver my file between different states and personal. I had 2 different attorneys because they finally gave up fighting with the SS Gestapo I ended finishing the fight myself, and WOW they couldn't find my file anymore to prove that I had been fighting with them for the past ?? 8-10 years and I should have been fully covered. But since I was past that 10 year mark I got screwed.

I got hurt four and a half years still fighting for my Social Security. They said I had a good job working ,yeah I was a good slave but in the meantime you starving here you worked all your life and they reduce you to begging for your benefits that you paid all these years for. I have 600 pages documents of medical care and the surgeries I had and the ones they are still pending.

I do not understand why anyone would even go into this process without an attorney...................If they feel you do not have a chance then they won't take your case anyway normally so what does one have to lose? Nothing! Always have an attorney when going through this process.

I respectfully disagree ...... If you have your ducks in a row, have all the medical evidence, I wouldn't apply, at least initially, with a lawyer and have to give up an amount of money which can be up to $6,000.00. If you don't have as much medical evidence and your case is "weak" then perhaps it might be better to go with an attorney. Just my humble opinion ..........

And...that he is a good reputable attorney. My first attorney lost my case. He somehow not only managed to piss me off before court because he didn't have all my records and messages I had left for my case, and said his para wouldn't lie about me not calling and leaving this information. But Me? The client? would lie? about said pertinent information??? I flipped, and knew I would lose. My second attorney reviewed the court documents and asked me if I had done something to anger the judge. I never got the chance to speak on my behalf. My 1st attorney didn't have all my records on file! Most importantly, a legal form that the doctor should have filled out. New attorney also mentioned that my first attorney wasn't a very liked attorney by many. My sister won her case by 1st attorney first time around. He did nothing for me, and I had more history with health issues as well as two surgeries within a year and in a chronic pain management program. Just don't get how some can win so easily and others have to battle it out.

This edition, the "work credits" would have been good to touch on. People get shortchanged on Disability because they can't file, if it's been 5 years since they worked. this period of falling out of eligibility is silly...you work for 40 years, then you don't the last 5... not eligible to file.

Let me tell you. They look at the assets you have also. You have assets they expect you to get ride of them. They do consider them towards how much you get also. They made me sell everything I had worked my whole life as a automotive technician where I made real good money. Its also all the project children on it out there selling their drugs. Just another way for the government to hold or get our money. We're taxed when we make money, when we save money, when we spend money and on any property. Talk about double taxation. That's what we need to be fighting!!!!!!!!!!. That and these wages these politicians think their worth. Most us working class do more in a week than they do all month.

Actually, it depends. If you're getting SUPPLEMENTAL SECURITY INCOME, your assets will be included on the determination. This is for folks who made under a certain amount (read slightly above poverty level). For SOCIAL SECURITY INCOME-Disability, how much you made (and you have to have worked 25 quarters) your assets are not counted at all. Know the difference between SUPPLEMENTAL SECURITY INCOME and SOCIAL SECURITY INCOME/DISABILITY. Hope this helps!

Steve Calson ~ If you worked and paid taxes then why would they look at your assets and tell you to get rid of some things? They don't do that because I know someone who got on federal disability and she owned a condo and had a new car. My only guess is when you were working you were getting paid in cash and not paying tax on it or either you had stopped working for at least 5 years and could no longer apply for federal disability but for SSI instead.

Unfortunately this process makes you give away a large portion of what you're entitled to to a lawyer. And after years it doesn't come close to pay off what you borrowed to feed your children. Then my kids suffered for seven years because they conveniently forgot to pay anything for them. I understand I was not the only one this happens to. My kids could have grown up so much better.

Actually, an attorney is allowed to collect 25 percent of your back due benefit when you're approved and that's it. If it took a LONG time (2+ years) to get approved and you received a large lump sum of back due benefits, 25 percent could definitely add up to a lot depending on the amount of your benefits.

They deny everyone the first two times and you always have to get a lawyer to help you so when you walk into the hearing in front of the judge they do all the work to get your disability. This is classic.

Wyndie Featherstone Not so. I was approved immediately. Also, I've never set foot in a social security office. Everything was and has been done over the phone. Beings that my heart has only a 9% EF rating that is backed up by Echocardiograms, there was no fighting.

I had an attorney, they deneyed me twice, I'm in a wheel chair and still had to fight, and I worked 31 years for the same company, and I had to get an attorney...sad..

You’re comments are wrong. I was approved the first time and without an attorney. Your diagnosis and documentation are significant in the process. There is a published list of illnesses and disorders that are accepted by SSDI. I had two of those disorders along with 17 yrs worth of documents leading up to and finalizing my two diagnosis. I took in a 5” ring binder full of documentation and a chronological summary of every Drs note, lab test, all reports of X-ray, cat scan, spinal tap, MRI, bone marrow biopsy, pathology, surgery, rehab and PT along with any other misc treatment by a medical professional. I also had to be examined by a doctor of their choosing. He told me he didn’t know how I had been able to work as long as I had. IMO, an important key is to have detailed documentation and also read up about your diagnosis and educate yourself about what’s going on with your body, go in acting like you’re looking for help, not just money.

A bill passed in 2014 HB 803 was passed for monies allocated for job training, a lot of companies don’t hire older people they want younger and under experienced workers. I know people who been on ssi or ssd younger then me who got quicker because of mental but if you have physical it’s harder , why the difference

Are we going to be cut off ssi or back I COPD and azma I have arthritis depressed blood clot in my knee. And I am 43years old and I have mentel issue s and have my service dogs for that.

Help I have multiple sclerosis dx 2015 i am 50 years old and I was an artist with ligit business and after 5 years of college was hit with car and got wiplash.and was able to work from home as artist. Years later after diagnosis and years of injuries my husband wants a divorce and I cant get on disability. Ive tried several places. A lot of artist have committed suicide please help

Here is the main question that SSDI ask and answer. Can the person with the disability work a basic entry level position? They don't care if you can't do your current job. Many focus on other questions like I can't drive...So What! Millions of remote jobs. My hands shake due to Parkinson's...so what! Here is a valid reason...If you fall asleep every 10 minutes, THAT would prevent you from a basic entry level job. I have explosive diarrhea every 10 minutes. Will you be fired after day one etc.

I been fighting SSI for over 8 years and still no farther then when I started.. I been in front of the judge 3 times and going again in a 6-8 months. And 3 times the vocational expert has said there is no way I would be able to keep any job and I have 3 doctors says I will never be able to work and all the test to back everything up and still getting denied !!

I have copd and just lost my job for being out sick and coming in late I just can't breathe good anymore and I sleep when I need to be awake and I cannot help it? Should I try to sign up I'm just not able to get up and going like I use to I've never been lazy

COPD is a debilitating factor. You must have a proven medical history of this that drugs aren't helping. Know that almost everyone is denied the first try.

Your situation is quite similar to mine. There's no reason not to apply. I had a good attorney and paralegal help me, although you can file on your own. There's no requirement that you have to have an attorney or a representative.

@@aaronhadley3750 it's better chance if you do have legal representation though. I had 2 different lawyers the last one got it for me. You also HAVE to go to your Dr appointments religiously. If you don't they will think that you really aren't disabled. I have to go to to my therapy, take my mental meds and go to my physical/primary Dr appointments.

SSI is something different than SS. It is a welfare payment and it doesn't depend on a work history. Eligibility for no-nncitizens depends on a number of factors. SSA has a wonderful web site

I started getting SSDI at 38 an still do at 45. I never had a problem getting it. I applied and was approved within 6 months without needing a lawyer. I did all the paperwork myself.

I agree that it depends on the disability and if the proof shows up on test. And if you have a doctor that wants to help you get it. Some doctors don't really care and they think you are faking.

No matter what the case is almost every case gets turn down the 1st and 2nd time and you have to appeal it. That's part of the process it's not personal against one person ... like I said they turn everybody down usually on the 1st round.

They know your disabled but they drag they're feet for two yrs bfor the finally say "Ok, well issue you a check" its a bogus waiting time. They space you out so far so they don't have to spend more money. Its all on a time limit. 2/3 SS application r shoved to the back of the line ON PURPOSE. Y, it saves them OUR MONEY. My guess is they get a kick back for every case they deny.

all of it was tagged as untouchable when the program started, clinton had congress change the law/rule so it could be raided whenever they wanted money for pet projects like this SHAM impeachment process

They are separate accounts. SSI comes from the general fund from the treasury department and is welfare. It’s not SS or disability! SSDI is social security disability and is paid by the SSA social security fund they paid into.

I am above the age of 50 I have worked all my life. In 2007 I filed for an increase in disability based on T.B.I and headaches and continued struggling to work. When I became so disabled that I could no longer work due to my service connected disabilities two years later I filed for 100% unemployable status based on tinnitus, lose of hearing, gunshot wounds, severed-reattached hand, two broken places in my back, Traumatic Brain Injury, ankle and a busted knee. As you know this process can take many years to accomplish. I was already awarded 70% and was forced to live on only that for about 6 years while homeless. After finally being given the opportunity to be evaluated by VA based on my claims VA sent me to a group of doctors. VA sent me a letter a month later informing me that Based on their medical opinion I was to be awarded 100% P and T. based on their findings in the case of T.B.I and headaches. VA stated that since i was to be awarded 100% P and T the case of Unemployability was a moot point thus denied. Great news right? Well I called the Social Security department immediately and they stated that they could not help me because I had not worked in the last 5 years. I told them that I had been truly unable to work, that I filed federally through VA. They stated that there was nothing they could do. Long story short, I get nothing from Social security! Also, I have received several letters from VA since I stared receiving my 100% P and T award where VA admits that I filed my claims in 2007 of T.B.I and headaches but somehow fails to award said back pay from the date of filing. They keep sending me these letter claiming that if I wish to pursue this I can get an evaluation. Say what? Does one department of VA not know what the other is doing? It's as if VA doesn't know the most recent evaluation by their own doctors is what got me the award of 100% P and T! Summery:Even though I am now a 100% P and T disabled vet, I will receive NO Social Security Disability and NO back pay from VA. Can anything be done?

Did you have a lawyer who specializes in military disability? If not, it might be worth contacting them. . Go to this site www.jag.navy.mil/ides/index.html and click on "find local attorney" or do a search for "military disability lawyer" or attorney. That link is for Navy & Marine branches of the service, there is likely a website for the others. Know that you can go through them OR get a private disability attorney. Some of them are retired JAG's. Don't let that they are private instead of in the services keep you from investigating all your options.You may be able to get a no cost consult from one or maybe two attorneys. VA disability is very specialized practice area of the law, so be sure a private attorney is specifically experienced- ask about their previous cases, successes, and not just with SSD but military disability. Their website may detail that info. If they believe they can help you with back pay, or work out the SSD, they can explain how they could work with you and under what arrangement. Good luck.
