If your disability is based on a mental health diagnosis like depression, anxiety, PTSD, or bi-polar disorder, what evidence do you need to win #socialsecuritydisability ?
Depression, anxiety disorders like PTSD and mood disorders like bi-polar are very frequently seen by #socialsecuritydisability judges. Even people with no history of mental health ailments will experience depression and anxiety if their physical problems like back or joint pain prevents them from earning a living or interacting with friends and family.
Because so many disability claimants report depression and anxiety when filing for disability, the evidence you need must be compelling to win your case if mental health problems are your primary impairment.
In sum, the level of impairment you must have to win #socialsecuritydisability if you are relying solely on mental health problems is high and your testimony alone won’t be enough.
Instead, you need hard evidence like records from an inpatient psychiatric hospitalization, documentation of suicide attempts and proof that your psychiatrist’s medical management of your symptoms is not working.
In 2023, a diagnosis and medication prescription from your family doctor just won’t be enough.
In this video, I discuss the type of evidence that I have found to be most convincing to judges.
I also talk about problems I have had with VA records and why I don’t like to rely solely on VA medical evidence in a mental health claim.
I also discuss how mild to moderate mental health issues can make your case STRONGER if they exist in addition to other impairments like back pain or organ damage.
Mental health problems can make it impossible for you to work, and I want you to know what I have learned about what works in a #socialsecuritydisability case.

They're a bunch of thieves. That really is disheartening. After 24 years of service to this country, I've also filed an appeal. I'm going on 3years and still waiting. We paid into a system who stole our money and left us to struggle and suffer.

I'm in my second review now and I will probably end up calling you. I should be getting a decision within the next week or two and after watching your video, I realize I may not be approved. I have awful ADHD and BPD as well as PTSD. (I am a kidnapping and torture survivor) When I went for my appointment I was not able to articulate all of my symptoms because the ADD was really bad that day, there were so many distractions and people were being SO loud in the lobby. I apologised to the lady and told her I couldn't think properly at that moment because my ADD was really bad at the moment and can't think of all my symptoms. But I did give her a few including that I was a kidnapping and torture survivor. I just don't know what else to do. It's really hard for me to keep a job. I've never had a job over a year and I'm in my late 50s. As soon as I hear something and if I need you, I'll give you a call. Thank you for having this channel.

All that treatment,therapy costs money...Icu RN 22 years.. covid took me down even more mentally, emotionally ,and physically,than before... I cant walk, work, see( keratsconus) , my OA is out of control.. I dont leave the house and I used to be the pta mom, team mom, Girl scout cookie mom, ICU RN w/13 hr shifts ... " Danielle, sit down" is what I heard ALL THE TIME.. No income- I've lost my car, losing my home, have ill bi polar "unreliable, irresponsible, unkind, not helpful" husband .I cant drive, ambulate, sleep, the pain is insane . I'm lost. My daughters deserve mom back..I need 2 hip replacements since having, working through,COVID. And a shoukder. coincidence ? Maybe.But now my Rock, my dad, has AML... I see why ppl drink, smoke, etc.. being a patient in this country is impossible. Our car is required to have insurance, but the human driving it is not.

Thanks for these videos Counselor, very informative. This whole endeavor is a time consuming, stressful effort. Got my first denial letter last week, after a year of waiting on the application result I am no suicide risk, seems like it will just be what it is and not worth the angst. The problem is, no one will hire an old guy. I get it that too many folks try to game the system, but when you have the evidence, the medical history, the treatment regimen, and still can’t get the assist?!?

My attorney was almost like your twin in personality, voice, way of speaking, and even looked very similar. Thanks to your advice I was prepared for my meeting with him, my C.E. with a psychologist, and my phone hearing. I did what you said in the "Beware of Consultative "Evaluations" Required...." and did my best at the C.E. and it was her report that helped the judge decide in my favor. But I`m also being treated for chronic pain and have been taking opioids since 2017. My doctor says my neck is too far gone for surgery on top of three serious mental health problems. Thank you sir. I would have been bewildered without your knowledge to guide me.

My husband strangled me, I have severe PTSD from this as well as depression from loosing my brother my mother and my father and recently my home. I have struggled with addiction and have recently dealt with police. I filed for SSDI I have not worked for a year. I need help and I can't find anyone who will help me without having to be poked at by a bunch of doctors. I'm tired of tests...

ive had sucha hard time maintaining a job for 15 years. I am trying medication and its not working, trying excercise and eating well and not drinking and feel awful all the time. Im going to try and get a case won.

I gave it a 5 star just now. I was denied at the initial level because they didn't think my mental issues with headaches and chronic pain in the back were severe enough. I am diagnosed with anxiety, depression, and trauma and and Osteoarthritis and a pinched nerve in my neck. I appealed for reconsideration and my neurologist is approving for me to get an MRI and prescribed a muscle relaxer and the VA is providing a back brace in addition to my many medications and ongoing treatments and counseling. I had a concussion in the military that left me with head pain and bleeding on my head and many years later, a couple crashed in behind me on the interstate and totaled my vehicle.

I have severe spinal stenosis through out my back and c spine as well as osteoarthritis through out I have torn meniscus in both knees both hips are torn severely both shoulders with full thickness tears degenerative disc disease through out my entire body as well as carpal tunnel in both wrists...I have major depression..anxiety disorder..intermittent explosive disorder and my phscicatrst has literally tried me on every thing for the past 17 years I lost my ssdi hearing a year and a half ago because I was 48 years old I have worked extremely physical labor jobs all my life and paid in a substantial amount of money Now im.getting closer to 50 and have lost any back pay I would have and should have gotten. And probably will loose my monthly payment I should have received. I can honestly say that the ssdi system is designed totally to destroy people

I was injured at work 4 years ago, ended up with a C-6 fusion. Nearly a year ago complication in nerves reopened the case. Been going through hell since. Occupational dr, surgeons, scans, pain management, and all the troubles involved with these medical personnel. I had depression and ptsd beforehand, but this spinal issue has destroyed my life, my lifelong hobbies destroyed. My symptoms are off the wall. Displaced reality, explosive anger, sadness, backed away from people & avoid interactions with public at all cost. No way for a person to live. Im still working full time but can't do 70% of my job, at work in pain both physically and mentally. Its like risk management doest even care.

Very well said. I think there are three levels. 1. Gen Z types who are pretty much anxious and sensitive to everything and don't have the tools to deal with life in general. 2. People who have depression/trauma and can't function. To the point that it is a disability and interferes with their daily life. and 3. People with severe mental illness who have been battling their whole life with medication, suicide attempts even, hospitalization etc. Even though it is a mental disability and it has affected my entire life. Even though I have had medication, therapy etc for years and it is a struggle. I will not qualify for benefits. That's just the reality of it. Society is not quite there yet. That's ok, at least I am clear that going down that path of filing to claim SSD would not work out. It really needs to be a years long process of gathering evidence, putting myself through medications that cause more harm than good. Therapy/meds/testimony/out of job ain't severe enough in this case. I understand. It's just a strange no mans land people in category 2 live in.

Thank you for this video. I am wondering about the episodic nature of mental disabilities and how that affects a claim. My medical evidence reflects a wide fluctuation of symptoms and functionality, spanning several years. I have had periods where I have semi-successfully worked and gone to school, and also periods where I have been housebound for several months due to symptoms. Because of this, if a judge looks at the medical documentation, he or she will notice incongruences of severity. I have heard the advice “answer the judge’s questions based on your worst day of symptoms”, but will the judge find that testimony credible if past medical documentation describes a higher level of functioning? Thank you.

I am wondering same thing! I recently realized that my "migraines" are most likely not from me putting two conracts in obe eye bc of my ADHD but actually episodes of "transitory temporary monocular blindness" All specialists basically gave me shoulder shrugs bc there is no physical damage detected. Went for neuro psych testing and they said that my memory loss (of emotional news like my cousin having cancer) and the blindness are somatic but board certified somatic specialist I saw 7or8 yrs ago that I definitely do not have a somatic disorder. As soon as I have one Dr. say I am anemic, low in vitamin (despite geaalthy diet) and that I have fibromyalgia, only for the next Dr. says none of that is true, and I am drug seeking and dx me being a hypochondriac bc I "take too many vitamins." I have good and bad days, weeks, months, years. No one wants to hire someone they can't depend on at all! I need help just nanaging myself. Sometimes, if I am awake, I can't even manage to play KZfaq videos or anything - eating is literally a struggle, and other days, I am fine. My family is seriously impressed if I do the dishes and a load of laundry in the same week. In less words - I feel ya

SS recipients SHOULD be ALLOWED to have enough in savings to fix their vehicle. You should be allowed to have enough in savings to get tires, or save a down payment for a new car. You should be allowed a 6 month emergency fund. Enough with the 2k cap in assets! The value of the dollar was significantly different when that was set up. It's not enough for an emergency now. The only way around SS assets is the Able account and only then if you was disabled before age 26? How can we fight for change? I want laws passed. More reasonable rules. Like working a whole 10-20 hours a month should no longer be a reason to target people for annual or however often reviews. It's good to have tax money on wages. Taxes that pay back into ss. Stop fighting people working for an hour. It's good to try. It's good to contribute. But they are so hyper focused on taking benefits away or catching the so called 3 percent of "fakers" they're losing out on tax dollars that could be going back into the system My belief ss is losing more money (taxation) by people not working when they can, then SS is saving trying to catch people supposedly faking. People are made to believe they aren't allowed to work. The question in my mind, is this intentional? Again so called fakers are ONLY 3 percent. We disabled folks have imaging, labwork, psych reports if applicable, Doctor reports and numerous Dr visits including specialists and their reports including ss's own doctors. Very few slip through the cracks with today's strict process. Social Security office worker actually told me if I work failed and used up my 9 months I'd be homeless. Very encouraging right? Imagine telling a disabled person if she work fails she will be homeless! Where's the accountability? Oh that's right only the disabled get punished! People are rightfully terrified of trying to work. Let's change that. We should have a RIGHT to do as much we can without them trying to make us homeless when we fall. It's really simple just don't pay ss that month if it's not needed. Those people in the office are biased towards those wanting to find something we can do for just a few hours. Apparently we should stay in bed. These are ableists attitudes and are not helping ss's bottom line. So when we work a few hours Too bad for us if we are in bed for a week. Cut them off! They aren't disabled! Quite frankly it's discriminatory to targeting folks for trying. The rules need revamped with common sense keeping disabled folks rights too People do feel targeted. Are we asking if this is true? Are we preventing it? What are we doing to raise the asset amount? Trial work months. Why is there only 9? Look how many illnesses have good days and set backs. Sometimes working puts disabled folks flat on their backs for a week or more. WE NEED THE SAFETY NET. If people wasn't afraid of losing that safety net, they would try to work. SS would rather spend thousands to save a penny, than spend a penny to save thousands. Reviews: People that are never getting better shouldn't have to worry about frequent or periodic reviews. I can't get a new body. It's never getting better. Period. SS should be required to be better stewards of their manpower and resources. I should be allowed to work if I can without fear of possible retaliation disguised as a triggered review. Just don't pay that month, don't take us off disability altogether. This is why we are afraid to work. Why don't they have common sense rules? Be the safety net it was created to be! SSI: On SSI the first $85 in wages don't count. Let's make it $350. Or $385. Or even what you said just don't count the first $6k like your video mentioned. We need to make enough to make it worth driving to work (gas, maintenance, insurance, car payments.) SS should be required to encourage working. Really and strongly encourage rather than hyper focusing on yanking the dang rug out from under folks. No one should be afraid to try. With funding running out, they should be thrilled to have tax money. I get they're trying to save resources. They could start by encouraging work and in turn increase taxes coming in. But instead, for those following the rules it,appears that they get cdr and work reviews triggered. Anything in their power to force folks off ss. SS that I paid into . Kinda like spending a hundred dollars to save a penny. It doesn't make sense, and it's only hurting what they are trying to protect. What can we do to hear us? Writing state reps? Create a movement. What do we need to do? Why does the ss office have a big screen tv on the waiting room? We can't afford luxuries. Why does SS lose paperwork, medical records, give inconsistent answers, and waste tons of papers. Wasteful postage. You can ask 3 agents questions and get 5 different answers. Hold each other accountable! Be better stewards of resources. Someone disabled needs in charge of making these rules. Non disabled obviously isn't capable. They tho well meaning just can't possibility understand.

I already have won but what about for learning disabilities? I am inattentive, never finished school work, didn't have a lot of friends and prefer to be alone a lot. In school I was not known to stay "on task". I was not a bad student and in fact never had one detention in school, I just simply listened when the teacher asked me to stop doing something or warned me not to continue it, whatever it was. I just had a really hard time with some aspects of math such as long division, I have no problems with simple addition and multiplication but once a lot of digits are involved there will be no guarantees that I get it right if I even complete it.

Counselor, Im coming up on a hearing here soon. I had a cervical fusion surgery, and a disctomy in my lower back L5 in july of 2023. Also i just got diagnosed with ptsd chronic, anxiety disorder, and unspecified mood affective disorder. What are my chances of winning in your opinion? I hope you can respond. I also look for mental health related arrests - seriously mentally ill people often can't regulate their behavior. Things like public nuisance, vagrancy, disorderly. Not things like burglary, or fraud, which are more related to psychopathic personality and require the ability to regulate behavior.

That is awful! Bipolar and schizophrenia should be as "easy" as epilepsy. Yes, they are treatable, but in many ways, treating them becomes a full-time job, like dialysis is treatment for kidneys damage.

I had a series of psychiatrists that worked part time and eventually quit. They were pretty much pill refillers. I haven't been able to find a job for over 5 years, I have applied to hundreds. When finally, I did get an interview, the interviewer saw that I had high anxiety, depressive behavior, angry, moody among other symptoms that made me get rejected. Would letters from people who see that I'm not getting better help my case?

Testimony letters do count and has weight (it helped in my VA disability claims). If you can get an RFC by one of your psychiatrist, it would really help in your case because it is by a medical professional and it gives the SSA a picture of how bad your disability is.

I have a question I am a diabetic and I've been suffering with diabetes for some years now and I also suffer from high blood pressure but for the past couple of months my hands been having like numb feeling and tingly feeling in it and hurting really bad my feet been having the same problem my legs and my knees but having the same problem I take 4 injection pens a day and I take 2 blood pressure pills a day in also I suffer from having low iron too I'm always weak in tired sometimes I can't even function at work or stand to long or bend sometimes my sugar drop constantly when I'm at work in I have to leave work I stay dizzy in have headaches constantly at this point I'm tired do I have a case to try to get disability?

I’m 23 I have anxiety, Depression & affective mood disorder I also have a learning disability. I applied for disability in November 2021 and I was denied, now I’m in reconsideration and I have a lawyer. I have a therapist & psychiatrist, my psychiatrist can’t seem to find a good medication combination for me I’m on 2 mood stabilizers I’m also on a antipsychotic & antianxiety medication. I have PTSD and related symptoms. My doctor filled out a Mental Health RFC but the CE examiner when against what my doctor wrote up. My doctor wrote another Mental RFC form in my behalf before my hearing next month. I do have solid medical evidence. Does my doctor opinion have more weight than the CE examiner? Will the judge approve me with my medical records with a current RFC form from my doctor?

I have all for SSI I've been Denied twice. I have bipolar disorder and panic disorder and am Completely blind in my right eye.. I've had the panic disorder and the bipolar disorder all my life and have not worked enough.. i have a hearing by phone in August?could i have my grown children and a friend, write a letter to the judge regarding my disabilitys and struggles, that they have seen and known about my life .. I HAVE A LETTER FROM MY PSYCHIATRIST THAT I AM CURRENTLY UNDER CARE OF HIS CLINIC AND HAS BEEN RECEIVING PSYCHIATRIC TREATMENT AND THAT I AM INELIGIBLE TO WORK FOR FIVE YEARS CONSIDERING MY UNDERLYING MENTAL HEALTH CONDITIONS. I have microscopic colitis (ibd). Anxiety disorder has made it worse and the ibd makes the anxiety worse. I have a great psychiatrist, GI doctor and Neurologist (stroke 10 years ago). The anxiety disorder is making everything else worse. Should the anxiety top the list?

My medical records were acquired, meds only for years. Never could see Dr for Mental help like psychology. I was awarded SS Disability based solely on depression and anxiety, not on 12 surgeries on hands, wrist, elbows and surgeries.

I am schizoaffective been on my meds for years now. my anxiety is so high when dealing with this I feel like the lawyer just took my case hoping they get some money and dont really do anything for me. Obviously I know I can be paranoid so I am just looking for people in these situations and had a positive outcome.

I am TDIU 100% P&T for depression related to constant pain due to a back injury that i received in the service which i have been awarded disability for as well. I am under the care of a psychiatrist at the VA. I also have numerous procedures on my back every year just so I can walk. I am 60 y/o and filed for SSDI a year ago for my depression and my bad back. They just scheduled me for a doctor visit for my mental disability. Does anyone have any advice for that exam? They scheduled it with a family practitioner in my local area . TYIA

So if you have PTSD and can not work but have not been hospitalized or attempted suicide and you are being treated by the VA, you will not qualify?

Hi Thank You for your Excellent Videos. We would like to know what are the Legal Citations for Federal Laws that exempt Social Security Disability Insurance income from Debt Collection. Thank you. Regarding there being more than twice the amount of monthly Social Security Benefits in a Bank Account, we were told that if that Bank Account is levied, we can file a Claim Of Exemption to have the Social Security Funds in the account, exempted, protected, unfrozen, and released from the Bank Levy. And who is the Levying Officer, how is the Levying Officer contacted and served with the Claim of Exemption? Thank you so very much.

Look at Section 207 of the Social Security Act - faq.ssa.gov/en-us/Topic/article/KA-02357. I would ask your bank to set up a sub account where only SS money is deposited and make sure the bank codes this sub account as being exempt from garnishment or levy.

I have borderline personality disorder, major depression disorder, ptsd, ocd, my stress levels cause me physical pain. I went to an in patient in 2022. It was 0 help.

Can you give information about trying to get ssi for autism for an adult. All the videos on that I've seen are for children.

It is really going to depend on the record. If you are not getting on-going treatment then I would try to get some sort of formal vocational assessment. These cases are tough because often there is not ongoing psych treatment.

It took me a long time to even learn how to get treatment for my mental health. Thank you so much for the information.

John, you don't win or lose disability based on a diagnosis. The question is how these "non-exertional" conditions impact your capacity for work and how strong is the evidence.

Disability said they didn't get my Dr."s records. I tried contacting my psychiatrist I have been going to since 2015 I believe. I found she passed away last month. How do I get my records? I don't believe she had them electronically stored. They were all in paper files

I have a question. I was approved for SSI last year on November then got one month of payments ($841) then my SSI was suspended and I was switched to SSA disability. My initial disability onset date was 6/20/2022. I received the few months backpay as well. then I logged on my SSA account and it stated that I had a new disability date which was 2/20/2018 and a new back pay was set to come (a larger one)?? Now I logged on my account and now my SSA is suspended and now I don’t know what’s going on? Did they make a mistake and are correcting it? Why the suspension?? Thank you

Don’t you think that mental illnesses are diagnosed way to much with little evidence that medications will help ? Many time the medications lead to more severe symptoms 😢.

Opinion evidence from social workers is not given much weight in SSD cases.

Too bad we can't all have you as our social security disability attorney. Some of the people you recommend ask for your age, and if you are not of a certain age, they won't even bother to evaluate your case. That's very disappointing.

In SC my son is schizophrenic. Mental health Dr says he can't work. He went into the prison system in his early teens. So work credit not possible. PTSD, Schizophrenic, depression.. tried repeatedly applying for assistance. SSA says there federal and son doesn't qualify. Try state aid. Is this true?

I don't know why ss is taking so long to pay you back...I got approved in May and got my back pay in June and this month. But I did keep calling the offices non stop about my back pay.

Attorneys aren’t supposed to “tamper” with clients that have a lawyer. I’m very careful to make sure prior attorney is discharged before i offer advice.

Jonathan was absolutely right about the things he said that may qualify you for mental health SSDI. You can’t just have the blues. They indeed want to see things like hospitalization. Records from medical providers are super important. Being in therapy is big. Being on a lot of meds and having TRIED many unsuccessfully. What do those drugs do to you? Make it dangerous to drive, for example? THAT makes it hard to work. You can’t just prove you’re disabled. It’s about why you can’t work. I was approved after my first hearing. I submitted a HUGE list from my pharmacy of the zillion psych drugs I’d been on/am on. Some, as I said, do not mix well with driving. My hearing with the judge was murder. I ABSOLUTELY thought I’d lost. I stammered and stuttered through it. It was awful. I just knew I blew it.

In my experience if a judge wants to deny you, he/she will cherry pick statements from medical reports ("patient reported that she was feeling better and had more energy") and from your testimony ("claimant testified that she took her kids to and from school and prepared family meals"). The issue in mental health cases is that there are no objective tests like MRIs so whether you win or lose is dependent on whether the judge believes you.
