The warning shot falls into the category of discharging a firearm, which is a crime, and because the perceived threat of deadly force is distant rather than immediate, the warning shot fails to qualify as self-defense. Self-defense is a response to an immediate threat of grievous bodily injury or death.

One of the situations defense can be good is when they defendant is innocent or the cops were bad and rights were ignored etc. There are cases when the defender is the good guy and when the prosecutor is. It really just depends on the side they are on.

I don't know the law, but being dump is the same as being reckless with evil intend. Bringing out the gun and unlock the safety and even shoot is being reckless with evil intend. Having a faulty gun is dump and is also evil intend. It's your gun, you hold it in your hand therefore it's your responsibility that the gun doesn't shoot anybody. It's your responsibility to make sure that the safety works, and your responsibility that the gun doesn't fire if it bumps somewhere.

I haven't watched this yet, but in the opening statement he said that, too. He's claiming he shot the warning shot into the air, and during the stumbling is when the fatal shot happened. His "thank god nobody got shot" remark is what he's claiming the murderer was thinking at the time.

I lived in the woods in rural Alaska for ten years. I now live in rural California. I also have lived on a property in the middle of nowhere in Northern California. I have had cars, motorcycles and four wheelers come on all these properties at night. I had guns. I had a twelve gauge shotgun by my bed. No way in hell would I have fired that gun without verbal contact. Oh, I’m old too. Not so old that I can’t tell a teenager when I see one. And I would never keep a gun that fired on its own.
