I got spinal disease 40% depression10% total 50% service connected. I worked as a cement mason for 27 years at51 years old I could not do it anymore. I had a lot of experience so the union would send me to jobs.That no one else wanted to do. Most of the time. I would change jobs daily or weekly plus it has been 10.5 years since I have worked. I don't understand why they want to talk to people from that long ago. They have my s s d I records.I have been on s s d I for 7.5 years. What do you think sir?

I'm TDIU. My claim took three years and five months(3yrs5mos) immediately following discharge. Approved on first try. Unemployed. If it weren't for my spouse's income and her medical insurance, who knows where I would have found myself? I was unqualified to navigate the claim process. It took me six years to wrap my head around it, I still don't know what happened in the processes from discharge to medical retirement(Chap 61). A process of acronyms and idiots. Social Security took 105 Days, they retro'd me back to my discharge date, as did the VA. I was also awarded CRSC, they did NOT retro their date. I lost $30,000 in CRSC benefits over that 3yr 7mos period.

TDIU can be permanent, but it's not always. It depends on your situation and whether your service-connected condition can improve. The VA also monitors your Social Security earnings if you receive TDIU benefits. If your income increases above the poverty line, you may need to argue for the continuation of your TDIU benefits. Which is better to do at 80%? With other claims to file? Fight it out to get “regular” 100% rating Or apply to just apply for TDIU? I do publish books for fun on KDP to help stay a tad sane but they don’t make much money if many times at all. Generally this is still deemed unemployed.

A single 100% rating is not easy to receive because it means that the condition you're experiencing is severe and is considered totally disabling. Also, the VA can reduce a 100% rating is they can prove that your condition has "shown material improvement." TDIU benefits pay the same as a 100% rating. The key difference between a 100% rating and TDIU is that you can work with a 100% combined rating if you're able. You cannot work with TDIU. It takes a long time Va sent me paper work it’s complicated you have to go back for me, I have been out of work sense 2018 have to go back to all the people I work for to get them to sign off on a DBQ switch jobs every 6 months on the average people retired or not with the company’s anymore ! I know I’am TDIU short temper, can’t handle being around a lot of people, can’t do the work due to my service connected issues! Chronic pain, depression, stress, anxiety, on medication now managing my mental health issues ! Working with a VA psychiatrist doctor now for the last two months ! Congestive heart failure 2012 , severe case of sleep apnea diagnosed by the VA 2013, threw a sleep study full face CPAP fitted mental health issues , depression, stress, anxiety 2022, and PTSD awarded to me in 2018 ! Hopefully P&T 100% I feel underrated at 90% and stuck here ! Need help

I just got my PTSD service connected award at 70% and the VA required that I fill out my TDIU documents because I was recommended for the highest rating by my C&P Evaluator. Can you tell me the length of time it will be for me in this situation? I did complete the 2 documents they said to complete and return to them for TDIU. However, there was nothing else that they required from me. It seems very clear cut at this time.

The good news is you meet the rating criteria for IU. However, the VA is pretty unpredictable with its decisions. If you get approved for IU on your first application, you won't wait too long. If you get denied and have to appeal your decision, you'll likely be waiting much longer.

@@woodslawyers I was immediately approved and now going after my next claim for OSA secondary to PTSD. However, I have to be sure I have the "link" which I am looking at racing thoughts and weight gain to make the connection because there is no direct connection/link. I think this strategy should work unless you have a better one.

Have a serious injury and Competent Doctors who can write in VA terminology to grant compensation for the Veteran because the VA likes to play games in denying Veterans the well deserve they deserve

I was only in the reserves 9 years, no active duty or deployments, but after running in combat boots and over training, I have had pain in my feet for decades. Now, (I am a nurse) I cannot work on my feet. I cannot keep jobs, for that reason and other trauma. What are my odds at getting some IU benefits? I have lost enumeral jobs.

Slim because you have to get a 60% Service connection first than you apply for IU. I don’t know what’s the max rating for feet problems but you will have to most likely have depression as a secondary which ties to your foot problem. My advice read the VA rules and laws on service connection for body parts or psychological impairments

You'll need that "connection" with "service". Medically connect the dots with medical documentation to that period of service and you can begin a long process. I'll tell you this, if you have to question it yourself, its going to be more difficult to convince the VA. Remember, they KNOW injured Veterans. They've mastered and scaled a standard. Their job is to weed out lesser candidates. its a process, and authentic cases stand true. THEY SEE IT ALL.

Im 80% disabled currently, 40% for lower back lumbar strain, 50% Anxiety/depression, 10% tenitus and 20% for a rotator cuff strain and have been separated since august 2018, i havent worked since but have been attending college, am i eligible for this IU while attending school?

No they will use your enrollment in school as reason to deny you. If you can put up with school they will say you can be employed it’s an easy out for the VA

@@drewdelaney4166 Yeah but school is like what 4-5 hours a day? 4 days a week at most/ 1 class physical and 3 online to be full time at home. compare to work where you have to work 40 hours + sitting too long or standing too long. So if you were to go to school for say CPA accountant to work privately at your own time?

I presently am employed but it’s hell for me having to deal with people and having outbursts and threatening people. I’m 70 percent service connected already and I filed for an increase and I also filed the TDIU. My question is will it be denied if I am currently employed?

That's a tough one. The VA may certainly interpret your current employment status as evidence that your disability does not preclude you from maintaining substantially gainful employment. However, veterans who can maintain only marginal employment or who can only work in sheltered work environments are not considered under the law to be substantially gainfully employed--and so may still qualify for TDIU. How long does it take once the exam has been completed to get approved?...my husband is only 10% for the degenerative lumbar strain that has progressively gotten worse that his neurologist has declared him totally disabled but the other is 50% for folliculitis so combined its 60%...we live in Michigan

Total disability by individual unemployability (TDIU) and individual unemployability (IU) are terms used interchangeably to describe the same VA benefit for veterans who are unable to work as a result of their service-connected medical conditions. TDIU or IU is not the same as having a 100% schedular rating. I hope that helps to clarify!
