That what I think, because as soon as he got a job, BOOM, child support came. That's how the Department of Revenue catches you. Their data base cross references with the IRS. @@broco6608 for the first 5 years for whores already exploiting paternity fraud should have to pay back all the child support back to the dad. If they haven't past the 5 year period they goto jail. If they have, they still get put on a list and charged with a misdemeanor (this list will include all fraudulent mothers, much like the sex offender registry). But, if a child is born after the law is enforced the 5 year period does not effect them. All children must take DNA tests, and if the woman is proved fraudulent they goto jail for at least 5 years and are put on the list.

It is a good idea to DNA test a child at birth to figure out paternity. DNA tests are non-intrusive, risk free for the most part, and guarantee result at 99.9% accuracy, which is more than enough to disregard any shred of doubt. This is why a women who will not agree under any conditions to prove paternity trough DNA is a massive red flag and you should start preparing a legal battle. You might disagree with me but it's wrong to leave kids when you have been parenting them for a long period of time. You assumed the responsibility of a parent by that point, which is exactly why you need to figure out paternity at the earliest possible moment (at birth or before birth).

And if it can be proven that he was never served no court should be allowed to say he still owes the money as he never got a fair trial, they may want to say that the time period to object is gone, kind of like a statute of limitations, but the fact that the crime is ongoing means that should not apply.

I have always maintained that aside from the irreducible "woman good, man bad" bias of courts, the reason there is legal paternity fraud in the West is to stick individual men with what would otherwise be a welfare bill for the state. Fathers (and MOTHERS- non custodial mothers have a worse record of paying child support than non custodial fathers) should support their children, but a man who is not the biological father doesn't owe one red cent in support. Indeed, the woman who falsely named him as a father should be forced to pay back every cent of the money she defrauded him of. No mother has ever named a man as father falsely when she didn't know that there was at least a distinct possibility he wasn't. The semen fairy didn't inseminate them in their sleep.

My ex brother in law took my sister to court once her youngest of 5 turned 18. She had claimed all of the kids were his, only the 2 oldest were his and we all knew this. The last 3 all have different dads. My sister only would claim her ex husband owed support. Every state she moved to I would report her for fraud. She gave all the kids to my family members and was still accepting child support. She hid his kids from him and more. My sister flipped her mind when I gave a statement against her for her ex husband to prosecute her. She shouldn’t have tried to punish and ruin him the way she did. She was mad when the judge stopped all “rear” garnishment, told her how horrible of a person she was, and more. My nieces and nephews all know the truth finally and my ex brother in law has a rebuilt relationship with his two biological children.

In Washington DC a man with my name was being searched out for child support. They came to my house 3 times and I went to them with my SS#, birth certificate, driver's license, and demanded they get it straightened out or I would sue them. They took me in the office to check the records and they didn't have any information on the man in the database except his name, age and basic description which was younger, shorter, 50 lbs lighter and with tattoos that I don't have. Paternity tests should be required before child support is awarded. Test to be paid by the court and recouped by billing the man if he is the father, and the woman if not, plus some admin fees.

Sounds more like the bill needs to focus on the courts, rather than the people involved. They need to create a process where the person can, at any time for any reason, petition to have the child support order invalidated because they find out that they are not the actual father. Establishing paternity should be automatically required in order for the court to proceed.

Ok the law is a good start but 2 things wrong with it. 1- If the action of paternity fraud can ruin someone else’s life It should definitely be a felony with jail time not a misdemeanor. 2- it’s worded if the mother knowingly puts a false name when it should just be If the mother puts the wrong name period. All this is going to do is have mothers claim they thought x-person was the father and without a dna test that puts the victim(false father) with burden of proof that the mother lied. All a mother would have to do is say they slept with that person even if they hadn’t and a lawyer would have to prove that she lied which is near impossible. It’s worded in a way that encourages legal debate. It doesn’t help victims it helps the accusers.

If a woman falsely claims that a man is a father to extort money from him and to extort money from the government then that should be a felony that should serve a minimum of five years in prison for that especially when you ruined this man's life all the last Thirty f****** years the bit should be thrown in prison for 30 years and should have to pay every bit of that $30,000 back to that man with interest

I used to work with foster kids and I was sitting in an Oregon court room- and in another case before the one I was testifying in came up. A man was challenging child support as the kid was not his- the court ruled against him saying the damage done to the child by stripping away child support outweighed the financial burdens done to the dad. The case I was called to testify in and I watched in horror as the same judge awarded custody to a drugged out sex performer with felony convictions, misdemeanor convictions, living in a rv, fresh out of jail and with abuse allegations against her over her son, the boys dad who was a hard working married general contractor with no criminal history, nice house and stable lifestyle got one weekend a month and ordered to pay child support. I lost all hope in the legal system on that day and I moved away from Oregon the following year. This was in 2002 This same system made national news after several kids died in foster care. CPS can take a portion of child support, especially if the child goes into the foster care system. The courts did not view men as anything but money cows.
