Mr. Ginsberg, I followed all your tips and did exactly what you advised! I won without having to get an attorney! Thank you so very much! I really think the best advice was to take my medical records to my medical examination. I also took the functional capacity paperwork signed by my rhuematologist! The doctor looked at my records and looked up at me and said, "I bet you don't feel very good"! A month later I got a call from SSD and I am getting back pay too! Thank you, Thank you, Thank you!

My case was verbally approved by the judge in open court with instructions that I will receive it in writing 2-3 months. In my case I had a detailed complete medical record. I worked to help my attorney get everything. I had proper tests ran. I had a COUNSELOR. Very simple testimony. Judge was very kind. All I remember is the judge asking me how I got to the hearing like she was amazed. Uber! NONE of my doctors agreed to fill out my attorney’s forms. They all turned their back on me.

I just watched your video and It took some of my anxiety away. I had my appeal hearing in October and I am so worried about it. But, I had four bloodclots in my lungs on two different occasions and three bloodclots in my leg and one in my arm this past June. I beat death three times these past two years and have continued with the therapies to get full function back. I have to keep reminding myself that I am strong, and with the Grace of God and my blood thinners no matter what the outcome of my hearing, I will be fine.

I am complementing this video, My attorney was so in prepared for my hearing didn't even have my medication list I will probably get denied.Good thing though my therapist agrees that I need to be on disability, and yes I would love to be able to work I really would.Have so many health issues with my spine and copd moderate to severe 3 to 4 and moderate to severe depression I hate it.

Great job. I did not have a legal advocate but was devastated about having to go through the process. I love to work. The evidence was overwhelming and it took about 3 minutes at the hearing to find out I pretty much was approved. Congratulations, I am considered disabled and am getting funds for life. But, I am grateful. If I was in another country, I may not be so fortunate. These are great tips. Thanks barrister!

Very goods tips. My work attempts (many of them) show I’m trying different areas, but I am failing each time, even after trying to stick it out for a couple of months at each job. I don’t want to rely on social security, but I’m deteriorating so much, I’m pretty much at the point where I need to go to them. That takes away from my self-confidence in that I can’t properly sustain myself and be independent. I feel like a loser because of it.

All I can tell those people that are waiting on a court date is be honest ....if you are hurting you are hurting, remember that everything you have said while being treated is being documented so the judge will try and trick question you....

I got really lucky because I applied first try with no lawyer was diagnosed with brown sequard syndrome apply in April 2018 got approved June 4 get my first check in July I got a severe trauma on March 4 2017 apply for disability through the state got approved expires March 24 2018 and watch your videos apply follow all your information and instructions and got approved

I got denied at my last hearing because the judge thought my doctor was exaggerating for me so she wouldn't ruin our doctor/patient relationship. I reapplied all over again a couple years later and I have a hearing coming up next week and I found out I have the same judge!! I have seizures. I'm so nervous that I'm already denied before I even walk through that door.

I am a 49 year old male who have been diagnosed with mdd and ptsd. I have no family support and all my kids are grown now. I was in the realtistate business for 10 years until I lost it all in the 2008 market crash where I end up losing all my properties and filing bankruptcy in 2012. At that time I went through a dark period in my life where I end up being hospitalized for suicide attempts on two occasions after becoming homeless. I have been turned down on 2 prior occasions and I have a hearing coming up in December. I have now been seeing a psychiatrist for the last 3 - 4 years consistently and taking celexa to nuetualized my depression. When I first was diagnosed with mdd and Ptsd in 2013 I told my psychiatrist that I have experienced with cocaine and alcohol in my past. Since I've been under medication managerment and doing group therapy for the past 4 years I have not used any drugs outside my subscription medication as I have had a drink or two on a occasion to be honest. I have just got my recent medical evalution from a new doctor at the clinic that I have probably seen maybe 3 times who subscribes my celexa for my medication management every 3 months and the reports makes me look like some drug using alcoholic with a attitude problem. I am taken back from this last medical report that they faxed to my Attorney to go into my SSD hearing next month. I am now experiencing servere dispression and anxiety because it seems that this doctor who I've only seen on 3 occasions in the last 4 years have written such a disingenuous report that contradicts all my other documentation that supports my major depression disability. Please let me know what should I do at this point as it is now even harder for me to leave my house.

David, I would speak to your lawyer about this and suggest that he argue to the judge that the damaging report from the doctor be given little or no weight because its conclusions about your drug/alcohol use are inconsistent with the rest of your record. That report could be a problem for you, however.

I sign up on my disability and got some Jakeleged laser out of Knoxville Tenn and went in front of the judge and got turned down and I was told that I could go thru the office in my town and sign up again just wondering you know a lot about this. Thanks Fred F

Interesting as I'm currently awaiting a decision on SSDI after applying last summer. Worker's Comp case adjudicated in my favor, receiving a very modest cash settlement. Attorney stated I was a 'shoe in' for SSDI and am eligible for early company pension and early SS later this year. I had hoped to go the full distance (66 years and 4 months - I'm currently 61) but began falling apart prematurely and wasn't taking it seriously until I had to report to an emergency room out of state nearly three years ago while employed. Was out of work for 6.5 months, went back for 3 months, out for 6 weeks, back to work for 3 months when another injury (out of state again!) put me out for good. Retained the services of a Worker's Comp law firm during the six week sabbatical the previous fall. Everything is well documented in the settlement; sent copy to Social Security as requested. Looking forward to the conclusion and the start of my pension as I don't care for the suspense and have no medical insurance of any kind - everything is cash.

I appeared at my hearing alone, and even wrote a pre-hearing brief that the judge complimented me on! I also got the VE to say there wasn't any jobs I could do. Judge has made his decision and is now with the writers, what are the chances that I am approved?

I have a question. I was approved for disability in January 2018 without having an attorney or without having to go through any appeals. However, back in November of 2019, I started delivering pizzas 3 hours a day / 4 days a week. Now, Social Security is doing a review on my case. I kind of thought it would trigger a red flag, but thought it would take a few months, but the letter came instantly. My question is, should I be concerned and gat an attorney? I have been well below the SGA limits allowed under the income limits.

My husband is a Janitor,and uses a buffing machine for the past 25 yrs at Vanderbilt Medical.He will be 59 in January and has only a high school diploma.He is bone on bone with one knee and has a terrible limp.The doctor has refused further treatment,saying that a knee replacement is necessary.His knee is 2x normal size and he has been on FMLA for over 5 yrs.He now has osteoarthritis that has worsened in the other knee,both hips,shoulder,fingers and back.He also has another issue with his spine.He misses a lot of days at work,which are covered with FMLA.He is fearful of knee replacements because he is diabetic.When he returns home from work,he can barely walk.I don't think he can continue working his job for much longer.How good or bad do you think his chances for approval are?Thank you in advance!

Based on his age and the medical condition you describe I think he has a solid claim for disability. SSA cannot, by the way, hold it against him that he is reluctant to undergo surgery. Since SSD is about work capacity, records of missed time from work would also help his claim. I would look at Grid Rule 202.04 as well as some of the sedentary grid rules (see my website www.gridrules.net) as a shortcut to get him approved quickly once he stops working.

I had an type A aortic dissection in june of 2012..i applied for permsnent disability sept of 2014..i worked for my company 22 years .it was a union job..any how. I seen a judge nov of 2015 and he gave me an unfavorable decision so it was sent to the appeals council and they agreed with the judge...about 3 months ago a federal judge saw my case and sent it back to the judge to take into consideration all my doctors reports which he did not....not one of my doctors held weight in his court room..and I forgot to tell you I also had a stroke on my right leg because of the open heart surgery and a lot of lower body pain because the hospital took to long to operate on me...THEY WAITED OVER 15 HOURS TO OPEN MY CHEST...WHAT I WANTED TO KNOW..what are my chances now of winning my case once I get an appointment to see a judge..

I have a several month gap in seeing doctors outside my house. I had my 2nd spinal fusion so couldn’t see my outside therapist and am not cleared for physical therapy yet. My insurance covered Home nursing and eight weeks of telephone therapist, health coach, and nutritionist. I still can’t clean my house or stand long enough to cook healthy meals, the nutritionist gave me ideas of ways to cook using crock pots and unwavering oven. Will that adversely effect my case??? I’m 61, does that make it harder to get SSDI? I’ve looked for jobs I can do as a physician assistant but all require full days, long hours, and long drive times, I can’t physically do that now.

I have a question, is it a good sign if Social Security had scheduled me a CE, they cancelled it after receiving my records from my psychiatrist, and now they told me to fill out the paperwork about my headaches, and send it back in quickly..The examiner had called me two weeks ago, also I suffer from depression, I applied for SSDI in July 2019

I am 35 years old. 7 years ago I found out I have underdeveloped back muscles and will most likely end up in a wheelchair by the time I'm 45 years old. Two years ago I had a heart attack and found out I have severe anxiety and the doctor who treated me in the hospital told me it's not advisable for me to work. Do I have a case? I have already applied for SSI. They have been pushing at me to get my papers in and want to interview me. Is this a good sign? I haven't worked since 2009.

I have a hearing next month its for my son he has adhd and anxiety...he was approved the first time.by a social security doctor ...he still has to go to a physiologist and takes the same meds...nothing in his diagnosis has changed.The only thing is that he has been doing good on the meds.so they said he was no longer disabled.but he has tried to not take them and he struggles with school and becomes very aggressive..I do not understand why he got denied at the second review

I have Addisons Disease and Hoshimotos thyroiditis. The hospital was helping me apply years ago. I applied several times over many years. I have been in and out of the hospital and my health is constantly causing problems at all the jobs I've had. I am nauseous daily and vomit every morning. I get dizzy and have fallen several times. The meds help some with energy but the dizziness fatigue and nausea never go away. I don't know what to do. It affects my emotions and I am generally in a depressed state. I am constantly having issues at work because of this. I think I'm about to lose my job now.

been suffering with extreme gout attacks since 22 and it's ruined my entire life.. sometimes I'm OK then I could be stuck in bed for a month in so much pain I couldn't make it out my house if it was on fire. shit sucks still no disability 6 years later

My doctor has done all of this, backs me 100%. Had three tier back surgery that failed. This I am assuming should have been approved in handbook. Still at reconsideration level since may they are putting my file on hold? Until after I had my total right hip replacement, they are asking for Hospital Reports. So now I'm confused. I hate being on pain, I hate not contributing to my family, I hate how all oh this has taken its toll on my marriage, my life, my happiness. Why did they put a hold on my case. Was seen by ssdi dr regarding my hip and knee, the doctor stated to me that she doesn't know why they even sent me to her that I'm 100% disabled, had to take xrays as well. Confused, depressed and angry. I've had no money come in since 2016, we spent in premiums and family deductibles (not including medications) roughly 30k dollars, that is a huge strain on my husband. We should still be in honeymoon stage only married 2 years, but I'm always so sad, don't smile etc sorry about my rambling.

I needed help, my attorney has not made real contact with me for 24 months, Aftr I called they set up a pre-hearing where I was told I didn't do my part and we have the hardest judge. After the hearing my attorney said ..."That was terrible". Don't be shocked if denied. Now I am told to wait 6 weeks to find out.The last 2 years have been very hard.

Unfortunately, delays in SSD hearings are reaching record levels - I personally find it shameful that a disabled person has to wait 2+ years just to get a hearing. And I also think that there is a problem with a system where Judge A approves 60% of claims and Judge B only approves 15%. Not sure when we can expect things to change too much, however.

I would much rather be working that's all i know get up and go to work started mowing yards at 14 and from 14-43 only have 3 jobs i know what hard work is. I am a provider and now i can't that is the worst thing for me my wife is a amazing woman she works her but off. We had to do major changes to the budget and a complete life style change she makes a little to much for me to get ssi while waiting on my hearing Jonathan has really helped with his videos he is a god send.

I don't know what to do. I went too long before applying for disability in 2012, so after THAT case was denied, I applied again, but that was only for SSI. That case was also denied. At that time I was separated from my husband. But now that I have returned to him, I understand that I am no longer eligible for SSI anyway, as his income is "too high" (that's a joke). My illness is classified as clinical depression and phobia. I struggled with alcohol abuse, and was denied because my records showed I had a brief relapse and was hospitalized briefly. I am presently sober 16 months. My questions are: Should I even bother applying again since I'm with my husband? And, after 16 months of sobriety, will that "red flag" hospitalization from 18 months ago cause another denial? I wouldn't bother if it weren't for the fact that my husband is a severe alcoholic who abuses me, and I would like to leave him. I depend completely on him.

My husband applied for SSDI on Sept.13,2019.Today, he was told that he has received a fast decision and will get a letter in 2-3 weeks.I wonder if he was denied or approved!!!!

I've had seizures my whole life they seemed to get worse as I get older, I'm 27 years old. I might have gaps from the standpoint of not having doctors is this an automatic disqualification? The reason for not having a doctor is because of not being able to afford health insurance due to lack of work. Does that work against me? I moved back with my parents so I could get insurance and resumed seeing a doctor recently, but it doesn't change the fact that I may have big gaps. When I wasn't under insurance every time I had a seizure I would have to go to the ER does that count for something?

Gaps in treatment are not necessarily going to doom your case but at your age you will need strong medical support indicating that your seizures are not controlled by medications and they make it impossible for you to get thru a workday.

I got denied and in the letter said appeal it by this date and I marked it down . went in a week before that do date .thien I was told that it's past the date .Lady Ssi worker help me fill out a late appeal. latter ..its been mouth are so" I don't know what to do know..can you tell me please

I wonder if this is one of those situations where the denial notice was mailed several weeks after it was issued, or if your appeal got lost in the mail. Unfortunately, decisions on whether SSA will accept a late filing are somewhat arbitrary and solely within the discretion of the local SSD office.

so my disability lawyer says to never tell your doctor your filing for disablility she also says to go to the doctor every month. but i feel like the doctor is going to think its weird i keep going back.

I think there has to be a balance. I tell my clients to discuss with their doctors the disability option, making it clear that it is a last resort. I would also prefer to know early on if the doctor is receptive to the idea.

This is great. I am autistic, and I have been denied not once, but 3 timesfor disability, I have passed all 3 of my psych exams. My dr. thinks that I am "not autistic enough" for disability. I guess I am screwed. :/

I have been denied twice and am currently waiting to go before a judge. My rhuematologist recently wrote an assessment letter on my behalf. He stated continuous movement makes my RA worse, I can only sit, stand or walk for no more than 20 minutes, I have RA in all my major joints and in his medical opinion I am totally disabled. Of course he said more, but that was just a general idea. My PCP is also writing one. Do you think this will help?

I feel your pain, I have had R. A. since I was 8 years old. I have been lucky to be able to work up until last year when I had a severe flare up. Applied for SSDI, and was denied, appealed and was given a hearing. Received a denial letter a month later. Disgusted by the whole damn process.

I have a hearing coming up for panic attacks, I'm only nineteen got assaulted back when I started highschool ever since then things got worse from there. My whole body goes numb, when im walking my legs shake, I'm constantly lightheaded. I repeat myself when something is bothering me. I have a two year old whom lives with me and luckily I get help been on disability since I was younger due to a lot of disorders. I haven't felt normal in a long time every medication I recieve doesn't help how can I explain this to the judge...

If you have been receiving regular counseling and/or treatment from a psychologist or psychiatrist, those records will carry more weight than anything you can say. However, you should still practice with your lawyer so that you can prepare yourself to answer the question: why can't you reliably perform a simple, entry-level type of job? Best of luck to you.

You will need solid medical support from a treating doctor (ideally a mental health provider like a psychologist or psychiatrist) who will state in a functional capacity form or narrative report that your symptoms make it impossible for you to reliably perform a simple, entry level job. In addition you will need ongoing treatment records showing mental health treatment.

I don't know if I agree with your lawyer's assessment. I often give the forms to my client and ask him/her to take the form to the doctor. Medical records alone don't generally speak to work performance issues and a form that "translates" medical problems into work limitations is a very powerful tool.

That sounds like a lot of hospitalizations to me and suggests that your condition is quite serious. So, based on what you write, there is hope of winning.

If you don't appeal within the 60 days you can try to submit a late filed appeal (you will need to explain why you were late in appealing). Otherwise you will have to start over and try to reopen your prior application.

Yeshua Man I've got bipolar,schizophrenia and depression and I've been denied 1 time so far and haven't been able to afford the medication that I need for help my suggestion is to pursue it as they will ultimately have you do a exam with some type of doctor that they pay for.... I personally had to see a psychiatrist for 1 1/2 hours two Friday's ago

No, what I am saying is that Social Security sees disability as an "either/or" proposition. Either you can work or you cannot. Ongoing part time work muddies the water and most of the time a decision maker (judge or adjudicator) will conclude that someone who can perform on-going part time work could likely perform on-going full time work.

@@ssdattorney the attorneys I’m using said I could legally work 20 hrs a week . ( never talk to my lawyer just his secretary) . I’m 5’3 51 years old and have work 30 years of my life ,I only have a GED . I’ve been getting denied since 2013 . I have very legit medical problems .I will talk the administrative law Judge in about another month or so on the phone for my hearing . If I get denied this time I don’t know what I’m going to do .

I went to my hearing and I don't understand why they would ask if I have looked for work. First of all if I was able to work comfortably, why would I apply for ssdi? That makes no sense. Second of all why have ssdi if we're going to be made to go thru all these hoops and bounds. We paid into this system. I shouldn't have to struggle for it. Lastly, we are going through a pandemic. Companies aren't open for business everywhere having huge hiring events. What a screwed up system I swear. I really hope I won my case. The judge hung up and I never heard back from my attorney. It was a phone hearing. Is this normal? This was a law office that advertises heavily on television.

Gabriela, judges are looking for claimants who are fighting the idea of being labeled as "disabled" and who have given up. If you are looking for work that tells the judge that you are not invested in the idea of being disabled. This all goes to how credible you would appear to the judge.

I have a permanent cardiac impairment resulting in the loss of 40 percent of heart tissue due to two heart attacks. I had an EP study for an ablation and went into cardiac arrest resulting in an ICD/defibrillator. My doctor says I cannot return to work in public transportation. I have no choice but to file for disability. Are my chances good for approval.

It is if your symptoms leave you too exhausted to get thru an 8 hour day. SSD is not about your medical diagnosis. It is about how your symptoms interfere with your capacity for work.

You can apply for SSI or for disabled widow's benefits. But there are non-medical qualifications and limitations for both of these programs.

I think it has to do with either mental or physical demand of the job. If someone with no physical problems but has severe social anxiety that person could still work par time by themselves. A person with physical limitations really can't before many job and that's the ones that couldn't do part-time and disability. Just my 2 cents.

I have degenerative osteoarthritis in the base of my kneck & the base of my spine. I have my own attorney do everything as said and it's been over 2 years. Still denying my benefits, can't work, and nearly lost my house.

I have also seen growing delays in the initial application and recon phases. SSA employees have been working from home since March, 2020 and it is my understanding that they are not being provided with the technology they need, nor is overtime available - thus longer delays.

@@ssdattorney It wouldn't have anything to do with that since my case predates covid and they deny benefits for hidden conditions that can't be shown on an x-ray or base on age. Which is absolutely absurd and unobtainable for those of us that need it most. Nothing like this should take 2 years. Theres no excuse.

I am saying that part time work raises the question of whether you could work full time at a slightly easier job. But a the same time, part time work shows that you motivated to try to work.

No but long story short Ive been treated pretty bad. twice. once they went over dates, had to start over..next barely knew my name much less my illness and details of which there are many. I have a complicated issues thing. Lyme disease since 2002, Fibromyalgia, 3 car accidents-rear ends at a stop, w/Neck and Back Problems, Trigeminal Neuralgia (maybe) Newly with Extreme Veretigo Attacks on top of Severe Migraines and Tinnitus maybe Meniueres Disease, then recently they found a rare Tumor on my MRI/CT attached to coratoid artery /jugular vein area as a bonus So I just cant have someone go in there half assed.trying to rattle off my cart full of crazy painful revolving symptoms expecially when 50% of he time my appearance is normal. Im better off trying to explain my illness, symptoms, Its just Hard while Im sick to do it. As you know.. It is wearing on me Physically and Draining.. This is my 1st Judge review Id like to try on my own,.Ive been waiting 3 years. Im thinking I will get one more opportunity to appeal if this end in denial is that correct? If that is correct and I dont come out with a positve result. I would then like to move forward possibly hiring you. However when you say you work with attorneys near me?? what does that mean? Just a referral or people you know. I was wanting more like you of course. Sharp...Im sick, this should be easy, but nothing is easy for me.Please let me know thank you for your time

​ Social Security Disability videos but really, would it matter even IF I could prove it substantially at this time? This is all under so much of an overlooked basis due to the fact deniability works in the favor of so many choices that you can say its never happened and most likely have 2/3 good hard workers in the department really trying to help but majority of the time you'll have someone sit there and ask "is this the person applying?" where they say nothing but suddenly either have a change in judgement or double down on a decision. Truth be told that's why I'm trying to apply as a worker in my hometown to help with that, problem is since its (controversially) favoring people/families that are dependent on the system so much for that money they're willing to jump through the hoops for that money to the point if someone is ever questioned, its a simple utilization of deniability. You can say its not there, you can go through your entire life and never experience it so in a way I can't disagree to your opinion, only share mine based off the same descriptions of what I believe factors in your disability benefits. MOST the time its from my VA MEDICAL here in Alaska. Luckily if you go through the others departments you're fine but because half are people faking and yes I rather be off by a couple people than have it not brought to anyone's attention.

Does using medical marijuana count? And the thing is I don't even use it all the time and it does help me to go to sleep maybe once or twice out of the month. I really wish people stop trying to criminalize when I'm trying to get help because there's no sleeping pills that I'm being prescribed.! I don't even know what to do anymore because I'm only seeing my psychiatrist every two and a half 3 months I'm getting prescriptions taking that and then when I had a best friend the claim was you're not even taking your medication so that tells me I didn't do any better and I might even started doing worse on the medications. Society didn't really recognize mental disabilities as much you know yeah I can go to a factory and maybe lift something but will I remember to do the safety stuff will I be able to get out of bed to even get to work it's like with depression you wish for these things but they don't even happen and everybody just thinks you're lazy you got PTSD oh you're just living in the past you should just get over it must be nice if I could just go in and have surgery or something to remove this part of my brain I would instead of having to beg for money at least I'm not homeless anymore

What if a 53 year old person has medical documentation of his/her disabilities 40% but kept it a secret from their employer because he/she didn't want to get fired and wind up homeless. This person has had excellent attendance up until now. This persons health condition has now worsened. This person also knows it's time to throw in the towel and apply for Disability. If this person would tell their employer the whole truth they would be most likely be fired. This person also has a CDL license and If He/she told the Examining Doctor at their next annual DOT Physical (which is in a week or two) their condition they would lose their CDL license. This person would then be terminated from employment. Would it be better to let the DOT Examining Doctor say that this person is not fit to drive then go to see the Voc Rehab for Adults Dept, show them all their Medical Documentation and see if they will say this person should apply for Disability? I was wondering what they best course of action would be. Do you have any advice or comments for this person?
