एखादी बेवारस व्यक्ती पागल असल्यावर तिला कोणीतरी सरकारी हॉस्पिटलमध्ये भरती करते मग तिला मनोरुग्णालयात भरती करण्यासाठी सरकारी हॉस्पिटल पोलिसांना पत्र देतात कोर्टाचा आदेश घ्या आणि मनोरुग्णालयात भरती करा. तरी मेंटल ॲक्ट व त्यातील पोलिसांच्या जबाबदारी बद्दल मार्गदर्शन करावे ही विनंती

If the accused complies the condition mentioned in the notice,he can be arrested by police upon recording reasons for such arrest. For such arrest there is no need of obtaining permission from the Magistrate. But when the accused doesn't comply the condition mentioned in the notice,for his arrest permission of Magistrate is must. Above scenario of legal provisions may not appear to stand to logic,still such is the law.

Respected Sir , S 41 A sub Clause (4) of S.41 A CrPC i.e. Prior permission of Magistrate is not necessary the term " Subject to such orders as may have been passed by a competent court in this behalf " is refers to orders relating to grant of anticipatory bail which the noticee may have obtained interregnum the issuance of notice and before actual arrest and not about the Prior permission of the magistrate before arrest. This was clarified by Honble Karnataka HC in the judgement dt. 22/06/2022 " Sri.Ramappa @Ramesh vs State of Karnataka" So sir prior permission of the magistrate is not at all necessary.
